If tokens were due on a stated date but remain unavailable, first identify who controls them and what event legally or technically triggers release. Check the signed agreement, vesting schedule, platform status and any notice or compliance conditions. Preserve every record, ask the custodian in writing for the exact reason and a dated release estimate, then use the contract’s complaint, arbitration or court process. A delay alone does not prove fraud, insolvency or a legal violation.
Start by identifying what kind of release failed
“Token custodian” can describe several materially different arrangements. Your remedy depends on whether an organization holds the asset off-chain, an issuer has promised to deliver tokens later, or software is enforcing a vesting rule.

The SEC and CFTC’s 2026 interpretation discusses agreements for future tokens and custodial staking arrangements, but it does not decide every custody or contract dispute. Read the release in its full context at sec.gov and the related custodial-staking discussion at sec.gov.
Do not treat an issuer promise, a custody platform’s terms and protocol code as interchangeable. The first question is always: who has control, and which document or code rule establishes the release event?

Check the controlling documents and the exact deadline
Collect the documents that could define your entitlement before arguing that a deadline was missed. Save the token purchase, grant or future-token agreement; custody agreement and platform terms; vesting schedule; amendments; distribution notices; and any release instructions. Use the version accepted when the transaction was made, as well as later amendments that you actually accepted.
Record the timing details
- Write down the promised date, time and time zone. “On 1 June” may not mean the same thing as “by 00:00 UTC on 1 June.”
- Identify whether the document uses calendar days, business days, epochs, block timestamps or a period after a request.
- Note the quantity, token network, destination wallet and whether partial releases are allowed.
- List every condition precedent: identity verification, sanctions screening, tax forms, an eligible wallet, a signed instruction, minimum balance or a completed staking period.
- Look for notice windows, maintenance periods, transaction limits, force-majeure language, legal-process exceptions and rights to suspend or refuse a transaction.
A filed custody agreement provides a useful example of why the contract matters. In that specific agreement, a withdrawal request may require up to 24 hours before submission to the network; offline key storage can add delay; and the custodian says it will notify clients as soon as practicable of anticipated delays beyond 48 hours. Those figures describe that agreement only, not a general industry rule. Read the filed terms at sec.gov.
Separate an internal status from an on-chain transaction
An account marked “pending” may mean no transaction has been broadcast. If a transaction hash exists, check the correct network explorer and determine whether it is pending, confirmed, failed or sent to the wrong address. A confirmed transfer to the specified address is a different problem from a custodian that has not initiated anything. Never assume a screenshot of a balance or a support message proves that a blockchain transaction occurred.

Preserve evidence without creating a security risk
Create one dated evidence file. Include the signed agreement and schedule, account statements, wallet addresses, transaction hashes, screenshots, support-ticket numbers, emails, notices and a timeline. Record what was due, the request you made, when you made it, and the exact response. Export files in their original format where possible and keep a read-only copy.
Protect the evidence itself. A legitimate custodian should not need your seed phrase, private key, password, one-time authentication code or remote-access session to investigate a release. Do not send those secrets to anyone promising to unlock or expedite tokens. Verify support addresses through the platform or agreement, not through an unsolicited direct message. If a wallet connection is required for a claim, check the contract address and transaction details before signing; a request to transfer assets first is not proof that a release is legitimate.
Ask for a written explanation and a concrete date
Use the custodian’s official support channel and the contractual notice address if one is specified. Keep the message factual. Identify the account, asset, amount, promised release event and relevant clause. Ask for four specific answers:

- Are the tokens held in custody, pending internal processing, subject to a hold, or awaiting an on-chain event?
- What precise reason is preventing release, and which agreement clause, policy or protocol rule is being applied?
- Is any condition or document still outstanding, and how can you satisfy it?
- What date and time zone does the custodian currently estimate for release, and what event could change that estimate?
An illustrative message could read:
Subject: Request for release status and date — account ending 1234 Under the token distribution terms dated 12 March 2026, 10,000 units were scheduled for release on 1 July 2026. Please confirm whether the tokens are held, pending, subject to a hold, or awaiting an on-chain event. Identify the clause or rule supporting any delay, list any outstanding condition or document, and provide the expected release date and time zone. Please preserve this request under ticket 456789.
This is practical wording, not a universal statutory notice form. Submit it through the channel the agreement recognizes and retain proof of delivery and the response.
Test the explanation against the agreement
Compare the response with the signed terms rather than assuming that any delay is authorized or unauthorized. Filed agreements show that a custodian may reserve rights to delay or refuse transactions for legal process, compliance duties, transaction limits or perceived fraud risk. Whether a particular clause applies depends on the current agreement and facts. One example of filed terms is available at sec.gov.
If the custodian cites compliance or identity checks
Ask which verification is incomplete, what document is acceptable, and whether the hold affects all assets or only the requested transaction. Submit documents only through the official secure channel. A compliance hold may be permitted by the agreement or law, but the custodian should still identify the applicable process where its terms require notice.

If the custodian cites network or protocol conditions
Request the network, transaction status, required confirmation count, epoch or unbonding period, and any transaction hash. Compare those details with the protocol’s actual state. A protocol delay does not necessarily mean the custodian breached a calendar-date promise, especially if the contract made release conditional on network availability or confirmations.
If the answer is vague or changes
Reply with the unanswered questions and ask for a supervisor or formal complaints contact. Preserve each version of the explanation. Do not make accusations in the initial record; a precise chronology is more useful if the matter later goes to arbitration, court or a regulator.
Use the agreement’s escalation and dispute process
Locate the complaint procedure, escalation email, formal notice address, governing law, arbitration or mediation clause, court venue and limitation period. Some terms require a written complaint and a waiting period before arbitration or litigation. Missing a notice window or limitation deadline can affect your options, so calendar every date.

A CFTC-filed exchange rulebook illustrates that dispute terms can be express and highly context-specific; it does not prescribe a procedure for every custodian. Review the example at cftc.gov.
When to obtain legal advice
Consider a lawyer experienced in digital-asset custody or contract disputes when the amount or deadline is material, a hold is prolonged, the custodian denies an apparent contractual obligation, assets may be dissipated, or a limitation period is approaching. Give counsel the complete evidence file and the jurisdiction stated in the agreement. The applicable law may depend on the parties, product, location and dispute clause; no general article can determine whether you have a breach claim or a right to specific performance.
Consider a regulator complaint only after documenting the facts
A regulator complaint may be appropriate depending on the firm, product, jurisdiction and conduct alleged. It is not a substitute for checking contractual deadlines or obtaining individual legal advice, and a regulator may not recover assets or resolve a private contract dispute for you. Identify the entity, preserve the agreement and communications, and describe the requested release and response accurately.
The CFTC’s consumer advisory urges caution when buying digital coins or tokens and states: “The article is provided for general informational purposes only and does not provide legal or investment advice to any individual or entity.” Read the advisory at cftc.gov. Related federal-register material is available at cftc.gov. Which agency, if any, has jurisdiction depends on the product, firm and location.
What a delay does—and does not—show
A missed date is a fact to investigate, not a diagnosis. It may reflect a stated processing window, a verification hold, a legal order, a network event, an unmet vesting condition, an operational error or a breach. No reliable frequency, average duration or outcome figure is published for missed token releases, so no prevalence figure can be inferred.
- Do not call the delay proof of fraud without evidence of deceptive conduct.
- Do not assume insolvency merely because support is slow or a transaction is pending.
- Do not conclude that a legal violation occurred before reviewing the agreement, applicable law and facts.
- Do not send additional money to “unlock” tokens unless an independently verified contract obligation requires it; an unexpected fee request is a warning sign to investigate.
A practical decision path
- Identify control. Decide whether the issuer, custodian, exchange, staking service or smart contract controls the asset.
- Identify the trigger. Confirm the calendar date, vesting milestone, withdrawal request, confirmation requirement, epoch or compliance clearance that was supposed to release tokens.
- Read exceptions. Check processing periods, notice windows, legal and compliance holds, transaction limits and network conditions.
- Verify status. Determine whether there is an internal pending status, a broadcast transaction, a failed transaction or no transaction at all.
- Preserve records. Save the agreement, account data, wallet information, hashes, screenshots and dated communications without exposing private credentials.
- Request answers. Send a written, clause-specific request through an official channel and ask for a dated estimate.
- Escalate correctly. Follow the complaint and notice route, then seek jurisdiction-appropriate legal advice if the deadline or amount warrants it.
- Report selectively. Consider a regulator complaint only with documented facts and realistic expectations about what the agency can do.
This sequence helps distinguish a contractual delivery failure from a platform-processing issue or an on-chain vesting rule, while preserving the evidence needed to decide what to do next.
