If a retailer cancels your pre-order but keeps the money, preserve every record, request a refund to the original payment method in writing, and contact your payment provider before any dispute deadline expires. The correct remedy depends on your country, payment method, seller of record, and whether a marketplace processed the order. The US and England examples below are separate; neither is a worldwide rule.
First, secure your evidence
Do this before deleting emails, closing a payment app, or continuing a phone conversation that leaves no record. Create one folder containing:
- The original order confirmation, order number, item description, price, taxes, shipping charge, and payment date.
- The promised shipping or delivery date, including any wording such as “ships by” or “estimated.”
- The cancellation email, account notification, text message, or screenshot showing when the retailer cancelled.
- Your card, bank, PayPal, or other payment statement showing the charge or authorization.
- Tracking information, if anything was shipped, and every message exchanged with the retailer or marketplace.
The Federal Trade Commission (FTC) recommends retaining order dates, shipping promises, confirmations, receipts, tracking details, and communications. Keep original files where possible, and note the date and time of each call, the representative’s name or reference number, and what was promised.
Send a dated refund request
Use email, the retailer’s support form, or another channel that produces a copy. State that the retailer cancelled an unshipped pre-order, identify the order and amount, and ask for the money to be returned to the original payment method. Do not agree to store credit unless you actually want it. Save your sent message and any automated ticket number.

Subject: Refund requested for cancelled pre-order [order number]
You cancelled order [order number] for [item] on [date]. The amount charged was [amount] on [date]. Please refund the full amount to the original payment method and confirm when the refund is submitted. I am keeping this request and your response for my records.
Payment reference: [reference]
There is no universal seller response period for every country and payment method. If the retailer gives a refund date, record it. If it gives only a vague assurance, ask for written confirmation that the refund has actually been initiated and for the transaction reference supplied by its payment processor.
Identify which rules and parties apply
Find the seller of record
Check the invoice, receipt, card statement, and marketplace order page. A marketplace may display one business while another company actually charges the payment method. Send the request to the named seller and, if a platform handled the order, open the platform’s own case as well.
Separate authorization from a completed charge
A pending card authorization may disappear automatically, while a completed charge requires a refund or dispute. Ask the issuer whether the transaction is pending, posted, reversed, or refunded. A screenshot showing “refund initiated” is not the same as a credit appearing on your statement.
Check your location
Consumer and payment rules are territorial. The FTC rules described below apply to covered US mail, internet, and telephone orders. Citizens Advice’s Section 75 and chargeback guidance applies to England. Other countries have different statutes, card-scheme processes, and deadlines, so use your local consumer authority and your issuer’s instructions rather than importing a US or English deadline.

United States: seller obligations and credit-card timing
When the FTC merchandise-order rule matters
According to the FTC’s August 2022 consumer guidance, if a seller gives no shipping time, it generally must ship within 30 days of the order. If it states a shipping promise, that promise governs. When the seller cannot ship on time, it must give you a choice between accepting a delay and cancelling for a full refund. The FTC says the seller cannot substitute store credit for that refund. Its consumer page puts the point plainly: “If the seller doesn’t ship your order, it has to give you a full refund — not just a gift card or store credit.”
This is a US federal rule summary, not a guarantee that every pre-order dispute falls within the rule. Product-specific laws, contracts, state law, and the seller’s status can affect the analysis. Keep the promised date and the cancellation notice because those facts determine whether the seller missed its commitment.
Credit-card disputes
For a covered US credit-card billing error, the FTC identifies a 60-day period measured from the date the first statement showing the error was sent. Send the dispute in writing to the issuer’s billing-dispute address, which may differ from the payment address, and follow the issuer’s required format. Describe the cancelled, undelivered order, attach the confirmation and cancellation notice, and state the amount requested.

The FTC says the issuer must acknowledge the dispute in writing within 30 days unless it has already resolved it, and resolve it within two billing cycles, with a maximum of 90 days. These are FTC guidance figures for covered disputes; an issuer may request additional information and its instructions still matter. Contact the issuer promptly rather than waiting indefinitely for the retailer.

Debit cards
Debit-card protections differ from credit-card protections. The FTC cautions that a debit-card user may not be able to obtain a refund for non-delivery under the same rules. Notify the bank or debit-card issuer as soon as the cancellation becomes a problem, ask specifically how it handles cancelled-order non-delivery, and submit the evidence it requests.
England: Section 75, chargeback and online-payment disputes
Section 75 for qualifying credit-card purchases
Citizens Advice says Section 75 may apply to a qualifying single-item credit-card purchase costing more than £100 and no more than £30,000. Ask the card provider whether the transaction qualifies and explain that the retailer cancelled before shipment but has not returned the money. Citizens Advice notes limits where a third party was involved, so identify whether a marketplace, payment intermediary, or separate seller took part in the transaction.
Chargeback
Chargeback is a payment-scheme process, not the same legal protection as Section 75. It may be relevant for a debit card or where Section 75 does not apply. Ask the bank for its chargeback procedure, submit the order, cancellation, and payment records, and follow its time limits and evidence requirements.

PayPal and buy-now-pay-later services
Citizens Advice says a PayPal website dispute must be opened within 180 days of payment. Confirm the provider’s current deadline, eligible transaction types, and required steps before relying on that figure. For buy-now-pay-later services, open the provider’s dispute process and ask how scheduled instalments or an outstanding balance should be handled while the cancelled-order claim is reviewed.

Do not confuse post-delivery cancellation rights
GOV.UK describes a 14-day cancellation window for qualifying online, mail, or telephone purchases after receiving goods, followed by a refund timetable after return. That guidance concerns a consumer cancelling a distance sale after delivery. It is not a general deadline for a retailer that cancelled an unshipped pre-order, so do not use it as the basis for this dispute.
Marketplace orders need a second escalation
Contact the seller first, then use the marketplace’s refund or buyer-protection workflow immediately. The FTC’s marketplace guidance warns that platform coverage and claim windows vary and can be short. Upload the order confirmation, cancellation message, payment record, and your written refund request. Keep copies outside the platform because a closed account or expired listing can make the original messages harder to retrieve.
Check who charged you. If the marketplace collected the payment, its process may be the fastest route; if the retailer charged you directly, the marketplace may still require a case before it will assist, but your card issuer will evaluate the actual merchant transaction.
If the retailer does not refund or stops replying
- Send one complete written follow-up. Include the order number, cancellation date, amount, original request, and the specific refund status you need. Attach the key records rather than a long narrative.
- Contact the payment provider. Ask for the correct dispute category for a cancelled, undelivered order and request the deadline in writing. Tell the representative when the first statement showed the charge if you are using a US credit card.
- Open the marketplace or wallet case. Do this in parallel when the purchase used a platform, PayPal, or a buy-now-pay-later provider. Record the case number and submission date.
- Escalate locally. A consumer-protection agency, ombudsman, or advice service may explain the available route in your jurisdiction. In the US, the FTC identifies consumer-reporting and payment-provider escalation options; in England, Citizens Advice can explain card-payment routes.
- Monitor statements. Look for a posted credit, not just a pending reversal. Preserve the final statement showing whether the refund arrived and whether any instalment or fee remained.
A payment dispute is not automatically successful. The issuer or provider will apply its own rules, review the evidence, and may ask the merchant for information. Answer every request by its stated deadline and keep proof of submission.

Build a dispute packet that answers the obvious questions
- What was purchased, from whom, and through which platform?
- When was the order placed and what shipment date was promised?
- When and how did the retailer cancel?
- How much was charged, on what date, and to which payment method?
- Did the retailer offer a refund, store credit, replacement, or no remedy?
- When did you request the refund, and what response did you receive?
- What remedy are you asking for: a full reversal to the original payment method?
Use a short chronology with dates. Highlight the cancellation and the posted charge. Redact unrelated account numbers, passwords, and identity documents before uploading anything, while leaving enough transaction information for the provider to match the payment.
Common mistakes that weaken a claim
- Waiting for the seller indefinitely. A friendly promise does not extend a card or platform deadline.
- Accepting store credit by accident. Read checkboxes and settlement language before clicking “accept.”
- Disputing the wrong transaction. Match the dispute to the posted merchant, date, and amount on your statement.
- Using a delivery-return rule for a cancelled pre-order. A product never delivered creates a different factual situation from returning goods after receipt.
- Relying on a phone call alone. Send a written recap immediately and keep the ticket number.
- Assuming a debit card has credit-card rights. Ask the bank which non-delivery and chargeback rules actually apply.
- Ignoring the marketplace. Platform protection can expire even while the retailer continues promising a refund.
When to seek additional legal help
Consider local legal advice when the amount is substantial, the seller disputes that it cancelled, the transaction crossed borders, a marketplace was involved, or the payment provider rejects the claim despite complete records. A consumer agency or advice service can identify the correct jurisdiction and complaint route, but no agency or product can guarantee a refund or chargeback.
Keep the issue focused on the cancelled order and missing refund. Do not publish full card numbers, identity documents, or private correspondence in a public complaint. If you suspect deliberate fraud rather than an ordinary fulfillment failure, report it through the appropriate local authority as well as notifying the payment provider.

- GOV.UK guidance on distance-sale cancellation and refunds, used only for purchases cancelled by the consumer after receiving goods.
Check each source and your payment provider for current procedures. The retailer’s country, your residence, the seller of record, the charge date, and the exact cancellation notice can all change the available remedy.
