A late Kickstarter game is not automatically a scam, and its estimated delivery month is not a guaranteed shipping date. Kickstarter describes backing as supporting the creation of something new. The creator, not Kickstarter, is responsible for fulfilling rewards on a funded campaign, while Kickstarter generally does not issue refunds or mediate individual disputes. Your best response is to document the campaign, seek specific answers in writing, protect any payment-dispute deadline, and escalate only when the facts justify it.
First, identify what actually happened
Different campaign outcomes require different actions. Open the project page and compare the current status with the original campaign record before contacting anyone.

Save the project URL, campaign description, reward tier, estimated delivery month, pledge confirmation, payment receipt, survey or address submission, every creator update, and your messages. Screenshots or downloaded PDFs are useful if the page later changes. Record dates for promised milestones, revised estimates, cancellation notices and any tracking number that never became active.

What Kickstarter’s terms and rules require
An estimate is not a retail guarantee
Backing is support for creating a new project rather than buying an already manufactured game. Kickstarter’s terms say reward delivery is not guaranteed merely because a campaign is funded. A creator-side article published January 29, 2026, gives a broad expectation of about a year from campaign end until the last backer receives a package, but calls that a general estimate, not a rule or promise. Complex products, tooling and first-time creators can take 18 months or longer. Use that context to judge a timeline, not to override the estimate stated on your campaign page.

The creator is the fulfillment party
Kickstarter’s current terms describe a direct contract between creator and backer; Kickstarter is not a party to that contract. The creator is solely responsible for making and delivering rewards. Kickstarter says it does not hold creator funds on a creator’s behalf and does not offer refunds for collected pledges. That means a support ticket to Kickstarter may document a problem or explain platform policy, but it is not a guaranteed refund request.
What a creator should do if completion becomes impossible
The terms set a reasonable-effort standard. If a creator cannot complete the project, the creator should explain what work has been completed, how funds were used and what barriers prevent completion; work diligently and in good faith toward the best possible conclusion on a communicated timeframe; demonstrate appropriate use of funds and reasonable efforts; communicate honestly; and offer remaining funds proportionally to backers who did not receive rewards, or explain an alternate use of those funds to complete the project. The terms also say a creator unable to satisfy these obligations may be subject to legal action by backers. They do not promise that a lawsuit or repayment will succeed.
What Kickstarter’s rules expect
Kickstarter’s rules say creators should update projects regularly, respond to messages in a timely manner, make a genuine effort to complete the project, proactively communicate failure and try to resolve issues directly with backers. Kickstarter may assist in some situations but says it is generally unable to mediate disagreements. In other words, platform involvement is limited; your central relationship is with the creator.

Send one precise written request to the creator
Use the project’s update comments, direct message channel and any listed contact address. Keep the tone factual. Ask for information that can be answered, not a promise that everything will be fine.
- State your record. Identify your reward tier, pledge date, original estimated delivery month and any revised date.
- Ask what is complete. Request the status of design, approvals, manufacturing, freight, fulfillment and address collection, as applicable.
- Ask what is blocking delivery. A specific manufacturing, tooling, shipping or cash-flow problem is more useful than “soon.”
- Ask how funds were used. You are asking for the explanation contemplated by Kickstarter’s terms, not demanding confidential business records.
- Request the next concrete milestone. Examples include a manufacturing proof, completed production run, freight booking or fulfillment start.
- Set a next-update date. Ask when the creator will report again even if there is no progress.
- Preserve the response. Save the message, attachments and date. Do not rely on a disappearing social-media reply.
If the creator answers with a credible plan, track the promised milestone and reassess after it passes. If the answer is vague, contradictory or absent, send one follow-up referencing the first message and then move to the escalation options below.
If the creator announces cancellation or says fulfillment is impossible
Ask for a final written update that addresses four points: work completed, use of funds, the barriers to completion and the timetable for the proposed resolution. The creator should explain whether any rewards, components or manufacturing assets exist and whether another use of remaining money could complete part of the project.

Under Kickstarter’s terms, the creator should make a reasonable effort to bring the project to the best possible conclusion. That can include offering remaining funds proportionally to backers who did not receive rewards, or explaining an alternate project use. “Proportionally” does not establish a guaranteed dollar amount for every backer; the available money, obligations and jurisdiction matter. Ask how the calculation was made and when any payment would occur.

Do not treat a cancellation announcement as proof that money was stolen. A failed product can result from tooling costs, supplier failure, regulation, freight problems or insolvency. Conversely, a cancellation does not erase the creator’s communication and reasonable-effort obligations. Preserve the announcement and all prior representations before deciding whether the conduct appears deceptive.
Can you dispute a Kickstarter charge?
United States credit cards
Federal Trade Commission guidance says a charge for something not delivered as agreed can qualify as a credit-card billing error. The general deadline described by the FTC is written notice within 60 days after the first statement containing the error was sent. Contact the card issuer immediately, use the billing-dispute address and instructions on the statement (which may differ from the customer-service address), and ask how it applies the rule to a crowdfunding pledge.

Include the campaign’s estimated delivery information, pledge receipt, reward description, creator updates, your written requests, cancellation or non-delivery evidence and any tracking details. Explain the timeline accurately. Kickstarter backing is not identical to an ordinary shipped retail purchase, so an issuer evaluates the facts and applicable protections; a dispute is not a guaranteed charge reversal. Keep paying undisputed portions of the account while the issuer investigates and follow its written instructions.
Debit cards and cards issued outside the United States
Debit-card protections differ from credit-card billing-error rules. Call the bank promptly and ask for its written dispute procedure and deadline; do not assume the 60-day credit-card period applies. Outside the United States, consumer-credit and payment rules vary by country. Contact the card issuer or payment service in your jurisdiction as soon as non-delivery becomes clear and ask what evidence and time limits apply.

When and how to report suspected deception
Report conduct that suggests intentional deception or misuse of funds, rather than reporting every late project as a scam. Examples include fabricated manufacturing claims, repeated false statements about shipment, concealed personal spending that conflicts with the campaign, or a refusal to honor a clearly stated refund policy combined with evidence of misrepresentation.

United States reporting routes
- Use Kickstarter’s reporting or support channel to provide the project record.
- Report suspected crowdfunding fraud to the Federal Trade Commission at ReportFraud.ftc.gov.
- Where appropriate, contact the state attorney general for the campaign organizer’s state.
These routes are U.S.-specific. In another country, use the local consumer-protection or law-enforcement agency after confirming its process for crowdfunding complaints. A regulator’s intake does not function as an individual refund service.
What the FTC’s board-game case does and does not show
In a 2015 release, the FTC described its first crowdfunding case involving a Kickstarter board-game campaign. The agency alleged that the creator raised money, failed to deliver promised rewards or refunds and spent much of the money on unrelated personal expenses. The matter ended in a settlement order prohibiting misrepresentations and failures to honor stated refund policies. That example shows that deceptive crowdfunding conduct can attract enforcement; it does not mean an ordinary production delay is fraud or that the FTC will obtain your individual refund.
When legal advice is worth considering
Consult a lawyer in your jurisdiction when the loss is substantial, there is evidence of apparent misuse of funds, the creator has dissolved or moved assets, or multiple backers have consistent evidence of false representations. Bring the campaign page, terms, pledge confirmation, payment statement, updates, messages, shipping records and any cancellation notice. Ask about realistic remedies, likely costs, limitation periods, the correct defendant and whether a group action is available. Kickstarter’s terms acknowledge that a creator unable to meet its obligations may face legal action by backers, but neither that language nor a lawyer’s consultation guarantees recovery.

- Archive the campaign page, reward, estimate, confirmation, survey and every update.
- Classify the event as unfunded, late, canceled, non-delivered or potentially deceptive.
- Send a written request for completed work, blockers, use of funds, next milestone and next update date.
- Ask for the creator’s proposed treatment of remaining funds if fulfillment is impossible.
- Contact a U.S. credit-card issuer immediately if non-delivery may be a billing error; check the 60-day written-notice rule from the first statement showing the error.
- For debit cards or non-U.S. payments, ask the bank or issuer for the applicable process and deadline.
- Report suspected deception to the platform and appropriate regulator; distinguish a complaint from a refund claim.
- Seek local legal advice for major losses or evidence of misuse, without assuming litigation will recover the pledge.
The useful dividing line is not simply “late” versus “on time.” It is whether the creator is communicating honestly, showing reasonable progress, explaining obstacles and offering a credible path toward completion or a fair treatment of remaining funds. Use the evidence and the deadlines available to you, and escalate proportionately.
