If a GST show-cause notice relies on statements made by suppliers, customers, transporters, employees or other third parties, do not ignore the notice or treat cross-examination as an automatic win. File a response by the deadline, identify every statement and allegation you dispute, obtain the relied-upon material, and make a focused written request to cross-examine each statement maker before the authority relies on that evidence. At the same time, answer the underlying tax allegations with your own records. Whether cross-examination must be granted, and which remedy is appropriate later, depends on the notice, the importance of the statements, the procedural stage and the governing state law.

What should I do first?

Start by preserving the notice and calculating the response timetable from the actual document. GST notices do not all carry one universal response period. The applicable deadline depends on the provision invoked, the notice wording, the mode of service and the current rules. Record the following before drafting:

  • Notice number, date on the notice and the date and method on which you received it.
  • The tax period, financial years and registration numbers covered.
  • Every statutory provision cited, such as a Section 74 demand proceeding.
  • The last date for a written reply and any scheduled personal hearing.
  • The portal acknowledgment, email, physical delivery record and any annexure list.

Download the complete notice and annexures from the GST portal, retain the original files and create a service log. If the notice gives a hearing date earlier than the reply deadline, ask promptly for clarification or an adjournment rather than assuming the later date controls.

Identify exactly how third-party statements are being used

A notice may quote a statement, summarize it, attach only selected pages or refer to an investigation report without supplying the underlying material. Separate what the notice actually relies on from background material that is merely mentioned.

Build a statement-to-allegation table

Item to record What to write down
Statement maker Name, designation, business relationship and whether the person is known to you.
Document reference Statement date, recording authority, page or paragraph cited in the notice and annexure number.
Attributed assertion The precise words or proposition the department says the person established.
Allegation supported For example, alleged fake invoices, non-receipt of goods, wrongful input tax credit, undervaluation or suppression.
Your dispute What is inaccurate, incomplete, misunderstood or inconsistent with your records.
Why it matters Explain whether the assertion is the main proof, one piece of corroboration or relevant only to a limited period or transaction.

This table becomes the core of both your evidence request and your cross-examination application. Do not write a general objection that “all statements are denied” without tying each objection to a particular allegation.

Request the material you need to answer

An effective reply requires access to the material actually relied upon. Ask for the complete statements, not just extracts, and identify every missing item precisely. Depending on the allegation, that may include linked invoices, e-way bills, transport records, payment trails, inspection reports, electronic data or investigation correspondence referred to in the notice.

Distinguish relied-upon material from every departmental record

Ask for copies or inspection of material that the notice identifies or uses as a basis for the proposed demand. You should not assert an unconditional right to every document in the department’s possession without checking the applicable law and facts. If an annexure is illegible, incomplete or in a language you cannot reasonably use, say so and request a readable copy or appropriate inspection.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

State how the missing material affects your ability to respond. For example, explain that an extracted sentence cannot be assessed without the preceding and following questions, that an electronic spreadsheet has no metadata or transaction key, or that a statement refers to invoices that were not supplied. Ask the adjudicating authority to provide the material, or to permit inspection, before fixing a final hearing.

How to request cross-examination properly

Cross-examination is a procedural request aimed at testing the reliability, context and accuracy of a statement. It does not replace a substantive defence to the tax demand. Make the request separately and make it specific enough for the authority to decide.

Include five elements

  1. Name the witness. If the name is withheld or unclear, identify the statement by its date, document number, business and paragraph cited.
  2. Quote or accurately describe the disputed assertion. Point to the exact proposition attributed to the person.
  3. Explain the factual conflict. Identify the invoice, ledger, delivery record, payment, return or correspondence that contradicts or qualifies the assertion.
  4. Explain materiality. Show how questioning could change the finding, such as by clarifying whether the witness had personal knowledge, whether the statement covered all transactions or only one, or whether the witness later corrected it.
  5. Ask for a decision before reliance. Request that the authority rule on cross-examination before using the statement to reach an adverse finding and give reasons for any refusal.

Ask for the witness to be produced, or for a hearing format the authority considers lawful and workable. If several witnesses are involved, list focused topics for each rather than seeking an open-ended inquiry.

Sample request language

I request an opportunity to cross-examine [name/description], whose statement dated [date] is relied upon at paragraph [number] of the notice. The statement is disputed because [specific factual conflict]. The witness’s personal knowledge, the transactions covered and the context of the quoted passage are material to the proposed finding of [allegation]. Please decide this request by a reasoned order before relying on the statement and inform me of the date and manner of cross-examination.

Adapt the wording to your facts. Do not state that a witness must be cross-examined merely because a statement appears in the file; explain why the evidence is central and what questions are necessary.

File a substantive reply as well

A cross-examination request challenges the way evidence is being used. It does not, by itself, prove that tax was correctly paid or that credit is eligible. Reserve your position on the procedure while answering each allegation on the merits.

Records commonly relevant to the factual defence

  • Tax invoices, purchase and sales registers, and reconciliations to returns.
  • Proof of movement or receipt of goods, such as e-way bills, lorry receipts, weighbridge slips, warehouse records and goods-received notes, where applicable.
  • Purchase orders, delivery challans, inspection records and correspondence showing the commercial transaction.
  • Bank statements, payment instructions, ledgers and confirmations that connect payments to the disputed supplies.
  • Input-tax-credit reconciliations, supplier communications and explanations for differences between returns and statements.
  • Contracts, credit notes, debit notes and accounting entries relevant to valuation or alleged suppression.

Organize the reply allegation by allegation. For each one, state the department’s proposition, your response, the supporting document and the conclusion you ask the authority to record. Explain gaps honestly; an unexplained missing record can undermine an otherwise strong answer.

What Section 75 means for the hearing

The CBIC-hosted text of the Central Goods and Services Tax Act identifies Section 75 as the general provision for determination of tax. Section 75(4) provides an opportunity of hearing in specified circumstances, including where an adverse decision is contemplated or a hearing is requested. The exact text and amendments applicable to the relevant tax period must be checked, along with the corresponding state GST enactment.

Section 75(4) is not a universal timetable or a self-executing guarantee that every requested witness will be produced. Use it to insist on a meaningful opportunity to answer the case, including a reasoned decision on a material cross-examination request. The notice’s statutory provision, the evidence actually relied upon and the authority’s procedure remain important.

JSW Steel Limited v. The Joint Commissioner of Central Tax — Karnataka, 13 August 2025

In a Section 74 proceeding, the Karnataka High Court considered an objection that the statute does not expressly provide for cross-examination. On the facts before it, the court found that third-party statements were the entire basis of the adverse view and that cross-examination was imperative for effective representation. It also treated a writ petition as maintainable in those circumstances despite an alternative remedy. The decision does not guarantee the same result where statements are peripheral, independent records prove the demand or the procedural posture differs.

The Joint Commissioner v. Nishad K.U. — Kerala, 17 February 2025

The Kerala High Court likewise addressed a Section 74 case and treated natural justice as requiring cross-examination where third-party statements formed the basis of the finding. The court discussed why the Supreme Court’s older Kanungo & Co. decision, which arose under the Sea Customs Act, 1878, should not be treated as a universal answer for a later statutory procedure. This is a jurisdiction-specific ruling, not a nationwide automatic entitlement in every GST investigation.

Delhi High Court judgment dated 29 July 2025

In its discussion of the hearing required under Section 75(4), the Delhi High Court stated: “before condemning a person that too on the basis of a statement of third party, the party against whom such statements have been relied upon is to be granted an opportunity to cross examine the person who gave that statement.” The sentence must be read in the context of that judgment and its facts. It is useful language for explaining why a witness who materially supports an adverse finding should ordinarily be available for questioning, but it is not a substitute for analyzing the governing provision and precedent in your state.

When is cross-examination most important?

The strength of the request generally turns on five decision factors:

Factor Why it changes the analysis
Central or corroborative statement If the statement is the sole or decisive basis, denying a chance to test it is more consequential than when independent records establish the same fact.
Access to the full evidence You can respond more effectively when the complete statement and relied-upon documents are supplied; extracts and undisclosed context support a stronger disclosure request.
Timing A request made during adjudication gives the authority an opportunity to correct the process before an order. A post-order challenge must address appeal limits and the relief available.
State and controlling precedent High Court decisions bind and influence proceedings within their jurisdiction differently. The state GST enactment and local procedural practice matter.
Available remedy A statutory appeal may be the ordinary route. Exceptional writ relief depends on the facts, the order, limitation and whether the court considers the procedural defect substantial.

Attend the hearing and preserve the record

Attend the personal hearing stated in the notice, or request a reasonable rescheduling in writing if attendance is impossible. At the hearing, repeat the cross-examination request, identify the unanswered disclosure points and ask that your submissions be recorded. Submit a short written note after the hearing if the authority permits it.

Preserve portal acknowledgments, emails, courier receipts, hearing notices, video-conference links, written submissions and any order rejecting or ignoring your request. If a hearing proceeds without deciding a material request, record the objection immediately and ask for a reasoned order before adjudication.

If an order has already been passed

Obtain the signed order and calculate the applicable appeal limitation period without waiting for informal assurances. Examine whether the order actually relied on the third-party statement, whether the complete statement was supplied, whether your request was decided, and whether the authority gave reasons. Then assess:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The statutory first appeal and its filing deadline.
  • Pre-deposit, stay and recovery consequences while the appeal is pending.
  • Whether the appellate authority can grant the procedural relief you need.
  • Whether the facts show an exceptional denial of natural justice that may justify writ proceedings.
  • The state’s controlling High Court decisions and any later amendments or binding authority.

The Karnataka decision shows that a writ challenge can be entertained in particular circumstances; it does not make a writ petition the universal first step. A missed statutory appeal deadline can create a separate problem, so obtain advice promptly from an Indian GST professional.

Common mistakes to avoid

  • Waiting for the department to send a statement instead of requesting it before the reply deadline.
  • Sending only a procedural objection and leaving the tax allegations unanswered.
  • Demanding “all investigation records” without identifying the relied-upon material and the prejudice caused by its absence.
  • Requesting cross-examination of unnamed persons without linking each witness to a disputed proposition.
  • Assuming a hearing date, response period or statutory version from another notice or tax period.
  • Quoting a High Court judgment as an automatic rule without checking the state, facts and current law.
  • Failing to preserve proof that the reply and attachments were filed successfully.

A practical filing checklist

  1. Save the notice, annexures and service proof.
  2. Record the provision, tax period, reply deadline and hearing date.
  3. Create the statement-to-allegation table.
  4. Request complete statements and identified relied-upon documents or inspection.
  5. Submit a witness-specific cross-examination request with reasons and a request for a reasoned decision.
  6. Prepare the allegation-by-allegation factual and legal reply with indexed records.
  7. File through the required GST channel and retain acknowledgment.
  8. Attend the hearing and renew unresolved procedural objections.
  9. If an order is issued, calculate appeal limitation immediately and evaluate statutory and exceptional remedies.

This checklist is a general guide. The correct response depends on the exact notice, evidence, statutory provision, procedural stage and jurisdiction, so case-specific representation should be obtained where the tax exposure or evidentiary dispute is significant.
