If a GST officer threatens arrest, stay calm, preserve every communication, avoid altering records, and contact an advocate experienced in GST investigations and criminal procedure immediately. A threat is not, by itself, proof that the statutory conditions for arrest have been met. Your lawyer should examine the actual summons, notice, search record, call, or message and advise on the response, bail risk, and any urgent court remedy.

This guide explains the practical records to secure, the difference between a summons and an arrest, the safeguards described in the Central Board of Indirect Taxes and Customs (CBIC) instructions, and the questions to ask counsel. It is general information, not case-specific legal advice. GST law and criminal procedure can change, so verify the current consolidated statute and later court decisions for your case.

What to do in the first few hours

1. Call a qualified lawyer

Contact an advocate who regularly handles GST investigations, arrests, bail applications, and criminal procedure. Send the lawyer the complete notice or summons, including attachments and the envelope or email headers where available. Explain exactly what was said, who said it, when it was said, and whether any deadline or appearance date was given.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask counsel to identify the tax administration involved, the statutory provisions cited, the person’s alleged role, and the immediate procedural issue. Depending on the facts, the urgent issue may be a summons response, production of documents, protection from coercive action, anticipatory relief, regular bail, or preparation for a court appearance. Do not assume that collecting documents alone prevents arrest or resolves liability.

2. Preserve the complete record

Save originals and make read-only working copies. Keep paper documents flat and unmarked; preserve electronic files in their original format. Do not delete messages, reset a phone, overwrite accounting data, or edit a scan to make it clearer. Record the following in a dated chronology:

  • Date, time, channel, and number or email address used for each contact.
  • Name, designation, office, and department identified by the officer.
  • Document identification number, case or reference number, and provisions cited.
  • Every document or explanation requested, and the deadline or place of attendance.
  • The precise words used about arrest, custody, payment, or consequences.
  • Names of people present, including employees, accountants, advisers, or family members.

Keep one secure copy with counsel and another in a location that the business can access if a key person is unavailable. A chronology helps counsel compare the communication with the formal record and identify contradictions without relying on memory.

3. Do not obstruct or destroy evidence

Cooperate lawfully, but do not conceal, backdate, delete, or modify records. Do not move inventory or devices to defeat a search. If an officer requests a document, ask for the request to be identified in writing and provide material through counsel or against a documented acknowledgment when practical. If you do not understand a question or proposed statement, pause and seek legal advice rather than guessing.

Understand which GST action you are facing

The document or event type determines the immediate task. A summons, notice, search or seizure record, and arrest memo are not interchangeable.

Document or event What it generally concerns Immediate response
Summons under section 70 Attendance to give evidence or production of documents Check the date, place, requesting officer, subject matter, and documents sought. Have counsel prepare the response and arrange attendance or a written request for clarification.
Tax notice or letter A stated discrepancy, demand, proposed action, or request for explanation Preserve the full communication and attachments, calendar the deadline, and prepare a fact-supported reply with counsel.
Search or seizure record Inspection of premises, records, goods, devices, or other material Keep the panchnama or inventory, note what was taken, and obtain acknowledgments or copies. Do not interfere with officers.
Arrest memo Formal recording of an arrest and its legal basis Ask for the grounds of arrest, read the memo carefully, request counsel, notify the nominated contact, and record the date and time.

These categories can overlap in one investigation, but a summons is not an arrest order. A request to attend or produce records should not automatically be treated as proof that arrest is imminent, while a verbal threat should not be ignored. Counsel must assess the actual facts and statutory provision.

What section 69 says about GST arrest authority

The “reasons to believe” requirement

Section 69(1) of the Central Goods and Services Tax Act (CGST Act) provides that the Commissioner may, by order, authorize a central tax officer to arrest a person when the Commissioner has “reasons to believe” that the person committed an offence in the categories specified in section 132(1)(a)–(d), punishable under the relevant clauses, or an offence under section 132(2). The statutory offence and punishment provisions therefore matter; a generic tax dispute or an unpaid amount does not, on the wording supplied here, automatically establish arrest authority.

CBIC Instruction No. 02/2022-23, dated 17 August 2022, says the Principal Commissioner or Commissioner should consider the nature of the offence, the person’s role, and the evidence available before recording reasons to believe and authorizing an arrest. It states: “Pr. Commissioner/Commissioner shall record on file that after considering the nature of offence, the role of person involved and evidence available, he has reason to believe that the person has committed an offence as mentioned in Section 132 and may authorize an officer of central tax to arrest the concerned person(s).” This describes an internal decision process; it does not let a reader determine from a threat alone whether that process occurred.

What section 70 summons power means

Section 70 gives the proper officer power to summon a person to attend and give evidence or produce documents. A summons can require a director, employee, accountant, consultant, or another person connected with the inquiry to attend. It does not itself prove guilt and is legally distinct from an arrest authorization.

Read the summons literally. Note the appearance date, location, officer, reference number, and specific records requested. Ask counsel whether the person named should attend personally, whether an authorized representative can provide particular records, and how to explain records that are unavailable or held by a third party. Never ignore a summons without legal advice; non-attendance or an incomplete response can create additional procedural problems.

Limits of a general arrest statement

Do not characterize every GST arrest as automatically bailable or non-bailable. Section 69(3) addresses bail and custody for specified offence categories, subject to applicable criminal procedure. The answer depends on the provision alleged, the facts, and the current procedural law. Counsel should analyze the exact section 132 category and the court with jurisdiction.

Documents to gather for your lawyer

The following is a practical organization checklist, not a list that sections 69 or 70 require in every case. Gather only relevant material, preserve originals, and do not create replacement documents that could be mistaken for contemporaneous records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Official communications and procedural records

  • Summons, notices, letters, emails, text messages, and call records.
  • Complete email headers, attachments, envelopes, and delivery information where available.
  • Search, seizure, inspection, inventory, panchnama, and acknowledgment documents.
  • Earlier replies, extensions, hearing notices, orders, and proof of submission.
  • Voluntary payment records, challans, electronic cash or credit ledger entries, and correspondence explaining any payment.

GST and accounting records

  • GST registration certificates and amendments for the relevant entities and periods.
  • Returns, payment ledgers, electronic liability records, and reconciliations connected to the inquiry.
  • Tax invoices, credit notes, debit notes, e-way bills, delivery records, and goods-receipt documents.
  • Books of account, general ledgers, trial balances, journal entries, and input-tax-credit workings.
  • Supporting purchase and sales registers, stock records, and transaction-level reconciliations.

Commercial and payment evidence

  • Bank statements, payment confirmations, payment gateway records, and correspondence about settlement.
  • Contracts, purchase orders, work orders, delivery terms, and amendments.
  • Supplier and customer correspondence relevant to the disputed transaction.
  • Proof of business premises, transport, delivery, or services actually supplied, where relevant.

People and responsibility records

  • A dated timeline identifying who prepared, reviewed, approved, and filed the disputed returns or invoices.
  • Names and contact details for the GST practitioner, accountant, finance lead, responsible officers, and former employees with relevant knowledge.
  • A family member or other nominated contact who can be notified if a person is arrested.

Organize a counsel set by issue and date, with an index and file names that do not change the underlying document. Keep a separate privilege-sensitive set for legal advice. Your lawyer can decide what should be produced, when, and with what explanation.

How to check a communication and officer identity

Confirm the source without confronting the officer

Write down the officer’s full name, designation, office address, telephone number, and the case or reference number. Compare those details with the contact information in the notice and with official departmental channels. If a message arrives from an unfamiliar number, preserve it and let counsel verify it rather than replying with sensitive records or money.

Check the Document Identification Number

CBIC Instruction No. 02/2022-23 refers to mandatory generation and quoting of a Document Identification Number (DIN) on CBIC communications to taxpayers and others for investigation. Preserve the communication exactly as received and ask counsel to verify the DIN and authenticity through official channels when there is any doubt. A valid-looking number does not, by itself, establish that the allegations or proposed arrest are legally justified.

Recognize pressure tactics

Urgent demands for cash, personal transfers, passwords, or an immediate admission should be treated as warning signs and reported to counsel. Do not send payment to a personal account. A legitimate tax liability and a lawful demand should be handled through the documented statutory process, not an unrecorded bargain to avoid arrest.

How to respond to a summons or interview

  1. Calendar the deadline. Record the date, time, place, and response method. Tell counsel immediately if the date conflicts with illness, travel, custody of records, or another legal obligation.
  2. Define the subject. Ask counsel to identify the tax period, transactions, entities, and provisions involved. Separate what you personally know from what an employee or adviser handled.
  3. Prepare an indexed set. Number the documents, keep a copy, and note whether each item is an original, certified copy, export, or explanation prepared from business records.
  4. Attend safely and accurately. Follow counsel’s advice about attendance and representation. Answer only what is asked, do not speculate, and say that you need to check records when you do not know.
  5. Review statements before signing. Read every page, correct factual errors, and do not sign a statement you do not understand. Ask for a copy or acknowledgment of what was submitted.
  6. Record follow-up requests. If the officer asks for additional records or another appearance, obtain the request in writing where possible and send it to counsel the same day.

Do not coach employees to give a common story or destroy drafts. Counsel can help witnesses give truthful, independent accounts and explain the difference between preserving evidence and creating new evidence.

If the officer arrests you

Ask for the grounds and arrest memo

Section 69(2) specifically states that when a person is arrested for an offence specified under section 132(5), the authorized officer must communicate the grounds of arrest and produce the person before a Magistrate within 24 hours. The 24-hour rule is tied to that described offence category; it should not be presented as a universal answer for every GST arrest without checking the charged provision and current criminal procedure.

CBIC Instruction No. 02/2022-23 describes an arrest memo that records the relevant legal provisions, confirms that the grounds were explained, notes notification to a nominated or authorized person, and states the date and time. Ask for a copy against acknowledgment. Note the names and designations of the officers present, the location, the time movement began, and any medical or personal needs.

Notify counsel and a nominated person

Tell the officer which lawyer should be contacted and which family member or other person should be notified. Ask that the notification be recorded. If you cannot reach counsel, request that the nominated contact receive the arrest information and location promptly.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Protect your health and legal position

  • Do not resist, threaten, or obstruct officers; ask your lawyer to challenge unlawful conduct through the proper court process.
  • Request necessary medication, medical attention, food, and an interpreter if required.
  • Do not sign a confession, statement, inventory, or acknowledgment you cannot read or understand.
  • Mark factual corrections on documents before signing, or state that you need legal advice.
  • Keep track of property taken and request an inventory or receipt.

Bail, custody, and the 60-day prosecution reference

Section 69(3) sets out bail and custody treatment for specified offence classes, subject to criminal procedure. Because the result depends on the charged section and current law, ask counsel to identify the precise classification before relying on general statements about release.

CBIC Instruction No. 04/2022-23, dated 17 August 2022, describes an effort to file a prosecution complaint in court within 60 days of arrest when the person has been arrested and bail has not been granted, including a proposal to the sanctioning authority. This is an administrative prosecution timeline described in that instruction, not a promise of bail, automatic release, or a finding that every case follows exactly the same path. Counsel should track custody dates, remand orders, bail filings, and court deadlines independently.

Common mistakes and safer alternatives

Mistake Why it creates risk Safer approach
Deleting or “cleaning up” books after receiving a notice It can destroy evidence and make an ordinary discrepancy look deliberate. Preserve the original system, export a read-only copy, and document any later correction through counsel.
Ignoring a summons because it is not an arrest order Failure to attend or produce records can create a separate problem. Have counsel confirm the response, request clarification or time where justified, and keep proof of submission.
Paying an officer personally to stop arrest It is not a documented statutory resolution and may expose you to criminal and financial risk. Use official payment channels only after counsel verifies the legal demand.
Signing a prepared statement without reading it An inaccurate or misunderstood statement can be used against you. Read every page, correct errors, and obtain legal advice before signing.
Assuming a threat proves arrest is lawful or unlawful The legal test depends on authorization, offence category, role, evidence, and procedure. Preserve the threat and let counsel test it against the statute and record.
Giving employees a rehearsed account Inconsistent or coordinated answers can undermine credibility. Preserve records and let each witness provide a truthful account based on personal knowledge.

A practical 24-hour preparation checklist

  1. Create a secure folder containing the original communication, attachments, headers, and call or message logs.
  2. Write a chronological account while memories are fresh, using exact words where possible.
  3. Make a one-page contact sheet for counsel, the GST practitioner, accountant, responsible officer, and nominated family contact.
  4. Export relevant returns, ledgers, invoices, e-way bills, bank proof, contracts, and prior replies without changing source files.
  5. Mark each document with its date, source, and connection to the transaction; do not add speculative explanations to the original.
  6. Ask counsel whether a written response, personal appearance, anticipatory relief, or another urgent application is appropriate.
  7. Tell key staff not to delete, edit, move, or discuss records outside the legal team’s instructions.
  8. Keep identification, prescribed medication, and emergency contact details available if an appearance or arrest is possible.

Questions your lawyer will need answered

  • Which entity, GST registration, tax period, and transaction are identified?
  • What section 132 offence, if any, is cited or implied?
  • Was there a written authorization, summons, search, seizure, or only a verbal statement?
  • What is the person’s role: owner, director, employee, accountant, consultant, supplier, or customer?
  • Which records exist, who controls them, and have any already been taken or copied?
  • Was a DIN quoted, and can the communication be authenticated through official channels?
  • Is there an appearance deadline, remand hearing, bail issue, or risk that records will be destroyed or moved?

Answer these questions accurately and distinguish personal knowledge from information learned later. That distinction helps counsel prepare a defensible, consistent response without inventing facts.

When to escalate urgently

Call counsel immediately rather than waiting for the next business day if officers arrive to search or arrest, a person is detained, a summons requires same-day attendance, a device or original ledger is taken, a deadline expires, or anyone demands money or a personal transfer. Ask counsel whether to seek urgent court relief, a production acknowledgment, medical assistance, or a bail hearing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the communication appears forged, preserve it and report the suspected impersonation through counsel and the appropriate official channel. Do not publish allegations on social media while facts are being checked; public posts can complicate the investigation and later proceedings.

Key takeaways

Preserve the complete record, keep business documents unchanged, and obtain prompt legal advice. Section 69(1) ties arrest authority to a Commissioner’s reasons to believe and an authorization concerning specified section 132 offences; section 70 summons power is different. If an arrest occurs, request the grounds, arrest memo, nominated-person notification, and acknowledgment described in CBIC’s instruction. The exact response, bail position, and court remedy depend on the allegation, evidence, person’s role, and law in force when the event occurs.
