A GST input tax credit (ITC) demand is not automatically invalid merely because it arrives after the relevant return or assessment period. The outcome depends on the tax year, the section cited, whether you received a show-cause notice or a final order, the dates of issue and communication, and any legally applicable exclusions, extensions or transitional rules.
First preserve the complete record and identify the procedural stage. Then check limitation under the version of the Central Goods and Services Tax (CGST) law applicable to that period, reply by the stated deadline, and obtain case-specific advice from a GST practitioner or tax lawyer. Do not ignore a notice while investigating whether it is time-barred.
Can a GST demand be raised after the assessment or return period?
Yes. The end of a return period, financial year or earlier assessment activity does not, by itself, extinguish the department’s power to examine wrongly availed or utilised ITC. Limitation is a statutory calculation tied to the particular proceeding. It can differ according to the section invoked, the tax period, the date on which a notice was issued and served, the date of the order, and legally recognised exclusions or extensions.
GST demand proceedings for ITC commonly fall under section 73 (cases not based on fraud, wilful misstatement or suppression) or section 74 (where those allegations are made). Section 75 contains general procedural safeguards, including hearing and reasoned-order requirements. Read the exact current text of the CGST Act and commencement notifications for the financial year involved at the CBIC CGST Act page; older versions of the Act cannot safely be used for a current calculation.

A notice may still fail on limitation, jurisdiction, evidence or procedure. Conversely, a demand that looks late may remain valid after exclusions, extensions, a stay or a change in the applicable law is taken into account. Treat “after assessment” as a trigger for a date-and-document review, not as the conclusion.
Identify exactly what you received
Download the full document, every annexure and the corresponding entry in the GST portal before deciding what to do. A portal alert or summary is not necessarily the same thing as a signed adjudication order.
| Document or event | What it means | Immediate response |
|---|---|---|
| Show-cause notice | The department proposes a demand and invites your defence; no final liability has yet been adjudicated. | Record the response date, answer each allegation with evidence, and request a hearing where appropriate. |
| Adjudication order | A decision has been made and may include tax, interest and penalty. | Calculate the appeal deadline from communication, obtain the order record and assess appeal, rectification or another lawful remedy. |
| Portal summary or other communication | It may provide information, seek data or point to a notice/order that is stored elsewhere. | Locate the underlying document, verify service and communication dates, and do not assume the summary starts or ends a limitation period. |
Write down these fields exactly as they appear:
- financial year and tax period to which the ITC relates;
- section and rule cited, including whether the allegation is under section 73 or 74;
- date of issue, date and mode of service, and date the document became visible or was communicated on the portal;
- response or payment date stated in the notice;
- separate amounts for tax, interest and penalty;
- the transactions, invoices, suppliers or periods listed in each annexure; and
- any reference to an earlier audit, inspection, reply, order, stay or extension.
Keep the original files rather than relying on screenshots. Preserve the portal download, email or other service proof and a dated log of every submission.

Preserve the evidence before analysing limitation
Limitation is only one defence. An organised record lets you answer the merits and prove when earlier events occurred.
- Save the notice or order, annexures, portal history and proof of service.
- Retain filed returns, electronic ledgers, purchase registers, invoice copies and the ITC reconciliation for the disputed period.
- Keep supplier communications, payment evidence and documents showing how the goods or services were received and used.
- Collect previous replies, audit correspondence, statements, orders and acknowledgements relating to the same credit.
- Create a working schedule matching every disputed line to the return, invoice, accounting entry and supporting document. Mark missing or contradictory items instead of silently estimating them.
Use read-only copies for the working file and preserve metadata and acknowledgement numbers. If records are held by an accountant, supplier or former employee, request them immediately; waiting until the hearing can make an otherwise answerable allegation difficult to prove.
How to check the applicable time limit
1. Start with the financial year and the statutory version
Identify the exact financial year and the version of the CGST Act and rules that governed that period and proceeding. Later amendments, commencement notifications and transitional provisions can change both the calculation and the available remedy. The Act text retrieved from official materials includes older legislative content, so confirm the current Gazette-notified text before relying on a section number, deadline, pre-deposit or scheme date.

2. Classify the allegation under section 73 or 74
Section 73 addresses proceedings not based on fraud, wilful misstatement or suppression; section 74 is used when those allegations are made. The distinction affects the limitation analysis and the procedural case you must meet. Read the factual allegations, not just the heading: an officer’s use of section 74 does not itself prove the fraud-related grounds.
3. Build a date line
Place the relevant return or financial-year dates, the statutory cut-off, notice issue and service, replies, hearings, order and communication on one timeline. Check whether a statute, notification, court direction or other legally recognised rule excludes a period, extends time, or governs a procedural transition. A prior assessment, audit or closed return period may be evidence in the case, but it is not automatically a limitation bar.
4. Treat the “two years nine months” figure narrowly
CBIC Circular No. 185/17/2022-GST discusses a two-years-and-nine-months notice timing in a specific section 74-to-section 73 situation: the fraud-related grounds are not sustained and the matter is treated under section 73. That figure is not a universal GST limitation period and must not be applied to a different year, section or fact pattern. Read the circular at Circular 185/17/2022-GST alongside the law applicable to your case.

5. Put the calculation in your reply, but keep an alternative merits defence
State each date, the provision on which your calculation is based, and why any claimed exclusion or extension does or does not apply. Also answer the ITC allegation on its facts. If an authority rejects your limitation argument, a complete merits response prevents the case from being decided on an unanswered allegation.
How to reply to a GST show-cause notice
- Calendar the deadline immediately. Use the date stated in the notice and verify how service was made. If an extension is legally available, request it before the deadline; never assume that an informal request stops the clock.
- Break the notice into allegations. Number each invoice, supplier, month and legal proposition. Create a response matrix with columns for the allegation, your answer, supporting document and annexure number.
- Reconcile the ITC. Tie the credit claimed in the return to the purchase register, invoice, ledger and supplier records. Explain discrepancies such as reversals, duplicate entries, credit notes or timing differences with a dated schedule.
- Address statutory eligibility. Apply the conditions cited in the notice to the evidence you have. Where a document is unavailable, say what was requested, from whom and when, and provide corroborating records rather than asserting that it exists.
- Raise limitation and jurisdiction separately. Show the date calculation in a short section, identify the applicable statutory version and challenge any unsupported extension or exclusion. Do not let a limitation argument replace a factual defence.
- Ask for a hearing in writing. Section 75 contains hearing and reasoned-order protections. State the issues on which oral clarification is necessary and keep the request with your filing proof.
- File through the prescribed channel and retain proof. Upload the response and annexures in the required format, note the acknowledgement and download the submitted package. If the portal fails, preserve error messages and make the alternative submission permitted by the current rules.
- Monitor for the next communication. A hearing notice, supplementary document request or order can create a new action point. Keep checking the portal and the registered contact details used for service.
A reply should be factual and restrained. Do not concede tax, interest or penalty merely to close the correspondence, and do not accuse an officer of bad faith without evidence. Have a GST professional review the completed matrix when the amount, fraud allegation or limitation calculation is material.

If a final demand order has already been issued
An adjudication order requires a different response from a show-cause notice. Read the findings, the quantification schedule and the service record, then calculate the appeal period from the date the order was communicated. Section 107 generally provides three months to appeal to the first appellate authority, with a possible further one month where sufficient cause for delay is accepted. The extra month is not automatic; obtain advice and file the delay explanation with the appeal.

Retrospective correction for certain section 16(4) orders
CBIC Circular No. 237/31/2024-GST describes a special rectification procedure for certain orders that denied ITC under the former section 16(4) timing rule, where the credit became available because of retrospectively inserted section 16(5) or 16(6). The route is limited by the affected period, order type, conditions and procedural status. Read Circular 237/31/2024-GST and the later notifications before requesting rectification. A historic filing window should not be assumed to remain open.
Section 128A waiver arrangement
CBIC Circular No. 238/32/2024-GST explains a section 128A waiver route for specified section 73 matters and the related forms and filing conditions. Eligibility can depend on the exact tax period, whether an appeal is pending or has been withdrawn, payment or filing steps, and deadlines. Review Circular 238/32/2024-GST, the governing notifications and current portal availability before relying on it. The circular does not create a general waiver for every delayed ITC demand.
Neither route substitutes for a timely reply or appeal. Preserve those rights while a professional checks whether rectification or waiver is genuinely available.
Quick Recap
Common mistakes and how to correct them
| Mistake | Why it causes trouble | Better action |
|---|---|---|
| Assuming the demand is void because the return period closed | Limitation depends on the section, dates and legal exclusions, not the label “old period.” | Prepare a dated calculation under the correct statutory version and plead the merits in the alternative. |
| Using two years nine months as a universal rule | The figure belongs to the specific 2022 circular scenario. | Quote it only with its section 74-to-73 facts and verify the period-specific law. |
| Treating a notice as a final order | You may miss the chance to answer allegations before adjudication or use the wrong remedy. | Classify the document and follow the route attached to that stage. |
| Ignoring the notice while researching limitation | An unanswered allegation can be decided on the department’s record. | File a protective, evidence-backed reply by the stated date. |
| Counting from issue instead of communication | Appeal and response calculations may use a legally defined communication or service event. | Keep proof of when and how the document was communicated and have the date checked professionally. |
| Submitting an incomplete reconciliation | Unexplained invoice-level differences weaken an otherwise valid credit claim. | Map every disputed line to a source document and identify genuine gaps. |
| Assuming a special scheme is automatic | Rectification and waiver measures cover limited cohorts and can have closed windows. | Verify period, order status, appeal status, forms, conditions and current notifications. |
| Relying on an outdated Act copy | Amendments and commencement dates can alter the answer. | Check the current official text and obtain advice for a live dispute. |
A practical decision path
- Notice received: download the record, identify the section and tax period, preserve evidence and submit the response and hearing request by the stated deadline.
- Order received: record the communication date, obtain the appeal papers and calculate the section 107 period immediately.
- Limitation appears arguable: prepare the date line, test exclusions and extensions, and cite the applicable statutory version without relying on a generic online calculator.
- Section 16(4) retrospective issue: check the specific rectification conditions under Circular 237/31/2024-GST while preserving ordinary remedies.
- Specified section 73 demand: test the section 128A conditions under Circular 238/32/2024-GST, including period, appeal status and filing window.
- Any uncertainty about dates, fraud allegations or a large amount: give the complete record to a GST practitioner or tax lawyer and follow the professional’s written deadline plan.
