If an Indian GST invoice appears to use the wrong rate, do not overwrite it yourself or claim the difference automatically. First verify the supply’s classification, place of supply, transaction date and applicable notification. Then ask the supplier to correct the document and align its GST return reporting. Tax charged above the amount legally payable is normally corrected with a supplier-issued credit note under section 34(1) of the Central Goods and Services Tax Act (CGST Act); tax charged below the amount payable requires a debit note (which includes a supplementary invoice) under section 34(3). A registered buyer must also review any input tax credit (ITC) already claimed.

Why a printed GST rate may be wrong—or may only look wrong

GST rates are attached to the actual supply, not simply to a product name typed on an invoice. The correct result can depend on the HSN or SAC classification, the description and composition of the goods or services, the customer’s status, the place of supply, whether the transaction is interstate or intrastate, exemptions or concessional notifications, and the date on which the supply took place.

Compare the invoice with the rate notification that applied on the supply date. Check whether the invoice should show CGST plus SGST/UTGST or IGST. A rate that looks unfamiliar is not necessarily an error, and a familiar percentage can still be wrong if the classification or place-of-supply tax type is wrong. Keep the complete facts together before asking for a correction.

What to check before contacting the supplier

  1. Identify the supply. Read the line description, quantity, unit, bundled items, service wording and any exemption or reverse-charge notation.
  2. Verify classification. Compare the HSN for goods or SAC for services with the classification used in the applicable rate notification. A classification dispute is different from a simple arithmetic mistake.
  3. Confirm the transaction date. Rate notifications and amendments can change. Use the date relevant to the supply and the tax period, not merely the date someone discovered the error.
  4. Check the place of supply and tax type. An interstate supply generally uses IGST, while an intrastate supply generally uses CGST and SGST or UTGST. The parties’ registration details and the statutory place-of-supply rule must support that treatment.
  5. Recalculate the tax. Compare taxable value, rate, tax amount and invoice total. Separate a rate error from an incorrect taxable value, duplicate line, rounding issue or wrong tax split.
  6. Check the parties’ status. A registered recipient’s ITC workflow has additional statutory conditions. A consumer without ITC still needs a corrected commercial document if the amount charged is wrong.

The official framework establishes how a difference between tax charged and tax payable is documented; it does not determine the rate for an unidentified product or service. If classification is uncertain, obtain a professional opinion before treating the invoice as conclusively incorrect.

Choose the correction path: overcharge or undercharge

The direction of the difference determines the supplier’s document and the buyer’s next action.

What the original invoice did Supplier’s correction document CGST Act treatment Buyer’s immediate action
Tax charged is higher than the tax payable Credit note Section 34(1) says the registered supplier may issue a credit note and declare it in the return for the month of issue, subject to the statutory outer deadline. Do not claim or retain excess ITC; obtain the credit note, adjust the payable amount and reconcile the supplier’s reporting.
Tax charged is lower than the tax payable Debit note, which includes a supplementary invoice Section 34(3) says the registered supplier shall issue a debit note containing prescribed particulars. Verify the additional tax, record the debit note and pay the supplier if the charge is valid; claim additional ITC only when statutory conditions are met.

These paths are not interchangeable. A buyer should not ask for a credit note merely because it prefers a lower price, and a supplier should not issue a debit note when the original tax was already higher than the law required.

When the invoice charged too much GST

Supplier’s credit-note process

For an overcharge, section 34(1) permits the supplier to issue a credit note. The credit note should identify the original invoice and show the corrected taxable value and tax difference. The supplier declares it in the GST return for the month in which the credit note is issued, within the applicable statutory time limit: September following the end of the financial year in which the original supply was made, or the date of filing the relevant annual return, whichever is earlier.

The supplier cannot reduce its output-tax liability through a credit note where the incidence of the tax and interest has been passed on to another person. That restriction matters when the customer has already borne the tax; the parties must structure the commercial refund and tax adjustment consistently with the statutory requirements.

Buyer’s treatment

Ask for the signed or digitally issued credit note and match it to the original invoice. Reduce the amount payable to the supplier or obtain the agreed refund. If you are registered and claimed ITC on the original invoice, review the credit reduction in your books and GST return workflow. Do not leave the original ITC unchanged merely because the invoice was once reflected in your purchase register.

When the invoice charged too little GST

Supplier’s debit note obligation

Section 34(3) uses mandatory language. It states: “Where a tax invoice has been issued for supply of any goods or services or both and the taxable value or tax charged in that tax invoice is found to be less than the taxable value or tax payable in respect of such supply, the registered person, who has supplied such goods or services or both, shall issue to the recipient a debit note containing such particulars as may be prescribed.”

The Act’s explanation treats a debit note as including a supplementary invoice. The document should reference the original invoice and state the additional taxable value and tax. The supplier reports the debit note in the applicable return, and the recipient should not treat the extra amount as an informal surcharge outside the GST records.

Buyer’s treatment

Check that the revised classification, rate, taxable value and tax type are correct before accepting the debit note. Pay the additional amount when the charge is valid. A registered recipient may consider the related ITC only after checking the section 16 conditions and the supporting debit note, receipt of the supply, payment of tax to the government and return-filing requirements.

How a registered recipient should review ITC

Section 16 sets eligibility conditions for ITC, including possession of a prescribed invoice or debit note, receipt of the goods or services, payment of the tax to the government and filing of the required return. A document with the wrong rate can therefore affect both the amount of credit and whether the evidence supports the claim.

  • Before claiming ITC: hold the claim until the supplier issues the corrected document and the tax details can be reconciled.
  • After an overcharge credit note: calculate the ITC reduction corresponding to the credit note. Section 43 links a supplier’s reduction of output-tax liability on a credit note with the recipient-side reduction of ITC.
  • After an undercharge debit note: record the additional tax separately and claim any additional ITC only after all section 16 conditions are satisfied.
  • If a return has already been filed: involve the person responsible for GST compliance or accounting to determine the adjustment period and documentation. Do not silently edit a filed invoice or backdate a correction.

ITC is not a mechanism for making a supplier’s invoice correct. The supplier must issue the proper correction document, while the recipient preserves evidence that the corrected tax was charged and paid.

How to request a correction from the supplier

Send a written request that lets the supplier reproduce your calculation. Include:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Invoice number and date, including the supplier’s and recipient’s GSTINs where shown;
  • description, HSN or SAC, quantity and taxable value;
  • place of supply and whether the invoice used CGST/SGST or IGST;
  • rate and tax amount printed on the invoice;
  • your proposed rate, tax amount and the rule or notification you relied on;
  • whether payment has been made and whether ITC has been claimed; and
  • a request for the appropriate credit note or debit note and consistent return reporting.

Keep the request factual. If the disagreement concerns classification, describe the competing classifications and ask the supplier to confirm its position rather than presenting an uncertain rate as settled law.

Documents and reconciliation to retain

Maintain an audit trail that connects the original transaction to the correction:

  • original tax invoice and purchase or sales order;
  • the classification and rate analysis used for the transaction date;
  • emails or letters requesting correction and the supplier’s response;
  • credit note or debit note with the original invoice reference;
  • proof of payment, refund or set-off;
  • purchase register, sales register and ledger entries before and after correction; and
  • GST return workings showing the output-tax or ITC adjustment.

Correction-document particulars are governed by the CGST rules. The reference to the underlying invoice and the corrected taxable value and tax details should be clear enough for a reviewer to trace the change without guessing.

What if the supplier will not cooperate?

There is no single escalation sequence that fits every refusal. The next step depends on the actual defect:

  • Rate disagreement: obtain a written classification and rate opinion and preserve both parties’ analyses.
  • Wrong tax type: check place-of-supply facts and whether the issue is IGST versus CGST/SGST, not merely the percentage.
  • Return mismatch: compare the invoice, correction document and supplier’s reported data for the relevant period.
  • Material amount or closed period: seek advice from a GST professional before making a voluntary payment, refund or return amendment.

Continue to preserve the original invoice and correspondence. Do not alter the supplier’s invoice, create your own credit note for the supplier’s tax, or claim an unsupported ITC adjustment. A commercial dispute may require contract remedies in addition to GST compliance steps.

Worked examples

Example 1: overcharged rate

An invoice uses a higher rate than the rate applicable to the verified HSN and supply date. The taxable value is unchanged, but the tax charged exceeds tax payable. The supplier issues a credit note referencing the invoice, reports it within the section 34(1) time limit and refunds or sets off the difference. A registered buyer reduces the corresponding ITC and keeps the credit note with its return reconciliation.

Example 2: undercharged rate

An invoice uses a lower rate than the verified rate, so tax charged is less than tax payable. The supplier issues a debit note or supplementary invoice under section 34(3) with the original invoice reference and additional tax. The buyer verifies the calculation, pays the additional amount and considers related ITC only after meeting section 16 conditions.

Example 3: wrong tax split

The percentage may be correct, but an interstate supply is shown with CGST and SGST instead of IGST, or an intrastate supply is shown with IGST. This is a place-of-supply and tax-type correction, not simply a rate correction. Ask the supplier to cancel or correct the original tax treatment through the proper GST documents and reporting workflow.
