Stop using the transaction until you have preserved the listing, packaging, serial labels, messages and payment records. Then open the seller and marketplace remedy process, ask your card issuer which dispute route applies, and report suspected fraud—using the deadlines and return instructions for your specific transaction.
First, protect your evidence
Do this before returning, modifying or discarding anything. A marketplace, payment provider or investigator needs to see what was promised, what arrived and when you complained.
- Save the complete listing URL and take screenshots showing the exact model name, condition, memory capacity, specifications, price, seller identity, shipping promise and return terms.
- Keep the order confirmation, invoice, tracking record, delivery date, payment receipt and the seller’s profile information.
- Photograph the shipping box, labels, seals, internal packaging, graphics card, cooler, ports, stickers, serial-number labels and any included accessories from several angles.
- Export or screenshot every message with the seller and marketplace. Keep the original image files and note their dates; do not edit the originals.
- Do not remove or alter serial labels, flash firmware, install a modified cooler, discard packaging or send the card back before opening the official claim and receiving return instructions.
These steps preserve practical evidence; photographs alone do not authenticate hardware. The Federal Trade Commission (FTC) advises keeping copies of communications and checking the marketplace’s return and refund deadlines.

Compare the delivered card with the original listing and order record. Describe an observable mismatch instead of making a broader accusation about the seller’s intent.

| Compare | What to record |
|---|---|
| Model | Brand and model printed on the card, box and software versus the model named in the listing. |
| Memory | Advertised capacity and type versus the capacity reported by the system or manufacturer support. |
| Condition | New, used, refurbished, damaged or repaired condition promised versus what arrived. |
| Specifications | Clock, ports, power connectors, cooler design or other material specifications that differ from the listing. |
| Identity | Serial numbers, product labels, packaging markings and the seller’s description. |
Write a short chronology: when you ordered, when it arrived, when you found the discrepancy and when you contacted the seller. If the manufacturer or an authorized support channel can assess the model or serial number, retain its written response. There is no universal GPU-authentication test established by the materials for this guide, so do not present a diagnostic result as conclusive unless the issuing authority says it is.
Avoid public accusations that exceed your evidence. In a claim, state “the listing says 16 GB, but the delivered card is identified as 8 GB” rather than alleging a criminal scheme you cannot prove.
Open the marketplace remedy
Contact the seller in writing
Use the platform’s message system or the contact method attached to the order. State the precise mismatch, request the remedy you want (usually a refund or a replacement that actually matches the listing), and attach only relevant screenshots and photographs. Keep the message factual and give the seller a clear response deadline if the platform allows one.

If the seller does not resolve the issue, or the platform directs you to file immediately, open the marketplace’s official “return,” “item not as described” or buyer-protection case from the order page. Do not rely on an informal email or a social-media complaint. Marketplace protections differ and can have short claim windows; the controlling deadline is the policy attached to your transaction.

Explain the mismatch in the platform’s form and upload the evidence that proves it. Keep the case number and every platform response. Do not close the case merely because the seller promises a refund; wait until the refund is actually posted or the platform confirms the resolution.
Follow return instructions exactly
If the marketplace tells you to return the card, use its label or shipping method, photograph the packed parcel, retain the tracking number and keep proof of delivery. Do not ship it to an address supplied only in an unsolicited message if it conflicts with the official case.
Some platforms have special handling for strong indicators of counterfeit goods. For example, eBay’s Money Back Guarantee policy says that, in certain counterfeit claims, a buyer may not be required to ship the item back and may have to cooperate with disposal instructions. That is an eBay-specific rule, not a general marketplace right. Wait for the platform’s decision and follow the actual instructions; do not destroy or resell the card on your own.
Understand the payment-dispute route
Credit cards: ask which process fits
Call or write the card issuer promptly and explain that the merchandise may be counterfeit or materially misrepresented. Ask which dispute category and documentation the issuer requires. Provide the listing, order record, photographs, correspondence and marketplace case information, and keep notes of the call.

The FTC distinguishes a Fair Credit Billing Act billing error from every dispute about product quality. Its guidance treats certain charges for merchandise that was not accepted or was not delivered as agreed as billing errors, and says a written dispute for a qualifying billing error must reach the issuer within 60 days after the first statement showing the error. That 60-day period does not automatically govern every counterfeit or “not as described” claim. A card-network, contractual or state-law process may have different requirements, so do not wait while deciding which label applies.
Debit cards and other payment methods
Debit-card protections and procedures differ from credit-card billing-error rules. Contact the bank promptly and ask for its merchandise-not-as-described or unauthorized-transaction process, if applicable. For payment services, digital wallets or bank transfers, use the provider’s transaction-specific dispute channel and preserve the provider’s confirmation.
Avoid conflicting cases
Check the terms before filing overlapping marketplace and payment-provider disputes. eBay says it may close a marketplace claim when a buyer files a payment-provider dispute for the same transaction. Other services may handle duplicate cases differently. Ask both providers how one filing affects the other, and record the answer.

A report can support enforcement even when it does not recover your money. Use the marketplace’s report-listing or report-seller function, preserving the listing identifier and case number.

- Report suspected dishonest businesses to the FTC at
ReportFraud.ftc.gov. - Send a complaint to your state attorney general when appropriate.
- Use the online-purchase complaint routes identified by USA.gov and any consumer-protection agency that has jurisdiction over the transaction.
Include the seller identity, listing, dates, amount, payment method, precise discrepancy and copies of your evidence. Reporting does not guarantee a refund; the marketplace or payment provider must decide the individual claim.
Do not put the card back into circulation
Do not sell a suspected counterfeit as genuine, give it to another buyer with the original description or alter its labels. Counterfeit goods can create a second consumer-loss problem and may violate platform rules or local law. Follow the platform’s disposal or return direction. eBay states that counterfeit items are prohibited and that some buyers must cooperate with disposal in qualifying cases.
Use this order of operations
- Pause handling. Disconnect the card if continued use could alter evidence or damage it, and keep every component together.
- Capture the record. Save the listing, order, seller details, packaging, labels, photographs, messages and payment statement.
- Write the discrepancy. Identify the exact model, capacity, condition or specification that differs and attach supporting proof.
- Notify the seller. Use the platform’s written channel and request a refund or compliant replacement.
- Open the official marketplace case. Submit it before the transaction-specific deadline and retain the case number.
- Follow the platform’s handling decision. Return only as instructed, keep tracking, or cooperate with an official disposal process.
- Contact the payment provider. Ask which dispute route applies to your payment type; provide the same evidence and observe its deadline.
- Report the suspected fraud. Notify the marketplace, FTC and relevant state or consumer-protection authority.
Deadlines and decision factors
| Factor | Why it changes your next step |
|---|---|
| Marketplace deadline | Buyer-protection and return windows vary by platform and transaction; a late claim may be rejected even when the discrepancy is real. |
| Payment type | Credit-card billing-error procedures, debit-card procedures and payment-service rules are not interchangeable. |
| Evidence strength | A clear listing screenshot, serial-label photograph, manufacturer response and written chronology make the mismatch easier to evaluate. |
| Jurisdiction | Your country, state, transaction date and applicable law can change available remedies and deadlines. |
| Return instruction | Shipping a suspected counterfeit without an official case can lose tracking, violate policy or interfere with a platform’s special handling. |
Verify the current policy and deadline for the specific order. Marketplace rules change, and the materials here do not establish that any particular buyer qualifies for a refund.

Common mistakes that weaken a claim
- Returning first: Sending the card away before opening the official case can leave you without platform tracking or proof of condition.
- Relying on a phone promise: Without a written record, it is harder to show what the seller agreed to do.
- Waiting for certainty: You can report a material mismatch while explaining what remains unconfirmed; waiting may exhaust a short marketplace deadline.
- Assuming the 60-day rule covers everything: The FTC’s 60-day written period is for qualifying credit-card billing errors, not every quality or counterfeit dispute.
- Filing duplicate disputes blindly: A payment-provider case can affect a marketplace case, as eBay’s policy illustrates.
- Reselling or discarding the card: That can destroy evidence and expose another buyer to the suspected counterfeit.
What the evidence can—and cannot—establish
A mismatch with the listing can support a refund or platform claim without proving who manufactured the card or whether the seller knew it was counterfeit. A manufacturer’s written assessment may strengthen the record, but no source cited here creates a universal authentication standard for every GPU. Keep the language of your complaint tied to what the documents and hardware show.
The FTC reported that online shopping scams were the second-most reported scam type in 2022, in a 2023 publication. That is broad online-shopping context, not a statistic about counterfeit graphics cards and not proof about any individual seller.
