After a crash in a construction or maintenance zone, stop without creating another hazard, check for immediate danger and injuries, and call 911 when anyone is hurt or an emergency exists. Follow police, incident responders, flaggers and other work-zone personnel; their directions control the live scene. Move a vehicle only when it is safe, the vehicle can be driven safely, and responders do not direct you otherwise.
Once people are safe, exchange information, document the crash from a protected location, notify your insurer promptly, and check the reporting rules for the state where the collision occurred. Deadlines and damage thresholds are not nationwide.
The first minutes: stop, assess, and call for help
Stop without creating a second crash
Bring the vehicle to a stop as safely as conditions allow. A construction zone may have narrowed lanes, temporary barriers, uneven pavement, shifting traffic patterns, workers, equipment and responders close to moving traffic. Turn on hazard flashers if you can do so without delaying emergency action. Do not step into a live lane, stand between vehicles, or walk around the work area to inspect damage.
Take a breath and make a quick safety assessment:
- Is anyone injured, trapped, unconscious or having trouble breathing?
- Is there fire, smoke, leaking fuel, a downed power line, unstable equipment or a risk of another collision?
- Are vehicles or debris blocking a travel lane?
- Are workers, flaggers or emergency responders already giving directions?
If there is an immediate threat, move yourself and passengers to the safest reachable location without crossing live traffic. Follow instructions from responders rather than trying to manage traffic yourself.

Call 911 for injuries or an emergency
Call 911 when anyone is injured or there is another emergency, such as fire, a dangerous spill, a blocked high-speed lane or a vehicle that cannot be safely occupied. Give the dispatcher:
- Your road, direction of travel and the nearest exit, intersection, mile marker or visible work-zone sign.
- The number of vehicles and people involved.
- Known injuries, entrapment, fire, smoke, fuel leaks or other hazards.
- Whether traffic is blocked and whether workers or responders are in danger.
Stay on the line and follow the dispatcher’s instructions. If you cannot identify the exact location, describe the road, direction, visible signs and nearby construction markers as clearly as possible.
Protect people in a live work zone
A work zone is more than the area where pavement is being built. Oregon Department of Transportation describes work zones as including construction, maintenance, traffic incidents, towing, traffic control and cleanup. Workers and responders may be only a short distance from fast-moving vehicles.
Recommended Free Tools
Follow directions from a police officer, firefighter, transportation incident responder, flagger or other authorized work-zone employee. A flagger may temporarily stop or route traffic; do not drive around that person or ignore a temporary instruction because the normal lane markings appear different.
Do not attempt to direct vehicles, remove barriers, retrieve scattered property or place yourself in a lane to warn approaching traffic. If you carry flares or reflectors, use them only if you can deploy them without leaving a safe position and only as allowed by local instructions. Oregon DMV emergency guidance discusses flares or reflectors but does not make a particular warning product mandatory.

Should you move your car after a crash?
Move only when all three conditions are met
Move the vehicle out of a travel lane only when it can be done safely, the vehicle remains mechanically safe to drive, and no officer or responder tells you to leave it where it is. California Department of Insurance’s consumer guide, revised December 2024, states: STOP Immediately and move only if it is safe to do so.
Oregon DMV similarly advises that when there are no injuries and vehicles can be safely moved, drivers should move them out of travel lanes as soon as possible. This is a safety instruction, not permission to drive a vehicle with damaged steering, brakes, tires, lights, leaking fluids or other dangerous defects.
When not to move
- Someone is injured and moving the vehicle would interfere with emergency care.
- The car is disabled, leaking fluid, smoking, unstable or otherwise unsafe to operate.
- You would have to cross a live lane, climb over a barrier or enter an active work area to reach a safe position.
- A police officer, incident responder or work-zone employee directs you to keep the vehicle in place.
If the vehicle cannot move safely, leave it where it is if you can occupy a protected position, turn on hazard flashers and tell 911 or the responding agency that the lane is blocked. Do not leave a safe position merely to place a warning device.
What to do if someone is injured
Do not move an injured person casually
Oregon DMV’s emergency guidance says, Injured people should never be moved carelessly.
Leave an injured person in the position found unless there is immediate danger such as fire or a serious risk of another collision. Moving someone unnecessarily can worsen spinal or other injuries.
Call 911, explain the person’s condition and follow the dispatcher’s first-aid directions. If the person is trapped, tell responders rather than attempting to pull them free. Keep other passengers away from traffic and hazards, and do not give food, drink or medication unless a qualified responder directs you.

When danger requires relocation
If fire, an explosion risk or an imminent second collision makes the current position unsafe, move people only as far as necessary to reach a safer location and follow dispatcher instructions. Do not send an uninjured person into a live lane to help unless responders specifically direct it and the movement can be made safely.
Do you need to call the police?
Call 911 for injuries or any emergency. For a crash without apparent injuries, contact the local law-enforcement agency or its non-emergency line when required by local rules, when vehicles or lanes are creating a hazard, or when the other driver refuses to exchange information, appears impaired or leaves the scene. In a work zone, a blocked lane or danger to workers is a strong reason to request an official response even when damage initially appears minor.
A police response or incident report does not necessarily satisfy a driver’s separate DMV collision-report duty. Oregon expressly says a driver’s DMV filing can still be required even when law enforcement filed a report.
Exchange information only from a safe position
After responders have made the area safe and no one needs immediate medical help, exchange details with the other driver. Do not cross active lanes or walk around barriers to gather information. Ask a police officer or responder how to make the exchange if the vehicles are separated by the work-zone layout.
Information to collect
- Each driver’s full name, address and telephone number.
- Driver-license number and issuing state.
- Vehicle year, make, model, color and license-plate number.
- Registered owner’s name and contact information if different from the driver.
- Insurance company and policy information.
- Names of passengers and a safe way to contact them if they witnessed events.
- Names and contact details of independent witnesses.
- The responding agency, officer’s name or badge number, and report number when available.
Keep the conversation factual. Do not argue about fault, promise to pay, speculate about speed or apologize in a way that could be interpreted as accepting legal responsibility. Do not sign a statement about fault at the roadside without understanding what it is.

Document the scene without entering danger
From a protected location, photograph or record details that may disappear when traffic is redirected or construction changes. Useful subjects include vehicle damage, lane markings, cones, barriers, temporary signs, flagger positions, lighting, visibility obstructions and the surrounding roadway. Include wide views that show how the vehicles and traffic controls relate to one another, then take closer images of damage.
Do not step into a live lane, climb a barrier, walk behind moving equipment or delay emergency operations for a photograph. If conditions are unsafe, rely on the responding agency’s documentation and make notes later about the time, direction of travel, weather, lane configuration and visible signs.
Save dash-camera footage and do not overwrite the memory card. Write down what you observed while it is fresh, separating direct observations from assumptions. Give copies to your insurer or investigator rather than posting them publicly.

Reporting thresholds, deadlines, forms and police-response practices depend on where the crash occurred. The following examples illustrate why you must check the relevant state’s DMV and local police agency instead of relying on a nationwide number.

| Jurisdiction | Rule described by the official source | Important limitation |
|---|---|---|
| Oregon | Oregon DMV lists a collision-report deadline of 72 hours when its conditions apply, including an injury or death, more than $2,500 damage to the driver’s vehicle, more than $2,500 damage to another vehicle when any vehicle is towed, or more than $2,500 damage to non-vehicle property. | The driver’s DMV filing is still required in the listed circumstances even if law enforcement filed a report. |
| California | The California Department of Insurance consumer guide revised December 2024 says drivers must report to the DMV within 10 days when someone is injured or damage exceeds $750. | This is California-specific guidance and is not a nationwide threshold. |
| Other states and localities | Requirements vary. | Check the state DMV and the police agency for the location of the crash, including the correct form and deadline. |
Oregon example in more detail
Oregon’s thresholds are based on the conditions listed by Oregon DMV. A police report does not replace the driver’s filing. If you are unsure whether a damage amount or towing circumstance meets the threshold, contact Oregon DMV promptly rather than waiting for an estimate.

California example in more detail
California’s guide uses a 10-day DMV deadline when there is an injury or damage above $750. The guide’s threshold and deadline apply to California rules described in that document; they should not be applied to a crash in another state.
Notify your insurer and arrange a safe tow
Contact your auto insurer as soon as practical, even if you do not yet know the full repair cost or who was at fault. Provide the time and location, parties’ information, police or incident-report details, photographs, witness contacts and a clear description of any injuries or hazards. Ask what documentation and medical-claim steps your policy requires.
If the vehicle cannot continue, request towing or roadside assistance through your insurer, an auto club or another service you already use. Compare options by immediate availability, whether the truck can reach the vehicle without entering the active work area, the destination, price or policy coverage, and any authorization required before towing. Tell the operator that the vehicle is in a construction zone and identify the safest access point. Keep receipts and note where the vehicle is taken.

Common mistakes that make a work-zone crash worse
- Walking into a live lane to inspect damage or retrieve belongings.
- Moving an injured person when there is no fire or immediate collision threat.
- Driving a vehicle with compromised brakes, steering, tires, lights or leaking fluids.
- Ignoring a flagger, officer or incident responder because temporary signs seem confusing.
- Trying to direct traffic, move cones or remove barriers yourself.
- Leaving before exchanging information or before responders say it is safe, unless you need emergency medical care and have told authorities.
- Assuming a police report automatically completes a separate DMV filing.
- Posting photographs or accusations before preserving the original evidence and notifying the insurer.
A concise checklist to keep in your vehicle
- Stop, turn on hazard flashers when safe, and assess immediate danger.
- Call 911 for injuries, fire, entrapment, dangerous leaks or blocked hazardous traffic.
- Give the dispatcher the road, direction, nearest marker or intersection, injuries and hazards.
- Follow police, emergency responders and work-zone personnel; stay out of live lanes.
- Move the vehicle only if it is safe, mechanically fit and responders do not direct otherwise.
- Leave injured people in place unless fire or another immediate danger requires movement; follow dispatcher instructions.
- When safe, exchange driver, vehicle, insurance, passenger and witness information.
- Photograph damage and traffic controls only from a protected location; preserve dash-camera footage.
- Notify the insurer and arrange a work-zone-accessible tow if needed.
- Check the crash state’s DMV and local police rules for deadlines, thresholds and forms.
Why extra caution is justified
Oregon Department of Transportation reported 621 work-zone crashes in Oregon in 2024, including 14 deaths and 36 serious injuries. ODOT said all deaths and serious injuries in those reported crashes were drivers or passengers. These are Oregon figures, not a national estimate, but they show why a seemingly minor roadside inspection can expose a driver or responder to a second collision.
The safest response is therefore procedural: make the emergency call, obey the people controlling the scene, keep out of active traffic, and postpone evidence gathering until a protected position is available.
