Before paying, verify the exact license for the version you are being offered, compare the seller with the project’s official channel, and write down what the charge actually buys. “Open source” describes rights granted by a license—not a promise that every distributor must provide every copy or service at no cost.
Is open-source software supposed to be free?
“Free” has two different meanings in software. It can describe price, or it can describe the freedom to use, study, modify and redistribute code. Open-source licensing concerns those rights. The Open Source Initiative (OSI) says its Open Source Definition permits commercial use and sale. Its FAQ puts the point plainly: “All Open Source software can be used for commercial purpose; the Open Source Definition guarantees this.”
That permission does not make every download free of charge. A seller can charge for a packaged copy, installation, hosting, support, maintenance, customization, a warranty or a separate proprietary feature. What the seller cannot do is use a royalty-based restriction to take away rights that the applicable open-source license grants. The exact boundaries depend on the license, version and distribution details.
Before you treat a price as either legitimate or suspicious, separate three questions:

- What rights does the license grant for this exact version?
- What product or service is the seller adding?
- Is this seller offering something the project’s official channel does not, and are the terms written clearly enough to evaluate?
1. Identify exactly what is being sold
Record the details of the offer before comparing prices. A listing can use a familiar project name while referring to a fork, an older release, a repackaged installer or an app that combines open and proprietary components.
- Exact app and edition name
- Publisher or seller’s legal and trading name
- Version and build number
- Operating system, architecture and region
- Where you found the offer (official project page, app store, marketplace or another site)
- Whether the price is one-time, recurring or usage-based
Save the listing, checkout page and terms at the time of purchase. They are the clearest record of what was promised if the offer later changes.
2. Verify the license for the offered version
Do not infer licensing from a repository being public or from a marketing phrase such as “source available.” OSI says software should be called open source only when it is distributed under an OSI-approved license, and OSI’s approved-license program states that those licenses conform to the Open Source Definition.

Find the license text
Look in the project’s repository, release archive, installer notices and documentation for the license name and version. Check that the notice applies to the release you are buying, not merely to the project’s current development branch. If the app contains bundled libraries, fonts, models or plug-ins, look for their separate notices as well.
Check the rights and conditions
The Open Source Definition (Version 1.9, last modified March 22, 2007) requires, among other things, free redistribution, access to source code, permission to create and distribute modified works, and no discrimination against commercial fields of endeavor. A copyleft license may require that certain distributed modifications remain under the same license; a permissive license may impose different notice or attribution conditions. “Commercially usable” does not mean “free of every obligation.”

Ask for clarification when the label is vague
Pause the purchase if the listing:
- Names no license at all;
- Says only that the code is viewable or source is available;
- Claims you must buy an additional permission merely to exercise rights that the stated license already grants; or
- Uses one license name for the whole app while excluding an important component without identifying its terms.
Ask the seller to identify the license governing each component and to explain any paid permission separately. If the answer is evasive, you cannot reliably assess what you are buying.
3. Compare the seller with the project’s official channel
Find the project’s canonical website, repository, release page or app-store listing through documentation maintained by the project—not through a similarly named advertisement. Confirm the exact version and publisher shown there. An official channel may provide a free download while a third party sells the same code, a convenience service or an altered build.
The Apache Software Foundation (ASF) explains this distinction for its projects: ASF project downloads are free, while third parties may sell the software or related services. ASF advises buyers to distinguish official pages from confusingly similar sites and to determine whether a third party is selling a useful service or merely charging for a copy available directly from the project. That is an example of ASF policy, not a universal price rule for every open-source app.
Questions that establish the relationship
- Does the project list this seller as an authorized distributor, sponsor or service provider?
- Is the seller the project maintainer, a contributor, an independent company or an unidentified reseller?
- Does the seller publish a checksum, release notes or a reproducible way to verify that its package matches the project release?
- Are support promises made by the project, by the seller, or by neither?
Never assume that a domain, logo or “official” wording proves affiliation. Treat an unverified third party as independent until the project itself confirms a relationship.
4. Determine what your payment covers
A legitimate charge is easier to evaluate when the invoice describes a concrete deliverable. OSI identifies several ways businesses can charge around open-source code:

“Premium” or “pro” labels are not enough. Ask for a feature list, service-level commitments and a description of what remains available if you stop paying.

5. Check price mechanics and cancellation terms
Classify the charge before comparing it with a free download:
- One-time purchase: Confirm whether it includes future updates or only the stated release.
- Subscription: Record the billing interval, renewal price, notice period and cancellation path.
- Usage-based fee: Identify the meter (users, storage, requests, devices or time) and any overage rate.
- Service quote: Separate the software license from labor, hosting and support charges.
Renewal, cancellation and refund rights depend on the specific listing, contract and jurisdiction; they cannot be inferred from the open-source label. Read the purchase terms for automatic renewal, trial conversion, prorated refunds, export or deletion of hosted data, and what happens to paid proprietary features after cancellation.
6. Evaluate updates, maintenance and support
Open-source status alone does not establish that a project is actively maintained or that a seller will provide updates. Locate the project’s release history, security-advisory process and support documentation. Then compare those public signals with the paid offer:

These checks are app-specific. A project may be healthy, dormant or somewhere in between; the license cannot answer that question for you.

7. Check privacy and security separately
Readable source code is not proof that a particular binary is safe, private or well maintained. Review the seller’s privacy notice, permissions, telemetry settings, data retention, subprocessors and breach-notification terms. For a hosted service, ask where data is stored and how it can be exported. For a desktop or mobile package, compare requested permissions with the app’s stated function and verify that downloads come from a channel you trust.
When a seller adds proprietary components, determine which component handles account data, analytics, updates or encryption. The open-source license for one component does not automatically govern the others.
8. Use a side-by-side offer worksheet
If you have two or more offers, fill in the same fields rather than comparing headline prices:

Use “not stated” when an offer supplies no answer. An apparently cheaper offer with no maintenance or support may not be equivalent to a higher-priced managed service; an expensive repackaged copy with no added value may not justify its price.

- Capture the offer: Save the product page, version, seller identity, price and terms.
- Locate the official project channel: Verify the project name, release and publisher through its maintained documentation.
- Read the license: Confirm the exact version and each bundled component; check whether the license is OSI-approved.
- Map the payment: Write down every included deliverable and mark anything described only as “premium.”
- Verify the seller: Look for a project-published relationship; do not infer affiliation from branding.
- Inspect lifecycle terms: Check update channels, support duration, security handling and maintenance fees.
- Inspect commercial terms: Confirm billing frequency, renewal, cancellation, refunds and post-cancellation access.
- Ask unresolved questions in writing: Request component licenses, service commitments and data-handling details.
- Decide on value: Pay when the added distribution or service solves a stated need and the terms are clear; otherwise use the official channel or continue investigating.
Common traps and how to respond
A public repository is treated as a free license
Public visibility is not the same as permission. Find the license file and the release-specific notices. Without a license, ask the rights holder for clarification before copying, modifying or paying.

The seller charges for a download that appears identical
Compare hashes, version numbers, build provenance and included documentation. Ask what service or warranty the fee adds. If the seller cannot identify added value, the official project channel may be the better source.
A paid feature is described as part of the open-source app
Request a component-by-component license map. A proprietary extension can be sold under its own terms, but those terms should not be presented as the license for the open-source core.
“Lifetime updates” has no definition
Ask whose lifetime, which releases and what support channel are covered. Have the promise placed in the purchase terms rather than relying on a banner or sales message.

Ask for concrete practices: update delivery, vulnerability handling, permissions, telemetry and data retention. The label itself establishes none of those outcomes.
When to stop and seek professional advice
License obligations can turn on details such as modification, distribution, linking, bundled components and the jurisdiction of the transaction. If you plan to redistribute the app, embed it in a commercial product, use a copyleft component, or rely on a warranty or indemnity, have a qualified legal professional review the exact license and contract. The OSI definitions explain general rights; they are not a legal opinion about a hypothetical purchase.
