Construction guarantee cover is not one standard product: its name, eligibility rules, triggers and limits depend on where the project is and what kind of work is being done. Before applying any threshold or coverage rule, identify the jurisdiction and the exact local scheme—then check the project-specific policy and certificate against your contract. Examples from Victoria, New South Wales, British Columbia and France illustrate why the details cannot be assumed to travel across borders.

What does construction guarantee cover actually protect you against?

Depending on the jurisdiction and policy, construction guarantee cover may provide a financial backstop if a builder dies, becomes insolvent or disappears, cannot complete work, or fails to fix certain defects. Some products instead insure a defined category of major damage. The label alone does not tell you what is covered: the policy, certificate and local law determine the covered events, limits, exclusions and claim process.

In Victoria, domestic building insurance is arranged for the client and is intended to respond in specified circumstances if the builder dies, becomes insolvent or disappears before work is complete. In other circumstances, the builder may have to complete or fix work, or pay costs awarded through the relevant process. Victoria also distinguishes insurance from implied warranties that apply by law to domestic building work; those warranties may support action for up to ten years from completion. These are Victorian rules, not general terms for construction cover. Consumer Affairs Victoria: domestic building insurance Consumer Affairs Victoria: building planning checklist

New South Wales describes Home Building Compensation (HBC) cover as last-resort protection if a builder cannot complete work or fix defects. British Columbia guidance emphasizes that the policy defines which defect categories are covered. France’s dommage-ouvrage (DO) insurance is a distinct product: for specified major building or renovation work, it can fund repairs for certain serious damage without first resolving who is liable. None of these descriptions should be treated as a substitute for the rules where your project is located. That “last resort” distinction matters when you set expectations. A policy may not operate like a routine service guarantee that pays whenever a homeowner is dissatisfied. For example, the Victorian examples tie insurance to specified circumstances, while BC Housing says covered defects are those identified in the policy. Ask what event must happen before the insurer or provider can be asked to act, and whether another step—such as notifying the builder or obtaining a final order—is a condition of a claim.

Start by identifying the local scheme and whether your project qualifies

Before comparing cover, establish the project’s country, state or province; the exact product name; the type and value of work; and who is responsible for arranging it. Ask whether eligibility depends on the contract date, building type, number of storeys, or whether the work is new construction or renovation. A threshold from one place is not a universal buying rule.

For example, NSW consumer guidance says valid HBC cover should be checked for home building work above $20,000 before any money is paid or work starts. Victoria’s current guidance describes domestic building insurance for work over $16,000. Victoria’s separate new Home Warranty scheme is described as applying from 1 July 2026 to eligible domestic building work valued above $20,000 for homes or residential buildings up to three storeys, subject to exclusions; older signed contracts are handled under transitional arrangements. These are jurisdiction- and scheme-specific thresholds, and the Victorian new-scheme description should not be applied to an earlier contract or an ineligible project. • Ask who must arrange the cover and who is insured or entitled to claim.
  • Confirm whether your project type and contract qualify, including any exclusions or transitional rules.
  • Get the scheme’s exact name and the insurer or warranty provider’s identity in writing.
  • Do not infer eligibility from a builder’s general statement that the project is “insured.”

Timing is part of eligibility, not just administration. In NSW the guidance says to check valid project cover before paying any money or starting work. Victoria’s instruction to builders likewise says the client must receive the policy and certificate before a deposit or other money is taken. Ask early enough to review and verify the documents before the payment or commencement point relevant to your scheme. If a contract was signed under an earlier set of rules, ask which version applies rather than relying on a current scheme summary.

Match the policy and certificate to your signed contract

A valid certificate for the wrong address, builder, contract or work is not a reliable confirmation of protection. Check the project-specific documents before paying, and compare them line by line with the signed contract and any variations.

  • Property address and any identifying property details
  • Builder or contractor name and, where shown, licence or registration details
  • Project description, contract amount and scope of work
  • Policy or certificate number and the named insurer or provider
  • Effective date, expiry date and any conditions affecting when cover starts

Consumer Affairs Victoria says a client should receive a copy of the policy and a certificate covering the property before paying. Its instruction to Victorian builders is: “You must provide your client with a copy of the policy and a certificate of currency covering their property before you take a deposit or any other money.” Confirm what applies under the local scheme where your project is located. Do not stop at the certificate’s headline description. Check whether the named project, amount and dates reflect the final agreement, including any changed scope or contract variations. If the certificate uses a different project description or amount, ask the builder and provider to explain the difference and issue corrected documents if needed. The certificate confirms a particular project; a generic policy brochure or a builder’s assurance does not answer whether that specific property and contract are covered.

Verify the certificate independently before paying

Do not rely only on a document supplied by the builder. NSW recommends contacting the insurance company shown on the certificate or using HBC Check to confirm that the project cover is valid. Keep a dated record of the check, including who you contacted or the result shown by the service. The verification method will depend on the jurisdiction and provider. NSW Government: check Home Building Compensation cover

  1. Locate the insurer or provider using the details printed on the project certificate.
  2. Use the relevant official verification service or contact channel; for eligible NSW projects, NSW identifies HBC Check as an option.
  3. Ask the provider to confirm the certificate number, insured property, builder and project details.
  4. Save the confirmation and date it. If details do not match, resolve the discrepancy before paying or allowing work to start.

Keep the result with your contract file rather than relying on an undocumented phone conversation. A dated screenshot, email or written response gives you a record of what was checked and when. If there is no official online check for your scheme, use the provider’s independently confirmed contact details and ask what evidence of validity it can supply.

Find the actual trigger, covered defects and exclusions

Read the policy’s wording on what event allows a claim. A general promise of “guarantee cover” does not establish that ordinary dissatisfaction, delay or every workmanship defect is insured. Depending on the scheme, the trigger may be restricted to a builder’s death, insolvency or disappearance, inability to complete work, failure to comply with a final order, or a defined category of damage.

Victoria’s April 2026 checklist says some policies issued on or after 1 July 2015 also cover failure to comply with a final VCAT or court order. That is not a statement that every Victorian policy—or policies elsewhere—cover any adverse decision. British Columbia guidance likewise directs homeowners to the policy’s listed defect categories. Consumer Affairs Victoria: building planning checklist BC Housing: home warranty insurance

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For each event you are concerned about, ask the provider to point to the clause that applies and explain what facts or documents would be needed to establish it. Separate a promise that the builder must fix work from a promise that an insurer will pay: Victoria’s guidance notes that in other circumstances the builder must fix or complete work, or pay awarded costs. Likewise, statutory or implied warranties may create rights independent of the insurance backstop. Do not assume that having one means the other has been satisfied.

Check both exclusions and policy conditions. Look for excluded causes, maintenance responsibilities, whether you must first give the builder a chance to fix the problem, whether repairs require approval, and what notice must be sent. France’s official DO guidance, for example, excludes intentional acts, normal wear or poor maintenance, abnormal use, and external causes from the described cover. Those exclusions are specific to that French framework and should not be assumed for other policies. Service Public: dommage-ouvrage insurance

Compare limits, durations and costs on a like-for-like basis

Compare policies within the same jurisdiction and scheme. Separate caps may apply to incomplete work, structural defects, non-structural defects, temporary accommodation or other costs. Check the excess or deductible, how each coverage period begins and ends, and whether a claim can exceed a sublimit. The examples below are not directly comparable because their thresholds, coverage structures and jurisdictions differ.

Scheme or guidance Figure or period stated What it means—and what it does not
Victoria domestic building insurance, Consumer Affairs Victoria guidance (2026) Work over $16,000; up to $300,000 for structural defects over six years and non-structural defects over two years Victorian figures only. Confirm the applicable policy and rules for the project; do not apply these limits elsewhere.
Victoria unfinished-work claims, Consumer Affairs Victoria checklist (April 2026) May be capped at 20% of the contract price A possible Victorian cap described by the checklist, not a general limit for all claims or jurisdictions.
NSW HBC cover, NSW Government guidance (2026) Home building work above $20,000 The stated NSW threshold for checking valid project cover; it is not Victoria’s threshold.
Victoria’s new Home Warranty, Building and Plumbing Commission guidance (2026) From 1 July 2026; eligible work above $20,000 for homes or residential buildings up to three storeys Subject to exclusions and transitional arrangements; the description is specific to the new Victorian scheme.
France’s dommage-ouvrage framework, Service Public guidance (2026) Ten-year guarantee period after receipt of works French framework period; policy and notification procedures still matter, and the period is not a universal cover duration.
British Columbia home warranty insurance guidance Specific limits and expiry dates depend on the policy Check the actual warranty documents; no single comparable limit is established by the guidance.

Do not read a dollar cap as a promise that every loss up to that amount is payable. Check whether different categories have separate limits and whether unfinished work is treated differently from repairs to a defect. In the Victorian guidance, for instance, the stated $300,000 limit and six-year/two-year periods are tied to structural and non-structural defects, while the checklist describes a possible 20% of contract price cap for unfinished-work claims. A headline maximum alone can conceal these distinctions.

The available official guidance does not establish a general premium or fee for construction guarantee cover. Ask for the actual amount payable, who pays it, whether it is included in the contract price, and whether any excess or deductible may apply to a claim. Compare the written quote and policy terms within the same scheme rather than assuming a higher premium buys broader cover or comparing costs across unrelated jurisdictions.

Understand who must act first and how claims work

Before committing, find the exact notification channel, required evidence, applicable deadline, dispute or escalation route, and whether you must notify the builder before the insurer or warranty provider. A scheme’s claim path can be as consequential as its headline limit.

British Columbia guidance advises prompt action and written notice to the builder and warranty provider under the applicable process. France’s DO framework has its own reporting procedure, including a minimum reporting window and a two-year outer notice rule described in the official guidance. These are different systems; use the deadline and sequence stated in your own policy and local rules, not a deadline borrowed from another country. BC Housing: home warranty insurance Service Public: dommage-ouvrage insurance

  1. Write down the event that triggers a claim and the first party you must notify.
  2. Record the required notice method, documents, photographs or reports, and deadline.
  3. Check whether you need approval before arranging repairs or whether the builder must first be offered an opportunity to remedy the issue.
  4. Keep copies of every submission and response, with dates and delivery evidence.
  5. Identify the policy’s dispute or escalation route before you need to use it.

For French DO insurance, the ten-year guarantee period after receipt of the works is not a reason to ignore the separate notification procedure. The official guidance describes a minimum reporting window as well as a two-year outer notice rule. Because those timing rules are specific to that product, verify the exact applicable dates and process with the local policy rather than treating “ten years” as the only deadline.

Keep a complete project file and check other insurance

Good records make it easier to establish what was agreed, what was built and when a problem appeared. Keep the signed contract and variations, policy and certificate, plans and specifications, payment records, inspection reports, dated photographs, defect notices, correspondence and final inspection or occupancy documents. Consumer Affairs Victoria specifically recommends retaining project documents and certificates. Consumer Affairs Victoria: keeping building documents

Ask your home and contents insurer whether renovation-related work affects your existing policy, and do so before work starts. A builder’s public liability insurance is separate: it does not itself prove that you have the project-specific guarantee or warranty cover required by a home-building scheme. Consumer Affairs Victoria: building planning checklist

Organize the file so that the current policy and certificate, signed contract, variations and provider verification can be found quickly. Add dated photographs and written defect notices as the project progresses, not only after a problem arises. Records do not expand cover, but they help you show which project was insured, what scope was agreed, and when you gave notice.

Check the contract and transfer rules, not just the cover summary

Confirm what the builder promises under the signed contract and applicable law, and resolve inconsistencies between those promises, the policy and any warranty documents. NSW contract guidance recommends checking the insurance certificate and explains contract requirements. Victoria’s distinction between insurance and implied warranties is another reason not to treat the insurance backstop as a replacement for contract rights. If the documents conflict or the project is complex, seek advice specific to the jurisdiction before signing or paying. If you are buying a home rather than commissioning the work, ask whether cover transfers to a later owner, for how long, and what claim rights transfer. France’s official DO guidance says the cover transfers to a new owner when the property is sold within the ten-year period. Transfer rules in other schemes may differ, so check the actual policy and local law. Service Public: dommage-ouvrage insurance

France’s DO example is also different in what it is designed to address: it applies to specified major building or renovation work and covers certain damage affecting structural solidity or making the building unusable for its intended purpose, subject to exclusions and procedures. It is taken out before work begins and is not simply another name for the Australian or Canadian warranty schemes. If your project is in France, verify whether the work falls within the specified category and follow that framework’s own application and claim procedures.

  • Identify the jurisdiction, local scheme and exact product name.
  • Confirm your project and contract qualify under that scheme’s current rules.
  • Match the certificate to the address, builder, scope, contract amount and dates.
  • Verify the certificate with the provider or official service and retain dated proof.
  • Understand the covered events, defect categories, exclusions and conditions.
  • Record limits, sublimits, excesses, start and end dates, and any transfer provisions.
  • Know the claim sequence, notice method, deadlines and evidence requirements.
  • Keep the full project file and check renovation implications with your home insurer.

Frequently Asked Questions

Does construction guarantee cover pay if I am unhappy with the workmanship?

Not necessarily. The product name does not show what triggers a claim. Some schemes respond only to specified events, such as a builder being unable to complete work or fix defects, while policies may cover only listed defect categories or defined damage. Check the actual policy and local rules; do not assume ordinary dissatisfaction or every workmanship issue is insured.

Is a builder’s public liability insurance the same as construction guarantee cover?

No. The Victorian checklist treats the consumer’s project cover and a builder’s public liability insurance as separate matters. Public liability insurance by itself does not establish that the project-specific guarantee or warranty cover required by a home-building scheme is in place.

How much does construction guarantee cover cost?

There is no general premium figure established by the official guidance cited here. Ask for the written amount payable, who pays it, whether it is included in the contract price, and whether an excess or deductible may apply. Compare costs only alongside the limits, triggers, exclusions and terms of the same local scheme.

Does the cover transfer if I sell the home?

It depends on the scheme and policy. France’s official guidance says dommage-ouvrage cover transfers to a new owner if the property is sold within its ten-year period. Do not assume that transfer rule applies elsewhere; check which rights transfer, for how long, and what notice or documentation is required.

What should I do if a defect appears after work is complete?

Act promptly and follow the policy’s process. Check the deadline, required notice method, evidence, and whether you must notify the builder as well as the provider or obtain repair approval first. BC Housing advises prompt written notice under the applicable process; notification rules are scheme-specific.

The Bottom Line

Before paying, identify the local scheme, confirm your project qualifies, and verify that the actual policy and certificate match your address, builder, contract and dates. Then check the triggers, defect categories, exclusions, limits, time periods and claim steps—and keep dated proof and project records. Thresholds and examples from Victoria, NSW, British Columbia and France are not interchangeable: the policy and rules for your project’s jurisdiction control.
