Before buying a newly built home in a slow market, verify six things in writing: the deposit-refund rules and contract contingencies, the complete financing cost after any incentive expires, construction quality through an independent inspection, the builder warranty, the full cost of ownership, and the exact condition of the home and community at closing. A slower market may improve your negotiating position, but national statistics cannot tell you what one builder or subdivision will accept.

What the 2026 market data actually tells a buyer

The latest national snapshot cited here is the National Association of Home Builders (NAHB) report published August 25, 2026, covering July sales. Newly built single-family home sales fell 10.5% in July to a seasonally adjusted annual rate of 607,000, which was 6.3% below July a year earlier. Inventory stood at 488,000 homes, and the median new-home sales price was $393,800.

NAHB also reported that a majority of builders continued to offer incentives, including mortgage-rate buydowns. A separate August 2026 builder survey found that 35% of builders had cut prices, with an average reduction of 6%, while 63% used sales incentives. Those figures are useful prompts for questions, not a guaranteed discount on your house. They do not establish unsold inventory, builder solvency, comparable prices, or negotiating leverage in your subdivision.

“New home sales fell in July to their slowest pace since the start of the year as affordability challenges limited home buyer traffic,” said Bill Owens, NAHB chairman.

National measure Reported figure How to use it
July 2026 new single-family sales 607,000 annualized; down 10.5% from June and 6.3% from a year earlier Context for asking about incentives; not proof that your builder must reduce its price
New-home inventory 488,000 homes Ask for the subdivision’s completed, underway, and unsold homes instead
Median new-home price $393,800 Compare with the same-size homes and lots in your local market
Builders cutting prices 35%; average cut 6% Use as a negotiation question, not as an expected concession
Builders using incentives 63% Request the actual written terms and eligibility conditions

To judge your leverage, obtain the builder’s current price sheet, the number of finished and unsold homes, recent incentives on comparable plans, and recent resale and new-build sales nearby. Ask how long each listed home has been available and whether a price includes lot premiums or upgrades. Local evidence is more useful than assuming a national trend applies to every community.

Read the deposit and purchase contract before you sign

Confirm exactly when the deposit is refundable

Ask how much you must deposit, who holds the money, whether it is placed in escrow, and the precise conditions and deadlines for getting it back. The Consumer Financial Protection Bureau (CFPB) specifically advises buyers of homes that have not yet been built to ask when the builder deposit is refundable. The answer may differ for a financing failure, an unsatisfactory inspection, a buyer-requested cancellation, or a builder delay.

Do not rely on a salesperson’s verbal assurance. Require the refund rule, timing, and method to appear in the signed contract or an incorporated exhibit. State law can change the effect of these clauses, so have a local real-estate attorney review an unfamiliar or unusually restrictive agreement.

Match the contract to the home you think you are buying

Read every exhibit, addendum, specification sheet, options form, and community document. Check:

  • Base price, lot premium, elevation, floor plan, square footage, and included features.
  • Every selected option, upgrade, appliance, finish, and change-order price.
  • Deadlines for making selections and the builder’s right to substitute materials.
  • Estimated completion date, permitted extensions, and the remedy if construction is late.
  • How deficiencies are documented, prioritized, and corrected.
  • Financing and satisfactory-inspection contingencies, appraisal provisions, cancellation rights, and dispute-resolution requirements.
  • Whether promises made in the sales office are included in the signed documents.

A purchase offer or sales contract can be contingent on financing and a satisfactory inspection, but the rights created by a particular clause depend on its wording and applicable local law. If an important promise is absent from the contract, treat it as unresolved.

Understand delay and cancellation exposure

Ask what happens if materials are delayed, permits are late, labor is unavailable, or the builder changes the completion date. Find out whether you can cancel and recover the deposit, whether the builder can extend the date unilaterally, and whether temporary housing or storage costs are addressed. Compare the contractual date with your lease expiration, sale of another home, rate-lock period, and planned move.

Compare financing and incentives by total cost

You are not required to use the builder’s affiliated mortgage lender. CFPB guidance states that buyers may shop around for a better deal. Obtain written estimates from the preferred lender and at least one outside lender or broker, using the same loan amount, term, down payment, and closing date.

Compare this item Questions to ask
Interest rate and annual percentage rate Is the rate fixed or adjustable? When does it expire? Are points included?
Up-front charges What are lender fees, discount points, underwriting charges, and required services?
Cash to close What is due at closing after deposits, credits, prepaid taxes, and insurance?
Monthly payment What is principal and interest, and what must be added for taxes, insurance, and HOA dues?
Loan terms Compare loan type, term, mortgage insurance, rate-lock rules, and prepayment provisions.
Incentive conditions Must you use the affiliated lender, close by a deadline, or choose specified upgrades?

Analyze a temporary rate buydown

Request the payment for every stage of the subsidy and the full payment after it ends. A low first-year payment is not the loan’s permanent payment. Compare the total subsidy, interest rate, points, lender fees, and break-even period with a lower purchase price or a closing-cost credit. Ask what happens to unused subsidy funds if the loan is paid off or refinanced early, and get the answer in the written offer.

Analyze a permanent rate reduction

For a permanent rate reduction, calculate the up-front cost and divide it by the monthly payment savings to estimate the break-even period. Compare that period with how long you realistically expect to keep the loan. The builder’s national use of buydowns does not establish that a specific offer is cheaper than a price reduction; your written loan estimates do.

Arrange an independent inspection even though the home is new

A new home can have construction defects, incomplete work, or systems installed incorrectly. CFPB recommends an independent inspector who is accountable to you. An inspection is not an appraisal: the appraisal supports the lender’s value decision, while the inspection evaluates physical condition.

Choose and schedule the inspector

  • Check your state or locality’s licensing rules; inspector licensing varies by location.
  • Ask for qualifications, references, insurance, and a sample report.
  • Confirm what the fee includes and whether specialist inspections are extra.
  • Review the contract for inspection access, deadlines, and contingency language.
  • Ask whether the builder permits inspections before drywall, before insulation is concealed, and at substantial completion.

When milestone access is allowed, a pre-drywall inspection can identify framing, plumbing, electrical, and mechanical issues before they are hidden. A final inspection should cover the completed structure, exterior drainage, roof, windows, doors, finishes, fixtures, appliances, and operation of installed systems. Attend if possible so the inspector can explain findings in context.

Document defects and required repairs

Send the builder a dated deficiency list tied to the inspection report. Photograph each issue, identify its location, and state the requested correction. Ask who will perform the work, how access will be arranged, and when a reinspection can occur. Keep copies of reports, photographs, emails, and signed repair agreements.

Read the builder warranty before relying on it

Obtain the complete written warranty before signing. Identify the start date, covered components, duration, exclusions, maintenance duties, notice deadlines, repair process, and any mediation or arbitration requirement.

Component pattern described by the FTC Typical example duration Important qualification
Workmanship and materials Often one year General pattern only; the builder’s written warranty controls
Heating, ventilation, air conditioning, plumbing, and electrical systems Generally two years Coverage, exclusions, and definitions vary by warranty
Major structural defects Some warranties cover up to ten years “Structural defect” is narrowly defined in many contracts

These periods are FTC examples, not a guarantee. Check whether the warranty covers labor as well as parts, whether cosmetic issues are excluded, and whether you must perform specified maintenance. Note the exact address and method for submitting a claim and any deadline after discovering a problem.

Do not confuse a builder warranty with an optional paid home-warranty service contract. Builder warranties generally address permanent construction components; service contracts cost extra and may overlap or provide limited coverage. Preserve the warranty, inspection reports, photographs, and every dated service request. Follow the stated claim procedure before escalating a dispute.

Budget the home’s true cost of ownership

The advertised mortgage payment is only one part of the budget. Build a cash-flow estimate for both closing and a normal month after move-in.

Cost category What to verify
Cash to close Down payment, builder deposit credit, lender and settlement charges, prepaid taxes, insurance, and escrow funding
Taxes Current estimate and likely reassessment after the completed home is recorded
Homeowners insurance Quote for the finished home, deductible, exclusions, and any required coverage
HOA Regular dues, one-time fees, transfer charges, rules, and planned increases
Utilities Electricity, gas, water, sewer, trash, internet, and connection or activation fees
Move-in costs Moving, storage, window coverings, furnishings, landscaping, and appliances not included
Repairs and improvements Reserve for maintenance, warranty gaps, upgrades, and emergency work

Ask for realistic tax and insurance estimates for the completed address, not only the undeveloped lot. Confirm how local assessment practices may change the bill after construction. Building codes and energy efficiency can affect utility and insurance costs, but the amount depends on location, property features, coverage choices, and local rates.

Evaluate the lot and the community, not just the model home

Verify what is included in your lot

Walk the actual homesite. Confirm grading, drainage, retaining walls, easements, driveway, fencing, landscaping, mailbox location, solar or utility equipment, and responsibility for unfinished work. A model home can contain upgrades that are not part of the base specification.

Check HOA and future phases

Read the declaration, bylaws, budget, rules, and fee schedule. Ask which amenities are complete, which are planned, who maintains roads and common areas, and whether future phases can change traffic, views, density, or dues. Obtain the developer’s timeline for promised facilities rather than treating a rendering as a commitment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compare nearby alternatives

Compare the exact plan and lot with other available new builds and resale homes nearby. Use the same assumptions for square footage, garage, lot, upgrades, taxes, insurance, HOA dues, and completion date. A lower base price may disappear after lot premiums and selections are added.

Negotiate with a written, local comparison

In a slower market, ask for several concessions at once and let the builder choose the structure that costs it least. Possible requests include a lower base price, reduced lot premium, closing-cost credit, rate buydown, included appliances or upgrades, and a clearer completion commitment. The sources establish that incentives are common nationally, not that every builder offers every concession.

For each proposal, request a revised price sheet and loan estimate. Confirm whether the concession changes the purchase price, cash to close, monthly payment, or only the payment for a temporary period. Verify whether an incentive requires the preferred lender, a specific closing date, or use of an approved vendor. Keep the signed version with the contract.

Complete the final walkthrough and closing review

  1. Schedule the walkthrough as close to closing as practical and bring the signed specifications, options list, inspection report, and repair agreements.
  2. Confirm the address, plan, finishes, appliances, fixtures, keys, remotes, manuals, and included equipment match the contract.
  3. Test lights, outlets, plumbing fixtures, heating and cooling, windows, doors, garage equipment, appliances, and safety devices.
  4. Inspect floors, walls, ceilings, cabinets, countertops, trim, exterior drainage, siding, roof-visible areas, and landscaping for damage or incomplete work.
  5. List every unfinished item or defect, take dated photographs, and obtain a written completion plan naming responsibility and deadlines.
  6. Review the closing disclosure and other documents before signing. Check the purchase price, credits, loan terms, cash to close, taxes, insurance, HOA charges, and prorations.

CFPB advises buyers to perform a final walkthrough and take time to review closing documents. Do not treat a verbal promise to finish work later as equivalent to a signed agreement.

Warning signs that justify a pause

  • The deposit-refund rule is unclear or appears only in an unsigned document.
  • The contract permits broad substitutions, indefinite delays, or cancellation without a clear remedy.
  • A salesperson refuses to put a price, upgrade, repair, or completion promise in writing.
  • The builder blocks reasonable inspection access or will not explain how deficiencies are corrected.
  • The warranty is unavailable before signing, excludes major systems without explanation, or has impractical claim deadlines.
  • The incentive cannot be valued because the lender will not provide a complete written estimate.
  • Taxes, insurance, HOA dues, or utility estimates are based on a different property or omit planned fees.
  • The community’s roads, utilities, amenities, or future phases are described only in marketing material.

For a contract, financing, title, tax, or warranty issue that you cannot interpret, obtain advice from a qualified local real-estate attorney, lender, tax professional, or HUD housing counselor before your deadline expires.

The practical decision rule

Proceed only when the signed contract makes the deposit, contingencies, delays, specifications, and remedies understandable; competing loan estimates show the real cost after incentives; an independent inspection is permitted; the written warranty is acceptable; and the completed home fits a budget that includes taxes, insurance, HOA dues, utilities, moving, and reserves. If any of those answers depends on an oral promise or an undefined future date, postpone signing until the term is documented or choose a different home.
