Before you pay, identify the exact game, edition, platform, storefront and country, then verify the transaction’s status and the scope of any binding commitment. A merger headline does not tell you whether your version will remain available, whether online services will continue, or whether you can obtain a refund if access changes.
Separate four different things: a proposed deal, a regulator’s allegations, remedies imposed or accepted as part of a transaction, and the publisher’s later operating decisions. The Microsoft–Activision example shows why that distinction matters. It also shows that a cloud-streaming remedy may protect a narrower right than native console or PC ownership.
1. Write down exactly what you are buying
Start with a purchase record before reading merger news. “The publisher’s game” is too broad to evaluate. Record the following:

- Title and edition: standard, deluxe, complete, remastered, expansion bundle or another edition.
- Platform: a specific console model, Windows PC, another PC storefront, or a cloud-streaming service.
- Storefront and seller: the platform store, a publisher store, a retailer or a marketplace seller.
- Country and account region: rights, taxes, refund rules and availability can differ by market.
- Purchase type: a perpetual digital license, a physical disc or cartridge, a subscription entitlement, or a cloud-streaming entitlement.
Save the product page, price, edition name, promised features and any stated account or subscription requirement. A publisher-wide announcement may concern only certain games, territories, release windows or services.

Why the edition matters
Different editions can contain different downloadable content, online features or entitlement keys. A physical copy may still require a platform account, a download or an authentication server. A digital copy may be tied to one account and storefront even when the same game is sold elsewhere. Do not assume that a remedy covering “the game” covers every edition or bonus item.
2. Establish whether the merger is proposed, completed or changed
Use a current regulator or official platform page, and note the page’s update date. A transaction can move through several legally and operationally distinct stages:
- Proposal: the parties announce an intended deal. Terms may change, and closing is not guaranteed.
- Regulatory proceeding: an agency may allege that the deal could harm competition. An allegation is the agency’s position in that proceeding, not proof that a particular game will lose access.
- Remedy or revised transaction: the parties may offer licenses, divestitures or other commitments with defined scope and duration.
- Closing and later operation: after completion, the new owner can still make product, pricing, support and service decisions within the limits of those commitments.
- Post-closing status: courts, regulators or the companies may update, enforce, modify or end arrangements.
The Microsoft–Activision example
In December 2022, the U.S. Federal Trade Commission described Microsoft’s proposed acquisition of Activision Blizzard as a $69 billion transaction. The FTC alleged that control of Activision franchises could let Microsoft change rival access, pricing, quality, release timing or availability. Those were potential effects asserted in an enforcement proceeding, not a finding that every named outcome would occur for every game.
Holly Vedova, then director of the FTC’s Bureau of Competition, said: “Microsoft has already shown that it can and will withhold content from its gaming rivals.” Treat this as her explanation of the agency’s position, not as a neutral prediction about an individual purchase.
The FTC gaming page, updated May 22, 2025, lists the administrative matter as closed. That later status should not be confused with the historical allegations in the 2022 announcement. When you assess a current purchase, use the latest status rather than relying on an old headline or archived social-media post.
3. Read the scope of every commitment instead of relying on the word “merger”
A commitment is useful only within the boundaries written into it. Extract each boundary before deciding that your purchase is protected.

The revised UK arrangement: a cloud-rights example
The UK Competition and Markets Authority’s case description says Ubisoft received specified global cloud-streaming rights, excluding the EEA, for Activision PC and console games released during the next 15 years. It also describes a non-exclusive license concerning EEA cloud rights and says Ubisoft can license those rights under models including buy-to-play and multigame subscriptions.

Microsoft’s dated August 21, 2023 announcement described the future Activision PC and console release window as 15 years and characterized the arrangement as rights in perpetuity. Attribute that “in perpetuity” wording to Microsoft; use the CMA description for the regulator’s account of what was granted and where. Neither description should be expanded into a promise about every console version, future release, territory or publisher transaction.
For a buyer, the practical lesson is narrow but important: a cloud-streaming right can preserve a way to play through a participating service while leaving separate questions about a native download, a boxed copy, local installation, pricing and online support.
4. Check whether your region has a separate consumer commitment
Geography can change both the remedy and the service through which you receive it. Microsoft’s Xbox legal page for the European Economic Area (EEA) states that consumers who hold a license for eligible Activision Blizzard PC and console games may stream them through eligible cloud-streaming services under European Commission commitments.
The same page says Microsoft’s obligations last 10 years and that a consumer or provider license taken during that period endures perpetually. These statements are explicitly about the EEA. They are not a worldwide guarantee. A buyer elsewhere must check the rules and service terms that apply in that market.

- Does the commitment expressly include your country, or is your territory excluded?
- Is the right limited to cloud streaming, or does it cover a download or physical release?
- Must the license be acquired during a particular period?
- Does “eligible game” include the edition and platform you intend to buy?
- Which cloud service must honor the license, and what subscription, device and network requirements does it impose?
5. Determine whether the game depends on a service that can change
Ownership language does not by itself describe how a game operates. Before purchase, identify each dependency:

- Account: a platform or publisher account required to activate, launch or synchronize the game.
- Subscription: a paid plan needed for multiplayer, a catalogue entitlement or cloud streaming.
- Servers: matchmaking, authentication, saved data, downloadable content or other features that rely on remote systems.
- Network connection: an always-online requirement or a periodic check even for a primarily single-player title.
- Cloud service: a supported streaming provider, device list, supported country and bandwidth requirement.
Find the current product page, technical support article and license terms for the exact platform. The merger example does not establish how long the servers for an unnamed game will operate. Do not infer a server-life guarantee from a regulator’s cloud-rights remedy.
How to record the risk
Write a one-sentence dependency note before checkout, such as: “Playable offline after installation, but account activation is required; multiplayer and cloud saves require the platform service.” If the official terms do not state whether offline play works, mark that point as unknown rather than assuming it.
6. Read the refund rule before you purchase
Refund rights are separate from merger remedies. A transaction commitment does not automatically create a right to return a game because its owner changes, its price changes or a feature is removed.
Microsoft Store support guidance says digital goods, including games, are not refundable unless the offer or applicable law makes the buyer eligible. It provides a request route for Microsoft Store PC games and notes that online returns are not available in all markets. That is Microsoft Store guidance, not a universal rule for every storefront.
Build a refund record
- Open the store’s refund or cancellation policy for your country before checkout.
- Check rules for digital downloads, preorders, bundles, consumable items and subscriptions separately.
- Note time limits, play-time or download conditions, and whether the request must be made through the store or the publisher.
- Save the order number, receipt, edition name and a copy or screenshot of the policy in force on the purchase date.
- Identify the local consumer-law authority that applies if the store policy says statutory rights may add to its voluntary policy.
If a game later changes, describe the concrete problem in a request: loss of access, a missing promised feature, a server requirement, a wrong edition or another issue covered by the store’s terms. Do not assume the merger itself is the qualifying event.
7. Compare digital and physical access when both are genuinely available
A physical and digital edition can have different failure points. Compare them using the same facts rather than treating one format as automatically safer.

The available merger information does not identify a particular game or edition that can be recommended in one format. Apply these checks to the actual listings you are considering.

8. Use this purchase-day checklist
Complete the checklist in order so an attractive sale price does not outrun your evidence.
- Identify the item: record title, edition, platform, storefront and country.
- Confirm the transaction stage: proposed, under review, revised, completed or subject to a later status update.
- Read the original source: distinguish a regulator’s allegation from a binding remedy and from a company announcement.
- Map the commitment: list covered games, platform type, territory, duration, eligible licensees and business model.
- Check the service: confirm account, subscription, server, network and cloud requirements for your edition.
- Open the refund policy: verify market-specific eligibility and save the policy and order details.
- Compare another format only if it is real: confirm stock, edition contents, compatibility and the seller’s return terms.
- Decide what uncertainty you accept: if a material point is not stated by an official source, postpone the purchase or treat it as a risk rather than a promise.
9. Common mistakes and how to correct them
“The regulator said it could happen, so it will happen.”
Correct the logic by labeling the statement as an allegation or risk theory. The FTC’s 2022 list of possible effects explains why the agency challenged the proposed deal; it does not establish the outcome for your title.
“A 15-year cloud arrangement means I own the console version for 15 years.”
Check the service type. The CMA description concerns cloud-streaming rights for specified Activision PC and console releases, with EEA exclusions and a separate non-exclusive EEA cloud license. It does not answer every native-access question.
“A remedy in one country applies everywhere.”
Check territorial language. The EEA page’s 10-year Microsoft obligation and perpetual endurance for qualifying licenses are geographically specific.
“A merger gives me a refund right.”
Open the store’s policy and local-law information. Microsoft Store guidance makes digital refunds conditional and says online returns are unavailable in some markets; other stores may use different rules.

“A publisher announcement is the same as a regulator’s order.”
Label the source and date. Microsoft’s August 21, 2023 description and the CMA’s case description should not be treated as interchangeable legal texts.
10. When to wait instead of buying
Waiting is rational when one of these facts is unresolved:
- The transaction’s current status cannot be confirmed from a current official or regulator page.
- Your country or platform is outside the clearly stated scope of a commitment.
- The listing does not say whether the edition needs an account, subscription or persistent connection.
- The store’s refund eligibility is unclear or the return window is too narrow for your risk.
- The purchase depends on a cloud service whose availability, supported region or license terms you cannot verify.
Waiting does not guarantee a better outcome; it prevents you from treating an unverified assumption as a consumer protection.
11. What the documented example can—and cannot—tell you
The Microsoft–Activision record demonstrates a method, not a probability. It shows that merger scrutiny can focus on rival access, pricing, quality, timing and availability; that a revised arrangement can target cloud-streaming rights rather than every form of access; that regional commitments can differ; and that store refunds remain a separate question.
It does not provide a statistical likelihood that an unnamed game will lose support, a general guarantee for future releases, or a universal refund rule. For a game-specific decision, repeat the checklist with that game’s current platform listing, service terms, transaction status and local storefront policy.
