Before a local board approves a data center near residences or a school, it should establish the complete approval path, obtain the facility’s operating numbers in writing, and test noise, air, water, power, traffic, land-use, fiscal and emergency-service effects against enforceable conditions. There is no national setback or universal approval checklist: zoning, permits, utility authority and public-comment rights depend on the site. Use the sequence below to turn a proposal into a documented decision.
1. Identify the decision that is actually pending
Start with the parcel map, full site plan, application, zoning designation, comprehensive-plan policies and every proposed condition. A project described as a “data center” may require several separate decisions, and a hearing in one process does not settle issues assigned to another agency.
List every approval
- Rezoning, conditional use, special exception or special-use permit.
- Site-plan, subdivision, building and grading approvals.
- Variances or waivers for height, setbacks, parking, landscaping or signage.
- Air-emissions permits for generators and other combustion equipment.
- Water-withdrawal, wastewater-discharge and stormwater authorizations.
- Wetland, floodplain, stream, tree-clearing or habitat approvals where applicable.
- Utility approvals for substations, transmission lines, interconnection and service upgrades.
Map the decision-makers and deadlines
For each approval, record the deciding body, notice method, hearing date, comment deadline, appeal route and location of the application file and technical reports. Ask whether the locality reviews a substation, transmission corridor, access road or water extension separately from the main building. Pennsylvania’s Department of Community and Economic Development planning toolkit is designed to help municipalities follow a proposal from initial inquiry through zoning, permitting and long-term planning. Treat its framework as a planning aid, not as a substitute for the law governing the particular parcel.
2. Demand a complete, written project description
Require the applicant and relevant utilities to answer the same questions in a consistent format. Written assumptions make it possible to compare the proposal with agency records and to convert promises into permit conditions.

Electricity and phasing
- State maximum demand in megawatts, expected normal demand and the timing of each construction phase.
- Identify expansion capacity, reserved but unused load and the point at which a later phase needs a new approval.
- Show how power will arrive: existing or new substations, transmission voltage, line routes, redundancy and delivery milestones.
- State who pays for each upgrade: applicant, utility, other customers or a combination.
Water and wastewater
- Report annual and peak-day water demand, source and whether water is potable, reclaimed or another supply.
- Describe the cooling system, including air cooling, closed-loop cooling or open-loop cooling, and explain how demand changes with weather and load.
- Identify wastewater flows, discharge destination, treatment capacity and any pretreatment requirements.
- Provide a water-balance calculation for normal operation, maintenance and abnormal conditions.
Backup power and building operations
- Name each generator and fuel or storage technology, with rated output and the number of units.
- Describe expected testing, maintenance, outage and emergency-run hours.
- List emissions-control equipment, fuel storage, battery systems and applicable permits.
- Provide building height, floor area, equipment yards, roof equipment, lighting, access roads, construction schedule, stormwater design, buffers and proposed operating hours.
A Florida Digital Infrastructure and Security Alliance planning reference, updated August 17, 2026, recommends documenting these power, water, cooling, generator, noise and site-design details. It is a planning reference rather than a model ordinance or legal advice, so apply the requirements of the project’s own jurisdiction.
3. Treat noise as a measurable condition
Noise is often the most immediate neighborhood concern, especially where homes, classrooms or outdoor school areas are close to mechanical equipment. Map every residence, school building, athletic field, playground and other sensitive receptor before accepting a sound study.
Interrogate the acoustic study
- Request the location and height of every measurement point and the distance to each receptor.
- Identify equipment included: chillers, cooling towers, fans, pumps, transformers, generators, rooftop units and construction machinery.
- Separate normal operation, generator testing, maintenance, construction and emergency generation.
- Ask which metrics and averaging periods were used. A-weighted dBA reflects common human hearing; C-weighted dBC can help reveal low-frequency or tonal hum.
- Require assumptions for nighttime operation, weather, sound barriers, equipment degradation and simultaneous operation of all units.
- Specify a post-construction verification study and corrective action if measured sound exceeds the approved condition.
The Florida planning reference suggests considering both dBA and, where feasible, dBC, along with pre- and post-construction studies. Those are planning suggestions, not universal legal requirements.
Understand Virginia’s 100-MW example
Virginia Code § 15.2-2209.5 defines a high-energy-use facility (HEUF) as one anticipated at application filing to require at least 100 megawatts of utility power. For a covered new facility, before approval of a rezoning, special exception or special-use permit, the locality must require a site assessment of sound effects on residential units and schools within 500 feet of the property boundary. The statute says:
“Prior to any approval of a rezoning application, special exception, or special use permit for the siting of a new HEUF, a locality shall require that an applicant perform and submit a site assessment to examine, to the extent practicable and within the timeline provided by subdivision A 7 of § 15.2-2286, the sound profile of the HEUF on residential units and schools located within 500 feet of the HEUF property boundary.”

This is a Virginia-specific assessment rule, not a national setback, decibel limit or no-build buffer. Check the local noise ordinance and any state standards that actually govern the parcel.
4. Review air pollution and generator operation
Backup generators may run rarely, but their permits and worst-case operating scenarios still matter. Ask which pollutants are modeled, how many hours are assumed for testing and emergencies, and what emissions controls and permit limits apply.
Questions for the applicant and air agency
- What generator fuel, engine tier and control technology are proposed?
- What are the permitted tons per year and short-term emission limits for nitrogen oxides, particulate matter, sulfur compounds, carbon monoxide and hazardous air pollutants?
- Does the permit cover simultaneous operation of all units, maintenance testing and extended outages?
- Where are exhaust stacks located relative to homes, classrooms, air intakes, playgrounds and prevailing winds?
- What monitoring, recordkeeping and public reporting are required?
Fairfax County explains that Virginia’s Department of Environmental Quality regulates air pollution from data centers and handles certain cooling-water discharge permits. That description is jurisdiction-specific; identify the air and water agencies for the actual site. The U.S. Environmental Protection Agency’s school-siting guidance highlights localized air pollution, including diesel exhaust, as an issue to examine around schools. The guidance is general school-siting advice, not data-center permitting law, and it does not establish a national health-distance rule.
5. Test water, wastewater and land constraints
Obtain a water-availability letter from the serving utility, not just an applicant estimate. Compare the facility’s annual and peak demand with existing commitments, drought restrictions, fire-flow obligations and planned growth.
Cooling and supply
- Confirm whether cooling is air-based, closed-loop or open-loop and how water use changes during heat waves.
- Identify potable, reclaimed or industrial sources and the priority of the facility during shortages.
- Check wastewater collection and treatment capacity for normal flows, blowdown and chemical handling.
- Ask whether large withdrawals trigger a state consumptive-use or similar permit; Florida’s process is not automatically applicable elsewhere.
Site and watershed effects
Review clearing, grading, impervious area, stormwater detention, floodplains, wetlands, streams, groundwater, habitat, agricultural land, parks and historic resources. Virginia law allows localities to require assessments of ground and surface water, agricultural resources, parks, registered historic sites and forestland for covered projects. EPA school-siting guidance also identifies hydrology and water quality as relevant evaluation topics. Require drawings that show drainage during construction as well as after build-out.

6. Understand grid infrastructure and who pays
Ask the serving utility to state the requested load, interconnection study results, delivery schedule, required substations and transmission upgrades, and the cost allocation for each item. Search for any separate rate case, utility approval or transmission proceeding; local zoning cannot decide matters assigned to a state utility regulator.
Fairfax County describes its State Corporation Commission as responsible for energy matters such as rates and transmission lines and notes that some infrastructure costs can be recovered through rates. That is a local explanation, not a universal rule. Confirm the current tariff, regulator docket and cost assignment for the proposed project.
Do not generalize Fairfax’s tax figures
Fairfax County reports that data centers contributed approximately $110.6 million in tax year 2026 to the county general fund, equal to approximately 1.9 percent of FY 2027 general-fund revenue. The county says most of that amount came from business personal-property taxes on data-center equipment. These are Fairfax County figures, not a forecast for another locality. Ask for a site-specific fiscal model that shows equipment depreciation, expansion timing, incentives and the cost of roads, water, emergency response and grid upgrades.
7. Compare public benefits with public costs
Evaluate projected taxes and employment alongside service demands. Pennsylvania’s planning toolkit identifies infrastructure, fiscal, economic and service impacts as core evaluation topics.
Require assumptions behind every benefit
- Number and duration of construction and permanent jobs, including skill requirements and local hiring assumptions.
- Taxable equipment value by phase, depreciation schedule and sensitivity to future technology changes.
- Any incentives, abatements or fee waivers, their expiration dates and performance requirements.
- Road, bridge, police, fire, emergency medical, water, sewer and inspection costs attributable to the project.
- Who pays if load, water demand, traffic or emergency calls exceed the original estimate.
A benefit is meaningful only when its calculation is transparent and its obligations are enforceable. Do not treat a headline investment number as a substitute for a net fiscal analysis.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
8. Keep school-specific exposure visible
When a school is nearby, map more than the school property line. Include classrooms, outdoor activity areas, athletic fields, bus staging, arrival and dismissal routes, walking and cycling paths, air intakes and construction haul routes.
Use EPA’s school-siting topics as a prompt: localized air pollution, utilities, traffic and pedestrian safety, hydrology and water quality, noise, lighting, public services and access to community resources. Then connect each topic to a measurable project condition—for example, truck-hour restrictions during arrival, protected pedestrian routing, construction dust controls, lighting limits, generator testing windows and noise verification at outdoor activity areas. The guidance is general and does not create data-center-specific approval requirements.
9. Compare sites, designs and cooling options on one scorecard
If alternatives are genuinely available, require the applicant to use identical assumptions, reporting periods and receptor locations. A side-by-side record prevents a low-impact phase at one site from being compared with a full build-out at another.
| Review axis | Evidence to compare |
|---|---|
| Distance and receptors | Homes, schools, outdoor areas, other sensitive uses and any applicable assessment distance. |
| Noise | Predicted sound at each receptor, time of day, tonal or low-frequency content, construction noise and post-build verification. |
| Air | Generator type, emissions, controls, permit limits and testing, outage and emergency scenarios. |
| Water | Source, annual and peak demand, cooling method, wastewater and stormwater capacity and effects on other users. |
| Power | Requested load, delivery timeline, substations, transmission, reliability and assigned costs. |
| Land and design | Zoning compatibility, footprint, height, buffers, lighting, traffic, habitat, flood risk and construction effects. |
| Public value and cost | Credible tax and employment assumptions against infrastructure and service costs, with enforcement mechanisms. |
These are review axes, not a nationally prescribed scoring system. Set thresholds from the applicable comprehensive plan, ordinances, permits and utility rules.

10. Turn promises into enforceable conditions
Before approval, rewrite important commitments as conditions that a public authority can monitor and enforce. Each condition should identify the responsible party, a measurable limit, a reporting schedule, a verification method, corrective action and the consequence of noncompliance.

- Construction truck routes, work hours, dust controls, pedestrian protection and restoration obligations.
- Landscape buffers, lighting shields, equipment screening and limits on expansion without renewed review.
- Financial guarantees or responsible-party provisions that remain effective after ownership changes.
A voluntary community-benefits agreement is not a universal legal requirement. If the locality relies on one, make its obligations specific, funded and enforceable rather than merely aspirational.
11. A practical hearing checklist
Use plain questions that force a numerical answer and identify the responsible decision-maker:
- How much power will the facility use at maximum build-out, and when will each phase reach that load?
- What water source, annual volume, peak-day volume and cooling technology are proposed?
- What will nearby homes, classrooms and outdoor school areas hear during normal operation, testing, construction and an outage?
- What will the backup generators emit, under which permit, and where are the exhaust stacks?
- Which substations, lines, roads and water upgrades are needed, and who pays for each?
- Which approval is being decided today, which agency decides the others, and when can residents comment?
- What local revenue is expected after depreciation and incentives, and what public-service costs were deducted?
- What monitoring reports will be public, how often will they be filed, and what happens when a limit is exceeded?
12. Recognize what remains location-specific
Without a parcel and application, no one can state the applicable zoning, setback, noise limit, utility territory, permit deadlines or appeal rights. Virginia’s 100-MW definition and 500-foot sound assessment illustrate one state’s approach, not a national rule. Florida’s planning material is guidance, not binding law. EPA’s school-siting document is general guidance, not a data-center approval standard.

A search result referring to Massachusetts Executive Order No. 658 and projects above 25 MW should not be used as a requirement until the order is verified in the Commonwealth’s official text. More broadly, rely on the current ordinance, permit, utility tariff and agency record for the proposed site, and preserve the exact version used in the approval file.
