Before approving a data center, ask officials to show exactly what is being built, how much electricity and water it will use, who pays for new infrastructure, what neighbors will experience, and which promised benefits are legally enforceable. Require written assumptions, site-specific studies, public reporting, and remedies before any discretionary approval.
The legal answer depends on the state, utility territory, permit type, and local zoning code. Use the questions below to build a complete record, then have municipal counsel identify which issues belong to the city or county, state agencies, and utility regulators.
Start with a precise project description
A data center is not a single standard land use. Facilities differ in size, purpose, cooling technology, electricity demand, water source, backup generation, and operating schedule. Officials cannot evaluate impacts or benefits until the applicant supplies a project-specific description.
Ask who is proposing and who will use it
- What is the developer’s legal name, parent company, and financial entity responsible for construction and operation?
- Is an end user or anchor tenant identified? Are there executed agreements, or is the load only a forecast?
- Are parallel site, interconnection, or utility-service requests pending elsewhere?
- Which statements are firm commitments and which are estimates that may change after approval?
Ask for scale, phasing, and timing
- What is the building area, number of data halls, planned peak electrical demand, and expected load at each phase?
- What is the construction sequence, start date, completion date, and expected operational life?
- What approvals are requested now, and which zoning, building, environmental, utility, or operating approvals will follow?
- What expansion triggers could increase the site’s power, water, noise, traffic, or generator footprint?
Maryland Executive Order 01.01.2026.16 specifically directs reviewers to test whether claimed loads are supported by an identified end user or executed agreements. That is a useful standard even where the order itself does not govern.

Determine what the locality can legally decide
Do not assume a public hearing gives one local body authority over every impact. Michigan’s guidance distinguishes local land-use and community-impact authority from state regulation of electricity, water withdrawals, air emissions, wastewater, wetlands, construction, and related matters. Maryland’s order likewise operates subject to existing statutes and regulations.
Ask officials to map every decision
- Does the comprehensive plan support the proposed use, location, building scale, and industrial intensity?
- Which zoning classification applies, and is the use permitted by right, conditional, special, or subject to a variance?
- Which board or department decides each request, and what are the notice, hearing, appeal, and ex parte rules?
- Which state permits cover water withdrawals, wastewater, air emissions, wetlands, stormwater, or construction?
- Which utility, public-service commission, or regional authority controls interconnection, tariffs, reliability, or cost allocation?
- What findings must the local decision-maker make, and what evidence must be in the record?
Ask the municipal attorney or planning department to provide this jurisdiction map in writing. Pennsylvania’s Department of Community & Economic Development frames local review from initial inquiry through zoning, permitting, and long-term planning, including infrastructure, fiscal effects, legal issues, and community priorities.
Ask who pays for power and grid upgrades
Electricity review must cover both physical capacity and cost responsibility. A project can appear attractive on a developer’s site plan while requiring generation, transmission, distribution, substation, or reliability work that affects existing customers.

Questions for the applicant and utility
- What is the facility’s full incremental load, including cooling, lighting, security, offices, battery systems, and future phases?
- Has the utility received accurate load amounts and in-service dates, or only a preliminary estimate?
- What generation, transmission, substation, feeder, or distribution improvements are required?
- Who pays the capital cost, ongoing maintenance, standby capacity, and any stranded cost if a phase is delayed or canceled?
- Could the project require a tariff change, special contract, or regulatory approval?
- How will reliability risks and emergency curtailment affect existing customers?
- What additional clean-energy supply is proposed, and is it matched to the facility over time rather than counted from existing resources?
Require a load schedule that separates contracted demand from speculative expansion. Ask for the utility’s written assumptions and the process for revising them. The exact regulator and ratepayer protections vary by jurisdiction, so local officials should identify the controlling tariff and agency.
Test water availability, cooling, and wastewater effects
Water questions should address withdrawal, consumption, seasonal stress, quality, wastewater, aquifers, surface waters, and who bears the cost of capacity. A statement that a facility has “access” to water is not a water-supply analysis.
Questions about demand and sources
- What are projected withdrawals and consumptive losses by source, month, season, and operating phase?
- Is the source municipal potable water, a private well, surface water, reclaimed water, or another supply?
- How would peak demand affect existing users, drought reserves, system reliability, water quality, aquifers, streams, wetlands, or other sensitive resources?
- Does the water supplier have a capacity analysis, allocation decision, or written service commitment?
- Who pays for treatment, storage, transmission, new wells, meters, pumping, and upgrades?
Require a cooling alternatives analysis
Ask the applicant to compare closed-loop, air-cooled, reclaimed-water, and other non-potable designs. The comparison should state water use, power penalty, noise, maintenance, chemical handling, discharge, and performance during heat waves or drought. Maryland’s order calls for water-availability analysis, cooling alternatives, and public disclosure. In one St. Louis permit, the city required a closed-loop system and air-cooled chillers; that is an example of a local condition, not a universal requirement.

Cover wastewater, stormwater, and drought operations
- What wastewater streams will be discharged, at what volume and quality, and under which permit?
- How will cooling blowdown, treatment chemicals, sanitary flows, and accidental releases be handled?
- What stormwater detention, infiltration, flood protection, and construction controls are required?
- What happens during drought restrictions, a water-main outage, contamination event, or aquifer decline?
- Will monthly or annual water withdrawals, consumption, and compliance reports be public?
Define what neighbors will experience
Request baseline data and enforceable limits rather than general assurances. Impacts depend on the site, equipment, operating hours, nearby homes and sensitive uses, and local standards.
Noise and generators
- Where are cooling towers, chillers, fans, transformers, and backup generators located relative to homes, schools, hospitals, and property lines?
- Does the noise study model normal operation, maximum cooling, generator testing, alarms, and simultaneous equipment operation?
- How many generators are planned, what fuel do they use, what emissions controls apply, and how many testing or emergency hours are expected?
- What nighttime limits, low-frequency analysis, construction-hour rules, and complaint-response procedures apply?
Traffic, appearance, heat, and emergency response
- What construction-worker, delivery, fuel, and maintenance traffic is expected, and for how long?
- What lighting, fencing, visual screening, setbacks, landscaping, and building-height controls will protect adjacent properties?
- What heat-management measures address large roofs, exhaust, equipment yards, and local microclimate concerns?
- Can fire, medical, hazardous-materials, and utility crews reach the site, and who funds specialized training or equipment?
- Which baseline and post-opening measurements will be published, and who answers complaints?
Separate fiscal gains from public costs
Ask for a net fiscal analysis, not a headline tax estimate. Subtract tax abatements, exemptions, road and utility work, public-safety costs, inspections, emergency preparation, and long-term service obligations from projected revenue.
Request a transparent benefits schedule
- What property, sales, utility, or other revenue is expected, by taxing jurisdiction and year?
- What incentives, abatements, grants, infrastructure contributions, or tax-increment arrangements reduce that revenue?
- What recurring police, fire, planning, inspection, road, water, wastewater, and emergency-management costs will the public incur?
- Which assumptions change if construction is delayed, a phase is canceled, equipment is replaced, or the site is partly vacant?
Distinguish temporary and permanent employment
Separate peak construction jobs from permanent operations positions. Ask for job counts, wage ranges, shift patterns, local-hiring targets, apprenticeships, workforce training, contractor reporting, and deadlines. Require measurable commitments rather than a general promise to create jobs.

Make community benefits binding and enforceable
A benefit is meaningful only when the public can verify delivery and obtain a remedy for nonperformance. Ask whether obligations will appear in a permit condition, development agreement, community-benefits agreement, or another document that binds successors.
Terms to put in writing
- Dollar amounts, in-kind contributions, job or training targets, and payment dates.
- The responsible legal entity and any parent, guarantor, or successor obligation.
- Construction and operating milestones that trigger each benefit.
- Annual reporting, independent verification, public access to records, and audit rights.
- Expansion triggers requiring updated benefits, impact studies, or approval.
- Remedies such as cure periods, stipulated payments, permit suspension, revocation where lawful, or legal action.
- Decommissioning, site restoration, equipment removal, and financial-security requirements.
Maryland’s framework highlights reporting, successor obligations, remedies, and periodic review. A St. Louis agreement states that specified conditions can support permit revocation if uncorrected and that the city may pursue legal remedies on agreement terms. Those mechanisms illustrate options; they do not automatically apply in another city.
Use a consistent comparison record
When officials compare sites or competing proposals, require the same data fields for each. No cited framework establishes a universal weighting formula, so publish the assumptions and explain any weighting used.

Build a public review process that survives approval
- Publish the application record. Post site plans, load and water schedules, studies, draft agreements, agency comments, and revised versions with dates.
- Hold technical briefings. Give residents separate sessions on power, water, noise, air emissions, traffic, fiscal effects, and emergency response.
- Set written questions and deadlines. Require the applicant and agencies to answer every material question, identify missing data, and state when corrections will arrive.
- Condition approval on measurable milestones. Tie construction, energization, occupancy, and expansion to permits, monitoring, financial security, and benefit delivery.
- Plan post-opening oversight. Name the department that receives complaints, publish contact methods, define response times, and schedule periodic compliance reviews.
- Reopen review when facts change. Require updated analysis for a larger load, different cooling system, new tenant, changed generator fleet, or material ownership change.
Recognize weak answers and common gaps
- “The utility approved it.” Ask whether that means a study, a conditional interconnection, a signed service agreement, or final capacity, and who pays for upgrades.
- “Water use will be minimal.” Request monthly and seasonal volumes, source, consumptive loss, cooling assumptions, and drought operations.
- “Jobs will be substantial.” Demand separate construction and permanent counts, wages, local hiring, and reporting dates.
- “Community benefits will be negotiated later.” Do not treat an unenforceable promise as a project benefit; identify the document, trigger, remedy, and successor duty.
- “The project is environmentally friendly.” Ask for equipment specifications, emissions calculations, energy matching, water alternatives, and monitoring data.
- “The next phase is only hypothetical.” Preserve expansion triggers and cumulative-impact review so an approved first phase does not silently establish a larger entitlement.
Use the St. Louis figures only as a local example
St. Louis’s April 21, 2026 announcement illustrates how a city can attach concrete terms to one development. Its community-benefit term sheet described a contribution of $30 per square foot and an estimated $15 million city fund. The broader development projected 200 full-time jobs, first-year city tax revenue of $27.4 million, and $33.4 million for St. Louis Public Schools. These are project-specific projections and commitments, not typical data-center results or a benchmark for another jurisdiction.
Mayor Cara Spencer summarized that approach as: “We want St. Louis to be open for business, but business on our terms; that means we’re only going to allow the development of data centers if the community benefits.” The practical lesson is to ask what “community benefits” means in enforceable numbers, deadlines, monitoring, and remedies for the proposal in front of you.
Final meeting checklist
- Project identity, end user, ownership, phases, peak load, water demand, and operating life are documented.
- Every local, state, utility, and regulatory approval is identified with the responsible decision-maker.
- Power upgrades, water capacity, wastewater, and emergency infrastructure have named payers.
- Noise, emissions, traffic, lighting, heat, visual screening, and emergency-service effects have baseline studies and limits.
- Net fiscal effects subtract incentives and public costs; jobs are separated by type and backed by reporting commitments.
- Benefits, monitoring, successor duties, expansion review, decommissioning, and remedies are legally binding.
- All material records, assumptions, updates, and compliance reports will be public.
North Carolina SB 730, Edition 5, appeared in the materials considered for this topic, but its enactment status was not verified. Do not describe it as current law without checking the legislature’s official status and consulting counsel. More broadly, Pennsylvania, Michigan, Maryland, and St. Louis materials describe their own governmental settings; confirm the current code, permits, utility rules, and legal authority for the actual site.
