Before voting on a data-center tax incentive, identify the exact benefit, every affected taxing body, the project’s measurable public costs, and the terms that make promised benefits enforceable. A large investment announcement is not the same as a net public gain. The town should compare the proposal with no incentive, require transparent assumptions, and obtain commitments that survive cost overruns, ownership changes, underperformance, and closure.
1. What exactly is the town being asked to approve?
Start with the legal and financial instrument, not the project’s marketing description. Request the complete draft ordinance, resolution, development agreement, payment-in-lieu-of-taxes (PILOT) agreement, host-community agreement, or other document that would be voted on. Identify whether the proposal is a local property-tax abatement, a PILOT, an exemption, a fee waiver, infrastructure financing, or a combination.
Separately list any state sales-tax, income-tax, utility, or economic-development incentive. A state program does not automatically authorize a local benefit, and a local vote may affect several taxing jurisdictions at once.

- Recipient: Name the legal developer, property owner, operating company, parent company, and end user if known.
- Property: Identify parcels, the planned building footprint, phases, eligible equipment, and the assessed-value assumptions.
- Term: State the start date, duration, phase-in schedule, renewal options, and what happens when the incentive expires.
- Conditions: List investment, hiring, wage, local-purchasing, energy, water, environmental, and community commitments.
- Decision-makers: Identify the town, county, school district, utility, planning body, and state agencies whose approvals or revenues are affected.
Ask how the local proposal interacts with state review and incentives. Maryland’s Executive Order 01.01.2026.16 directs future guidance to address that interaction, along with first-contact questions such as the end user, power demand, water needs, project timeline, and indicators of a speculative proposal. Read the order at Maryland Executive Order 01.01.2026.16; it directs government work and is not a project-specific finding or a rule that controls every town.

2. What will the tax break cost over its full term?
Require a documented comparison between the proposed deal and a no-incentive baseline. The analysis should cover the entire term, not just the first construction year, and should show results separately for each taxing body.
| Item to show | Questions for the applicant and public agencies |
|---|---|
| Foregone revenue | How much property, sales, payroll, or other tax revenue would each jurisdiction give up each year? |
| Expected receipts | What taxes, fees, or PILOT payments would the project actually generate, and when? |
| Public service costs | What will the town spend on roads, inspections, planning, police, fire, emergency medical services, and administration? |
| Utility and infrastructure costs | Who pays for substations, transmission, water mains, treatment capacity, sewer extensions, stormwater controls, and road improvements? |
| Assumptions | What completion date, occupancy, assessed value, equipment replacement cycle, electricity demand, and water use are assumed? |
| Risk protection | What happens if the building is delayed, vacant, assessed below forecast, or never reaches the promised load or employment level? |
Ask for sensitivity cases rather than one optimistic forecast: delayed construction, partial build-out, lower assessed value, higher service costs, reduced electricity use, and early closure. Show nominal dollars and, where the town uses it, the present value of future revenues and costs. Explain whether payments are fixed, indexed, tied to assessed value, or subject to credits for infrastructure spending.
New Jersey’s Economic Development Authority municipal resource hub discusses how communities can examine fiscal assumptions, protections sought by other communities when projected revenue fails to materialize, and comparisons with other agreements. It also points municipalities toward technical assistance on infrastructure and community-benefit documents: New Jersey Data Center Municipal Resource Hub. Its guidance is comparative assistance, not a determination of your town’s finances or legal authority.

Separate temporary construction activity from permanent operations. A construction peak can last months or years, while a staffed data center may operate with relatively few employees after commissioning.
Define the job claims
- Set a definition for a permanent job, a temporary construction job, a contractor, and a full-time equivalent.
- Require annual headcount, wages, benefits, work location, and average tenure, disaggregated between direct employees and contractors.
- Specify local-hiring and apprenticeship goals by date, with a method for verifying residency and completed training.
- Identify whether wage promises are nominal, inflation-adjusted, or tied to a published standard.
Count investment without treating it as a benefit by itself
List eligible real-property, machinery, and equipment investment and the date each phase becomes operational. Gross investment can increase an assessment while the incentive simultaneously removes or delays taxes. The fiscal model must connect the investment to net public revenue after all costs.

Build in verification and remedies
The agreement should require periodic reports, supporting records, independent or third-party verification where appropriate, public access to nonconfidential results, and a review date. Define cure periods, repayment or clawback amounts, reduced benefits, interest, termination rights, and dispute procedures before approval. A promise without a measurement method, deadline, and remedy is not an enforceable public benefit.
Maryland’s executive order calls for standard methods to measure jobs, wages, local hiring, apprenticeship use, and net fiscal impact, together with time-bound commitments and periodic review. Pennsylvania’s Responsible Infrastructure Development (GRID) standards provide a useful example of program-specific thresholds: the state announcement describes at least $250 million in cumulative new investment, 200 prevailing-wage construction jobs, and 50 jobs meeting specified wage levels by the fourth anniversary of certification. Those are conditions for developers seeking that Commonwealth support, not universal local requirements. See the announcement at Pennsylvania GRID standards.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute4. Who pays for the electric system and what could happen to rates?
Obtain the project’s expected and maximum demand in megawatts, load shape, ramp-up schedule, redundancy requirements, and proposed energization dates. Ask for the energy plan, interconnection application status, transmission and distribution studies, and a list of upgrades needed before each phase can operate.
Ask the utility—not only the developer—to explain the applicable large-load tariff or rate classification, deposits, construction contributions, and cost-allocation rules. Determine which upgrades are assigned directly to the project and which might be recovered from a broader customer base. The key resident question is, “Will my electric bill go up?” A reliable answer requires the utility’s tariff and cost-allocation analysis, not a developer assertion.
Maryland’s guidance work specifically raises ratepayer and utility-infrastructure effects. Pennsylvania’s GRID materials require covered applicants to provide an energy plan and pay specified project-caused electricity-system costs; that standard applies to the state program and does not automatically govern a local approval. Preserve the utility’s written assumptions in the public record and require updates if the load forecast changes.

5. How much water and wastewater capacity will the facility consume?
Request annual demand and peak-day demand for each phase, the water source, required pressure and reliability, cooling technology, water-reuse plans, and discharge characteristics. Peak-day use can control whether a system can serve the facility even when annual averages appear manageable.

- Document wastewater volume, temperature, chemical characteristics, pretreatment, discharge location, and permit requirements.
- Evaluate alternatives such as air cooling, closed-loop systems, reclaimed water, or seasonal operating limits where technically feasible.
- Include stormwater detention, impervious area, flood risk, and maintenance responsibility.
New Jersey’s municipal resource hub identifies peak-day usage as a consideration. Maryland’s executive-order materials identify water supply, cooling alternatives, stormwater, and discharges for agency review. A water letter of availability should not be treated as a guarantee that the town can absorb later phases without capital work.
6. What land-use and neighborhood conditions must be addressed?
Tax approval does not replace zoning, conditional-use, building, environmental, or traffic review. Ask the planning and public-safety departments to identify conditions before the incentive vote, and make any incentive effective only when the necessary approvals and enforceable operating conditions are in place.
- Setbacks and buffering: Measure distances to homes, schools, parks, and property lines; specify landscaping and maintenance.
- Noise: Set construction and operating limits, including cooling equipment, transformers, and emergency generators, with a measurement protocol and complaint response.
- Lighting: Control glare, spill, color temperature, hours, and security lighting.
- Traffic: Model construction deliveries, worker traffic, road wear, signalization, and extraordinary maintenance.
- Emergency services: Confirm fire-water flow, hazardous-material information, access, training, staffing, and reimbursement for specialized equipment.
- Backup generation and air: Inventory generator fuel, testing schedules, emissions permits, noise, and outage operations.
- Environment: Review habitat, wetlands, air emissions, heat, stormwater, water discharges, and cumulative effects with the responsible agencies.
Maryland identifies zoning, conditional-use review, setbacks, noise, lighting, buffering, traffic, emergency services, and environmental considerations. New Jersey advises communities to assess infrastructure, utilities, emergency response, and surrounding-community effects before finalizing community-benefit terms.
7. Can residents see the deal and participate before the vote?

Do not schedule a final vote while key terms remain unpublished or subject to an undisclosed side agreement. Maryland’s order calls for disclosure, public engagement, and community voice. South Bend’s published framework illustrates one local policy choice—public agreements, regular meetings, annual reporting, developer-paid utility upgrades, and neighborhood investment—but its rules are not automatically applicable in another jurisdiction. Review it at South Bend Data Center Framework.
8. What if the project changes, underperforms, or closes?
Draft the agreement for realistic failure modes, not only successful completion. Define:
- Reporting: Frequency, data fields, certification, audit rights, and public release.
- Reopener triggers: Missed investment or job milestones, material load changes, ownership transfers, prolonged vacancy, major design changes, or new public costs.
- Successor obligations: Whether a purchaser, tenant, lender, or affiliate must assume every commitment before receiving the benefit.
- Remedies: Reduced exemption, repayment, penalties, security, termination, and collection procedures.
- Decommissioning: Removal or reuse of equipment, demolition or stabilization, environmental cleanup, abandoned-structure security, and funding responsibility.
- Review: A scheduled public review rather than a one-time approval with no later checkpoint.
Maryland’s order specifically directs attention to reopener terms, measurable standards, reporting, successor obligations, remedies, decommissioning, and periodic review. Obtain legal advice on enforceability under the town’s statutes and ordinances before promising any remedy.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.9. Would the project proceed without the incentive?
Require the applicant to explain alternatives: other sites, ordinary taxation, a smaller or shorter incentive, different infrastructure terms, or private financing. Ask what decision factors are actually decisive—customer proximity, fiber connectivity, land, reliability, workforce, permitting time, or electricity prices.
Washington State’s Joint Legislative Audit and Review Committee reported in its 2026 review that it could not determine how much activity occurred because of the tax preference. The report said some capital investment likely would have happened anyway and that location factors, including proximity to customers, also influenced decisions. That is a warning against treating every announced job, dollar of investment, or assessed-value increase as incentive-caused.

10. Use a common comparison before choosing among options
If the town has more than one proposal, compare each on identical assumptions. Include the no-incentive case and alternatives such as a smaller benefit, shorter term, stronger conditions, or no project approval.
| Comparison axis | Evidence to place side by side |
|---|---|
| Net fiscal return | Full-term revenue, foregone taxes, service costs, infrastructure costs, sensitivity cases, and allocation by taxing body. |
| Workforce benefit | Verified permanent jobs, wages, local hiring, apprenticeships, deadlines, and remedies. |
| System costs | Electric, water, wastewater, road, emergency-service, and inspection requirements; payer for each cost. |
| Neighborhood and environment | Noise, lighting, traffic, setbacks, emissions, stormwater, water impacts, and enforceable limits. |
| Transparency | Public documents, comment opportunities, meeting schedule, annual reports, and confidentiality boundaries. |
| Durability | Reopeners, successor duties, security, clawbacks, decommissioning, and closure plans. |
Do not use another state’s framework as controlling law. Use it to generate questions, then verify the authority, rates, procedures, and remedies that apply in your town.
11. What the available evidence can—and cannot—tell you
Washington JLARC’s 2026 review illustrates why headline outputs require qualifications. It reported about $42.4 million in estimated beneficiary savings in the reviewed urban-county preference; owners claimed four exemptions and tenants claimed six. It also reported nearly 300 temporary construction jobs and 53 permanent family-wage jobs, but noted that the Department of Revenue had not verified those job numbers. In two counties, the review identified at least $111 million in assessed value and $1.2 million in property taxes added. Eligible equipment purchases rose from $40.6 million in fiscal year 2023 to $141.7 million in fiscal year 2026, while JLARC said it was uncertain how much spending was attributable to the exemption.
Those figures describe a particular Washington program and review. They are not a forecast for your town, and they do not measure net public return after incentives, utility work, services, environmental mitigation, or opportunity costs. JLARC also reported that at least 38 states offer some form of preferential tax treatment specifically targeting data centers. The prevalence of incentives is evidence of varied policy choices, not proof that any one deal works.
12. A pre-vote records checklist
Before the hearing, staff and council members should be able to answer each item below with a document, calculation, or named responsible agency:
- What exact incentive, term, recipient, property, and conditions are in the proposed agreement?
- Which town, county, school, utility, and state revenues or approvals are affected?
- What is the full-term net fiscal result against no incentive, including sensitivity cases?
- How will permanent jobs, wages, local hiring, apprenticeships, and investment be verified?
- What peak and expected electric load will the project create, and who pays for each grid upgrade?
- What annual and peak-day water and wastewater demands will occur, and does capacity exist?
- What conditions control noise, lighting, traffic, setbacks, emergency response, emissions, stormwater, and discharges?
- Have residents received the draft terms, fiscal assumptions, studies, and a meaningful comment period?
- What reopener, reporting, successor, remedy, security, and decommissioning provisions apply?
- What evidence shows the incentive changes the location decision rather than subsidizing a project that would proceed anyway?
A vote can be responsible only when the public can see the trade-offs and the agreement can enforce the promises. The most defensible outcome may be approval with narrower terms, a shorter or smaller incentive, a delay for missing analysis, or rejection—not because data centers are inherently good or bad, but because the measurable public value has not been established on enforceable terms.
