Before preparing questions, read the hearing notice, agenda, application and staff report. Confirm exactly what decision is being considered, which board or agency will make it, what issues it has authority to decide, and when and how comments must be submitted. Then ask for project-specific evidence and for any promised protections to be written in a form the decision maker can enforce.

Start by finding out what this hearing can decide

A “data center hearing” may concern a zoning change, conditional use, site plan, environmental review, water or stormwater permit, air permit, or another approval. The hearing body’s authority depends on the proceeding. A land-use board may be able to approve a site plan or impose conditions within its authority, while a separate agency or utility handles other permits or infrastructure decisions. A comment can be relevant only to matters the body is authorized to consider.

Read the project notice and application rather than relying on a general project description or a meeting announcement. The Pennsylvania Department of Environmental Protection’s Carbon Node East notice, dated August 19, 2026, illustrates why: it identifies specified water-obstruction, encroachment and discharge permit applications, limits testimony to those applications, and gives proceeding-specific procedures and a comment deadline. Those details apply to that proceeding, not automatically to hearings elsewhere.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What application or approval is before the body? Note the formal name, applicant, project site, and any application or docket number.
  • What can the body approve, deny, or condition? Ask which decisions are reserved for another board, agency, permitting process, or utility.
  • What documents make up the record? Locate the application, staff report, plans, technical studies, proposed conditions, and any written responses to public comments.
  • What are the participation rules? Check the deadline and required delivery method for written comments, how to register to speak, any speaking-time limit, and instructions for remote or accessible participation.
  • Is testimony limited by topic or permit? Follow the notice’s scope. If an issue is outside it, ask which process covers that issue and when it will accept comments.

Hearing opportunities also differ by approval pathway. Fairfax County’s local guidance describes different zoning and hearing routes; it should not be treated as a universal process. Keep a copy of the notice and record the deadline and submission method somewhere you can check easily.

Ask for numbers on water supply and cooling

Questions about water are most useful when they distinguish the source, the amount withdrawn, the amount consumed, and what happens to water after use. A broad assurance that the project has a water plan does not tell residents how much water the facility will need or how the demand may change across construction and operating phases.

  • What is the projected water use during each phase and at full operation? Is the estimate for an average day, a peak day, or another period, and what assumptions were used?
  • Where will the water come from: potable supply, reclaimed water, groundwater, surface water, or a combination? Which supplier or source is expected to provide it?
  • Which cooling system is proposed, and how does it affect withdrawals, consumption, wastewater, and water demand during hot or dry periods?
  • What wastewater and stormwater will the site discharge, where will it go, and which permits govern the discharge? How will water quality and quantity be monitored?
  • What happens during drought or a supply restriction? Are curtailment triggers, limits, or other commitments written into a permit or condition?

Tulare County identifies water supply and cooling among the areas it reviews, and Tucson’s adopted data center standards include adequate water supply and environmental review. Those local examples establish that the subjects can be part of review; they do not establish a single water-use limit or cooling requirement for every community.

Separate the facility’s power demand from grid costs

Ask for demand figures by phase and for the connected infrastructure needed to serve the project. “Power demand” can refer to the facility’s expected use, while new transmission lines, substations, generation, or other grid work can involve separate planning and cost-allocation decisions. Do not assume from the hearing alone that residents will—or will not—pay for those costs. The answer depends on local utility arrangements, approvals, and project facts.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What are the expected peak demand and annual electricity use, including each planned phase? What date, operating assumptions, and build-out schedule underlie the estimates?
  • What transmission, substation, generation, or other grid upgrades are needed? Which parts are dedicated to the project and which serve other customers?
  • Who pays construction and ongoing costs for each upgrade, and which utility, regulator, or public body decides that allocation?
  • What energy mix is expected? If renewable energy is claimed, is it physically supplied to the facility, contracted, or represented through another accounting method?
  • What reliability assumptions are used, and how will the facility be accounted for in local grid planning?
  • Where can residents review the utility or agency’s evidence on system costs and rate effects?

Local review materials from Tucson, Tulare County, and Fairfax County identify electricity demand, energy mix, grid infrastructure, or infrastructure costs as relevant subjects. They do not establish a general household-bill outcome for data centers.

Pin down noise, lighting, and effects on nearby homes

Ask whether the noise analysis covers all major sources, not just the building itself. Cooling equipment, transformers, construction activity, and backup generators can have different operating patterns. A useful study should identify predicted conditions at homes and other sensitive locations, explain its assumptions, and state how compliance will be checked.

  • Does the study include cooling equipment, transformers, construction, and generator testing? Does it model normal operations as well as outages or other emergency operation?
  • What are the predicted sound levels at the nearest homes and other sensitive places? Where were baseline measurements taken, and what modeling assumptions were used?
  • What setbacks, building design, sound barriers, landscaping, and lighting controls are proposed? Where will equipment and lights be located?
  • What operating noise limit would apply, at which locations and times? Who will measure compliance, and will measurements and monitoring records be available to the public?
  • How can residents report a suspected violation, who investigates it, and what corrective action or enforcement process applies?

Tucson’s adopted standards include sound-impact studies, noise barriers, and operating noise limits; Fairfax County describes local noise studies, visual screening, and siting standards. Ask what the actual proposed conditions say in your jurisdiction rather than assuming those examples apply to your project.

Ask about generators, air quality, and emergency response

Backup power can involve equipment that is tested periodically and may run during outages. Ask which generators are proposed, what permits cover them, and what operating limits apply in ordinary testing and emergencies. Keep air-permit questions distinct from land-use questions if a different agency is handling the emissions approval.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • How many generators are planned, what fuel do they use, and what emissions permits cover construction and operation?
  • How often may the generators be tested, for how long, and what limits apply during outages or other emergencies?
  • What air-quality modeling or monitoring is available for nearby residents, and what pollutants and operating scenarios does it address?
  • Have fire and emergency services reviewed site access, water supply, training, equipment, battery or fuel storage, and response procedures?
  • Who maintains the emergency plan, and how will it be updated if the site expands or its equipment changes?

Wisconsin DNR’s Port Washington proceeding describes an air-permit and public-hearing process for emergency generators at a proposed data center. Tulare County and California Energy Commission docket materials identify backup power, air quality, fire risk, and emergency response among review topics. These examples do not replace the permit notice or agency rules for another location.

Check siting, construction traffic, and what happens if the project closes

A site plan can affect nearby residents through building placement, equipment height, lighting, buffers, construction traffic, and the project’s eventual shutdown. Ask about the proposed layout and alternatives using nearby homes, schools, and other sensitive uses as reference points.

  • What zoning change, conditional use, or site approval is requested, and what alternatives were evaluated?
  • How close will buildings and equipment be to homes, schools, or other sensitive uses? What setbacks, height limits, screening, buffers, and open space are proposed?
  • What construction traffic, road work, delivery patterns, and telecommunications infrastructure are expected? What routes and time periods are assumed?
  • What happens if the project is delayed, abandoned, or shut down? Is there a financial assurance for cleanup, equipment removal, or site restoration?

Tucson’s rules provide local examples of separation distances and landscaping requirements. Tulare County lists siting, compatibility, transportation, and decommissioning among its evaluation areas. Ask which standards govern your application and whether the proposed plans meet them.

Ask who pays for public services—and what benefits are enforceable

Separate projected tax revenue or community benefits from the costs of infrastructure and public services. A project may involve roads, utility upgrades, water and sewer capacity, or fire-protection needs, but the payer and the public share vary by project and local arrangements. Ask for the assumptions and time period behind both costs and benefits.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What taxes, fees, incentives, and public-service demands are projected, and over what time period?
  • Who pays for roads, utility upgrades, water and sewer capacity, fire protection, and other services?
  • Are promises about jobs, local procurement, training, or community benefits written into an enforceable agreement or permit condition? Who is responsible for tracking delivery?
  • What assumptions support each estimate, and will the applicant or local government publish actual results over time?

Pennsylvania DCED’s municipal planning toolkit frames infrastructure and fiscal impacts as proposal-review issues. Massachusetts Executive Order 658 provides a separate, state-specific example: for covered projects, it ties permitting to community engagement and community-benefit agreement steps. It is not a nationwide requirement.

Compare alternatives on the same assumptions

If the application presents different sites, designs, phases, or mitigation packages, compare like with like. A claimed improvement is hard to assess if it uses a different operating phase, time horizon, modeling assumption, or set of affected locations from the alternative beside it.

Comparison area What to line up
Water Source, projected consumption and withdrawals, operating phase, cooling approach, and drought assumptions
Power and grid Peak and annual demand, phase, required upgrades, and proposed cost allocation
Noise Predicted levels at the same sensitive locations, equipment included, and operating scenarios
Backup power and air Generator count, fuel, modeled emissions, testing schedule, and operating limits
Siting and construction Setbacks, screening, building or equipment placement, and construction traffic
Community effects Emergency response requirements, public costs and benefits, and who verifies commitments
Oversight Monitoring, reporting, public access to records, and consequences for noncompliance

These are comparison axes, not a universal scoring system. The local record should identify which alternatives were evaluated and what evidence supports each one.

Make one focused, record-based comment

A concise comment can identify a gap more clearly than a long list of general concerns. Choose an issue within the hearing’s scope, point to the relevant page, figure, or claim in the application, explain what is missing, and request a specific response or condition.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Name the issue and cite the record. Identify the application page, study section, plan sheet, or proposed condition you are discussing.
  2. State the gap or concern. For example, explain that a water estimate does not identify the source, or that a noise study does not say whether generator testing was included.
  3. Ask for evidence or an enforceable response. Request the missing calculation, a defined limit, a monitoring plan, public reporting, or another condition the decision maker can lawfully require.
  4. Submit it the required way and on time. Follow the notice for deadlines, registration, time limits, and delivery method; keep a copy and note when you submitted it.

If the issue falls outside the current proceeding, ask which agency, permit, or later hearing addresses it. Do not assume that raising it in one forum automatically places it before every other decision maker.

Turn assurances into measurable conditions

When an applicant says it will reduce noise, conserve water, protect emergency access, or provide community benefits, ask how the commitment will work after approval. A useful condition identifies what must happen, when it applies, who checks compliance, what information becomes public, and what response follows a violation.

  • Measure: What limit, threshold, schedule, or performance standard applies, and where is it measured?
  • Monitor: Who conducts inspections or measurements, and how often or under what operating conditions?
  • Report: What records will be kept, who receives them, and can the public access them?
  • Enforce: Which agency handles complaints or violations, what corrective action is required, and what happens if the operator does not comply?
  • Update: Does the requirement account for later phases, equipment changes, or project expansion?

Tucson’s adopted standards illustrate that some jurisdictions can require noise studies, barriers, and operational limits. The particular body’s authority and the wording of the actual approval determine what can be imposed on another project.

Keep local examples in their proper context

Tucson, Fairfax County, Tulare County, Pennsylvania, Massachusetts, Wisconsin, and California materials describe their own rules, review topics, or proceedings. They can help residents recognize issues to investigate, but they do not establish one national hearing process or one set of data center standards. Verify the current notice, local code, agency authority, and permit requirements for the specific site and application before relying on any example.
