The Election Commission of India (ECI) is the permanent constitutional body responsible for preparing electoral rolls and conducting elections to Parliament, state legislatures, and the offices of the President and Vice-President. Article 324 places the superintendence, direction and control of that work in the Commission.
Under the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, a Search Committee prepares a panel, a Selection Committee recommends candidates, and the President makes the formal appointment. The law also sets eligibility rules, tenure and different removal protections for the Chief Election Commissioner (CEC) and the other Election Commissioners.
What the Election Commission of India is
The ECI is a permanent constitutional body rather than a temporary body created for one election. Its central authority comes from Article 324(1) of the Constitution, which vests in it the “superintendence, direction and control” of preparing electoral rolls and conducting specified elections.
Those elections are:
- elections to the Lok Sabha and Rajya Sabha;
- elections to the legislatures of the states; and
- elections to the offices of President and Vice-President under the Constitution.
The constitutional wording gives the Commission an overall supervisory and directing role. Parliament can add statutory details, and other laws assign the ECI additional responsibilities, but Article 324 is the starting point for understanding its authority.

The ECI’s current institutional description says the Commission consists of the CEC and two Election Commissioners. That is the present arrangement described by the ECI, not a permanently fixed three-member structure in the Constitution. Article 324 allows the President to determine the number of other Election Commissioners.
Decisions of a multi-member Commission are made by majority vote. The CEC chairs the Commission, but the constitutional and statutory framework does not make the CEC the sole decision-maker when other Commissioners are in office.
What the ECI does
Prepares and supervises electoral rolls
Electoral rolls are the lists of eligible voters used for elections. The ECI sets the framework for preparing, revising and maintaining those rolls. Registration work is carried out through officials working at state, district and constituency levels, under the Commission’s direction.
Roll-related work includes publishing drafts and final rolls, handling claims and objections through the prescribed process, correcting entries and maintaining the administrative systems needed for polling. The ECI’s constitutional responsibility is to control this preparation, while field officers perform much of the practical work.
Conducts elections
The Commission plans and supervises the election cycle: announcing the schedule, coordinating the machinery needed for polling, setting procedures, monitoring compliance and overseeing counting and the declaration of results. Its constitutional remit covers parliamentary, state legislative, presidential and vice-presidential elections.
Conducting an election is not limited to polling day. It requires electoral-roll preparation, nominations, scrutiny, withdrawals, campaigning rules, polling arrangements, counting and post-election administration. The ECI issues instructions and coordinates the officials and government agencies that carry out these stages.
Enforces election-period standards
The ECI says it oversees observance of the Model Code of Conduct by political parties and candidates. It also works to prevent misuse of official election machinery and electoral malpractices during the election period.

The Commission’s role includes monitoring reported violations and directing corrective action through its instructions and the legal powers available to it. This does not mean that every election offence is investigated or prosecuted solely by the ECI; law-enforcement and other authorities may have separate responsibilities.

Performs related statutory and advisory functions
The ECI’s official manual describes responsibilities that arise under laws in addition to the core Article 324 mandate. These include registration and recognition of political parties, dealing with certain party disputes, and advising on specified questions about disqualification of members of legislatures.
These are important functions, but they should not obscure the constitutional core: electoral rolls and the conduct of the elections listed in Article 324.
How the ECI relates to election officials on the ground
The ECI directs the national framework, but it does not employ every person who works at a polling station or in an electoral office. Election administration uses state and local government machinery and staff made available for election duties.

A Chief Electoral Officer (CEO) operates at the state or Union-territory level. The CEO coordinates the election administration in that jurisdiction under the ECI’s instructions, including roll revision, training, logistics and communication with district officials.
District Election Officers
District Election Officers (DEOs) manage election arrangements within their districts. Their work can include coordinating polling locations, personnel, materials, transport, security arrangements and the reporting systems used during an election.
Electoral Registration Officers
Electoral Registration Officers (EROs) handle the statutory processes for electoral rolls in their designated constituencies or areas. They process applications, claims and objections under the applicable rules and directions.
Why this distinction matters
These officials implement the ECI’s directions, but they are not all central ECI employees. State governments and other public authorities provide personnel and administrative support. The result is a nationally supervised system that depends on a large, decentralised field machinery.

The 2023 appointment Act sets a qualification threshold. A candidate must be a person who holds or has held a post equivalent to Secretary to the Government of India. The person must also have integrity and knowledge of, and experience in, the management and conduct of elections.

The qualification is therefore not framed as an open public examination or a general political appointment without criteria. It targets senior public-service experience at Secretary-equivalent level, together with election-management knowledge and experience and an integrity requirement.
The statute deals with appointment of both the CEC and other Election Commissioners. A person may first serve as an Election Commissioner and later become CEC, but the Act limits the combined period in the two offices to six years.
How appointment works under the 2023 Act
Article 324(2) provides the constitutional baseline: the President appoints the CEC and other Election Commissioners, subject to any law Parliament makes. The 2023 Act supplies the process that leads to that presidential appointment.

Stage 1: the Search Committee prepares a panel
The Search Committee is headed by the Union Minister of Law and Justice. Two other members, each not below the rank of Secretary to the Government of India, serve with the chair.
This committee prepares a panel of five people for consideration by the Selection Committee. Its function is screening and panel preparation; it does not make the appointment.
Stage 2: the Selection Committee considers candidates
The Selection Committee has three members:

If no Leader of Opposition is formally recognised, the leader of the single largest opposition party in the Lok Sabha is treated as the Leader of Opposition for this appointment process.
The Selection Committee may consider a person who is not on the five-person panel prepared by the Search Committee. The Act also says that the Selection Committee will regulate its procedure in a transparent manner. The statute therefore creates a panel-preparation stage but does not make that panel an exclusive list from which the final recommendation must be selected.

Stage 3: the Selection Committee recommends
After considering candidates, the Selection Committee recommends a person for appointment as CEC or Election Commissioner. Recommendation is a distinct legal step from appointment: the committee does not itself issue the appointment warrant.

Stage 4: the President appoints
The President makes the formal appointment by warrant under the President’s hand and seal, on the recommendation of the Selection Committee. The President’s action is the final appointment step specified by the Act.

Constitutional rules and statutory details: what is different
It helps to separate the two legal layers.
What Article 324 establishes
- There is an Election Commission for the specified elections.
- Superintendence, direction and control of electoral-roll preparation and election conduct are vested in it.
- The President appoints the CEC and other Election Commissioners, subject to legislation made by Parliament.
- The Constitution provides special protection for removal of the CEC and states that an Election Commissioner cannot be removed except on the CEC’s recommendation.
What the 2023 Act adds
- Eligibility based on Secretary-equivalent public service, integrity and election-management knowledge and experience.
- The Search Committee’s membership and five-person panel.
- The Selection Committee’s membership and its ability to consider someone outside the panel.
- The President’s appointment by warrant following the Selection Committee’s recommendation.
- Term limits, the no-reappointment rule and service-related provisions.
The Act operates within the constitutional framework; it does not replace Article 324’s description of the Commission’s basic role.
How long Commissioners serve
The Act provides a term of six years from the date the person assumes office or until the person reaches 65, whichever comes first. A person cannot be reappointed.

The age limit can shorten a six-year term. For example, a person who takes office shortly before turning 65 does not receive six years; the term ends when the person reaches 65. Conversely, a younger appointee may serve until six years have elapsed, subject to the same statutory limit.
If an Election Commissioner becomes CEC, the aggregate period served in the two offices cannot exceed six years. Moving from one office to the other does not restart the clock.

Chief Election Commissioner
The CEC can be removed only in the same manner and on the same grounds as a judge of the Supreme Court. This is a constitutional protection involving a specially defined removal process and grounds.
Other Election Commissioners
An Election Commissioner other than the CEC cannot be removed except on the recommendation of the CEC. The protection is therefore different from the CEC’s: the two categories do not have identical removal arrangements.
The distinction matters when describing institutional independence. Saying that every Commissioner has the same removal protection would be inaccurate.

What happens during an election in practical terms
The ECI’s responsibilities can be understood as a chain of oversight:
- Roll preparation: electoral authorities compile, revise and publish voter lists through the prescribed claims-and-objections process.
- Election programme: the Commission announces the schedule and issues instructions for nominations, polling and counting.
- Field coordination: CEOs, DEOs, EROs and other officials organise local implementation with government-provided staff and resources.
- Campaign oversight: the Commission monitors the Model Code and action against misuse of official machinery or electoral malpractice.
- Polling and counting: the field machinery conducts voting and counting under the Commission’s directions, with reporting and monitoring arrangements.
- Results and follow-up: results are declared through the prescribed process, while complaints, compliance questions and related statutory matters are handled by the competent authorities.
This division explains why the ECI can be constitutionally responsible for an election without directly performing every task at every polling station.
Common misunderstandings
“The CEC appoints the other Commissioners.”
No. Under the 2023 Act, the Selection Committee recommends candidates and the President makes the formal appointment. The CEC has a role in the removal protection of other Election Commissioners, but that is not the appointment mechanism.
