The U.S. Department of Justice (DOJ) Civil Rights Division protects civil and constitutional rights by enforcing federal civil-rights and anti-discrimination laws. Its work includes civil investigations and lawsuits, criminal prosecutions, coordination with other federal agencies, and technical assistance.
Which office can act depends on the statute, the conduct, the covered person or organization, the evidence, and whether the matter is civil or criminal. The Division’s current statutes-enforced index is the best way to connect a particular law with the DOJ section and case type responsible for it.
What the DOJ Civil Rights Division is responsible for
The Civil Rights Division (CRT) is a DOJ component focused on enforcing federal protections against discrimination and other violations of federally protected rights. DOJ describes its mandate this way: “Our mandate at the Civil Rights Division is protecting the civil and constitutional rights of all Americans. We do this by enforcing federal anti-discrimination laws and civil rights laws.”
That mission covers more than one kind of case. Depending on the authority involved, a section may investigate a public agency, employer, housing provider, school-related entity, federal-funding recipient, institution, or person; negotiate a settlement; file a civil lawsuit; refer a matter; or prosecute a federal criminal civil-rights offense.

The Division is organized into specialized sections addressing areas such as criminal justice, disability rights, education, employment, federal coordination, housing, immigration-related employment, institutionalized persons, religious liberty, and voting. The section that handles a matter is determined by the law and facts, not simply by the subject’s general label.
How the Division enforces rights
Civil investigations and litigation
Civil sections can review complaints and other information, investigate where the governing statute permits, and seek remedies through a settlement or litigation. A civil case may involve changes to policies or practices, compensation or other relief authorized by the statute, or an agreement requiring compliance. The Division does not automatically open a case for every complaint, and its authority varies by law.
Criminal civil-rights prosecutions
DOJ also prosecutes federal criminal civil-rights violations. The Criminal Section describes a possible sequence of complaint review, investigation, grand-jury proceedings, indictment, and trial. That sequence is not guaranteed: many complaints do not become investigations, and not every investigation leads to an indictment or prosecution.

Criminal jurisdiction is divided within DOJ. The Assistant Attorney General for Civil Rights has authority over federal civil-rights statutes, subject to exceptions for certain criminal laws involving specified aspects of voting rights, civil unrest, fraud, and abortion. Those exceptions are enforced by DOJ’s Criminal Division. Thus, a law or incident commonly described as a “civil-rights” matter is not necessarily handled exclusively by CRT.
Coordination and technical assistance
Some work is collaborative rather than a single case against one defendant. CRT coordinates enforcement with other federal agencies and provides public or agency technical assistance. The Federal Coordination and Compliance Section, for example, implements Title VI and related authorities for recipients of federal funds and has a coordination and oversight role across federal agencies.

- 18 U.S.C. § 241: conspiracy against rights. It can apply when two or more people conspire to injure, oppress, threaten, or intimidate someone in the exercise of a federally protected right, or to intimidate someone because of that exercise.
- 18 U.S.C. § 242: deprivation of rights under color of law. DOJ’s index explains that the offense requires a willful deprivation of a federally protected right by someone acting under color of law. It does not require proof of racial or other discriminatory animus.
The index also includes federal hate-crime provisions and other criminal civil-rights statutes. The elements, required intent, covered actors, possible penalties, and available defenses are statute-specific; the name of a right alone is not enough to establish a federal crime.

What Title VII and the Pregnant Workers Fairness Act do
Title VII
Title VII prohibits covered employment discrimination because of race, color, religion, sex, or national origin. DOJ’s description also addresses retaliation and other prohibited conduct. Whether a particular workplace decision violates Title VII depends on facts such as the employer’s coverage, the action taken, the timing, comparable treatment, and the evidence linking the conduct to a protected basis or protected activity.
Pregnant Workers Fairness Act
The Pregnant Workers Fairness Act concerns reasonable accommodations for a qualified worker’s known limitations related to pregnancy, childbirth, or related medical conditions. The obligation applies to covered employers and is governed by the Act’s statutory standard. A disagreement about an accommodation therefore requires analysis of the worker’s qualification, the limitation, the requested adjustment, the employer’s response, and any statutory defenses.
Voting matters: why the correct referral matters
The Voting Rights Act covers specified discriminatory voting practices, but election-related complaints do not all go to CRT. DOJ explains that responsibility can depend on the conduct and legal theory. Its voter-fraud guidance directs reports to the FBI, a U.S. Attorney’s Office, or the Criminal Division’s Public Integrity Section. A complaint about access, discrimination, or another civil voting-rights issue may follow a different route.

Before contacting DOJ, identify what happened, who acted, which election or jurisdiction is involved, and whether the allegation concerns discrimination, access, administration, or suspected fraud. Those distinctions help determine the responsible component and prevent a civil-rights complaint from being sent to an office that does not handle that type of conduct.
Title VI and federal-funding enforcement
Title VI and related authorities address discrimination by recipients of federal financial assistance. CRT’s Federal Coordination and Compliance Section has a coordination and oversight role, working across federal agencies rather than treating every matter as a stand-alone lawsuit by CRT.
Federal funding can bring an organization within a civil-rights compliance framework even when the organization is not a government agency. The applicable program, funding relationship, protected-rights theory, and agency procedures determine what review or remedy is available. DOJ pages record policy changes affecting some historical guidance, so current agency guidance should be checked before relying on an older policy statement.

Contacting DOJ does not establish that a violation occurred, create an attorney-client relationship, guarantee an investigation, or guarantee a case. A practical screening process is:
- Define the conduct and setting. Record what happened, when it happened, where it happened, and whether the actor was an employer, public entity, federal-funding recipient, housing provider, institution, election official, or private individual.
- Identify the potentially protected right. Consider discrimination, retaliation, voting access, disability rights, religious liberty, housing, education, employment, or a criminal deprivation of rights.
- Match the facts to a statute. Use DOJ’s current statutes-enforced index and the law’s dedicated page. Do not assume that a general allegation of unfairness satisfies a statute’s elements.
- Check the responsible component. Determine whether CRT, another DOJ division, a federal agency, the FBI, or a U.S. Attorney’s Office is identified for that authority or conduct.
- Preserve evidence. Keep notices, policies, messages, recordings where lawful, witness information, dates, and records showing what relief was requested and how the organization responded.
- Review the required route and timing. Some laws have agency-specific complaint forms, referral rules, exhaustion requirements, or filing deadlines. The applicable DOJ page controls.
- Describe the requested outcome accurately. Explain whether you seek an investigation, referral, policy change, accommodation, or another remedy authorized by law; DOJ may still decline to act or refer the matter.
What DOJ enforcement can and cannot mean for you
Possible outcomes
- A complaint may be reviewed and referred to the DOJ section or another agency with authority.
- A civil section may investigate, negotiate a settlement, or bring litigation when the statute allows.
- A criminal matter may proceed through investigation, grand-jury review, indictment, and trial.
- An agency or public audience may receive technical assistance or compliance guidance.
Important limits
- Not every complaint is investigated, and not every investigation results in a case.
- Each law has its own coverage, proof requirements, procedures, and remedies.
- CRT does not represent every individual complainant as a private lawyer.
- Another DOJ component or federal agency may have primary responsibility even when the allegation involves civil rights.
Where to start
Begin with DOJ’s About page for the Division’s mission, its current statutes-enforced index for section and case-type assignments, and the dedicated page for the law that appears to fit the facts. Read the complaint or referral instructions on that page, gather a concise chronology and supporting records, and follow any instructions about urgent safety issues or election-related referrals.
The strongest initial submission is specific rather than expansive: name the actor, identify the setting, describe the protected right or conduct, state the relevant dates, attach key evidence, and explain why the facts appear to satisfy the statute. That approach gives DOJ enough information to assess jurisdiction without assuming that a label such as “civil-rights violation” proves the legal claim.
