First identify which decision is affected: USCIS may be deciding your employer’s H-1B petition, or a Department of State consular officer may be deciding your visa application. Those are separate decisions. A delayed visa stamp does not automatically mean your USCIS petition was denied, and a pending petition does not by itself prove that you may work. Read the notice, check your current I-94 and status, and involve your employer’s immigration counsel or a qualified immigration attorney before working, changing employers, filing another request, or traveling when the outcome is uncertain.
Start by identifying the case and the agency
Look at the document title, issuing agency, receipt or case number, and the exact language about what is missing or denied. USCIS adjudicates the employer’s Form I-129 petition. A consular officer at a U.S. embassy or consulate adjudicates the worker’s visa application. The Department of State states that consular officers have the sole authority to approve or deny visa applications under section 104(a) of the Immigration and Nationality Act.

These documents answer different questions. A visa is a travel document; it is not the same thing as immigration status inside the United States. Conversely, an approved petition does not guarantee visa issuance or admission. Your location, current status, petition history, requested extension or change, employer, and the wording of the notice can change the result.
If USCIS has not decided the H-1B petition
Monitor the case with the receipt number
- Use the USCIS receipt number exactly as printed on the I-797 receipt notice.
- Check USCIS’s current Case Processing Times tool using the particular form and service center shown for the case. USCIS describes posted times as estimates that change, not promises of a decision by a fixed date.
- If the case appears outside the agency’s inquiry window, use the case-inquiry route USCIS provides for that form and service center. Keep the confirmation number and a copy of the submission.
- For a premium-processing filing, use the contact details and instructions on the receipt notice. Confirm the current premium-processing rules, fee, eligibility, and deadline on USCIS’s live official page before deciding whether to file Form I-907; do not rely on an older article or an assumed turnaround period.
Have the employer or counsel review every USCIS notice. A request for evidence (RFE), notice of intent to deny, or other request normally has its own response deadline and delivery requirements. Missing a deadline can be more damaging than the original delay. Send USCIS only the evidence requested, organized to match each question, and retain the complete filing and delivery record.

Do not treat a pending label as work permission
“Case Was Received” or “Case Is Being Actively Reviewed” describes an agency status, not an independent grant of work authorization. Whether you may continue working can depend on an approved petition, a timely filed extension of stay, an I-94 date, a different immigration classification, or another rule. Ask counsel to compare the filing receipt with your current I-94, prior approval notices, and the job you are performing before you rely on a pending case.
If the consulate gives you a 221(g) refusal
What 221(g) means
The Department of State explains: “A visa denial under section 221(g) of the INA means that the consular officer did not have all of the information required to conclude you are eligible to receive a visa.” A 221(g) refusal can mean the application is incomplete and documents are needed, or that the case requires administrative processing. It is not an approval and is not necessarily a final determination that you can never qualify.

Follow the written instructions exactly
- Read the refusal sheet, email, or portal message and identify every requested document or item of information.
- Submit materials through the channel and in the format the consulate specifies. Do not send sensitive records to an unlisted address or substitute a different delivery method without confirmation.
- Keep scans of everything submitted, the date sent, courier or upload confirmation, and the case number.
- Tell the employer and immigration counsel what was requested. They can check that the response is consistent with the approved petition, labor-condition application, job description, and prior immigration filings.
- Wait for the case to be reassessed. The Department of State says a case may later be approved or the applicant may remain ineligible.
Administrative processing has no universal duration. The Department of State states, “The duration of the administrative processing will vary based on the individual circumstances of each case.” Except for emergency travel, its after-interview guidance advises waiting at least 180 days from the interview or from submission of supplemental documents, whichever is later, before asking about administrative-processing status. A consulate may provide different local instructions, so follow the notice and the post’s current guidance.

Understand the CEAC “refused” display
On March 5, 2020, the Department of State explained that CEAC could show “refused” for a case that had previously displayed “Administrative Processing.” The explanation concerned the 221(g) refusal status; the display could change if eligibility was later established or outstanding issues were resolved. Therefore, a CEAC “refused” label alone does not tell you whether requested documents are still being reviewed or whether a separate ineligibility ground has been applied. Read the written notice and ask the consulate or counsel to interpret the specific case.

If the petition or visa is denied
Separate a petition denial from a visa refusal
A USCIS petition denial concerns the employer’s petition. A consular refusal concerns the visa application needed for travel. The consequences can differ for employment, status, travel, and future filings. The available facts do not support one outcome for every worker: an extension of stay, change of status, consular-processing request, expiration of authorized stay, other immigration status, and petition history all matter.
Build a case-specific review before taking action
- Obtain the complete decision or refusal notice, including every page and attachment.
- Confirm the current I-94, passport validity, place of residence, and whether you are inside or outside the United States.
- List the petition receipt and approval numbers, employers, job locations, requested validity dates, and any prior RFEs or refusals.
- Ask counsel whether the notice identifies a missing document, a factual or legal deficiency, a security or administrative issue, or a different statutory ineligibility.
- Do not continue work, begin a new job, depart the United States, or file a new petition based only on an online status label.
The notice may describe review, motion, appeal, refiling, or other options, but those rights and deadlines depend on the decision type and current rules. Have the employer’s immigration counsel or another qualified immigration attorney read the notice promptly rather than assuming that a generic “appeal” or “grace period” applies.

Changing employers while an H-1B transfer is pending
The Department of Labor’s Fact Sheet #62W describes portability this way: “The portability provision enables an H-1B worker to change to a different job without the risk of being ‘out of status.’” The fact sheet says the new employer must file a nonfrivolous Form I-129 before the worker’s authorized stay expires and submit an unexpired approved labor condition application covering the work.

Those conditions are not a blanket authorization for every worker or job. Before starting, the worker and new employer should have counsel verify that the filing is timely, the LCA covers the offered position and location, the worker is eligible for portability, and the current authorized-stay record supports the move. Keep the new filing receipt and the prior I-94 and approval notices available. If USCIS later denies the petition, the effect on employment and status requires individualized advice.

Use this decision path when the answer is unclear

What to send your employer’s immigration counsel
- Every USCIS receipt, approval, RFE, notice of intent, and decision.
- The consular appointment confirmation, refusal sheet, document-request email, and CEAC screenshots showing dates and labels.
- Your passport biographic page, current visa (if any), I-94, most recent admission record, and prior approval notices.
- A chronology of employment, work locations, job duties, trips, status changes, and filing dates.
- Copies of anything you already submitted and proof of delivery or upload.
- Your planned travel date, start date with a new employer, or other deadline that makes timing critical.
Use the official notice as the controlling instruction. Agency case tools are useful for monitoring, but they do not replace the notice, an I-94, or legal advice tailored to your facts. Keep your employer informed because the company may need to respond to USCIS, update a consulate, preserve payroll records, or decide whether a filing should be amended.
Common mistakes that create additional risk
- Calling every problem a “visa denial.” A USCIS petition delay, a 221(g) refusal, and a final visa ineligibility are different events.
- Booking nonrefundable travel after a petition approval. Petition approval does not guarantee visa issuance or admission.
- Starting a transfer before checking portability. The filing date, authorized-stay expiration, LCA, job, and worker history must fit the rule.
- Ignoring a response deadline. An RFE or consular document request should be handled through the exact channel and by the stated date.
- Relying on a status label without reading the notice. CEAC “refused” can describe a 221(g) case that remains subject to reassessment.
- Using old processing-time or premium-processing figures. USCIS estimates and requirements change; verify the live tool and receipt instructions.
Bottom line for a delayed or denied H-1B case
Identify the agency, preserve the notice and status records, and match your next step to the actual issue: USCIS monitoring or inquiry for a pending petition, exact document submission for a 221(g) refusal, or individualized legal review after a denial or uncertain work authorization. Before you work, change employers, file again, or travel, have the employer’s immigration counsel or a qualified immigration attorney apply the current rules to your petition history, location, I-94, and notice.
