Start with an inventory, not a legal guess. List every AI tool and workflow, where your business and affected people are located, what data and decisions are involved, and whether you are supplying the system or using someone else’s. Then apply proportionate controls for sensitive data, human review, customer notice, vendor terms and records.

“Small business” is not a legal category that answers applicability by itself. Obligations can turn on the system’s purpose, risk, industry, role and geography. The steps below create an evidence trail for those decisions, but they do not replace advice on a specific company’s duties.

Why an AI inventory comes before compliance decisions

A single company may be a deployer of a customer-service chatbot, a buyer of an employment-screening tool and a provider of an AI feature embedded in its own software. Those roles can trigger different responsibilities. Location matters too: the business, its customers, workers and the system provider may all be in different jurisdictions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For each use, record:

  • Tool, vendor, model or feature name and version, if known.
  • A named business owner and the teams or contractors who use it.
  • Intended purpose, users and the customers, applicants, students, patients or workers affected.
  • Business and user geography, including markets served remotely.
  • Input and output data categories, such as contact details, financial information, health information, biometrics, confidential business material or children’s data.
  • Whether an output only assists a person or influences a price, eligibility decision, ranking, safety action, employment decision or public claim.
  • Whether the company develops, substantially modifies, supplies or merely deploys the system.
  • Human-review points, disclosures shown to people, retention settings and the date of the last review.

Keep the register in a controlled document or system with an owner and change history. A new model, plug-in, data source, market or use case should create a review event rather than silently expanding the original approval.

Map applicability by place, role and intended use

Use the inventory to answer five questions for every system:

  1. Where are the business and affected people? Record countries and states, not just the headquarters. A service sold online can reach people in a jurisdiction whose rules your local office never considered.
  2. What is the system intended to do? “Uses AI” is too broad. A drafting assistant, identity-matching system and automated eligibility score present different issues.
  3. Who is the legal actor? Determine whether your firm is acting as a provider or developer, a deployer or user, an importer, or a supplier of a component used in a larger product.
  4. What consequences can follow? Mark decisions affecting employment, education, essential services, credit-like access, safety, identity or vulnerable people for enhanced review.
  5. What information is processed? Sensitivity, confidentiality, volume, retention and onward sharing should determine the strength of security and privacy controls.

This is a triage method, not a legal classification. For EU-facing systems, compare the intended use with the current AI Act text and the Commission’s guidance for providers and deployers of high-risk systems at the European Commission high-risk AI guidance.

Prioritize uses that can cause material harm

Do not rank projects only by technical sophistication. A simple rules-based workflow can be more consequential than an impressive text generator if it determines who receives a service.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

High-consequence triage flags

  • Hiring, promotion, dismissal, scheduling or worker monitoring.
  • Education admissions, assessment or access decisions.
  • Access to housing, finance, insurance, healthcare or other essential services.
  • Biometric identification or categorization.
  • Safety-critical operation, industrial control or decisions affecting physical security.
  • Customer eligibility, fraud blocks, account suspension or individualized pricing.
  • Systems processing children’s information or other sensitive personal data.
  • Generated media that could mislead people about a person, event, product or public statement.

For a flagged use, require a documented purpose, a qualified reviewer, testing on relevant cases, an appeal or correction route and a stop condition when the system behaves unexpectedly. A low-impact drafting tool may need only approved-use rules and data restrictions; an eligibility model needs a deeper review even if a vendor markets it as “assistive.”

Track the EU AI Act’s changing calendar

The dates below come from European Commission notices and guidance published in July 2026. They are category-specific. They do not mean that every AI application has the same deadline or that a later date suspends other obligations.

Requirement or milestone Date and scope What a small business should do
AI Omnibus package Entered into force across the EU on July 27, 2026. It includes measures supporting smaller businesses, broader regulatory-sandbox access, simplified AI-literacy requirements and changes to high-risk timelines. Recheck the consolidated legal text and implementation timetable before a launch or contract renewal. Read the Commission notice at AI Omnibus enters into force.
Article 50 transparency guidance Guidelines were published July 20, 2026; the relevant transparency obligations apply from August 2, 2026. Map every user-facing interaction and generated or altered content to the current guidance at the Article 50 transparency guidelines.
Interactive AI disclosure From August 2, 2026, the Commission says chatbots and other interactive AI systems must tell users they are dealing with AI rather than a human, where the Article 50 conditions apply. Place a clear notice at the start of the interaction, preserve the wording and delivery decision in your records, and test that the notice is visible on mobile and accessible interfaces.
Deepfake and specified synthetic-content marking From August 2, 2026, deepfakes must be labeled and specified AI-generated or altered content must carry machine-readable marks, subject to Article 50 scope and implementation guidance. Identify media production and publishing workflows, retain provenance or marking settings, and verify that downstream platforms do not strip required signals.
Specified Annex III high-risk systems December 2, 2027 for the categories covered by the updated Commission timeline. Do not treat this as a universal grace period. Determine whether the intended use falls in an Annex III area and plan conformity, documentation and oversight work accordingly.
Specified high-risk AI embedded in Annex I products August 2, 2028 for the categories covered by the updated timeline. If AI is part of a regulated product, coordinate the AI assessment with the product-safety and conformity process; the date does not cover stand-alone systems outside those categories.

The Commission’s July 31 announcement, Commission starts enforcing AI Act rules and new transparency requirements on 2 August, explains the August 2 transparency start. Because the law and implementation material are time-sensitive, assign someone to check official updates before relying on any date.

Use NIST as an organizing method, not a legal shield

In the United States, the National Institute of Standards and Technology describes the AI Risk Management Framework (AI RMF) as voluntary and says it is being revised. NIST’s stated purpose is to help organizations incorporate trustworthiness considerations into the design, development, use and evaluation of AI products, services and systems. See the NIST AI Risk Management Framework and its AI RMF FAQs.

The Generative AI Profile, NIST AI 600-1, was released July 26, 2024. It can help a firm identify risks specific to generative systems, but using it does not establish that a company has met a statute, regulation or contract. A separate NIST Risk Management Framework Small Enterprise Quick Start Guide, published July 23, 2024, is intended for small and under-resourced organizations starting information-security and privacy risk management.

A practical NIST-style cycle

  1. Govern: assign an executive owner, approved-use rules, escalation paths and review frequency.
  2. Map: document purpose, users, affected people, data, context and foreseeable harms.
  3. Measure: test accuracy, bias-relevant performance, security, privacy, reliability and failure modes that matter to the use.
  4. Manage: apply mitigations, human review, monitoring, incident response and a decision to restrict, replace or discontinue the system.

Retain the reasoning and evidence for each cycle. A framework is useful because it makes work repeatable; it is not a safe harbor.

Set rules for data, accounts and prompts

Publish a one-page approved-use standard that every employee and contractor can follow. It should state which tools are authorized, which account type is required and what information may never be entered into an unreviewed service.

Minimum data controls

  • Prohibit secrets, passwords, payment details, health information, identity documents, confidential client files and unnecessary personal data in unapproved prompts.
  • Prefer minimization, redaction, pseudonyms or synthetic examples when the task can be completed without identifying information.
  • Use business-managed accounts with centralized access, multi-factor authentication, role-based permissions and an offboarding process.
  • Document retention, deletion and export settings. Do not assume that deleting a chat removes provider backups or training copies.
  • Log material prompts, outputs and approvals where doing so is lawful and proportionate, with access limited to people who need the records.
  • Define how employees report accidental disclosure, suspicious output, account compromise or a vendor incident.

Connect the data rule to the actual workflow. A blanket ban often drives staff to hidden personal accounts; a short list of permitted tasks, prohibited data and an escalation channel is easier to follow.

Review vendors before connecting business data

Ask the supplier for current contractual and technical information, then record who reviewed it and when. At minimum, check:

  • Whether prompts, files and outputs are retained, for how long and in which regions.
  • Whether customer content is used to train or improve shared models, and how that setting is controlled.
  • Encryption, access logging, administrator controls, vulnerability handling and independent security reports.
  • Subprocessors, international transfers, confidentiality commitments and the process for deleting or exporting data.
  • Incident-notification timing, support contacts and cooperation with investigations or individual requests.
  • Service changes, model substitutions, rate limits and the vendor’s right to change terms.
  • How the vendor supports transparency, audit evidence, human review and correction when an output affects a person.

If the answers are vague, limit the tool to low-sensitivity work or choose a process that does not send the data externally. A vendor’s statement that its model is “safe” is not a substitute for documenting your own use and controls.

Keep a person accountable for consequential outputs

Require a qualified person to check material outputs before they affect customers, workers, prices, eligibility, safety or public claims. The reviewer should have enough context, authority and time to reject an output; clicking “approve” without seeing the underlying case is not meaningful oversight.

What the reviewer should check

  • Whether the output addresses the actual request and uses the right data.
  • Factual accuracy, unsupported citations, fabricated details and unexplained confidence.
  • Disparate or unreasonable effects on relevant groups.
  • Whether the decision can be explained and corrected.
  • Whether the system encountered an out-of-scope case that requires escalation or manual handling.

Give affected people a route to report an error, request correction where appropriate and reach a human. Record the case, the reviewer’s decision and the corrective action for higher-impact workflows.

Make customer-facing AI and synthetic media clear

Audit websites, support channels, sales material, product demonstrations and social-media workflows. For EU-facing interactions, map each chatbot and generated-content process to the current Article 50 wording and Commission guidance rather than relying on a generic “AI may be used” footer.

Separate three questions in your review:

  1. Does a person need to be told that they are interacting with AI?
  2. Does generated or altered media need a visible label, a machine-readable mark or both?
  3. Are marketing statements about accuracy, savings, detection or autonomy supported by evidence for the actual product and conditions?

Use the least misleading disclosure that still meets the applicable rule. Preserve the approved text, placement, language versions and test screenshots so a later reviewer can see what users were told.

Substantiate AI claims and monitor U.S. developments

On July 1, 2026, the Federal Trade Commission announced a proposed policy statement on AI accuracy and opened comments through July 31, 2026. The cited release is a proposal and comment process, not a final rule. The FTC also states that the FTC Act prohibits businesses from engaging in “unfair or deceptive” conduct. Read the release at FTC Seeks Public Comment on Policy Statement Addressing AI Accuracy and consult current FTC Business Guidance before describing later action.

Practically, keep evidence for claims such as “detects,” “prevents,” “bias-free,” “fully autonomous” or quantified performance. Define the test population, conditions, error rates and limitations. If the evidence does not support a claim, narrow the wording or remove it. Do not advertise a vendor’s benchmark as your own real-world result.

  • The AI use register and approval owner.
  • Risk classification and the facts supporting it.
  • Vendor questionnaires, contracts, settings and review dates.
  • Staff instructions, training attendance and approved-use changes.
  • Test plans, representative results, known limitations and human-review procedures.
  • Customer notices, labels, machine-readable-marking decisions and accessibility checks.
  • Complaints, incidents, corrections, model changes and decisions to restrict or retire a tool.

Set a recurring review and an event-triggered review. Reassess when the model, vendor, data, users, market, business process or law changes. NIST’s statement that AI RMF 1.0 is under revision and the EU’s changing implementation material are reasons to monitor official sources rather than freeze a policy indefinitely.

A manageable 30-, 60- and 90-day rollout

Days 1–30: discover and contain

  1. Name an accountable owner and deputy.
  2. Survey departments, contractors and systems for current AI use, including unsanctioned tools.
  3. Create the register and flag high-consequence, sensitive-data and EU-facing uses.
  4. Publish interim rules: approved accounts, prohibited data, required human checks and incident reporting.
  5. Pause a use that cannot be explained, controlled or reviewed safely.

Days 31–60: assess and contract

  1. Complete purpose, role, geography and data assessments for each flagged use.
  2. Review vendor retention, training use, security, subprocessors, deletion and incident terms.
  3. Test consequential workflows with realistic edge cases and document failures.
  4. Draft customer notices, synthetic-content labels and correction or appeal procedures.
  5. Map EU-facing systems to Article 50 and high-risk guidance where relevant.

Days 61–90: operate and monitor

  1. Obtain management approval for residual risks and record any restrictions.
  2. Train users on the approved-use standard and run a short incident exercise.
  3. Turn on logging, review queues and periodic quality checks.
  4. Schedule official-source reviews, with an additional check before each new high-impact launch.
  5. Report metrics such as unresolved incidents, overdue vendor reviews, human overrides and correction time to the owner.

Choose a preparation approach by evidence, not fashion

Approach Best fit Strength Limitation
Basic inventory and approved-use policy Low-impact internal drafting, summarization or brainstorming Fast containment of shadow use and sensitive-data leakage Insufficient by itself for consequential decisions or regulated products
NIST-informed risk cycle U.S.-based firms wanting a repeatable governance structure Organizes govern, map, measure and manage work; supported by small-enterprise guidance Voluntary and not a legal safe harbor
EU-focused Article 50 review Businesses serving people in the EU or publishing synthetic content there Targets disclosure, labeling and machine-readable-marking questions Does not determine high-risk status or cover every jurisdiction
Formal high-impact assurance Systems affecting employment, eligibility, safety, essential services or regulated products Produces testing, oversight and evidence proportionate to potential harm Requires more specialist time, documentation and ongoing monitoring

Compare options using jurisdictional coverage, provider-versus-deployer role, likely harm, data sensitivity, implementation effort and evidence retained. Combining a simple inventory with targeted formal review is usually more defensible than applying an elaborate framework to every harmless experiment.

Common failure modes and fixes

“We are too small for the rules.”

Fix: classify the use and affected people first. Size may influence available support or proportionality, but it does not answer whether a particular obligation applies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The vendor handles compliance.”

Fix: document your own purpose, users, data, geography, human oversight and customer communications. Contractual assurances do not transfer every responsibility.

“The deadline is years away, so we can wait.”

Fix: separate August 2, 2026 transparency duties from the later category-specific high-risk dates. Build notices, labels, data controls and records now; they are operational changes, not last-minute paperwork.

“A human is in the loop, so the risk is solved.”

Fix: verify that the reviewer can understand, challenge and override the output, and that the process records corrections and escalations.

“A framework proves compliance.”

Fix: use NIST or another structured method to organize evidence, then perform the jurisdiction- and use-specific legal analysis separately.

The practical standard for a small business

By the time a regulator, customer or employee asks how an AI decision was made, the business should be able to identify the tool, owner, purpose, data, affected people, applicable geography, review steps, vendor terms and correction path. Maintain that record as the system changes, and revisit official EU, NIST and FTC material before a high-impact launch. This disciplined, proportionate process is the most durable preparation for rules that are still being implemented and revised.
