Contain the exposure, preserve evidence, determine exactly what happened, coordinate with the AI provider, and assess notification duties immediately. There is no single AI-breach deadline that applies everywhere. Your obligations depend on the affected people’s locations, the data involved, whether it was accessed or acquired, your industry, contracts, and the facts established during the investigation.

1. Stop further disclosure without destroying evidence

Activate your incident-response process as soon as a sensitive prompt, output, log, training dataset, connector, or administrative screen appears to expose information. Bring together security or IT, privacy and legal counsel, the business owner, operations, communications, management, and any specialists needed for the system involved.

First limit the path that is leaking data. Depending on the failure, that may mean disabling a public endpoint, removing a data source from retrieval, revoking a token, restricting a connector, pausing a workflow, narrowing permissions, or temporarily taking a feature out of service. Record who approved each change and the exact time.

Do not apply a blanket “turn everything off” rule. FTC breach guidance tells organizations to move quickly to secure systems and stop additional loss, while cautioning against powering down affected machines before forensic experts arrive. FTC small-business guidance similarly advises disconnecting an infected device without turning it off. Those instructions concern preservation of evidence on particular devices; an AI service, cloud tenant, or vendor-managed endpoint requires a containment decision with incident responders.

Assemble the right response team

  • Security and IT: isolate systems, preserve logs, review identities, and implement technical fixes.
  • Privacy and legal: classify the data, evaluate privilege and notification duties, and manage regulator or law-enforcement contact.
  • AI or product owner: explain prompts, model versions, retrieval sources, integrations, deployment changes, and normal behavior.

  • AI provider and other suppliers: preserve their records, investigate their infrastructure, and coordinate containment under the contract.

Open an incident record

Start a time-stamped record containing the discovery time, reporter, affected systems and accounts, actions taken, decision owners, provider contacts, and unanswered questions. Limit access to the record according to your legal and security requirements, but do not let confidentiality controls prevent the operational team from obtaining the facts it needs.

2. Preserve evidence and establish the scope

Before deleting a prompt, retraining a model, rotating every credential, or changing retention settings, consult your forensic lead. Preserve relevant evidence in a way that maintains chain of custody and protects personal information from additional exposure.

Capture the technical record

  • Relevant prompts, outputs, uploaded files, system instructions, and retrieval results, where collecting them is safe and lawful.
  • Identity, access, API, application, network, audit, and administrator logs for the AI service and connected systems.
  • Model, configuration, policy, plug-in, connector, and deployment-version history.
  • Data-flow diagrams showing sources, transformations, storage locations, exports, and downstream recipients.
  • Provider tickets, notices, status messages, contractual contacts, and statements about remediation.
  • Backups or forensic images needed to determine what was present before the fix.

Preserve the original evidence and analyze copies. Record any evidence that could not be collected, why it was unavailable, and who made that determination.

Answer the scope questions

The investigation should distinguish between information displayed to an unauthorized person, information technically accessed, information downloaded or copied, and information subsequently disclosed or misused. Determine:

  • What categories of data were involved, such as credentials, financial information, health information, identity data, confidential business material, or source code.
  • Whose information was involved and where those people or organizations are located.
  • Which accounts, roles, tenants, data stores, prompts, outputs, or integrations were exposed.
  • When the exposure began, how long it lasted, and whether it is still possible.
  • Who could access the material and whether there is evidence of acquisition, use, downloading, or onward disclosure.
  • Whether the issue arose from a model behavior, training or retrieval data, a prompt, an authorization error, a compromised credential, a vulnerable integration, a provider incident, or a business-process failure.

If your organization lacks the necessary capability, engage an independent digital-forensics investigator. Document the investigation’s methods, assumptions, findings, and confidence level; regulators and affected people may need a clear explanation of what is known and what remains uncertain.

3. Treat the AI service as a complete system

An AI interface is only one component of the exposure path. ICO AI-security guidance recommends a holistic view that includes the model, software components, data flows, organizational processes, and people using the system.

Map every component

Review the base model and fine-tuning data, retrieval or search indexes, vector stores, prompt templates, moderation layers, plug-ins, agents, APIs, identity systems, browser tools, file stores, monitoring platforms, analytics exports, and human approval steps. An apparently harmless answer may have drawn from a connected database, a cached transcript, an overly broad service account, or a vendor’s administrative environment.

Check provider responsibilities

Notify the AI provider through its security or incident channel and preserve the ticket number. Ask what systems, tenants, logs, retention settings, personnel, and subprocessors may be involved; whether the provider has isolated the path; what evidence it has preserved; and how it will test and document the fix. Review contractual notice periods, cooperation duties, audit rights, data-location terms, and allocation of responsibilities. Verify provider claims rather than treating a statement that a vulnerability is “fixed” as proof that exposure has ended.

4. Contain and remediate the underlying cause

Containment stops additional disclosure; remediation removes the condition that allowed it. Use the evidence to make targeted changes and then test them from an unauthorized-user perspective.

  1. Restrict access: remove unnecessary users, roles, service accounts, tokens, and public routes. Apply least privilege separately to humans, agents, connectors, and background jobs.
  2. Rotate credentials where appropriate: revoke exposed API keys, session tokens, passwords, certificates, and signing keys. Check for persistence or newly created accounts before declaring rotation complete.
  3. Correct configuration or code: fix tenant isolation, authorization checks, prompt-injection defenses, data filters, logging controls, retention settings, or vulnerable dependencies identified by the investigation.
  4. Review data minimization: remove sensitive fields that the AI workflow does not need, mask or tokenize identifiers, and reduce the amount and duration of retained content.
  5. Inspect segmentation and encryption: verify that retrieval indexes, object stores, backups, and exports are separated by tenant and protected in transit and at rest.
  6. Test the repair: use controlled test accounts and adversarial cases to confirm that one user, tenant, or agent cannot retrieve another’s data. Preserve the test results.
  7. Confirm with suppliers: obtain the provider’s description of changes, affected versions, validation tests, and any remaining customer actions.

Do not retrain, purge, or overwrite data solely to make an unwanted output disappear. Such actions can destroy evidence and may not remove copies from logs, backups, caches, exports, or a provider’s environment.

5. Assess notification and reporting duties by jurisdiction

Whether an AI exposure is legally reportable cannot be decided from the label “AI incident.” Make a written decision record covering your organization’s role, affected people’s locations, data categories and sensitivity, evidence of access or acquisition, likelihood and severity of harm, contracts, and sector rules. Obtain privacy counsel when the facts are uncertain or the organization lacks specialist expertise.

Situation What the cited guidance says How to use it
United States state and territorial laws FTC guidance states that every state, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands has breach-notification laws involving personal information. Requirements differ. Identify each affected person’s jurisdiction and apply its definition, thresholds, recipients, content, and timing. Other federal or sector rules may also apply.
Covered financial institution under the FTC Safeguards Rule FTC guidance dated December 2024 describes notice to the FTC as soon as possible and no later than 30 days after discovery of a qualifying notification event. This is a specific rule for covered institutions and qualifying events, not a general U.S. deadline. Confirm coverage and the event definition.
UK personal-data breach ICO guidance updated August 2025 says a breach likely to risk people’s rights and freedoms must be reported to the ICO within 72 hours of awareness, even if details are incomplete. If the risk is unlikely, ICO notification is not required under that guidance. People must be told without undue delay when risk to their rights and freedoms is high. Confirm the current rule while handling the case because the ICO page notes changes under the UK Data Use and Access Act and says the guidance is under review.
Electronic health records and health data FTC guidance flags that the FTC Health Breach Notification Rule or HIPAA Breach Notification Rule may apply, depending on coverage and facts. Determine whether the organization and service are covered and which rule, recipients, and deadlines govern.

These examples illustrate why “you have 72 hours” is not a universal answer. A regulator may accept an initial report with incomplete details where its rule allows that, but you still need a process for supplying updates. Keep the legal analysis, evidence, assumptions, and approval trail with the incident record.

6. Communicate with affected people accurately

Appoint a spokesperson and one operational owner for updates. Coordinate with counsel, the provider, and law enforcement where appropriate, but do not delay a required notice while waiting for a perfect forensic narrative.

A useful notice explains, in plain language:

  • What happened and when the organization detected it.
  • What information was involved, using meaningful categories rather than vague “personal data” wording.
  • What is known about access, acquisition, or misuse, and what remains under investigation.
  • What the organization has done to contain and remediate the issue.
  • What recipients should do now, tailored to the exposed data.
  • How to contact the organization and how legitimate future updates will be delivered.

Protect recipients from secondary harm. Do not publish exposed credentials, complete identity numbers, private prompts, or technical details that would help an attacker. Avoid claiming that no misuse occurred when the investigation only shows that misuse has not been detected. Explain uncertainty directly and update people when material facts change.

Depending on the data, protective steps may include changing a password that was reused elsewhere, enabling multifactor authentication, monitoring financial or health accounts, replacing compromised credentials, reviewing account activity, or being alert to targeted phishing. Give only actions relevant to the information involved, and make every support channel easy to verify independently.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Review the incident and prevent recurrence

After containment and required notifications, conduct a documented post-incident review. Ask why the AI workflow had access to the data, whether each field was necessary, whether permissions or tenant boundaries were too broad, why monitoring did or did not detect the exposure, and whether provider contracts supplied workable incident contacts and evidence access.

Controls to revisit

  • Data inventory, retention, deletion, masking, and minimization for prompts, outputs, indexes, logs, and backups.
  • Role-based access, service-account scope, tenant isolation, secrets management, and privileged-provider access.
  • Approval and testing for new models, connectors, plug-ins, agents, and prompt or policy changes.
  • Monitoring for abnormal retrieval, bulk exports, repeated probing, cross-tenant responses, and unusual administrator activity.
  • Incident playbooks covering cloud and provider-hosted AI services, not only employee devices.
  • Contract terms for breach notice, cooperation, audit evidence, subprocessors, retention, and deletion.
  • Training that teaches employees not to place unnecessary sensitive information into unapproved AI tools.

Covered financial institutions subject to the FTC Safeguards Rule should ensure their written incident-response plan addresses objectives, internal processes, roles and authority, communications, remediation, documentation and reporting, and a post-incident review. Other organizations can use the same structure to make ownership and follow-through explicit. NIST Special Publication 800-61 Revision 3, published in April 2025, is another current reference for organizing incident-response capability, but legal duties still come from the applicable law and regulator.

Operational checklist

  • Exposure path restricted and continued disclosure tested.
  • Incident team, provider contacts, counsel, and communications owner assigned.
  • Prompts, outputs, logs, configurations, versions, and provider records preserved.
  • Data categories, affected people, locations, duration, access, acquisition, and misuse assessed.
  • Credentials, permissions, connectors, segmentation, retention, and vulnerable code reviewed.
  • Jurisdictional, contractual, sector, and regulator-notification analysis documented.
  • Notices contain known facts, uncertainty, protective actions, contact details, and update method.
  • Remediation independently tested and the post-incident review completed.
