There is no single worldwide law governing every voyage carrying animals by sea. The applicable duties depend on the departure, transit and destination jurisdictions, the species, the commercial status of the movement and the law in force when the voyage occurs. The main international benchmark is the World Organisation for Animal Health (WOAH) Terrestrial Animal Health Code, Chapter 7.2. For journeys within the European Union or covered by its border controls, Council Regulation (EC) No 1/2005 is the central welfare instrument, supplemented for livestock vessels by Commission Implementing Regulation (EU) 2023/372.

Start with the route, not the vessel

Animal-welfare rules at sea are jurisdiction-specific. A voyage can involve the law of the departure country, transit or port-call countries, the destination country and, for some movements, regional rules that apply when animals enter or leave a trading bloc. International standards may guide authorities and operators without automatically being directly enforceable domestic law.

The European Commission describes Regulation (EC) No 1/2005 as regulating the transport of live vertebrate animals between EU Member States and providing for checks on animals entering or leaving the EU. That description does not make the regulation universal maritime law. Whether a particular export, import, transit or sea leg is covered requires a route-specific check of the current legislation and competent-authority guidance.

The EU framework: Regulation (EC) No 1/2005

The basic welfare duty

Article 3 establishes the core prohibition: “No person shall transport animals or cause animals to be transported in a way likely to cause injury or undue suffering to them.” The same article requires transport to be planned in advance so that the journey is as short as possible and the animals’ needs are met.

In practical terms, the parties arranging or conducting a covered movement must ensure that animals are fit to travel, transport equipment and loading facilities are suitable, handlers are trained or competent, the journey proceeds without unnecessary delay, and welfare is checked regularly. Space, height, water, feed and rest must be adequate for the animals and the journey conditions.

Planning, records and assigned duties

Regulation 1/2005 assigns duties to transporters and journey organisers rather than treating the ship as the only point of responsibility. Required documentation includes the animals’ origin and ownership, place of departure, departure date and time, intended destination and expected journey duration. Missing or inconsistent records can create a compliance problem even when onboard conditions appear acceptable.

Planning must cover the whole movement, including road travel to a port, loading delays, the sea passage, unloading and any onward journey. A plan that works only in calm weather is not adequate for a voyage exposed to foreseeable delays, heat, cold or mechanical problems.

Which vessels need EU approval?

Article 7(2) contains a specific trigger, not a universal rule for every animal or ship. For specified domestic equidae, cattle, sheep, goats and pigs, a livestock vessel must be inspected and approved before transport by sea for more than 10 nautical miles from a Community port. The species list and the distance trigger both matter.

The 10-nautical-mile threshold should not be turned into a blanket approval requirement for poultry, pets, wildlife, every vessel or every sea journey. Operators must first determine whether the animals fall within the listed categories and whether the voyage meets the geographic and distance conditions in the regulation.

Technical requirements in Annex I

Annex I supplies detailed conditions that sit beneath the general duty. Depending on the species and transport method, the requirements address:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • fitness to travel and conditions that make an animal unfit;
  • the design and maintenance of vessels, vehicles and containers;
  • air quality and ventilation;
  • safe access for inspection, feeding, watering and treatment;
  • floor area, headroom and stocking arrangements;
  • reliable water-supply systems and suitable feed; and
  • species-specific provisions and stated exceptions.

These provisions are not a one-size-fits-all checklist. Species, age, physical condition, weather and the design of the livestock deck can change what is required. A compliance review should therefore map each Annex I requirement to the animals and equipment actually being used.

Additional EU livestock-vessel controls from Regulation (EU) 2023/372

Commission Implementing Regulation (EU) 2023/372 supplements the general framework for livestock vessels. It sets out how competent authorities record, store and share written records of official controls. It also addresses emergency contingency plans, vessel-approval matters and minimum requirements for designated exit points.

EUR-Lex lists the instrument as in force, with partial application beginning on 1 January 2024. The practical effect is that compliance is not limited to conditions inside pens during the crossing. Authorities also examine how inspections are documented, whether an operator has a workable contingency plan, whether the vessel remains eligible for approval and whether the port infrastructure used as an exit point meets the minimum standard.

Because 2023/372 is a supplement, it does not replace the welfare duties in Regulation 1/2005. Its controls must be read together with the route, species and voyage conditions that determine which parts of the wider framework apply.

WOAH’s international standard for transport by sea

WOAH Terrestrial Animal Health Code Chapter 7.2 is titled “Transport of animals by sea.” It provides an international reference point for authorities and industry, covering journey planning, vessel selection, competent handlers, contingency planning, loading, food, water, ventilation, protection from weather, regular inspection and responses when problems arise.

The chapter treats welfare as a shared chain of responsibility. It states:

“Exporters, importers, owners of animals, business or buying/selling agents, shipping companies, masters of vessels and managers of facilities are jointly responsible for the general health of the animals and their fitness for the journey, and for their overall welfare during the journey, regardless of whether duties are subcontracted to other parties during transport.”

That approach matters when a shipper hires a carrier, a port hires a contractor or a vessel delegates feeding and inspection. Contracting out a task does not remove the shared responsibility described by the chapter. Each participant should know who makes decisions, who records checks and who acts when an animal becomes ill or a system fails.

WOAH standards are not automatically legislation in every country. Their legal effect depends on adoption or implementation through national or regional rules. WOAH’s January 2026 statement emphasizes implementation and enforcement, clear responsibilities, trained veterinary services and staff, adequate infrastructure, monitoring, communication and coordination. It is a policy statement and implementation message, not a substitute for the law governing a particular voyage.

What operators must control during a sea journey

Fitness before loading

Animals should be assessed before they reach the ramp. Injuries, weakness, disease, advanced pregnancy, inability to walk normally or other conditions can make transport unlawful or unsafe. The assessment must reflect the species and the planned duration, not merely whether an animal can be moved into a pen.

Loading and accommodation

Loading areas, ramps, doors and decks must allow animals to be moved without avoidable injury. Onboard accommodation needs enough floor space and headroom, secure surfaces, appropriate grouping and access for inspection. Containers or compartments must be designed and maintained for the animals being carried.

Air, temperature and weather protection

Ventilation and air quality must remain suitable throughout the voyage. Weather protection is part of welfare planning: the vessel and its operating plan should account for heat, cold, spray, wind and other foreseeable conditions. A contingency plan should specify what happens if ventilation, power, pumps or climate-control equipment fails.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Water, feed and rest

Water and feed must be available at suitable intervals and in forms the animals can use. Supply systems should be checked, replenished and protected from contamination. Rest periods and journey timing must be planned around the animals’ needs and the applicable species-specific rules, including any inland portions before or after the sea leg.

Inspection and response

Animals require regular inspection, with access sufficient to identify illness, injury, overcrowding, dehydration or equipment problems. The response plan should identify who can isolate an animal, provide treatment, obtain veterinary help, adjust ventilation or water, and notify the competent authority. Records should show what was observed, when it was observed and what action followed.

Who is responsible?

Responsibility is distributed across the transport chain. Depending on the rule and the task, relevant parties include exporters, importers, animal owners, buying or selling agents, journey organisers, transporters, shipping companies, vessel masters, handlers, port and exit-point managers and facility operators. Authorities responsible for approval and official controls have their own inspection and record-keeping duties.

A written contract can allocate work, but it should not be used to create gaps in accountability. The operating plan should name the decision-maker for fitness determinations, loading, water and feed, inspections, veterinary escalation, delays and emergencies.

How the EU and WOAH approaches differ

Comparison point EU Regulation 1/2005 and 2023/372 WOAH Chapter 7.2
Geographic reach Applies according to EU territorial and border-control rules; coverage depends on the journey and current law. International standard intended to guide national and regional systems; direct legal force depends on implementation.
Species and exemptions Regulation 1/2005 covers live vertebrates within its scope, with species-specific provisions and exceptions in the text and annexes. Provides sea-transport recommendations that must be applied with the relevant species and national requirements.
Vessel approval For specified domestic equidae, cattle, sheep, goats and pigs, approval is required for sea transport over 10 nautical miles from a Community port. Calls for appropriate vessel selection and competent oversight but does not create that EU distance trigger.
Operational controls Sets enforceable duties on planning, fitness, equipment, handlers, monitoring, space, water, feed and documentation; 2023/372 adds official-control records, contingency plans and exit-point requirements. Addresses planning, loading, food, water, ventilation, weather protection, inspection and responses to problems.
Responsibility Places duties on transporters, organisers and other regulated participants, with official controls by competent authorities. Expressly describes shared responsibility among exporters, importers, owners, agents, shipping companies, masters and facility managers.

A practical compliance workflow for a planned voyage

  1. Map the journey. List every port, inland leg, border crossing, transfer and destination, then identify which authority has jurisdiction at each point.
  2. Classify the movement. Record species, age or category, number of animals, ownership, commercial status and whether any exemption or special provision may apply.
  3. Confirm the governing texts. Check the current national rules, EU provisions where relevant, port requirements and any incorporated WOAH-based standards. Do not rely on an old summary when the sailing date is months away.
  4. Check vessel status. Determine whether the ship is a livestock vessel and whether the EU approval trigger for the listed species and more-than-10-nautical-mile voyage is met. Verify approval before booking loading.
  5. Assess fitness and facilities. Arrange competent pre-loading assessments, inspect ramps and pens, calculate space and headroom, and verify ventilation, water and feed capacity for the planned duration and weather.
  6. Prepare documents. Include origin and ownership, departure place and time, destination and expected duration, along with permits, certificates and inspection records required by the route.
  7. Write and test the contingency plan. Cover delays, storms, equipment failure, loss of power or water, illness, injury, refusal to unload and emergency veterinary care. Assign names or roles, contact methods and escalation times.
  8. Run the voyage log. Record loading, inspections, water and feed checks, environmental conditions, incidents and corrective actions. Keep records in the format and retention system required by the competent authority.
  9. Review after unloading. Document problems, animal outcomes, delays and equipment failures, then update the plan before the next voyage.

Enforcement, evidence and changing law

Official controls can occur before departure, during port operations, at vessel approval inspections and when animals enter or leave the EU. Regulation 2023/372 specifically concerns the recording, storage and sharing of written control records, so an operator should be able to produce a coherent audit trail rather than isolated forms.

The Commission has reported work on a broader revision of EU animal-welfare legislation, including transport. Proposals and amendments can change before adoption. For a real voyage, verify the current consolidated EUR-Lex text and the competent authorities’ instructions immediately before relying on a particular requirement, especially an approval, inspection or exit-point rule.

Country-by-country veterinary certificates, customs procedures and species-specific operating instructions are not identical and cannot be inferred from the general framework. They require the route, species, commercial status and timing to be checked together.
