Yes, recreational fishing can be legal in a marine protected area (MPA), but the designation alone does not tell you what you may keep. You must identify the exact MPA and zone, confirm whether extractive fishing is allowed, and then meet every current rule for the species, season, minimum size, bag and possession limit, gear, license, permit, and reporting. A no-take marine reserve normally prohibits removing fish and other marine life.
Rules can change at a boundary, between zones in the same site, or between state and federal waters. Use the managing agency’s current map and regulations immediately before your trip.
What “marine protected area” means for an angler
NOAA’s National Marine Protected Areas Center defines an MPA as any area of the marine environment that has been reserved by federal, state, territorial, tribal, or local laws or regulations to provide lasting protection for part or all of the natural and cultural resources therein.
That definition covers a wide range of places: multiple-use areas, national marine sanctuaries, wildlife refuges, fishery closures, seasonal management zones, and fully protected reserves.
Consequently, “MPA” is not a fishing status. NOAA’s FAQ says, There are many types of Marine Protected Areas in the United States, and most do not prohibit fishing and recreational uses throughout their boundaries.
NOAA Ocean Service likewise says nearly all U.S. MPAs allow multiple uses, including fishing, although a marine reserve can prohibit catching or removing fish and other resources.

The national picture shows why the label can mislead. A 2026 NOAA Ocean Service page reports more than 1,600 U.S. MPAs and about 41% of U.S. marine waters protected in some way, while roughly 3% is in highly protected no-take MPAs. A 2011 National MPA Center analysis found that 86% of U.S. MPAs were multiple-use, covering 97% of MPA area; no-take MPAs represented less than 3% of MPA area and about 1% of U.S. waters. These are nationwide statistics, not permission for any particular site.
Protection levels and what they usually allow
The exact regulation controls, but the following framework helps you interpret a site’s designation. A single named MPA may contain several zones, so read the zone rule rather than relying on the site name.
| Protection level | Typical fishing rule | What to verify |
|---|---|---|
| Multiple-use area | Hook-and-line or other specified recreational fishing may be allowed. | Allowed species, legal gear, seasons, size and bag limits, and any closed subzones. |
| Gear-restricted area | Fishing may continue only with permitted methods; bottom-contact gear, traps, nets, or spearfishing may be banned. | Gear definitions, anchoring restrictions, and whether possession of prohibited gear is allowed while transiting. |
| Seasonal or species closure | Fishing or retention is prohibited during a stated period or for listed species. | Opening and closing times, stock area, and whether catch-and-release is allowed. |
| Marine reserve or no-take zone | Extractive fishing and removal of marine life are generally prohibited. | Whether transit, anchoring, or possession of gear has separate rules. |
How to determine what you may keep
Use this sequence for every trip. It prevents the common mistake of checking only a species limit while overlooking a local closure or gear ban.

Locate the exact boundary and zone
Open the current map from the agency that manages the site, and compare it with your chart or navigation display. Confirm coordinates, boundary lines, shoreward and seaward limits, and any internal zones. A point that appears outside a sanctuary may be inside a state reserve, and a named MPA can contain both fishing and no-take areas.

Read the site-specific activity rule
Look for the words that govern extraction: “take,” “harvest,” “possession,” “fishing,” “spearfishing,” “commercial,” and “recreational.” Determine whether the rule bans all fishing, only certain methods, or only removal of specified species. If the rule is silent, do not assume silence means permission; obtain clarification from the managing agency.
-
Identify the water jurisdiction
State rules generally apply in state waters, commonly from shore to 0–3 nautical miles, although the precise boundary varies by state and location. Federal fishery rules apply beyond state jurisdiction and can also affect federally managed species nearer shore. Check both sets when a trip crosses the boundary.
-
Check the target species and stock area
Regional rules can prohibit retention of a species even where fishing is allowed. They may distinguish stocks, management areas, or vessel categories. NOAA Fisheries explains that the eight regional fishery management councils establish measures such as seasons, size limits, and bag limits, which NOAA Fisheries then implements.

Confirm season, minimum size, and bag or possession limit
Read the current rule for the date of your trip. “Bag limit” commonly describes the number an angler may take in a day; “possession limit” can govern the number carried, stored, or landed. A possession limit may apply aboard a vessel even when fish were caught elsewhere. Measure fish with the method specified by the rule, such as fork length or total length.

-
Verify legal gear and method
Check whether hook-and-line, trolling, hand gathering, traps, bottom-contact tackle, or spearfishing is allowed. Some MPAs allow a species to be taken but prohibit the gear normally used for it. Rules can also restrict whether a prohibited device may be carried, deployed, or merely possessed in a zone.
-
Check licenses, permits, and reporting
Obtain the state fishing license required for the waters you will fish. A federal permit may be required for highly migratory species or for Hawaii bottomfish, among other fisheries. Some programs require a landing report, vessel report, or electronic harvest record even when the general license is valid. Keep proof of authorization available for inspection.
-
Recheck immediately before departure
Closures, emergency orders, quotas, and boundary notices can change after you plan a trip. NOAA specifically warns that regulations can change and that state rules may be more restrictive than federal rules. Save or print the current regulation page, and note the effective date and time.

There is no nationwide MPA catch list
An unspecified MPA has no universal list of fish that recreational anglers may keep. The legally retainable catch is the intersection of the site’s zone rule and the current regional species regulations. If either source prohibits retention, you cannot keep the fish.

NOAA’s Greater Atlantic materials illustrate the complexity. Atlantic cod has a limited open season and minimum-size requirements in some stock areas, while the Southern New England stock area can show “NO RETENTION ALLOWED.” The same regional materials list Atlantic salmon, sea scallop, ocean pout, red drum, several skate species, striped bass in federal waters, sturgeon, windowpane flounder, and wolffish as having no recreational fishing allowed in the listed contexts. Those entries are regional examples, not rules for every U.S. MPA or every state water.
| Question to answer | Why it matters | Where the answer comes from |
|---|---|---|
| Is this exact zone open to recreational take? | A multiple-use designation may still contain a closed subzone. | MPA managing agency’s map and regulations. |
| Is my species legal to retain here? | Species closures can apply inside an otherwise open fishing area. | Current state and regional fishery rules. |
| Is the fish in season and large enough? | Open waters do not override seasonal, size, or quota limits. | Current species regulation for the stock area. |
| Am I within the bag and possession limits? | Limits can differ for private and for-hire vessels or by jurisdiction. | State or federal rule applicable to the trip. |
| Is my method legal? | An MPA may permit a species but ban the gear used to catch it. | Zone-specific gear provision and fishery regulation. |
| Do I need a license, permit, or report? | A general license may not cover a federally managed or specially regulated fishery. | State fish-and-wildlife agency and NOAA Fisheries. |
Transit, anchoring, and carrying fish through an MPA
Fishing and transit are often regulated separately. A rule may allow a vessel to pass through with legally caught fish aboard while banning fishing or gear deployment inside the zone. Transit permission does not authorize you to catch, retain, transfer, or land additional fish there.
California’s 2026 example
California’s 2026 Ocean Sport Fishing Regulations demonstrate how detailed these distinctions can be. A vessel may transit a state marine reserve with catch onboard, but it may not deploy fishing gear while transiting the reserve. In state marine parks, conservation areas, and recreational management areas, only gear used for species identified as allowed for take may be deployed.
Spearfishing gear must be unloaded and not carried in hand when transiting an area that prohibits spearfishing or where the species aboard is not allowed. Anchoring is generally allowed with catch onboard unless an area-specific rule says otherwise; whether gear may be deployed while anchored depends on the area’s classification and the listed species. This California example cannot be exported to another state, but it shows why “I am only passing through” is not a complete legal answer.

Licensing and permits: state versus federal waters
For state-water fishing, follow the license requirements of the state fish-and-wildlife agency that manages those waters. The commonly used 0–3-nautical-mile description is a starting point, not a substitute for the state’s boundary definition. A saltwater license, registration, or special endorsement may be required even if you fish from a private boat and release everything.
Federal waters can add species-specific permits, vessel permits, reporting duties, or area restrictions. Highly migratory species are a common example; Hawaii bottomfish can also require federal authorization. A charter passenger may be covered by a for-hire vessel’s authorization in some fisheries, while a private angler may need an individual license or permit. Confirm which person or vessel must hold the authorization before departure.
Common mistakes and how to avoid them
- Assuming “protected” means “closed” or “open.” Read the zone’s activity table. The designation describes a conservation purpose, not a single fishing rule.
- Using a sanctuary-wide map without checking internal zones. Zoom to the exact boundary and carry the coordinates into your chart plotter.
- Checking only the MPA rule. A site can allow fishing while a regional rule bans retention of your target species or imposes a size, season, or possession limit.
- Confusing catch-and-release with unrestricted fishing. A no-take rule may prohibit hooking, possession, or any extractive gear, not merely keeping the fish.
- Leaving prohibited gear ready for use. Some zones regulate deployment, carriage, unloading, or hand-carrying of spearfishing equipment separately.
- Relying on last year’s booklet. Emergency closures and annual changes can make an older summary inaccurate. Check the effective date on the current notice.
- Forgetting the vessel’s total possession. Count fish already stored aboard when a possession limit applies, regardless of which angler caught them or where they were caught.
- Assuming a neighboring state has the same rule. State boundaries, license systems, and conservation classifications differ even along one coastline.
Why MPAs can allow fishing while protecting resources
Multiple-use MPAs are designed to protect particular habitats, cultural resources, or vulnerable species while allowing compatible activities under controls. Limits on season, size, gear, or catch can reduce pressure without banning every form of recreation. No-take reserves use a stricter approach by removing extraction from the protected area.

The National MPA Center reported that fishing was allowed in 98% of the sanctuary. During 2007–08, more than 400,000 visitors and residents made over 2 million recreational-sport-fishing person-days and spent $262 million in Monroe County, including about $103 million on fishing items, bait, lines, and charter fees. A practical pre-trip checklist
Complete this checklist for each planned location, including every waypoint where you might stop, anchor, or fish:
- Record the MPA name, managing agency, exact coordinates, and zone classification.
- Confirm whether recreational extraction is allowed, restricted to certain methods, seasonal, or prohibited.
- List each target species and check its current stock-area rule.
- Write down the open season, minimum measurement, daily bag limit, and vessel or personal possession limit.
- Confirm the approved hook, line, lure, trap, net, or spear method and any gear-carriage restriction.
- Verify state licenses, federal permits, vessel authorizations, endorsements, and reporting requirements.
- Plan how you will measure, mark, store, and document legal fish on board.
- Check for emergency closures or rule changes on the day you leave.
- If transiting a closed zone, stow or unload gear exactly as that zone requires and do not deploy it until outside the boundary.
What to do when the rule is unclear
Do not resolve an ambiguity by relying on a forum post, an old chart, or another angler’s interpretation. Contact the managing agency or the relevant state fish-and-wildlife office with the MPA name, coordinates, date, species, gear, and whether you plan to fish, anchor, or transit. Ask for the current written rule or regulation number, and keep the response with your trip records.
If two rules appear to conflict, follow the more restrictive requirement until the agency clarifies which rule governs. A state rule can be stricter than a federal baseline, and an MPA-specific provision can be stricter than the general recreational season. When in doubt, do not deploy gear or retain the fish.
