Real-time bidding (RTB) is the automated auction used to decide which advertisement appears in a particular ad slot. A publisher offers an impression, an ad exchange sends a bid request to potential buyers, algorithms return bids within milliseconds, and the winning ad is displayed. The privacy risk is that the bid request may be sent to many companies—including companies that lose the auction—so personal data can travel beyond the advertiser whose ad you actually see.
What is real-time bidding?
RTB is a collection of technologies and business practices within programmatic advertising. When a website or app has an advertising space to fill, it can offer that single opportunity through an ad exchange or supply-side platform. Advertisers, demand-side platforms, data companies and other intermediaries evaluate the opportunity automatically and submit bids. The auction normally finishes in the short interval before the page or app displays the advertisement.
The auction concerns one impression, not a general promise to show advertising to everyone who visits a site. A buyer may decide that a particular impression is valuable because of the device, app, approximate or precise location, content, time, or characteristics associated with the person who could receive the ad. The fields available to bidders differ by auction, publisher, device and market; no single bid request contains every possible data type.
The Federal Trade Commission (FTC) describes these broadcasts as occurring in milliseconds. That speed makes it difficult for an ordinary user to see how much information is collected at the moment an ad loads or how many participants receive it.

How an RTB auction works, step by step
- A publisher creates an impression. A website or app reaches a point where an advertising slot is available. The publisher or its ad server decides that the slot can be offered programmatically.
- An exchange prepares a bid request. The request describes the opportunity and may contain information about the device or person who could receive the ad. It can also include technical details needed to deliver the winning creative.
- The request is distributed. The exchange sends the request to prospective buyers and intermediaries. The FTC says an auction can broadcast data to potentially dozens of bidders, although the exact number varies.
- Automated systems evaluate the impression. Each buyer compares the request with its campaign rules, audience segments, budget and expected value. A buyer can decline to bid or return a price and creative instructions.
- The auction selects a winner. The exchange or related platform applies its auction rules and chooses the bid that qualifies to win. Only one buyer normally obtains the opportunity to serve the ad.
- The ad is delivered. The winning creative is passed back through the ad-delivery chain and appears in the slot. Other bidders may already have received the bid-request data even though their bids lost.
This sequence explains why the privacy question is broader than “which company showed me the ad?” The data-sharing event begins when the request is broadcast, before the winner is known.
How can RTB expose personal data?
A bid request may include information that identifies or describes a device, an account, a location or a potential audience member. The FTC gives location and personal characteristics as examples. It also discusses precise location, app names and unique mobile identifiers as sensitive information that companies may collect or use. Whether any of these fields appears depends on the particular implementation; their presence should not be assumed in every auction.
| Possible information category | What it can tell a bidder | Important qualification |
|---|---|---|
| Location | Where a device is, or an area associated with an impression | Precision and availability vary; a request may contain no location or only a broad area. |
| App or site name | Which digital service is presenting the ad | An app name can provide context about the environment, but it does not by itself prove who is using the device. |
| Unique mobile or advertising identifiers | A way to recognize a device or advertising profile across requests | Identifier availability and controls differ by operating system, app and jurisdiction. |
| Personal characteristics or audience attributes | Signals used to decide whether an impression matches a campaign | The exact attributes and their accuracy are not established for every request. |
| Technical and auction details | Information needed to select, price and deliver an ad | Technical fields can become more revealing when combined with identifiers or location. |
Even a field that looks harmless in isolation can become more revealing when combined with other data. A recurring identifier, a sequence of locations and the names of apps or sites can create a detailed behavioral picture without the person ever entering those details into an advertising form.

Potential recipients can include the exchange, the publisher’s ad-tech partners, demand-side platforms, advertising agencies, data providers and individual advertisers. The chain differs by auction. Some participants may process the request only to decide whether to bid; others may be able to store it, match it with an existing profile or use it for later analysis, subject to their own policies and legal obligations.
The number of recipients matters because the winning advertiser is not the only party that can see the request. The FTC says auctions can broadcast user data to potentially dozens of bidders even though only one wins the impression. A losing bidder can therefore receive information without displaying anything on the screen.
That does not mean every bidder keeps or misuses every field. It means the auction architecture can distribute data to more parties than a user would reasonably infer from looking at the ad. The privacy assessment must ask who received the request, for which purpose, for how long, and whether a non-winning participant retained it.

What sensitive inferences can location enable?
Precise location can reveal or suggest that a device visited a healthcare facility, church, labor union, military installation or another sensitive place. Repeated visits may allow a company to infer an association or interest. Such an inference is not proof of a person’s identity, religious belief, health condition or union membership: a device may be shared, location may be inaccurate, and the reason for a visit may be unknown.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →The risk comes from combining many signals over time. A single impression might indicate only that a device was near a place. A retained series of bid requests can map movements, routines and visits to categories of locations. The FTC’s discussion of precise location and mobile identifiers is why regulators treat some RTB data as potentially sensitive rather than as ordinary anonymous statistics.
Why retention by losing bidders is a concern
Winning an auction does not define all subsequent data use. A participant that lost the impression may still have received the request. If it stores the record, the data can remain available after the advertisement disappears and may be joined with other information.
In its December 2024 article about Mobilewalla, the FTC discussed allegations that the company collected and retained auction-derived data, including information from auctions it lost. Those are allegations described in an FTC enforcement matter, not a finding that every exchange or bidder behaves that way. The example illustrates the specific control problem: a person cannot assume that a company which did not show the ad never received the associated request.
Retention questions should be concrete: does a participant keep raw requests, identifiers or location; does it aggregate or delete them; how quickly does deletion occur; can data from lost bids be used for profiling; and are records shared with additional partners? Auction documentation and privacy notices do not always make these answers easy for an individual to verify.

The UK’s 2019 ICO findings
The Information Commissioner’s Office (ICO) reported concerns about transparency and consent in its June 2019 update on adtech and RTB. The report said RTB protocols contained fields that could constitute special-category data and analyzed the need for explicit consent when such data is processed under the GDPR framework. Those statements describe the ICO’s position at that time; they are not a universal rule for every country or every auction today.

A separate ICO summary of its 6 March 2019 adtech Fact Finding Forum recorded concerns that publishers using an industry consent framework could not practically validate the operations and processing of every listed vendor. That is what the forum report recorded, not a current audit of every participant or framework deployment.
Current UK online-advertising guidance
In guidance accessed on 13 October 2026, the ICO says UK online-advertising uses of storage and access technologies require consent. It also says people should be told who their data will be shared with, why it will be shared and how they can exercise control. The guidance indicates that consent must cover third-party sharing across the advertising chain. These requirements concern the UK legal context and do not automatically apply to every country or to every processing operation.
GDPR legal bases are context-dependent
The European Data Protection Board lists six GDPR legal bases: consent, contract, legal obligation, vital interests, public task and legitimate interests. The list does not decide which basis is available for a particular RTB flow. The appropriate basis depends on the data, purpose, parties, safeguards and circumstances of the processing. A company cannot establish compliance merely by naming one basis in a policy.

TCF, OpenRTB and the EU case summary
An official European Union case summary concerning IAB Europe’s Transparency and Consent Framework (TCF) and OpenRTB discusses GDPR issues in the context of real-time profile auctions. The existence or adoption of a framework does not prove that every participant’s processing is lawful. Technical compatibility can help transmit choices, but it cannot by itself verify every vendor’s purposes, retention practices or legal basis.
What the ICO’s survey figures do—and do not—show
The ICO’s 2019 forum summary reported Harris-commissioned research involving 2,300 participants. The figures are historical and should not be treated as current, worldwide population estimates.
| Reported result | How to interpret it |
|---|---|
| 54% said they would rather see relevant ads. | This measures a preference for relevance in that survey, not blanket approval of every data practice used to produce targeted ads. |
| 63% said it was acceptable for adverts to fund content. | This concerns advertising as a way to support content and does not establish consent to sharing data with every vendor. |
| 36% agreed that RTB was okay after receiving a simple explanation. | The report presents this as a before/after framing. It is not a direct measure of all consumers’ attitudes or a current approval rate. |
The same forum included a suggestion of more than a billion bid-request broadcasts per day. That was a statement recorded at the forum, not a measured ICO statistic, so it should not be presented as an established count.

RTB compared with contextual or non-personalised advertising
Contextual advertising selects an ad based primarily on the content or setting of a page or app rather than a profile built from a person’s observed behavior. “Non-personalised” can mean different things in different products, so the label alone does not answer every privacy question. The useful comparison is the data flow.
| Privacy question | RTB | Contextual or non-personalised approach |
|---|---|---|
| Is a person-level profile created or used? | May use identifiers, audience segments or inferred characteristics; the implementation determines this. | May rely mainly on page or app context, but the product must be checked for additional identifiers or measurement. |
| Which attributes enter the request? | May include location, app name, identifiers and personal characteristics. | Often needs contextual information, yet the exact request fields are implementation-specific. |
| How many parties receive data? | Potentially many bidders and intermediaries can receive a broadcast before one wins. | Can involve fewer parties, but the actual vendor chain and measurement tools determine the exposure. |
| What can non-winning parties retain? | A losing bidder may receive and potentially retain auction data; retention policies must be verified. | Retention depends on the systems used; “contextual” is not a guarantee of immediate deletion. |
| What consent and controls apply? | They depend on jurisdiction, identifiers, purposes and the parties involved. | They also depend on the implementation and applicable law; a different targeting method does not remove all obligations. |
| Does targeting depend on cross-site or cross-app observation? | It can, when identifiers or profiles are used. | It may not, but measurement or frequency-control systems can introduce additional tracking. |
The cited regulatory materials do not establish a universal performance advantage for either approach. They support examining data flows, recipients, retention and user choice rather than assuming that an advertising label settles the privacy question.

Questions for people using websites and apps
- Which companies are listed as advertising or measurement partners?
- Does the consent interface explain purposes separately, or does one control cover a long list of vendors?
- Does the notice say whether location, app activity or advertising identifiers are used?
- Can you refuse targeted advertising while still accessing the service, and is the choice recorded for third-party sharing?
- Can you later withdraw or change the choice, and is there a clear way to do so?
These questions help you understand the chain, but no single purchase, subscription or setting can be claimed to eliminate all RTB exposure. Different websites, apps and jurisdictions can make different choices about partners and controls.
Checks for publishers and ad-tech teams
- Map every recipient of a bid request, including vendors that do not win.
- List each field sent, its purpose, its sensitivity and whether it is necessary for the auction.
- Set retention and deletion limits for raw requests, identifiers, location and logs.
- Verify that consent signals cover every third-party disclosure and are honored downstream.
- Document how vendors use, combine, secure and delete auction data.
- Test whether a user can understand the recipients and purposes before making a choice.
A compliance assessment should examine the actual OpenRTB implementation, contracts, logs and vendor behavior rather than relying only on a framework name or a generic privacy statement.
Common misunderstandings about RTB
“The advertiser that showed the ad is the only company that saw my data.”
Not necessarily. The request can be broadcast to many prospective bidders before the winner is selected.
“A losing bid means the company received nothing.”
Not necessarily. A bidder may receive the request while deciding whether to bid, even if its price is rejected.

“A location signal proves a person’s diagnosis or beliefs.”
No. Location can reveal or suggest visits to sensitive places, but an inference is not proof of identity, belief, health status or intent.
“Using a consent framework proves that every participant is compliant.”
No. Frameworks can transmit choices and standardize signals, but they do not by themselves validate every participant’s purposes, legal basis or retention.
“The ICO’s 2019 percentages describe consumers today.”
No. They are results from a Harris-commissioned survey of 2,300 participants reported in 2019, not current global estimates.

The practical takeaway
RTB turns each ad impression into a rapid, multi-party data exchange. The central privacy issue is not merely that an ad is targeted; it is that a bid request may contain personal or sensitive signals and may be sent to numerous potential buyers, including companies that lose the auction. Precise location can support sensitive inferences, and retained records can extend the impact beyond the milliseconds in which the ad appears.
Assessing an RTB system therefore requires looking at the entire chain: fields in the request, every recipient, the purposes for processing, retention after a lost bid, and the consent and control mechanisms required in the applicable jurisdiction. Regulatory statements from the FTC, ICO, EDPB and European Union materials provide important warnings, but none should be stretched into a worldwide rule covering every implementation.
