Being able to read or download a research paper does not automatically give you permission to use it with AI. The controlling answer depends on the paper’s article-level licence, the publisher’s current text-and-data-mining (TDM) or AI policy, your subscription or institutional agreement, the purpose of your project, and any written permission. Training a model, creating embeddings, running retrieval-augmented generation (RAG), and providing an AI service are separate uses that may carry different conditions.
This guide explains how to determine what you can do, with particular attention to subscription content, gold open access (OA), non-commercial research, and commercial products. Publisher policies describe contractual positions; they do not by themselves settle copyright exceptions or enforceability in every country.
Access and reuse are separate legal checks
A subscription login, library download, or API response answers an access question: can you lawfully obtain the content? It does not answer the reuse question: may you copy, extract, store, transform, expose, or use that content to build an AI system?
AI workflows usually create several copies or derivatives. A crawler may copy article text for analysis; a training pipeline may retain statistical information from that text; an embedding service stores numerical representations; a RAG application may retrieve passages and show them to users. A licence can allow one activity while restricting another. It can also limit who may access the resulting dataset, how long it may be retained, whether outputs can reproduce source text, and whether a competing service is created.

Publisher terms are not universal law. They are evidence of a particular publisher’s contractual and licensing position. Copyright exceptions, database rights, privacy, confidentiality, funder mandates, repository terms, authors’ retained rights, and third-party images or datasets can change the analysis for a specific project and jurisdiction.
Four questions to answer before using a paper with AI
- What exact content and version are you using? Record the article title, DOI, version of record or accepted manuscript, publication page, and every licence notice. Read credit lines for figures, photographs, tables, data, and other third-party material.
- How did you obtain it? Identify whether access is through a personal subscription, an institutional subscription, a repository, a publisher API, or an open-access agreement. The institution’s contract may add conditions to the publisher’s public policy.
- What precisely will the system do? Distinguish searching and TDM, model pre-training, fine-tuning, evaluation, embedding storage, RAG retrieval, internal teaching, or an externally available service. “AI use” is too broad to approve a project responsibly.
- Which document grants permission? Compare the article licence, the publisher’s current AI/TDM policy, the institutional subscription or data licence, and any separate written agreement. If they conflict, follow the more restrictive requirement unless a superior written agreement clearly governs.
Can AI use paywalled research papers?
Sometimes, but a paywall is neither a blanket prohibition nor a blanket permission. Several publishers describe non-commercial TDM routes for users with lawful subscription access, while requiring a separate licence for commercial AI use. A subscription may also prohibit systematic downloading, redistribution, or making the content available to people outside the subscribing institution.
Commercial use includes more than selling a downloadable copy. A paid search product, hosted RAG service, model offered to customers, or internal corporate system used to deliver a commercial service may all require additional rights. The relevant policy may also restrict outputs that compete with or substitute for the publisher’s products.

Does open access mean AI can use the paper?
No. “Open access” describes how readers can access an article, not every possible reuse. Gold OA articles normally carry an article-level Creative Commons licence under an open-access agreement. The exact licence controls AI reuse.
For example, a CC BY licence generally permits commercial and non-commercial reuse subject to its conditions, including attribution and indication of changes. A non-commercial licence limits use to non-commercial purposes, and a no-derivatives licence can restrict distributing adaptations. A paper may also contain third-party material excluded from the article’s licence. Check each credit line rather than assuming the article’s headline licence covers every component.
Open access also does not erase publisher rules about systematic extraction, machine-accessible resources, external exposure, or technical safeguards. Read the publisher policy alongside the Creative Commons notice and your project’s intended outputs.

What major publisher policies say
The following positions are publisher-specific examples, not a general rule for all journals. Policies can change, and a signed agreement may override a standard web page.

How each AI activity changes the permission analysis
Text and data mining
TDM usually means automated extraction and analysis of machine-readable content to discover patterns, facts, or relationships. A policy may allow it for non-commercial research through an API while prohibiting bulk downloading or redistribution. Use the approved delivery method, authenticate with the entitled institution, respect rate limits, and preserve access controls.
Training and fine-tuning
Training can involve copying entire corpora into a pipeline and retaining model parameters after the source files are deleted. Do not assume that a policy mentioning TDM also authorises training. Wiley, Springer Nature, and other publishers describe explicit permission requirements or restrictions for training, while some subscription policies distinguish non-commercial research from commercial development. Edward Elgar Publishing states: “Technically, a model cannot be untrained on specific inputs.” That is programme guidance about a technical limitation, not a universal legal conclusion; licensing should address retention, deletion, audit, and downstream use before training starts.

Embeddings and RAG
RAG commonly stores chunks or embeddings in a vector database and returns retrieved passages at query time. Permission may be needed for the source copy, the embedding store, the audience that can query it, and the displayed output. A licence that allows an internal research assistant may not allow a public chatbot. Check whether verbatim excerpts, systematic retrieval, external users, and storage after licence termination are permitted.
External services and outputs
Putting a model or retrieval system behind an API can expose publisher content to customers or partners, even if the underlying files remain on your servers. Policies may prohibit third-party access, competing services, resale of datasets, or outputs that substitute for the publisher’s platform. Attribution requirements should be implemented in the interface and in exported answers, and output filters should prevent substantial verbatim reproduction where required.
Step-by-step permission workflow
- Capture the source record. Save the article URL, DOI, version, licence text, publication date, and third-party credit notices.
- Classify access. Note whether the copy came from a subscription, institutional agreement, repository, API, or gold OA route, and identify the institution or account that provides entitlement.
- Write a one-sentence use description. State the corpus size, activity (TDM, training, fine-tuning, RAG, embeddings, evaluation), users, commercial status, geography, retention period, and intended outputs.
- Read governing terms. Check the article licence, publisher AI/TDM policy, institutional subscription or data licence, API terms, and any funder or repository conditions.
- Request written permission when required. Ask for explicit coverage of training or RAG, commercial or non-commercial status, external users, storage, attribution, output limits, sublicensing, audit rights, duration, and deletion at termination.
- Implement controls before ingesting content. Use access-controlled storage, provenance records, deletion schedules, retrieval filters, attribution templates, and logs showing which licence covers each document.
- Recheck on release and renewal. Confirm that model, embeddings, indexes, prompts, and outputs stay within the licensed audience and term. Remove or quarantine material when permission expires.
Operational safeguards that reduce licensing risk
- Maintain a per-document rights ledger rather than one blanket “research corpus” label.
- Separate subscription, OA, and expressly licensed material in storage and training jobs.
- Block automated crawling where the policy requires an API or other approved delivery channel.
- Keep source citations and attribution metadata attached to chunks and generated answers.
- Set retrieval limits and prevent long, contiguous passages from being returned when verbatim distribution is restricted.
- Restrict indexes and model endpoints to the authorised institution or customer group.
- Document deletion of source files, embeddings, caches, and derivative datasets when a licence ends.
Legal boundaries and unresolved questions
This publisher guidance does not determine whether a use is lawful under a copyright exception in a particular country. Some jurisdictions have statutory TDM exceptions; others permit contracts to narrow or override them in different circumstances. Courts may also treat temporary copies, model training, embeddings, and generated output differently. A project involving personal data, confidential manuscripts, export-controlled research, or third-party datasets needs additional review.

When the policy language is ambiguous, obtain advice for the relevant jurisdiction and preserve the written answer with the project records. Do not present a publisher’s permission requirement as proof that the law always forbids the activity, and do not present a statutory exception as proof that a subscription contract permits it.
Bottom line
AI access to research papers is a licence-matching exercise, not a simple paywall or open-access question. Identify the exact paper and licence, define the AI activity and audience, read the publisher and institutional terms, and obtain written permission for any use those documents do not clearly cover. Treat training, TDM, RAG, embeddings, and external service delivery as separate rights questions, then enforce the resulting conditions technically throughout the system’s life.
