Businesses facing central GST action in India are not without safeguards. The CGST Act sets conditions and deadlines for searches, seizures, provisional attachments and transit detention. CBIC instructions add controls on investigation letters, summons, voluntary payments and arrests. These protections do not automatically invalidate every disputed action, but they give a business concrete questions to ask, records to demand and channels through which to challenge improper conduct.
This guide focuses on central GST (CGST) law and CBIC instructions. State GST officers may follow parallel provisions and state-specific procedures, so identify which authority issued the communication before deciding how to respond.
Protections by enforcement stage
“GST enforcement” covers several legally different actions. A summons is not a search, a DRC-03 payment is not an adjudicated demand, and a bank-account attachment is not an arrest. The source of power determines what an officer must record, what the business can do next and how long the action may continue.

| Voluntary payment during enforcement | CBIC payment instruction; sections 73(5) and 74(5) | DRC-03 is initiated through the taxpayer’s GST portal credentials; payment is supposed to be voluntary | No automatic ruling on whether a particular payment was coerced |
| Provisional attachment | CGST Act section 83 | Written order, specified underlying proceedings and necessity to protect revenue | Attachment ceases after one year |
| Goods detained in transit | CGST Act section 129 | Notice, an opportunity to be heard and statutory release routes | Penalty notice within seven days; order within seven days after notice |
| Arrest | CGST Act and CBIC arrest instruction | Statutory conditions, credible material and a non-mechanical necessity assessment; arrest memo | Grounds, date and time must be recorded and a nominated person informed |
The safeguards are procedural and fact-dependent. A defect may support an objection or court challenge, but the documents, authority, jurisdiction and underlying conduct must be examined by a GST professional.

When an investigation letter or summons arrives
The inquiry should be defined
CBIC’s Instruction No. 01/2023-24-GST (Inv.), dated 30 March 2024, says a communication to a regular taxpayer should disclose the specific nature of the inquiry. Expressions such as “GST enquiry” or “GST evasion” without a defined subject are expressly disallowed. The instruction also rejects a fishing inquiry and says officers should not use an investigation-created pro forma to demand information.
Information already available digitally on the GST portal should generally not be requested again from a regular taxpayer. If a request appears to duplicate portal data, ask the officer to identify the additional information genuinely required and preserve both the request and your response.
Internal approvals and duplicate investigations
Each investigation is to begin only after the Commissioner’s approval, subject to the higher-level approval categories described in the instruction. The office should ascertain whether another central or state tax authority, or another CBIC office, is already examining the same taxpayer and subject. Where record-based investigations concern different subjects, the Commissioner is expected to consider whether one office can handle them and record reasons if consolidation is not feasible.
For listed companies, public sector undertakings and specified public bodies, record-based requests should initially be sent by official letter to the designated officer. The letter should state the reasons and legal provisions and allow a reasonable period to respond; a departure from that approach should have written reasons.
Summons should be approved and proportionate
The 2024 instruction says a summons should normally have prior, reasoned approval from an officer not below Deputy Commissioner or Assistant Commissioner. The approving officer should consider what is sought, why it is relevant and whether the compliance period is reasonable. Repeated summons and piecemeal requests should be avoided, and statements and search or inspection outcomes should be placed on the relevant electronic file.

A separate CBIC summons instruction dated 17 August 2022 says a Superintendent should generally obtain prior written permission from a Deputy or Assistant Commissioner, with reasons recorded. An operational exception must be reduced to writing at the earliest opportunity. Summons should normally identify the alleged offender unless disclosure would harm the investigation. Statutory documents available online should generally not be summoned.
Senior officers are not automatically the first witnesses
The 17 August 2022 instruction cautions that senior company officials should not generally be summoned first unless there are indications that they were involved in decisions leading to revenue loss. This does not give directors or executives immunity. It means the department should connect a person’s attendance to the subject under investigation rather than summon seniority alone.

- Verify the issuing office, officer’s designation, GSTIN, subject, statutory provisions cited, date and attendance or response deadline.
- Ask for clarification in writing if the subject is vague, the request duplicates portal information or the period and documents sought are unclear.
- Prepare a document index and provide responsive records in an organized form. Keep an identical internal copy and a delivery acknowledgment.
- Attend through an appropriately briefed representative where permitted. Statements should be read carefully before signing, and factual corrections should be requested immediately.
- Record every appearance, extension request, document handover and follow-up communication in a chronology.
Administrative grievance channel
For a complaint about an ongoing investigation, the 2024 instruction identifies the Additional or Joint Commissioner in charge of investigation as the grievance officer. A taxpayer may approach that official by letter, email or appointment. If a reasonable grievance persists, the Commissioner may consider meeting the taxpayer. This is an administrative channel; it does not replace a statutory appeal, a response to a notice or a court remedy.
What to do during a search or seizure
What section 67 requires
CGST Act section 67 authorizes inspection, search and seizure where the proper officer, not below Joint Commissioner rank, has statutory reasons to believe that conditions such as suppression or wrongful input tax credit connected with evasion exist. The power is not a general license to search any premises without the section’s conditions.
Seized goods may be released provisionally on bond and security, or on payment of applicable tax, interest and penalty, in the manner specified by the Act. If no notice concerning seized goods is issued within six months, the goods are to be returned. The period may be extended by up to a further six months when sufficient cause is recorded.

Practical safeguards at the premises
- Note the names, designations and offices of all officers and request to see the authorization or record its identifying details.
- Keep a contemporaneous log of arrival time, areas entered, systems accessed and documents or devices taken.
- Review the inventory and seizure documents for descriptions, quantities, serial numbers and condition; seek corrections before acknowledging them.
- Request copies of the panchnama, inventory and statements, and preserve CCTV footage, access logs and employee accounts.
- Do not obstruct a lawful search. Raise objections calmly in writing and obtain legal advice promptly if privileged material, personal devices or business-critical systems are involved.
These records help assess compliance with section 67 and support a release request or challenge. A procedural irregularity does not automatically nullify every search, so the full file should be reviewed.

What “voluntary” means in CBIC’s instruction
CBIC Instruction No. 01/2022-23 (GST-Investigation), dated 25 May 2022, addresses complaints that taxpayers were pressured to make recovery payments. It states that a DRC-03 voluntary payment is initiated by the taxpayer through the GST portal using the taxpayer’s credentials. The instruction refers to sections 73(5) and 74(5), which permit payment before a notice in the circumstances those sections specify.
That process is different from an officer unilaterally creating a demand. A business may choose to pay an amount it has independently ascertained and accepts, but should not describe a disputed figure as voluntary merely because a DRC-03 was generated.
Preserve the circumstances of disputed payment
If the business says it paid under pressure, preserve the written request or notice, officer details, emails and messages, the payment challan and DRC-03, internal approvals, a timeline of conversations and witness accounts. Promptly obtain advice from a GST lawyer or tax practitioner. These records can establish who initiated the payment and how it was presented; an allegation of pressure does not by itself cancel the tax liability or guarantee a refund.
When a bank account or property is attached
Section 83 limits provisional attachment
CGST Act section 83 permits the Commissioner, by written order, to provisionally attach property, including a bank account, after proceedings under the specified chapters have been initiated, where attachment is considered necessary to protect government revenue. The attachment ceases after one year.

Immediate steps for a business
- Obtain the signed attachment order and identify the GSTIN, property or account affected, issuing authority and date.
- Identify the underlying proceedings and the statutory chapter cited; an unexplained or unrelated attachment requires urgent clarification.
- Ask the bank or custodian for the exact operative instruction and amount or scope blocked.
- Prepare evidence on payroll, statutory dues, customer receipts and essential operating expenses so counsel can assess proportionality and seek appropriate relief.
- Have a GST lawyer evaluate administrative representations and any court challenge. The outcome depends on the record and applicable precedent.
Do not assume that the one-year limit makes the attachment harmless: cash-flow damage can occur immediately, and other recovery or adjudication steps may continue.
If goods are detained in transit
Notice, hearing and deadlines under section 129
Section 129 applies when goods are transported or stored in transit in contravention of the Act or rules. The proper officer must serve an order of detention or seizure, issue a notice specifying the penalty within seven days and pass an order within seven days after serving that notice. The person concerned must receive an opportunity to be heard before the penalty is determined.
The section provides release routes, including payment of the specified penalty or furnishing security. Obtain the detention order, notice, e-way and transport records, invoices, vehicle details and proof of tax treatment immediately. Track each seven-day deadline in writing and submit a focused reply before the hearing.
Common response errors
- Waiting for an informal phone assurance instead of recording a written request for release or hearing.
- Submitting inconsistent invoice, e-way bill and transport explanations.
- Ignoring the distinction between a clerical discrepancy and a contravention that supports penalty.
- Failing to arrange security or payment documentation when release is commercially urgent.
Arrest and prosecution: safeguards before custody
Arrest is not automatic
CBIC’s Instruction No. 02/2022-23 (GST-Investigation), dated 17 August 2022, says arrest requires the statutory conditions and an unambiguous reason to believe based on credible material. The competent authority should consider whether arrest is necessary to secure the investigation, prevent evidence tampering or witness interference, or ensure the person’s presence. The instruction says arrest should not be routine or mechanical and should not be used for a technical dispute involving a difference of opinion on legal interpretation.
The instruction reproduces this Supreme Court statement from Siddharth v. State of Uttar Pradesh, Criminal Appeal No. 838 of 2021, dated 16 August 2021: “Merely because an arrest can be made because it is lawful does not mandate that arrest must be made.” The quotation describes a necessity principle; it is not immunity from arrest where statutory requirements are met.

Arrest memo and information to a nominated person
The arrest instruction calls for an arrest memo consistent with Supreme Court directions. It should identify the applicable provisions, explain the grounds to the arrested person, record that a nominated or authorized person was informed, and state the date and time of arrest. The arrested person should receive the memo against acknowledgment. Preserve the memo, acknowledgment, notices and communications, and seek immediate advice on bail and production before the appropriate court.
Status of the October 2026 arrest proposals
A Press Information Bureau FAQ published on 9 October 2026 reported that the GST Council had recommended removing GST arrest provisions, raising the prosecution threshold and changing offences and penalties. The FAQ describes recommendations and proposed amendments. It does not establish enactment or commencement. Until an enacted amendment and effective date are verified, businesses should rely on the law and instructions currently in force rather than assume GST arrest has been abolished.
Escalating a coercive or procedurally defective action
Start with a complete evidence file: notices, summons, authorizations, panchnamas, inventories, statements, DRC-03 and challans, attachment orders, detention papers, emails, messages, call notes, payment approvals and a dated chronology. Preserve originals and metadata, restrict editing and identify every officer and witness.
Use the CBIC investigation grievance officer for an ongoing-investigation complaint where appropriate, while meeting every statutory response deadline. A representation, appeal, bail application, attachment challenge or writ petition may be available depending on the document and procedural posture. The correct forum, limitation period and relief cannot be selected from a generic “GST raid” description; a GST lawyer or tax practitioner should review the actual papers promptly.
Preventive controls that reduce exposure
- Maintain reconciled sales, purchase, input-tax-credit and e-invoice records that can be produced quickly.
- Assign a response team and backup contact for summons, searches, detention and bank restrictions.
- Keep a secure register of portal submissions, DRC-03 payments, officer communications and document handovers.
- Train staff not to delete records, obstruct officers or make unapproved admissions during an inspection.
- Review high-risk transactions and related-party decisions with tax counsel before an investigation begins.
These controls do not prevent lawful enforcement, but they make it easier to distinguish an accurate, self-ascertained liability from an unsupported demand and to prove what occurred during an enforcement event.
