In the United States, a commercial nuclear power project normally follows one of two Nuclear Regulatory Commission (NRC) licensing routes: the two-step process in 10 CFR Part 50, or the Part 52 combined license (COL). Both routes require detailed nuclear-safety analysis, environmental review, public-hearing opportunities, and continuing NRC oversight. A Part 50 construction permit lets the owner build but not operate; operation requires a separate operating license. A Part 52 COL combines construction authorization with conditional operating authority, but the reactor still cannot start until the applicant completes the license’s inspections, tests, analyses and acceptance criteria (ITAAC), and the NRC finds those criteria satisfied.
The exact approvals outside the NRC depend on the site and its impacts. Federal, state and local agencies may require additional water, air, wetlands, land-use, wildlife, emergency-management or other permits. The NRC coordinates with other agencies, but there is no single universal permit list for every location.
The two U.S. licensing routes
NRC licensing is the central legal authorization for a commercial power reactor. The choice between Part 50 and Part 52 determines when information is submitted, how construction and operation are authorized, and what must be verified before fuel loading and startup.

NRC describes Part 50 as providing more flexibility to update design information before the operating-license review. Part 52 places more information and commitments up front, which can make later design changes more constrained. The practical tradeoff depends on the reactor design, site, prior approvals and the conditions written into the license.

Part 50: construction permit, then operating license
The Part 50 route divides authorization into two major decisions.
- Prepare the construction-permit application. The applicant submits a preliminary safety analysis report (PSAR), an environmental report, and antitrust and financial information. The PSAR describes the proposed reactor, site-related safety issues, major safety systems and the analysis of potential accidents at the preliminary-design stage.
- NRC review and hearing. NRC staff evaluates the application and a hearing is held before a construction permit may be issued. The permit authorizes construction of the approved facility; it does not authorize generation of electricity or other operation of the reactor.
- Develop the final design during construction. The applicant completes engineering, procedures and operating programs while construction proceeds under the permit and NRC oversight.
- Apply for an operating license. The operating-license application includes a final safety analysis report (FSAR), technical specifications and operational plans. Those plans cover areas such as fire protection, physical security and emergency preparedness.
- Complete the operating-license review. Construction by itself is not permission to operate. The NRC must complete its technical and environmental reviews, resolve applicable hearing matters and issue the operating license before the plant can operate.
This sequence can accommodate a design that is still being finalized when the construction permit is requested, but it also creates a second major licensing decision after a long construction period.
Part 52: combined license
A Part 52 COL combines authorization to construct a particular facility at a particular site with conditional permission to operate it. The NRC reviews the applicant’s qualifications, design safety, site safety, environmental impacts, operational programs and construction-verification plan as part of the COL application.

The application includes ITAAC—inspections, tests, analyses and acceptance criteria. Each ITAAC item states what must be inspected or tested, what analysis must be performed, and what result demonstrates that the completed facility conforms to the license and applicable requirements. The applicant must submit the required completion information, and the NRC must determine that the acceptance criteria have been met before operation may begin.
A COL therefore is not an automatic startup authorization. It is a construction authorization plus conditional operating authority that becomes usable only after the prescribed construction-verification process is complete.

Early site permits and design certifications
Part 52 can resolve some questions before a project reaches the COL stage. An early site permit can address site safety, environmental protection and emergency-preparedness issues without being tied to a specific reactor design. A standard design certification can resolve design issues in advance for a certified reactor design. Using either approval can improve predictability at the COL stage, although the issues covered, expiration dates, conditions and applicability are controlled by the individual approval and NRC rules.
What the nuclear-safety review examines
The safety review is not a single checklist. It is a documented demonstration that the proposed reactor and site can withstand expected operating events and hypothetical accidents while protecting the public and plant workers.

The applicant describes the reactor, safety-related structures, systems and components, the site characteristics that affect plant behavior, and the methods used to analyze hazards. The analysis addresses how safety features prevent accidents, control releases and reduce consequences if an accident occurs.
Under Part 50, the PSAR supports the construction-permit decision and the FSAR supports the operating-license decision. Under Part 52, the NRC reviews the design and site safety information in the COL application and then uses ITAAC to verify that the constructed facility matches the licensed design and requirements.
Accident analysis and safety features
Safety documentation analyzes hypothetical accident conditions rather than relying only on normal-operation performance. It explains the assumptions, systems and procedures used to keep radioactive material contained, maintain essential cooling and control other consequences. The report must show how the proposed features prevent accidents or limit their effects to meet NRC requirements.

Operational programs
The licensing record also covers programs needed to run the plant safely. For a Part 50 operating license, the application includes technical specifications and plans for fire protection, security and emergency preparedness. Part 52 reviews operational programs as part of the COL process, with the specific commitments and verification obligations set out in the license.

Every construction-permit or COL application includes an environmental report. It evaluates effects of the proposed facility and associated activities, including impacts on land, waterways and wildlife. The NRC conducts its environmental review under 10 CFR Part 51 in parallel with the safety and licensing reviews.
The NRC coordinates environmental matters with agencies such as the Environmental Protection Agency, the U.S. Fish and Wildlife Service and the National Oceanic and Atmospheric Administration. Depending on the site, other federal, state or local approvals may also be required. Those approvals can involve matters such as water use or discharge, wetlands, threatened or endangered species, cultural resources, land development and emergency planning. The responsible agencies and required permits vary with location and project impacts; an NRC license does not replace every other legal authorization.
How long the environmental review takes
The NRC currently estimates that a new-reactor environmental review takes approximately 24 to 36 months. That estimate includes scoping, preparation of a draft environmental impact statement, a public-comment period and a final environmental impact statement. It applies to the NRC environmental-review process, not to the complete licensing effort, construction period or commercial-startup schedule. Project complexity, site conditions, requests for additional information and litigation or other proceedings can affect actual timing.
Hearings and public participation
Public hearing procedures are part of nuclear power plant licensing. The exact rights, filing deadlines and standing requirements are governed by the applicable notice and regulations, so a potential participant must read the notice for the specific project.

Construction and combined-license hearings
For a Part 50 construction permit, NRC review includes a hearing before the permit may issue. NRC also describes a mandatory hearing for a Part 52 COL. These proceedings provide a formal setting for evaluating contested or required findings under the applicable licensing rules.
The Part 52 ITAAC hearing opportunity
Before operation under a COL, the NRC publishes a notice providing a limited opportunity to request a hearing on whether the COL’s ITAAC acceptance criteria have been or will be met. This proceeding is confined to construction verification. It is not a second environmental review and does not reopen every issue decided when the COL was issued.
Construction oversight after licensing
NRC involvement continues after a permit or COL is issued. The NRC’s Construction Inspection Program conducts inspections during the period between licensing and initial operation. Inspection reports document the results, and the program includes inspections of vendor quality-assurance activities.
For a Part 50 project, these inspections support the later operating-license decision and help establish that construction and quality controls conform to the approved design and requirements. For a Part 52 project, inspections and the applicant’s records support the ITAAC completion process. A COL holder must demonstrate the specified results; it cannot substitute a general statement that construction is complete.
What a project team must prepare
Although document names differ by licensing route and project stage, a serious application program must assemble several categories of evidence:

- Reactor and site descriptions, including safety-related structures, systems and components.
- Preliminary or final safety analysis reports, depending on whether the filing is for a Part 50 construction permit, Part 50 operating license or Part 52 COL.
- Analyses of hypothetical accidents and the performance of features intended to prevent or mitigate them.
- An environmental report addressing land, water, wildlife and other affected resources.
- Financial and antitrust information required for a Part 50 construction-permit application.
- Technical specifications and operating programs for fire protection, security and emergency preparedness when seeking a Part 50 operating license.
- ITAAC and the records, inspections, tests and analyses needed to show compliance for a Part 52 facility.
- Quality-assurance, inspection and construction records that can withstand NRC review.
Common permit and licensing misunderstandings
“A construction permit means the reactor can run.”
It does not. Under Part 50, the construction permit authorizes building only. The NRC must issue a separate operating license after reviewing the final safety analysis and operating programs.
“A combined license removes the final safety gate.”
It does not. A COL authorizes construction and provides conditional operating authority. ITAAC must be completed and the NRC must find the acceptance criteria satisfied before operation begins.
“The environmental review is the whole licensing process.”
It is one parallel component. The environmental report and Part 51 review address environmental effects, while the safety review addresses reactor and site safety, accident analysis and compliance with nuclear requirements.
“NRC approval replaces state and local permits.”
Not necessarily. Additional approvals may be required under other federal, state or local laws, depending on the site and impacts. The NRC coordinates with other agencies but does not publish one universal permit list for every project.
“Public comments reopen every decision.”
Participation is bounded by the applicable proceeding. In particular, the later Part 52 ITAAC hearing concerns construction-verification criteria, not a renewed environmental review of the entire project.
A practical sequence for understanding a new project
- Identify the licensing route. Determine whether the applicant is pursuing Part 50 or Part 52 and whether an early site permit or design certification is involved.
- Locate the safety filings. For Part 50, look for the PSAR and later FSAR; for Part 52, examine the COL safety information and ITAAC.
- Read the environmental documentation separately. Check the environmental report, NRC scoping materials, draft environmental impact statement, comment period and final statement.
- Check the hearing notice. Confirm the intervention deadline, standing rules, issues that may be litigated and the scope of any later ITAAC proceeding.
- Track construction verification. Review NRC inspection reports, quality-assurance findings and the applicant’s ITAAC completion records before assuming operation is authorized.
- Identify site-specific permits. Consult the responsible federal, state and local agencies for water, wildlife, land-use, emergency-management and other approvals that apply at that location.
The result is a layered approval system rather than one all-purpose building permit: nuclear authorization, environmental findings, construction inspections, operating conditions and site-specific permits each address a different risk or legal requirement.
