Indiana does not issue one statewide “data-center permit.” A proposed facility must pass a site-specific review covering local zoning, building and fire codes, IDEM environmental programs, Indiana DNR water and floodway rules, utility approvals, and sometimes federal requirements. The exact permits depend on the parcel, disturbance area, wetlands and floodways, cooling system, wastewater route, generators, and utility configuration.
Indiana’s permit system is trigger-based, not a single checklist
Every Indiana data-center project should begin with a permit matrix tied to its actual site and design. Local governments control land-use compatibility, while state agencies regulate environmental, water and construction impacts. A facility may need several approvals before construction starts and additional registrations or operating permits after completion.
The Indiana University Environmental Resilience Institute reports that counties and municipalities have been adopting data-center ordinances, moratoria and bans. Local rules can change during site selection, so a parcel that appears suitable under a current zoning map may still require a rezoning, special-exception hearing or compliance with a newly adopted ordinance.

Local zoning and development approvals
Confirm the underlying zoning
Ask the host county or city whether a data center is permitted by right in the proposed district. If it is not, the project may require rezoning, a conditional-use or special-exception hearing, a planned-unit-development approval, or another discretionary land-use decision. Obtain the written zoning interpretation rather than relying on a broker’s description of the parcel.
Expect site and infrastructure conditions
Local applications can include an improvement-location permit, site-development approval, civil plans, traffic analysis, landscaping, setbacks, lighting, stormwater details and utility plans. Ordinances may impose noise limits, water and infrastructure conditions, annual operating reports, generator disclosures, emergency-response information and limits on expansion.
Check moratoria and pending ordinances
Before spending on final engineering, search the county commission, city council, planning commission and zoning-board agendas for pending data-center rules, public hearings or moratoria. Ask whether an application is vested under existing rules or will be reviewed under an ordinance adopted after filing. A public hearing can add months to the schedule even when the project ultimately receives approval.

Building, electrical, mechanical and fire-code permits
Indiana’s engineering standards framework includes the Indiana Building Code, Mechanical Code, Electrical Code based on the National Electrical Code, Fire Prevention Code, Energy Conservation rules, Plumbing Code, structural-engineering standards, Indiana Occupational Safety and Health Administration requirements and environmental approvals.
The local authority having jurisdiction (AHJ) normally reviews building plans, structural calculations, electrical distribution, generators, fuel systems, cooling equipment, plumbing, fire detection and suppression. Expect construction permits, staged inspections and a certificate of occupancy or other final approval before the facility is placed in service. Confirm the code editions and local administrative process with the building official because the applicable edition and submittal requirements can differ by jurisdiction.
Data centers often have unusual electrical rooms, battery systems, raised-floor areas, high fire loads, large mechanical systems and redundant equipment. Provide the AHJ with a clear single-line electrical diagram, generator and fuel details, fire-protection design, equipment clearances, egress plans and emergency-shutdown procedures. Changes made after permit issuance may require revised drawings or additional inspections.

Construction stormwater: the one-acre trigger
IDEM requires a Construction Stormwater General Permit (CSGP) for construction activity that disturbs one (1) acre or more of total land area. The disturbance calculation includes more than the building footprint: clearing and grading for roads, parking, substations, transmission connections, laydown areas, drainage works and temporary construction areas can all count.
The Tool Desk
Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →The applicant must submit a Notice of Intent and prepare a Construction/Stormwater Pollution Prevention Plan (SWP3). The plan identifies drainage patterns, erosion and sediment controls, stabilized entrances, inlet protection, detention or treatment measures, inspection responsibilities and procedures for correcting failures.
Treat stormwater permitting as a pre-construction critical-path item. Clearing or grading before the required filing and local approvals can expose the owner and contractor to enforcement, stop-work orders and restoration costs. Update the SWP3 when the site layout, phasing or outfall changes.
Wetlands, streams, floodways and lake-related work
Wetland delineation before the layout is fixed
An IDEM isolated-wetland permit may be required when construction impacts a protected wetland. Wetland impacts can arise from buildings, access roads, utility corridors, stormwater ponds and grading outside the main campus. Mitigation may be proposed for functional impacts to wetlands and streams, but mitigation does not eliminate the need for the underlying authorization.
Commission a field delineation and jurisdictional review early enough to move the design. A wetland boundary discovered after engineering is complete can force a road relocation, reduce the buildable area or require additional mitigation.
DNR floodway and public-water approvals
Indiana DNR water programs require approval for regulated construction in floodways, development at or lakeward of a public freshwater-lake shoreline, and specified structures, withdrawals or material extraction in navigable waterways. Check current floodway maps, ordinary high-water information and permit exemptions before selecting the final building pad, access bridge, intake, outfall or utility crossing.

Floodway review is separate from local floodplain zoning and from IDEM stormwater authorization. A project can satisfy one review and still need another. Keep the civil drawings, hydraulic information and finished-floor elevations consistent across submissions.
Cooling water, wastewater and NPDES permits
Direct discharge to a water body
If process water is discharged directly to a stream, lake or other water body, IDEM’s Office of Water Quality requires a National Pollutant Discharge Elimination System (NPDES) permit. The application must describe the wastewater’s composition, expected flows, treatment system, discharge location and operating conditions. Cooling blowdown, treatment chemicals, corrosion-control products and cleaning wastes may affect the characterization.
Discharge to a publicly owned treatment works
When noncontact cooling water is sent to a publicly owned treatment works (POTW), the receiving plant must notify IDEM’s permits branch. IDEM then determines whether the plant’s NPDES permit needs modification. The data-center owner should provide the utility with projected maximum and average flows, temperature, chemical constituents, peak discharge timing and upset conditions before signing a sewer-capacity agreement.
Closed-loop and air-cooled systems
A closed-loop or air-cooled design can reduce process-water withdrawals and eliminate some routine discharge, but it does not eliminate permitting analysis. The project still must address sanitary wastewater, construction stormwater, cooling-system blowdown if any, maintenance discharges and emergency or treatment-system releases. Compare cooling alternatives by water balance and discharge route, not by equipment name alone.
When Indiana DNR water-withdrawal registration applies
Indiana DNR defines a “significant water withdrawal facility” as facilities that, in aggregate from all sources and by all methods, have the capability of withdrawing more than 100,000 gallons in one day of groundwater, surface water or both. The threshold is based on capability and aggregate sources, not merely the average daily volume.
The owner must register within three months after completion of the facility and report annual water use within three months after each calendar year. Include all planned wells, surface-water intakes and backup sources when evaluating the threshold. A registration is not a substitute for other approvals: well construction, utility service, intake, discharge, floodway, environmental or local requirements may still apply.

Air permits for generators and other combustion equipment
Indiana’s business guidance explains that federal rules require permits to construct and operate new facilities, or modify existing facilities, that emit specified quantities of pollutants. Sources emitting listed toxic pollutants may also require permits. The applicable classification depends on equipment, fuel, hours, emissions, location and whether units are treated individually or as part of a source.
Equipment to screen
- Emergency and prime diesel or natural-gas generators.
- Fire pumps and diesel-driven life-safety equipment.
- Boilers, water heaters and other combustion units.
- Fuel-storage and fuel-handling systems where emission rules apply.
- Temporary construction engines and replacement units.
Obtain an IDEM applicability determination before ordering or installing major combustion equipment. Provide model numbers, rated output, fuel type, stack parameters, proposed operating hours, emergency-testing schedule and control equipment. Local zoning may separately require generator locations, noise controls, disclosure of testing schedules or annual reporting.
Demolition or renovation involving asbestos requires an IDEM permit and certified workers. Include asbestos surveying and notification in the demolition schedule; it is not covered by a generator or building permit.
Utility capacity and large-load infrastructure
Coordinate with the serving electric, natural-gas, water and wastewater utilities at the start of site screening. A large campus may require new substations, feeders, switching equipment, gas mains, wells, treatment capacity, elevated storage or sewer extensions. Written utility studies should identify available capacity, upgrade scope, construction ownership, cost responsibility, tariff requirements, energization milestones and redundancy assumptions.
The Indiana Utility Regulatory Commission regulates electric, natural-gas, steam, water and wastewater utilities and oversees rates, financing, environmental-compliance plans, service territories and certain construction or acquisition of utility plant and equipment. Its jurisdiction differs for municipal and other utilities, so first identify the provider and then confirm which approvals, tariffs or commission filings are relevant.

Do not treat a utility letter of intent as a permit. Building, environmental and land-use approvals remain separate, and utility work may itself require stormwater, wetland, floodway, road-opening or air approvals.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Tax-incentive compliance is a separate approval track
The Indiana Economic Development Corporation (IEDC) reports that its Data Center Gross Retail and Use Tax Exemption can cover qualifying data-center equipment and energy for up to 25 years for investments below $750 million and up to 50 years when investment exceeds $750 million. Eligibility, transaction-award certificates, qualifying costs and statutory conditions must be confirmed before representing the exemption as available.
IEDC also notes that a local government may provide a personal-property-tax exemption for qualified enterprise information-technology equipment when the owner invests at least $25 million in real and personal property. This is not automatic statewide relief; it requires the host locality’s action and an agreement or other process required by current law.

Proposed water legislation: House Bill 1043
Indiana House Bill 1043 was introduced in the 2026 legislative session and referred for consideration. The proposal described prohibiting operation of a data center without a DNR consumption permit and included application and transfer procedures. The legislative record does not establish that the bill became law. Treat it as proposed legislation unless an enacted statute and effective date are verified immediately before filing or publication.
A practical Indiana permitting sequence
- Screen the parcel. Verify zoning, comprehensive-plan consistency, pending ordinances, moratoria, floodway mapping, wetlands, public-water boundaries, road access and available utility corridors.
- Meet the authorities. Hold pre-application meetings with local planning, building and fire officials, IDEM program staff as appropriate, Indiana DNR and the serving electric, water and sewer utilities.
- Develop the impact baseline. Complete wetland delineation, floodway checks, a preliminary grading plan, a water balance, cooling-system selection and wastewater-discharge characterization.
- Lock the civil and mechanical assumptions. Quantify total disturbed acreage, intake and discharge points, maximum withdrawal capability, generator fleet, fuel storage, operating hours and emergency-testing schedules.
- File environmental applications. Submit the IDEM CSGP Notice of Intent and SWP3 when the one-acre trigger applies; obtain wetland, wastewater/NPDES and air determinations or permits; coordinate any asbestos requirements.
- Complete DNR reviews. Screen significant-withdrawal registration, floodway, lake, navigable-waterway and other regulated-water obligations, including applicable exemptions.
- Obtain local construction approvals. Submit building, structural, electrical, mechanical, plumbing and fire-protection plans, then complete inspections and occupancy approvals.
- Finalize utility and incentive documents. Execute capacity and service agreements, confirm tariff and commission issues, and validate IEDC and local tax-incentive eligibility against current law and award procedures.
- Recheck before work begins. Confirm that no ordinance, moratorium, code edition, permit condition or legislative status changed after the original design review.
How to compare two Indiana sites or cooling designs
| Decision area | Questions to answer |
|---|---|
| Local land use | Is the use permitted by right, or is rezoning, a special exception, a hearing or a moratorium risk involved? |
| Disturbance and stormwater | How many acres will be disturbed, including roads, substations and temporary areas, and when must the CSGP be filed? |
| Wetlands and floodways | Are protected wetlands, streams, floodways, lake shorelines or navigable-water crossings in the buildable area? |
| Water supply | What are the source, maximum daily capability and aggregate withdrawal, and will DNR registration be required? |
| Wastewater | Will process water reach a surface water directly, a POTW, or remain in a closed loop, and who must approve the route? |
| Air emissions | How many generators and other combustion units are planned, what fuels will they use, and what IDEM permit category applies? |
| Utilities | Can electric, gas, water and sewer providers deliver the required capacity and redundancy on the project schedule? |
| Codes and fire safety | Which code editions apply, and can the AHJ review the electrical, mechanical, suppression and emergency systems as designed? |
| Tax incentives | Does the project meet current IEDC and local investment, equipment and award requirements? |
| Schedule risk | Could public hearings, moratoria, wetland mitigation, utility upgrades or permit modifications delay construction? |
What a complete permit file should contain
- Current zoning map, written use determination and copies of pending ordinances.
- Survey, title constraints, wetland delineation, floodway map and public-water review.
- Grading, drainage, erosion-control and SWP3 documents with disturbed-acre calculations.
- Water-balance model covering cooling make-up, blowdown, sanitary flows and peak demand.
- Well, intake, pump-capacity and backup-source information for DNR screening.
- Wastewater composition, treatment design, outfall or POTW information and utility correspondence.
- Generator, fire-pump and boiler specifications, fuel data, stack information and test schedules.
- Building, structural, electrical, mechanical, plumbing, fire-protection and emergency-response plans.
- Utility capacity studies, tariffs, upgrade agreements and energization milestones.
- IEDC award documents, local incentive agreements and records supporting qualifying investment.
The safest approach is to maintain one coordinated matrix showing each trigger, agency, application, responsible party, filing date, approval condition and renewal or reporting deadline. Indiana’s requirements are extensive but predictable when the project is screened by site characteristics and equipment rather than by the label “data center.”
