India does not require prior environmental clearance (EC) simply because a project is called a data center. The Ministry of Environment, Forest and Climate Change (MoEFCC) stated in a Rajya Sabha answer dated 6 August 2026 that AI data centres do not, per se, require EC under the Environmental Impact Assessment (EIA) Notification, 2006, as amended. EC becomes relevant when the proposal falls within a scheduled category—most importantly, a building and construction project exceeding 20,000 m² of built-up area, or a township/area-development project meeting its larger thresholds.

That conclusion answers only the national EIA trigger. A real project must also clear local planning and building controls, water and pollution requirements, fire and fuel rules, power and aviation checks, waste obligations, and any forest, wildlife or coastal restrictions that the site and design create.

The short answer: EC is threshold-based, not data-center-based

The MoEFCC’s 6 August 2026 parliamentary answer says: “Artificial Intelligence (AI) Data Centres do not, per se, require Environmental Clearance (EC) under the Environmental Impact Assessment (EIA) Notification, 2006, as amended.” In practical terms, the label data center is not itself a prior-EC trigger. The project must be tested against the categories and thresholds in the EIA Schedule and against other laws that operate independently of the EIA notification.

For a qualifying building project described in that answer, the State Environment Impact Assessment Authority (SEIAA) at the state or Union-territory level is the EC authority. The exact categorisation and procedure should be confirmed for the selected state, parcel and project configuration before construction commitments are made.

An EC, where required, is not a substitute for a building sanction, land-use permission, utility approval or operating consent. Official clearance conditions routinely make those approvals conditional obligations, so the project team needs a complete permit map rather than a single environmental filing.

When a data-center project crosses an EIA threshold

EIA Schedule category Published threshold How it can affect a data center Authority identified by MoEFCC
Item 8(a): building and construction Built-up area exceeding 20,000 m² A data center proposed as part of a building/construction project above this built-up-area threshold requires prior EC. State/UT SEIAA for the qualifying building project.
Item 8(b): township and area development Project area at least 50 hectares and/or built-up area at least 150,000 m² An integrated campus or development that meets either stated threshold can require prior EC, even if the data halls themselves are considered separately. Confirm the applicable category and process with the relevant authority.

The figures above are regulatory cutoffs quoted by MoEFCC in 2026, not estimates of typical facility size. “Built-up area” should be calculated consistently with the drawings and definitions used by the approving authorities. Include all buildings and phases that legally form part of the proposal; do not assume that splitting construction into packages removes an otherwise applicable township or area-development trigger.

Projects below the thresholds

A standalone facility below the listed thresholds is supported by the ministry’s statement that data centers do not per se require EC. That does not certify the project as permit-free. Local development control, water abstraction, pollution, fire, fuel, electrical, waste, forest, wildlife and coastal rules can still apply. A large mixed-use or phased development may also need to be assessed as an integrated proposal under Item 8(b).

Why written applicability confirmation is worthwhile

The EIA answer addresses AI data centres at the national trigger level. It does not provide a site-specific ruling for every architecture, campus boundary or phased build. Before land acquisition becomes irreversible, submit the project description, site plan, built-up-area calculation and development context to the relevant environmental consultant and seek an applicability view from the competent state process. Keep the calculation and correspondence in the project record so later design changes can be checked against the same baseline.

Approvals to screen in addition to EC

The following are screening categories drawn from official clearance conditions and ministry answers. They are not a universal checklist: the authority, permit name and timing depend on the state, municipality, water source, fuel inventory, building design and ecological setting.

Land use, zoning and building sanction

Confirm that the parcel permits the proposed industrial, commercial or technology use under the applicable master plan and zoning rules. Obtain planning permission and building sanction from the local authority, and design to the current local building bye-laws. A data center may combine high-rise structures, substations, cooling plants, diesel generators and security works; each can affect setbacks, access, parking, fire egress and permissible floor area.

Pollution-board consent and emissions

Cooling systems, generators, fuel handling, sewage treatment and other equipment can create air-emission, wastewater or noise obligations. The relevant State Pollution Control Board (SPCB) or Pollution Control Committee (PCC) regulates compliance under the Water (Prevention and Control of Pollution) Act and Air (Prevention and Control of Pollution) Act. Determine whether the design needs Consent to Establish (CTE), Consent to Operate (CTO), authorisations for specific waste streams, or only the conditions embedded in another approval.

Do not assume that an EC determination resolves pollution consent. The board may review the site, discharge route, emission controls, monitoring plan and operating conditions separately.

Water source, abstraction and discharge

Identify every source: municipal supply, industrial estate supply, surface water, tanker water, treated sewage or groundwater. Groundwater abstraction is governed by the framework in Notification S.O. 3289(E) dated 24 September 2020, amended on 29 March 2023. The competent authority and permission depend on the source and location. A borewell that appears operationally convenient can therefore be unavailable, restricted or subject to metering and conservation conditions.

Prepare a water balance covering process and domestic demand, cooling-tower make-up, blowdown, cleaning, sewage, greywater generation, treatment capacity, recycling and final discharge. The MoEFCC says appraisal of qualifying building projects considers freshwater availability, especially in water-stressed regions, along with water balance, greywater generation and reuse. The SPCB or PCC monitors water-use and wastewater-discharge compliance.

Forest, wildlife and coastal regulation

Check the legal status of the land and its surroundings before finalising the parcel. Forest diversion, protected-area or wildlife permissions and Coastal Regulation Zone (CRZ) clearance are conditional, site-specific processes. Use the PARIVESH portal and the relevant forest, wildlife or coastal authorities to screen the coordinates, access roads, transmission lines, water pipelines and other associated works—not only the main building footprint.

No forest, wildlife or CRZ approval should be assumed merely because a data center is an industrial or technology project. Conversely, the absence of an EC trigger does not remove a separate ecological clearance requirement where the land or activity activates one.

Fire safety, diesel storage and civil aviation

Obtain the applicable fire-department approval for the building and its emergency systems. Backup generation can trigger approvals for diesel storage, dispensing arrangements and hazardous-area controls depending on the quantity and layout. Building height, cranes, rooftop equipment and proximity to an aerodrome can require civil-aviation clearance. Official environmental-clearance conditions identify these approvals as obligations where applicable; the exact filing is determined by the design and location.

Power connection and electrical infrastructure

Secure a certificate of available power or load from the supplying agency and confirm the utility’s connection conditions. A high-density campus may require a dedicated substation, transmission line, right-of-way or onsite transformers. Check state-specific electrical-inspector and energisation requirements for those works. Capacity confirmation is a project dependency, not merely an operational formality: an approved building with no deliverable grid connection cannot meet its commissioning plan.

Construction and operational waste

Map excavated material, construction and demolition debris, packaging, used oil, batteries, electronic equipment, sewage sludge and ordinary municipal waste. Official building-project conditions refer to solid-waste and e-waste rules, but the required authorisations depend on the actual waste profile and contractors. Put segregation, authorised transport, recycler records and storage limits into construction and operations contracts rather than treating waste as a final commissioning task.

The 2024 Consent to Establish qualification

MoEFCC’s February 2025 parliamentary answer summarised notifications G.S.R. 702(E) and 703(E), both dated 12 November 2024, and the related standard operating procedure. It reports that projects requiring prior EC are exempt from obtaining a separate previous CTE, provided the project obtains the EC and the required establishment safeguards are incorporated into its EC conditions.

The same answer says SPCBs may comment on site suitability, project feasibility and safeguards, and that the existing Consent to Operate mechanism continues. Therefore, an EC-required data-center project should not budget on the assumption that all board interaction disappears. Confirm with the state board whether the exemption is being applied to the project, what fees or documents it expects, and how CTO will be obtained before operation. The ministry’s summary is not a site-specific adjudication.

Cooling and water planning can change the permit profile

Cooling choice affects water demand, discharge volume, chemical handling, plant-room space and generator load. Compare designs using a quantified water balance rather than a generic “water efficient” description.

Design question Why the permitting team needs the answer
What is the annual and peak cooling-water demand? It supports freshwater-availability review and identifies whether abstraction or a supply allocation is needed.
Can treated greywater or sewage effluent provide cooling-tower make-up? Reuse can reduce freshwater demand, but treatment quality, storage, monitoring and discharge arrangements must be documented.
Where does blowdown and treated wastewater go? The receiving sewer, surface water or zero-liquid-discharge design determines SPCB/PCC conditions and monitoring.
Is the site in a water-stressed area? MoEFCC appraisal gives particular attention to freshwater availability and conservation in stressed regions.
Is groundwater proposed? Apply the current groundwater-abstraction framework and verify the competent authority before drilling or contracting supply.

The Bureau of Energy Efficiency’s District Cooling Guidelines 2023 recommend treated water for cooling-tower make-up wherever feasible and emphasise efficient cooling, alternative water sources and conservation. Those are design recommendations, not a blanket permit requirement. They are nevertheless useful evidence when explaining why the selected cooling and reuse design is proportionate to local water conditions.

A practical approval sequence for a project team

  1. Fix the project boundary. Record the state, municipality, parcel coordinates, intended land use, utility corridor, access roads, construction phases and whether the facility is standalone or part of a township or area-development scheme.
  2. Calculate the EIA metrics. Prepare a signed built-up-area schedule and total-area plan. Test Item 8(a) against “exceeding 20,000 m²” and Item 8(b) against “at least 50 hectares and/or at least 150,000 m².” Obtain a written applicability view from the relevant SEIAA process or qualified environmental adviser before starting work that could be irreversible.
  3. Screen ecological and land constraints. Check forest status, protected areas, wildlife sensitivities, CRZ mapping, groundwater conditions and rights-of-way. Initiate any relevant applications through PARIVESH and the responsible authorities.
  4. Design the water and wastewater system. Quantify domestic and cooling demand, identify the source, size treatment and reuse systems, define greywater and blowdown handling, and confirm discharge monitoring with the SPCB/PCC.
  5. Resolve the CTE position. If prior EC is required, ask the state board to confirm how G.S.R. 702(E) and 703(E) are implemented, what safeguards must appear in the EC and how CTO will be processed. If no EC is required, obtain the board’s written view on the applicable consent route rather than assuming an exemption.
  6. Secure local and utility approvals. Obtain planning and building sanction, fire approval, power-capacity confirmation and, where triggered, diesel-storage and civil-aviation approvals before the relevant construction, fuel installation or operation stage.
  7. Build a compliance register. Assign an owner, filing date, validity, renewal trigger and evidence record for every approval. Re-run the threshold and site screening whenever built-up area, cooling technology, generator capacity, water source or campus boundary changes.

This sequence is a planning aid, not a statutory filing order. State and municipal processes differ, and an authority may require parallel submissions or additional documents.

How to compare candidate sites before committing

Decision axis Questions to answer Warning sign
EC trigger and development scope Does the built-up area exceed 20,000 m²? Is the campus part of a proposal meeting 50 hectares or 150,000 m²? Different teams use different area definitions or omit later phases.
Water reliability Is a legally available source secured year-round? Is groundwater restricted? The business case assumes tanker or borewell supply without written permission.
Cooling and reuse Can treated water meet make-up quality? Is discharge capacity available? Cooling design is selected before the water balance.
Ecological constraints Are forest, wildlife or CRZ overlays affecting the parcel or associated infrastructure? Only the main plot is screened; lines, roads and pipelines are ignored.
Local safety controls Can the layout meet fire access, fuel storage and height requirements? Generator yard or rooftop equipment is added after building approval.
Power deliverability What load and energisation date has the utility confirmed? An indicative connection letter is treated as guaranteed capacity.

Common mistakes and how to correct them

  • “A data center never needs EC.” Correct the statement to “the label alone is not a trigger.” Recalculate both EIA Schedule categories for the complete development.
  • “EC is the only environmental permission.” Add water source, discharge, pollution-board, waste, ecological and local-authority checks to the permit register.
  • “The 2024 CTE exemption means no SPCB approval is needed.” Ask the board to confirm applicability and plan for CTO; retain all establishment safeguards in the EC conditions where relevant.
  • “Municipal water is always available.” Obtain a supply commitment and document peak cooling demand, drought constraints and contingency sources.
  • “A small first phase avoids Item 8(b).” Examine the legal project boundary and future phases together where they form one township or area-development proposal.
  • “A generic clearance checklist is enough.” Re-screen after every material design change, including extra generators, a new borewell, a taller building, a larger substation or an altered wastewater outlet.

What the project file should contain

Keep a single, version-controlled file containing the land title and zoning confirmation; site coordinates and overlay maps; built-up-area and campus-area calculations; phase and ownership structure; water balance and cooling narrative; source permissions; wastewater and reuse drawings; generator and diesel inventories; fire and aviation correspondence; utility load confirmation; waste-management contracts; EC applicability advice; EC and consent applications; and all authority conditions.

Record the date and source of every regulatory interpretation. The MoEFCC answer of 6 August 2026 is the key national statement on the data-center EC trigger, while the February 2025 answer explains the CTE qualification. Local procedures, notifications and board implementation can change, so verify the current position before filing.

Bottom line

Plan an Indian data-center project around a threshold test and a site-specific permit map. Prior EC is generally not required merely because the facility is a data center, but it is required for a qualifying Item 8(a) building project exceeding 20,000 m² of built-up area or an Item 8(b) township/area-development project reaching at least 50 hectares and/or 150,000 m² of built-up area. Even where no EC is triggered, local building approval, water and pollution controls, ecological screening, fire and fuel permissions, power confirmation and waste compliance remain potential prerequisites. Resolve the area calculation, water source and site constraints before design is locked, and confirm the state board’s CTE and CTO treatment in writing.
