In the United States, a small hydropower project may need a Federal Energy Regulatory Commission (FERC) license, a statutory exemption, or a qualifying-conduit notice. The generating capacity alone does not decide the answer. FERC jurisdiction depends on the waterway, land ownership, dams and conduits involved, when construction occurred, and effects on interstate or foreign commerce. A licensed project normally receives environmental review under the National Environmental Policy Act (NEPA), usually through an Environmental Assessment (EA), with an Environmental Impact Statement (EIS) if significant effects are likely. Water-quality certification, species consultation, coastal consistency, historic-preservation review, and fish-and-wildlife conditions may also apply. State, tribal, local, and non-U.S. requirements must be determined from the specific site and design.

Start by identifying the federal approval path

Before commissioning studies or filing an application, establish whether FERC has jurisdiction and which authorization fits the facility. FERC describes four relevant paths for small projects: a conventional license, a 10-megawatt (MW) exemption, a conduit exemption, and notice for a qualifying conduit facility. Each has different eligibility rules and environmental procedures.

A low nameplate capacity does not automatically remove a project from federal regulation. A 2-MW plant can still require a license if its waterway, land, dam, or construction history meets the Federal Power Act criteria. Conversely, a larger facility on a qualifying conduit may fit a conduit pathway. Treat capacity as one screening fact, not as the jurisdiction test.

When FERC jurisdiction is likely

FERC says a non-federal hydropower project may require a license or exemption when it:

  • uses surplus water or water power from a federal dam; or
  • is on a stream within Congress’s Commerce Clause jurisdiction where construction or modification occurred on or after August 26, 1935, and affects interstate or foreign commerce.

FERC describes a valid pre-1920 federal permit as an exception to the jurisdiction framework. If the facts are uncertain, a proposed project owner can seek a Declaration of Intention for a jurisdictional determination. An owner of an operating project may instead request a Declaratory Order.

Compare the four FERC pathways

Path Typical eligibility described by FERC Environmental-review treatment Important conditions
FERC license A non-federal project that meets Federal Power Act jurisdiction criteria and does not qualify for an exemption. An original license may run for up to 50 years. NEPA review is required. FERC typically prepares an EA and prepares an EIS when staff determines significant effects on the quality of the human environment would occur. Application studies, consultation, agency recommendations, mitigation proposals, and supporting engineering and property information are expected.
10-MW exemption A project of 10 MW or less proposed at a non-federal pre-2005 dam or a natural water feature, subject to eligibility and property-interest requirements. The described pathway does not apply at a federal dam. The exemption has its own filing and environmental conditions; do not treat it as a release from environmental requirements. Federal and state fish-and-wildlife agencies and FERC can impose mandatory terms and conditions.
Conduit exemption Certain facilities up to 40 MW using a man-made conduit operated primarily for a non-hydroelectric purpose. The applicant must have the required property interests or an option to obtain them. FERC says these applications are categorically exempt from its EA/EIS preparation requirement, while retaining authority to require an EA or EIS if adverse effects appear likely. The conduit’s primary purpose, ownership, capacity, property rights, and likely effects must be documented.
Qualifying-conduit facility notice Certain facilities up to 40 MW on a non-federally owned conduit that is not primarily for generating electricity and was not licensed or exempted on or before August 9, 2013. A notice is filed with FERC instead of seeking a license or exemption under the described conditions. Other environmental and agency requirements can still apply. Confirm every qualifying-conduit condition before relying on notice treatment.

These categories are not interchangeable. A project at an existing dam may be screened for the 10-MW exemption, while a facility added to a municipal water conveyance may fit a conduit pathway. A project that fails an eligibility condition returns to the licensing analysis.

What environmental assessment does a licensed project receive?

NEPA review: EA first, EIS if significant effects are expected

For a FERC license, the Commission conducts environmental review under NEPA. FERC’s licensing process generally begins with an EA. The EA evaluates the affected environment, the proposed action, alternatives and mitigation, and whether effects are significant. If FERC staff determines that significant effects on the quality of the human environment would occur, FERC must prepare an EIS instead.

That rule does not mean every small project receives an EIS. FERC’s small-project program is intended for projects expected to have minor environmental effects, such as little change to water flow and use and a low likelihood of affecting threatened or endangered species. The actual document depends on site conditions and the evidence developed during consultation and studies.

How the Integrated Licensing Process develops the record

FERC’s Integrated Licensing Process (ILP) coordinates the technical and environmental work before a licensing decision. The sequence generally includes:

  1. Pre-application consultation: define the proposal, affected resources, agency contacts, and study needs.
  2. Scoping: invite agencies, tribes, the public, and other interested parties to identify issues and alternatives.
  3. Studies: collect information on resources such as fish and wildlife, water quality, cultural resources, recreation, and tribal interests.
  4. Recommendations and conditions: agencies submit recommendations or mandatory conditions under applicable statutes.
  5. Environmental document: FERC prepares the EA or EIS, responds to comments, and identifies mitigation and license conditions.
  6. Commission order: the Commission decides whether and under what conditions to issue the license.

Early consultation matters because a late request for a fish survey, cultural-resource investigation, or flow analysis can change the schedule and require additional field seasons. The ILP is designed to coordinate related processes rather than run them as isolated permit applications.

Other environmental approvals that may be triggered

A FERC license is not the only approval a project may need. The applicable process depends on the location, affected resources, and project effects.

Clean Water Act Section 401 water-quality certification

When a project may result in a discharge requiring federal authorization, the relevant state or authorized tribe may review water quality under Section 401 of the Clean Water Act. FERC identifies a Section 401 certification as information it may need before deciding a license application. The certifying authority can address water-quality standards and conditions within its legal authority.

Endangered Species Act consultation

If listed species or designated critical habitat could be affected, consultation under the Endangered Species Act may be required. FERC’s ILP materials identify a Biological Opinion as an example of information that can inform the licensing decision. A project with no apparent species effects still needs a documented basis for that conclusion.

Coastal Zone Management Act consistency

A project in or affecting a coastal zone may need consistency documentation under the Coastal Zone Management Act. Whether a consistency review applies and what it requires depends on the state’s coastal program and the project’s reasonably foreseeable effects.

Fish and Wildlife Coordination Act and agency conditions

FERC identifies the Fish and Wildlife Coordination Act as one of the laws affecting hydropower regulation. Federal and state fish-and-wildlife agencies can recommend protective measures, and mandatory terms and conditions may attach to an exemption or license. An exemption therefore is not a promise that agencies cannot require fish passage, flow protection, monitoring, or other measures within their authority.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Historic and cultural resources

The National Historic Preservation Act can require review of historic properties and cultural resources. Studies may need to cover archaeological sites, historic structures, traditional cultural properties, and tribal concerns when those resources could be affected. Consultation with potentially affected tribes should begin early, not after engineering is complete.

What to include in the application and study package

FERC’s application-completeness guidance expects a complete description of the environment that may be affected, completed consultation, and study reports. If an applicant concludes that a project will have no effect on a particular resource, FERC asks for an explanation for each resource rather than a general statement.

Project and engineering description

  • Existing and proposed facilities, dimensions, materials, capacities, and operating plan.
  • Preliminary drawings of applicable dams, spillways, penstocks, powerhouses, tailraces, intakes, discharges, and generating units.
  • Expected operating changes, including how water will be diverted, stored, released, or returned to the watercourse.
  • A construction schedule with major activities and proposed environmental controls.

Maps and property evidence

  • Maps showing the project boundary, facilities, impoundment, transmission elements where applicable, water features, and access routes.
  • Ownership information for land and facilities affected by the proposal.
  • Deeds, leases, easements, rights of way, or an option to obtain the required interests when an exemption pathway requires them.

Environmental baseline and impact analysis

  • Existing conditions for water resources, fish and wildlife, vegetation, recreation, cultural and historic resources, and tribal interests that could be affected.
  • Study reports addressing issues raised during scoping and agency consultation.
  • Analysis of construction and operation effects, proposed avoidance and mitigation measures, and monitoring commitments.
  • An explanation for every resource the applicant believes will not be affected.

The exact studies are site-specific. FERC’s guidance does not create one nationwide checklist that can substitute for consultation. A project altering a river channel may need a different study program from a generator installed on an existing water-supply conduit.

Practical step-by-step permitting roadmap

  1. Define the site and design. Record the waterbody or conduit, dam ownership, federal-land involvement, proposed capacity, diversion and discharge points, construction date of existing works, and expected operating changes.
  2. Screen FERC jurisdiction. Compare those facts with the navigable-water, federal-land, federal-dam, and Commerce Clause criteria. If the answer is uncertain, evaluate a Declaration of Intention for a proposed project or a Declaratory Order for an operating project.
  3. Test each authorization path. Check the 10-MW, conduit-exemption, and qualifying-conduit conditions individually. Confirm capacity, conduit purpose and ownership, dam status, dates, and property rights; do not assume that an existing structure automatically qualifies.
  4. Map every potentially affected resource. Identify water quality, threatened or endangered species, fish passage, wetlands or shoreline resources, cultural and historic properties, recreation, tribal interests, and public access issues that the design could influence.
  5. Begin agency and tribal consultation. Use the ILP approach for a license and coordinate water-quality, coastal, species, fish-and-wildlife, and historic-preservation processes early enough to perform seasonal studies if needed.
  6. Prepare the baseline and alternatives. Document existing conditions, the proposed action, feasible design or operating alternatives, predicted effects, and mitigation. Support no-effect conclusions resource by resource.
  7. Assemble the filing. Include drawings, maps, property evidence, consultation records, study reports, environmental measures, and construction dates appropriate to the selected path.
  8. Track agency conditions and comments. During FERC review, respond to scoping comments, recommendations, requests for information, and draft environmental-document comments. Conditions can affect design, operations, monitoring, and construction timing.
  9. Obtain non-FERC approvals. Confirm Section 401, coastal consistency, species, historic-preservation, dam-safety, land-use, building, water-rights, and other approvals with the authorities that regulate the site. Their requirements vary by state, tribe, locality, and project design.

How project choices change the environmental workload

Existing dam versus new diversion

Using an existing dam may reduce the amount of new civil construction, but it does not eliminate analysis of altered flows, fish passage, sediment, recreation, dam safety, or cultural resources. A new diversion, impoundment, penstock, or transmission corridor can expand the affected area and the studies needed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Natural water feature versus man-made conduit

A conduit project can have a narrower physical footprint when the conveyance already exists, but eligibility depends on the conduit’s purpose, ownership, capacity, and licensing history. A water-supply or irrigation conduit operated primarily for a non-hydroelectric purpose is not the same as a conduit built primarily to generate electricity.

Federal land or federal dam involvement

Federal land and federal-dam connections can establish FERC jurisdiction and add land-management or operating constraints. The 10-MW exemption described by FERC does not apply at a federal dam, even though federal land may be involved in an otherwise eligible project.

Common mistakes and how to correct them

  • “It is small, so no FERC filing is needed.” Recheck jurisdiction using the waterway, land, dam, construction-date, and commerce facts rather than capacity alone.
  • “An exemption means no environmental obligations.” Exempted projects remain subject to mandatory terms and conditions from federal and state fish-and-wildlife agencies and FERC, and FERC can require additional review when adverse effects appear likely.
  • “A conduit label guarantees a conduit exemption.” Verify the 40-MW limit, man-made nature, primary non-hydroelectric purpose, ownership, property rights, and relevant licensing dates.
  • “An EA is the same as an EIS.” An EA is the usual starting document for a licensed project; FERC prepares an EIS when significant effects are expected.
  • “A general no-impact paragraph is enough.” Address each environmental resource separately and explain the factual basis for a no-effect conclusion.
  • “State and local permits can be listed from a national template.” Requirements for water rights, dam safety, construction, land use, shoreline protection, and similar matters vary by jurisdiction and must be confirmed locally.

What cannot be settled without site details

No nationwide checklist can determine every permit for an unnamed project. The final set depends on the state or territory, tribal jurisdiction, county or municipality, landowner, water-rights system, dam classification, conduit ownership, affected species and habitats, cultural resources, and construction methods. Projects outside the United States follow the law of their own jurisdiction rather than the FERC framework described here.

For a U.S. proposal, the defensible sequence is therefore: establish FERC jurisdiction, select the correct license or exemption route, consult agencies and tribes, develop resource-specific studies, and then confirm parallel state, tribal, local, and land-management approvals. That sequence prevents a capacity threshold from being mistaken for a complete permit decision.
