A retailer breach does not prove that anyone has used your card. In the United States, your protection depends on whether the card is credit or debit, whether only an account number or the physical card was compromised, and how quickly you report an unauthorized transaction. Monitor the account immediately, contact the issuer about anything suspicious, and use the formal dispute process and deadlines that apply to your card.
What a breach notice does—and does not—mean
A breach notice means information held by a retailer may have been accessed. It is a warning to watch the account, not evidence that a fraudulent charge has already occurred. The Consumer Financial Protection Bureau (CFPB) advises checking statements and transaction alerts closely and reporting suspicious activity promptly. Fraud can appear months after information is stolen, so do not stop monitoring when the first few statements look normal.
Review both recent and older activity for small test charges, unfamiliar recurring payments, cash withdrawals, electronic transfers, and merchant names that differ from the store name. A legitimate transaction can appear under a parent company, payment processor, or abbreviated descriptor, so ask the issuer to identify a merchant before treating an unfamiliar name as fraud. If you cannot recognize a transaction after checking, report it rather than waiting for another charge.

The rules below describe U.S. consumer credit and debit cards. Your issuer’s contract, account type, and the payment network can add procedures or broader protection. Commercial cards, anonymous prepaid cards, and transactions outside a network’s processing system can be treated differently.

Credit cards: the federal baseline
Account number exposed, but the physical card is still with you
Under the federal Fair Credit Billing Act (FCBA), you generally are not responsible for unauthorized charges made with only your credit-card account number. This is the usual fact pattern after a retailer database breach: the number or token may be exposed while the physical card remains in your wallet. Report the charge to the issuer as soon as you see it so the account can be blocked, replaced, and investigated.
Physical credit card lost or stolen
Federal law generally limits liability for unauthorized credit-card use to $50 when the statutory conditions are met. The U.S. Code provision applies to unauthorized use before the issuer receives notice and requires the issuer to provide specified disclosures and satisfy other conditions. If the card is missing, notify the issuer immediately; do not rely on the account-number rule for a physically lost or stolen card.
What the FCBA dispute process covers
Credit-card rights are broader than a simple “someone used my card” claim. The FCBA can cover billing errors such as unauthorized transactions, charges for goods or services not delivered as agreed, duplicate charges, and certain amount or date errors. A retailer breach by itself is not a billing error; the dispute begins when an incorrect charge appears on your statement.

To preserve the formal written-notice procedure, send the issuer a written billing-error notice within 60 days after the first statement containing the error was sent. Use the billing-inquiries address printed on the statement or the electronic method the issuer specifically accepts for billing disputes. A customer-service phone call is useful for immediate containment, but a call alone may not satisfy the FCBA written-notice requirement. Keep a copy of the notice, the statement, supporting records, and proof of delivery.
Credit-card investigation timing
The CFPB describes a general expectation of resolution within two billing cycles for a credit-card billing-error investigation. That is an investigation framework, not a promise that every claim will be credited on a particular day. Ask the issuer whether it will provide a temporary adjustment while reviewing the claim and how it wants you to handle the disputed amount during the investigation.
Debit cards: timing controls much of the risk
Only the debit account number was exposed
For unauthorized electronic fund transfers involving an account number, the Federal Trade Commission (FTC) summarizes a federal reporting period of 60 calendar days after the statement showing the transaction is sent. Report as soon as you discover the problem; waiting until the last day can make it harder to establish when you learned of the charge and can allow additional withdrawals.

Debit transactions remove money directly from a deposit account, so the practical consequences differ from a credit-card charge. Ask the bank or credit union to block further electronic debits, replace the card or account credentials, and explain its process for provisional credit and written confirmation.
The physical debit card was lost or stolen
If the debit card itself is missing, CFPB guidance says to notify the financial institution within two business days after learning of the loss to limit liability to no more than $50. The reporting clock starts when you discover the loss, not when a breach notice arrives. If you find the card missing, freeze or cancel it immediately even if no unauthorized transaction has appeared.
Debit-card liability can increase when notice is delayed. Because the exact outcome depends on the facts, account agreement, and applicable electronic-fund-transfer rules, get the bank’s instructions in writing and preserve the date and time of every report.

Debit investigation and provisional credit
CFPB consumer guidance describes a general 10-business-day investigation expectation. A debit investigation can take up to 45 days, and sometimes 90 days, when the institution provides provisional credit under the applicable conditions. These are general time frames, not a guaranteed reimbursement date. Confirm whether provisional credit is available, when it will appear, and what could cause it to be reversed.
Credit versus debit: the key differences at a glance
| Situation | Credit card | Debit card | Action |
|---|---|---|---|
| Only account number exposed in a retailer breach | Unauthorized account-number charges generally carry no consumer liability under federal rules. | Report account-number misuse within 60 calendar days after the statement is sent; delay can affect liability. | Monitor continuously and notify the issuer at the first suspicious transaction. |
| Physical card lost or stolen | Federal liability is generally capped at $50 when statutory conditions are met. | Report within two business days after discovering the loss to limit liability to no more than $50. | Lock or cancel the card immediately and request a replacement. |
| Formal dispute deadline | Written FCBA notice within 60 days after the first statement carrying the error is sent. | Use the bank’s electronic-fund-transfer dispute procedure; prompt notice is critical. | Follow the issuer’s stated channel and keep proof. |
| Investigation guidance | Generally two billing cycles. | Generally 10 business days; may extend to 45 or sometimes 90 days when provisional-credit conditions apply. | Ask when temporary credit is issued and how to avoid reversal surprises. |
Network “zero-liability” promises are separate from federal law
Payment networks may advertise zero-liability protection that is broader than the statutory baseline, but the promise is contractual and conditional. Visa says its policy applies to most Visa credit and debit cards, with exclusions that include certain commercial and anonymous prepaid transactions and transactions not processed by Visa. Mastercard conditions its policy on reasonable care and prompt reporting and excludes certain commercial and unregistered prepaid cards.

What to do after receiving a breach notice
- Read the notice for scope and dates. Identify whether the retailer says payment-card numbers, expiration dates, security codes, tokens, or other identity information were involved. A notice may not establish that every customer or every data element was affected.
- Check the account now. Review pending and posted transactions, statements, cash withdrawals, and recurring payments. Turn on push, text, or email alerts for purchases, withdrawals, and changes to contact information.
- Verify suspicious activity with the issuer. Call the number on the back of the card or use the issuer’s official app or website. Explain that you received a breach notice and identify each transaction you do not authorize. Request a card lock, replacement card, new number, or account change as appropriate.
- Follow the correct written process. For a credit-card billing error, send the FCBA notice within 60 days to the billing-inquiries address or accepted electronic channel. For a debit dispute, use the bank’s specified fraud or electronic-transfer process and ask whether a written statement or affidavit is required.
- Document every step. Save the breach notice, statements, transaction dates and amounts, screenshots, emails, confirmation numbers, and the names of representatives. Record when and how you reported the issue.
- Continue monitoring after replacement. A new card number stops many further card transactions but does not erase already posted charges or necessarily stop a merchant’s recurring authorization. Review subsequent statements and confirm that unwanted recurring payments are canceled.
- Escalate unresolved issues. Ask for the issuer’s written explanation and complaint process. If the issue remains unresolved, consult the appropriate federal consumer-protection complaint channel and keep your complete records.
When the breach involved more than card credentials
If the exposed information includes a Social Security number, driver’s-license data, login credentials, or other identity information, watch for new-account fraud and account-takeover attempts as well as card charges. The FTC directs consumers to its free IdentityTheft.gov recovery service when identity theft is suspected. That resource is separate from the card issuer’s dispute process.
Paid monitoring is not a prerequisite for the federal protections described here, and monitoring cannot prevent every fraudulent transaction. Treat any monitoring offered after a breach as optional and secondary to contacting the issuer, reviewing accounts, and filing the required dispute.
Common mistakes that can weaken a claim
- Waiting for a charge before acting. A breach notice alone does not prove fraud, but it justifies closer monitoring and alert setup immediately.
- Confusing an unfamiliar merchant name with fraud—or ignoring it. Verify descriptors with the issuer; report transactions that remain unauthorized.
- Using only a phone call for a credit-card billing error. Call to stop further use, then send the written FCBA notice through the required channel.
- Missing the debit-card reporting clock. The two-business-day rule for a lost physical card and the 60-day account-number rule are different.
- Assuming every zero-liability policy is unconditional. Network exclusions, reasonable-care requirements, prompt-reporting conditions, and issuer rules still apply.
- Stopping after a replacement card arrives. Continue checking statements for delayed or recurring transactions.
- Disputing the wrong problem. A breach-related unauthorized charge is different from non-delivery, an incorrect amount, or a product-quality complaint. Credit-card billing-error rights can cover some of those issues; debit protections are narrower.
Questions to ask your issuer
- Was the transaction processed as credit, debit, an electronic fund transfer, or a recurring authorization?
- Is the physical card considered lost or stolen, or was only account information exposed?
- What is the issuer’s required dispute form, address, or secure-message path?
- When will the investigation begin, and is provisional credit available?
- Will replacing the card stop recurring payments, or must each merchant be contacted?
- Which network zero-liability terms apply, and are there exclusions for this card type?
Bottom line for U.S. consumers
A retailer breach is a trigger for vigilance, not a finding that fraud occurred. Credit-card account-number misuse generally has the strongest federal protection, with no liability for account-number-only charges and a statutory $50 ceiling for qualifying unauthorized use of a physical card. Debit-card protection depends heavily on when you report the problem, especially when the physical card is lost. Contact the issuer promptly, meet the applicable written or reporting deadline, preserve records, and treat network zero-liability promises as conditional benefits rather than replacements for federal rights.
