Mortgage lenders can use AI agents for intake, document handling, servicing support, and decision assistance, but an agent does not change the lender’s legal responsibilities. Govern each use as part of the origination or servicing operation: define its authority, restrict and monitor borrower-data flows, assign accountable owners, preserve an audit trail, and provide human escalation. If an agent influences a credit decision, the lender must be able to identify the actual decision factors and give specific, accurate adverse-action reasons when required.

The U.S. rules that apply depend on the lender, loan product, transaction, data flow, and jurisdiction. Fannie Mae’s seller/servicer framework is important for covered business, but it is not a universal AI statute. Confirm current federal and state requirements with qualified counsel before placing an agent into production.

Why an AI agent needs a different control plan

A conventional software rule follows a fixed path. An AI agent can interpret unstructured documents, choose among tools, generate messages, infer information, and alter its behavior when a model or prompt changes. Those capabilities create control questions that ordinary application access reviews may miss:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What task is the agent authorized to perform, and can it merely assist or actually approve, deny, price, or change a loan?
  • Which borrower information can it retrieve, infer, retain, or send to an outside model?
  • Can a reviewer reconstruct the information and instructions that produced an output?
  • What happens when the agent is uncertain, encounters conflicting records, or produces an answer that cannot be explained?
  • Who can pause, correct, or roll back the use case?

Treat the agent as a controlled business process, not as an isolated chatbot. The consequence of an incorrect marketing draft is different from an incorrect underwriting recommendation, so controls should increase with decision authority, data sensitivity, and the difficulty of reversing an outcome.

What Fannie Mae’s 2026 AI/ML framework covers

Fannie Mae Lender Letter LL-2026-04, dated April 8, 2026, applies when a seller/servicer uses AI or machine learning in the origination of loans sold to or guaranteed by Fannie Mae or in servicing performed on Fannie Mae’s behalf. It becomes effective 120 days after publication. A lender covered by that scope should map its agent program to the letter and continue to follow applicable law and the Lender Contract.

The letter calls for policies and procedures covering development, implementation, use, maintenance, and risk management. It also expects transparent communication to appropriate personnel; trustworthy and ethical AI characteristics; legal and regulatory awareness; risk management tied to the organization’s risk tolerance; and assigned ownership with at least annual review. Information-security requirements remain relevant, and vendor or subcontractor AI governance must be no less protective than the seller/servicer’s own controls. Fannie Mae may request information about the AI types used, their purpose and manner of use, safeguards, and other details.

Fannie Mae states: “To the extent a seller/servicer uses AI/ML in connection with the origination of loans sold to or guaranteed by Fannie Mae or servicing loans on behalf of Fannie Mae, the seller/servicer must ensure compliance with applicable laws and the Lender Contract.” The statement is a seller/servicer expectation with a defined scope, not a rule that automatically governs every lender, model, or loan.

Classify an agent by authority and consequence

Before approving a deployment, write a plain-language description of the agent’s task, permitted actions, prohibited actions, data sources, and required human decisions. The following risk bands are an internal planning tool, not a regulator’s official classification.

Use case Typical authority Controls to emphasize Why the risk changes
Clerical extraction Reads documents and populates a draft field; a person verifies it Source citations, field-level validation, correction log, restricted write access An error can enter the file but does not directly decide eligibility if verification is real.
Borrower communications Drafts status messages or answers routine questions Approved content boundaries, identity checks, disclosure review, escalation for complaints or hardship Incorrect guidance can mislead a borrower or affect deadlines.
Underwriting assistance Summarizes records or recommends conditions for an underwriter Independent human decision, reason traceability, disparate-outcome testing, versioned prompts and models The recommendation may materially influence credit treatment even if a person signs off.
Automated credit action Approves, denies, prices, or changes terms without case-by-case human review Highest validation standard, decision-factor logging, adverse-action production, strict change control and rollback The agent’s output is the operative credit decision and is difficult to reverse later.
Servicing action Applies a payment, fee, loss-mitigation step, or account change Authorization limits, transaction confirmation, exception queues, complete event history Errors can affect balances, delinquency status, or borrower rights.

Control borrower data from collection through deletion

Inventory every data path

Document each field the agent can access, generate, infer, or transmit. Include loan files, identity information, income and asset records, property information, communications, internal notes, model prompts, tool responses, and telemetry. Record the system of origin, permitted purpose, user or service account, destination, retention period, and whether an outside model or subcontractor receives the data.

Use only necessary and permitted information

For each field, state why the task needs it and whether the proposed use is permitted under the laws and contracts that apply to the lender and product. A privacy impact assessment can help identify how personally identifiable information is collected, used, and handled, test conformity with requirements, and document mitigations. Fannie Mae’s Selling Guide identifies borrower privacy and consumer-credit/equal-credit requirements among the laws covered sellers, servicers, subservicers, third-party originators, and technology licensees must follow.

Do not assume that masking a name makes a mortgage record harmless. Combinations of address, property, income, dates, and free-text notes can identify a household. Separate production data from development and testing, minimize copied records, and prevent prompts or model logs from becoming an unapproved secondary repository.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Set security and retention rules before launch

Use least-privilege credentials, encrypt data in transit and at rest, restrict tool calls, and require a human confirmation for irreversible actions. Define how long prompts, outputs, and audit records are retained, who can retrieve them, and how deletion or legal holds work. Test that a vendor cannot use borrower content for unrelated model training or expose it through another customer’s session. Align incident notification, evidence preservation, and access revocation with the lender’s existing information-security program.

Make credit decisions explainable and reproducible

When an agent influences eligibility, pricing, terms, or another credit decision, preserve a decision record that a qualified reviewer can understand later. At minimum, capture the model and prompt versions, data snapshot or source references, retrieved documents, tools called, rules applied, human overrides, timestamps, and the final decision owner. A generic statement that “the algorithm declined the application” is not a useful explanation.

In guidance issued September 19, 2023, the Consumer Financial Protection Bureau said creditors using complex algorithms must provide specific and accurate reasons for adverse action. Its examples warn that a checklist of possible reasons is inadequate when the selected items do not reflect the actual reasons. CFPB Director Rohit Chopra stated: “Creditors must be able to specifically explain their reasons for denial. There is no special exemption for artificial intelligence.” This is 2023 guidance; apply it together with the current statute, regulation, official interpretations, and later agency materials.

Design the adverse-action process before deployment. Map each decision factor to a permitted reason code and a plain-language explanation, test that the generated notice matches the factors actually used, and route cases to a human when the system cannot produce a faithful explanation. Store the evidence needed to reproduce the result without relying on a model that may later be updated.

Address fair-lending, privacy, and technology oversight

AI oversight is not limited to accuracy. A September 2025 Government Accountability Office report on property technology in homebuying and mortgage evaluation identified potential fair-lending, privacy, and oversight concerns. Test whether outcomes, error rates, escalation rates, and explanations differ across relevant borrower and property characteristics. Investigate disparities rather than assuming that removing a protected characteristic removes its proxies.

The CFPB’s current ECOA resource records a final Regulation B rule issued April 22, 2026, amending provisions concerning disparate impact, discouragement, and special purpose credit programs. Because the legal text and interpretations can change, compliance staff should read the current rule and determine which provisions apply to the lender’s product and conduct. Do not treat an older policy memo or a general “fairness score” as a substitute for that analysis.

Regulation Z is another mortgage rule set to check: CFPB materials identify mortgage loans, disclosures, servicing, and appraisal requirements within its coverage, while noting that an interactive resource is not the official legal edition. Use the official regulation and applicable interpretations for legal reliance.

Manage vendors, models, and subcontractors

List every provider that hosts a model, supplies data, operates an agent, labels training records, or can view borrower content. Review its access controls, geographic processing locations, retention and deletion terms, incident procedures, model-change notices, subcontractors, audit rights, and ability to support an adverse-action explanation. Require the provider to identify material model or prompt changes and to preserve the records your lender needs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For Fannie Mae-covered use, vendor and subcontractor AI risk governance should be no less protective than the seller/servicer’s own program. A contract alone does not transfer accountability: the lender still needs an owner who can suspend the integration, investigate an incident, and demonstrate compliance.

Deploy an agent with a controlled lifecycle

  1. Define the use case. Name the business owner, intended users, loan products, jurisdictions, permitted outputs, prohibited actions, and the point at which a human must decide.
  2. Classify authority and data. Rate the consequence of an error, sensitivity of the data, external sharing, reversibility, and explainability. Use the highest applicable control level when factors conflict.
  3. Complete privacy and legal review. Map data flows, confirm purpose and permissions, identify federal, state, and local requirements, and document unresolved questions for counsel or compliance.
  4. Validate before production. Test representative and edge cases, conflicting documents, missing data, prompt injection, unauthorized tool calls, hallucinated facts, and the quality of explanations. Compare results across relevant borrower and property scenarios.
  5. Build human escalation. Define confidence or exception triggers, response time, reviewer authority, borrower communication, and a safe state when the agent is unavailable. A human review that merely rubber-stamps an output is not meaningful control.
  6. Record and approve changes. Version models, prompts, retrieval sources, tools, policies, and thresholds. Require documented approval and regression testing before a material change.
  7. Monitor in operation. Track error and override rates, drift, unexplained decisions, disparate outcomes, data-access violations, vendor incidents, and complaints. Give a named owner authority to pause the agent.
  8. Review at least annually where required. For Fannie Mae-covered use, align the program with LL-2026-04’s ownership and annual-review expectation. Reassess sooner after a law, product, vendor, model, or data-flow change.

Choose an implementation approach by control needs

Approach Suitable when Main advantage Main trade-off
Internal agent with approved enterprise models The lender can operate identity, logging, security, and model governance Greater control over data paths and change management Requires substantial validation, monitoring, and specialist staffing
Managed vendor agent A provider supplies hosting, orchestration, or domain workflows Faster deployment and access to specialized capabilities Vendor and subcontractor access, retention, model changes, and evidence must be contractually and technically controlled
Human-in-the-loop assistant The lender wants productivity gains without delegating the final decision Limits autonomous actions and creates a review point Review quality must be measured; human involvement does not erase discrimination or explanation duties
Fully automated decision agent The lender has mature validation, monitoring, rollback, and explanation controls Potentially consistent handling at high volume Highest consequence, documentation burden, and exposure when a factor is wrong or unexplained

There is no evidence-based universal ranking among these approaches. Select based on authority, data sensitivity, reconstructability, human oversight, vendor access, and the loan-program and jurisdiction obligations that apply.

Common failure modes and corrective actions

  • “It is only a chatbot.” If it retrieves account data, drafts a borrower-specific answer, or recommends a condition, document it as an operational use case with appropriate controls.
  • Training or testing with live borrower records. Remove unnecessary fields, segregate environments, and confirm that the provider’s retention and training practices match the approved purpose.
  • Adverse-action reasons selected from a generic menu. Generate reasons from the factors that actually drove the outcome and test the notice against the decision log.
  • Human approval without evidence of review. Require the reviewer to see source records, record changes, and explain why an override was accepted.
  • Vendor assurance accepted at face value. Verify subcontractors, access paths, incident handling, retention, and model-change notification; obtain evidence suitable for the lender’s audit.
  • One-time approval. Monitor drift, complaints, overrides, and disparities, and trigger reassessment after material changes.
  • Applying Fannie Mae’s framework universally. First determine whether the lender sells loans to or services loans for Fannie Mae; then apply the letter alongside all other applicable law and contract terms.

Documents an examiner or auditor will expect

Maintain a current inventory of agents and owners; approved use-case and data-flow records; privacy impact assessments; vendor and subcontractor reviews; validation and fairness-test results; model, prompt, and policy versions; access and tool-call logs; human-review and override records; adverse-action reason testing; incident and rollback exercises; monitoring reports; complaints and remediation; and annual governance reviews. Keep the record tied to the actual production configuration, not only to a pilot or a vendor brochure.

Because state privacy and AI laws, federal interpretations, Fannie Mae implementation guidance, and CFPB rules can change, assign responsibility for watching updates and connecting each change to affected products and workflows. The reviewed federal materials do not resolve every state requirement or every technical control for every architecture; facts-specific legal and security review remains necessary.

A practical go-live checklist

  • The business owner and accountable executive are named.
  • The agent’s authority, prohibited actions, escalation triggers, and rollback method are tested.
  • Every borrower-data input, output, destination, retention period, and subcontractor is documented.
  • Applicable loan-program, federal, state, and local requirements are identified using current official text.
  • Decision factors can be reconstructed, and adverse-action reasons are specific and accurate where required.
  • Validation covers edge cases, security abuse, model changes, errors, drift, and relevant disparate outcomes.
  • Monitoring, complaint intake, incident response, and periodic review have assigned owners and deadlines.
  • Production access is limited to approved users and service accounts, with logs retained under policy.
