“Made in America” is not the same as “assembled in America.” For an unqualified Made in USA claim on an electronic or technology product, the Federal Trade Commission (FTC) expects final assembly or processing, all significant processing, and all or virtually all components to be made and sourced in the United States. A product with imported parts may qualify for a carefully worded assembly claim only when the U.S. assembly is principal and substantial and the product was last substantially transformed in the United States.
A U.S. company address, American brand, or factory where workers perform a final screwdriver operation does not establish domestic origin by itself. Marketing claims and the country-of-origin marking required by U.S. Customs and Border Protection (CBP) involve related but separate analyses.
The short answer: three origin questions matter
When you see an origin statement on a laptop, battery, router, appliance, industrial controller, or other technology product, evaluate three separate questions:
Recommended Free Tools
- What exactly does the label say? “Made in USA,” “Assembled in USA,” and qualified statements about U.S. content carry different implications.
- What happened in the United States? The location of final assembly is only one factor. The amount and importance of processing performed there also matter.
- Where did the components come from? Major electronics parts such as circuit boards, processors, storage devices, displays, cells, motors, and power modules can be decisive for an unqualified claim.
The FTC describes the unqualified standard this way: “For a product to be called Made in USA, or claimed to be of domestic origin without qualifications or limits on the claim, the product must be ‘all or virtually all’ made in the U.S.” That is a demanding standard, not a synonym for final packaging or testing in an American facility.

What an unqualified “Made in USA” claim requires
An unqualified claim is one that presents a product as American-made without a limiting phrase, percentage, component disclaimer, or other qualification. The FTC’s current business guidance connects three conditions.
U.S. final assembly or processing
The product’s final assembly or processing must occur in the United States. This condition identifies where the finished item came together, but it does not settle the claim by itself. A facility that merely installs imported modules, applies a label, or performs a simple connection may not be doing enough work to support the representation.
All significant processing in the United States
Significant processing must also take place domestically. Processing can include operations that give the product its functional characteristics, not just the last visible assembly step. The relevant question is whether the U.S. work represents meaningful manufacturing rather than a minor finishing operation.
All or virtually all components made and sourced here
For an unqualified claim, all or virtually all components must be made and sourced in the United States. “Virtually all” is not a published percentage that can be applied mechanically to every product. A marketer needs a reasonable basis for the overall impression, including the origin and significance of the parts that make the product work.
In electronics, a small imported screw and an imported processor do not carry the same significance. A claim that ignores the origin of major functional components can mislead even if many low-cost parts are domestic.

Why U.S. assembly alone is not enough
The FTC’s computer example illustrates the boundary. Imagine a computer whose motherboard, hard drive, and other major components are imported and then joined in the United States through a simple screwdriver operation. That location of the last step does not support an unqualified Made in USA claim. The FTC says the product would not qualify for an unqualified Assembled in USA representation on those facts and would need a foreign country-of-origin mark.
This is an example, not a universal ruling about every computer or every electronics factory. Origin depends on the actual production record: which parts arrive from abroad, what transformations occur domestically, how extensive the work is, and which components are central to the product’s identity and function.
“Assembled in USA”: when imported parts may be disclosed
“Assembled in USA” can be accurate when a product contains foreign components, but it is not a shortcut around the Made in USA standard. The FTC looks for two related facts:
- Principal assembly occurs in the United States. The domestic operation must be the main assembly activity, not a minor finishing or packaging step.
- The assembly is substantial and the product was last substantially transformed here. The U.S. process should create a meaningful finished product rather than simply join largely complete imported units.
A qualified statement must also avoid creating a misleading impression about the amount or role of U.S. content. “Assembled in USA from imported and domestic components” communicates more than “Assembled in USA” alone when the source and importance of foreign parts would otherwise be unclear. The exact wording must be supported by the company’s production and sourcing records.
Made in USA, qualified claims, and assembled claims compared
| Claim wording | What must be evaluated | What the wording does not establish | Primary context |
|---|---|---|---|
| Unqualified “Made in USA” | U.S. final assembly or processing; all significant processing in the United States; and all or virtually all components made and sourced in the United States. | It is not established by a U.S. headquarters, American brand, or a final installation step. | FTC marketing standard and, for labeling claims, the Made in USA Labeling Rule. |
| Qualified U.S.-origin statement | A truthful, substantiated explanation of domestic content or processing that does not overstate the U.S. contribution. | A qualification does not excuse an implication that the whole product is domestic when important parts are imported. | FTC deception analysis under the FTC Act and applicable labeling requirements. |
| “Assembled in USA” | Principal, substantial U.S. assembly and last substantial transformation in the United States, with wording that accurately reflects foreign components. | It does not mean every part is U.S.-made or that any U.S. assembly qualifies. | FTC guidance, with CBP origin principles relevant to imported-goods marking. |
| Foreign country-of-origin mark | CBP’s case-specific determination of where the imported good was last substantially transformed and whether marking is required. | A CBP conclusion about marking does not automatically authorize a Made in USA promotional claim. | Customs marking, separate from the FTC’s advertising standard. |
FTC marketing rules and CBP customs marking are different
Companies often confuse two decisions: what origin mark an imported good must carry and what origin claim may appear in advertising, packaging, or a product listing. CBP administers foreign country-of-origin marking. Its general substantial-transformation analysis asks whether a process creates a new and different article with a new name, character, and use. CBP makes that determination case by case.

The FTC’s consumer-protection analysis is broader in a different way. It examines whether a representation gives consumers a deceptive impression, including whether “Made in USA” suggests that major imported electronics are domestic. The FTC has emphasized that a CBP finding that a foreign mark is not required does not necessarily permit a Made in USA promotional claim. A business may therefore need no foreign mark under a particular customs analysis and still lack support for an unqualified U.S.-origin advertisement.

The FTC’s July 2021 announcement states, “The rule applies only to labeling claims.” The rule gives the agency a specific enforcement tool for covered labels, tags, packaging, and similar representations. The FTC also retains authority under Section 5 of the FTC Act to pursue deceptive origin claims outside the rule’s labeling scope, including misleading advertising or online product descriptions.
For a technology company, the practical result is that every consumer-facing expression should be reviewed: the product carton, quick-start guide, online store page, marketplace listing, specification sheet, paid advertisement, and statement made by sales staff. Changing the wording from a box to a website does not eliminate the need for substantiation.
How “substantial transformation” works for technology products
Substantial transformation is a fact-intensive concept rather than a single assembly-time threshold. The relevant process must create a new and different product with a new name, character, and use. A simple operation that leaves the imported article essentially the same is less likely to qualify than a complex process that gives the item its final identity and function.
Questions to ask about a device
- Does the U.S. operation manufacture or significantly process the core electronics, or only install finished modules?
- Are the imported parts generic inputs, or are they the product’s principal functional units?
- Does the domestic process determine the product’s final capabilities, configuration, and intended use?
- How much labor, engineering, testing, calibration, and integration occur domestically?
- Would a reasonable buyer view the imported component as the product itself or as one input into a newly made device?
These questions help organize a compliance review, but they do not replace a CBP ruling or an FTC substantiation analysis for a particular product.

Electronics-specific examples
Computers and networking equipment
A desktop, server, router, or industrial gateway may have a U.S. final-assembly line while relying on an imported motherboard, processor, memory, storage device, radio module, or power supply. The origin analysis must account for those parts and for the work performed in the United States. Plugging modules into a chassis, loading firmware, and applying a serial-number label may be insufficient if the imported components already provide the product’s essential identity and function.
Batteries and power products
Cells, battery-management electronics, housings, and pack integration can come from different countries. In April 2022, the FTC described its first case under the Made in USA Labeling Rule as involving allegations that Lithionics marketed batteries as Made in USA while using lithium-ion cells made in China. The agency’s account was an allegation in that case, not a finding about every battery or a survey of current products. It illustrates why a company must document the origin of major energy-storage components before using an unqualified claim.
Displays, appliances, and embedded systems
For a monitor, smart appliance, medical device, or vehicle controller, the panel, sensor package, control board, motor, or communications module may be more significant than the enclosure or final wiring. Domestic machining of a cabinet does not by itself make an imported display-based product American-made. The analysis follows the actual bill of materials and manufacturing sequence.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to evaluate an origin claim before buying or publishing it
- Capture the exact wording. Save the label, product page, advertisement, and any nearby qualifier. “Made in USA,” “Designed in USA,” “Assembled in USA,” and “contains U.S. and imported parts” are not interchangeable.
- Map the production steps. List where fabrication, board population, software loading, calibration, testing, final assembly, and packaging occur.
- Identify significant components. Separate major functional parts from low-value hardware. Record the country of manufacture and sourcing for each.
- Test the claim’s overall impression. Ask what an ordinary buyer would infer about the finished product, not merely what a technically accurate sentence could mean in isolation.
- Keep contemporaneous substantiation. Maintain supplier certifications, bills of materials, process descriptions, cost and value analyses, and engineering records that support the wording used.
- Separate customs advice from marketing review. A CBP marking conclusion and an FTC advertising analysis should be treated as distinct workstreams.
- Recheck after design changes. A new imported chip, display, battery cell, contract manufacturer, or preassembled module can change the factual basis for an existing claim.
Common mistakes and how to correct them
“Our company is American, so the product is American”
Corporate domicile, ownership, or a U.S. mailing address says little about where a particular product was made. Correct the claim by analyzing the product’s actual components and processing.

“Assembled” and “made” mean the same thing
They do not. Use an assembly statement only when the U.S. operation is principal and substantial, and qualify it so consumers are not misled about imported parts.
“No foreign mark was required, so our ad is compliant”
Customs marking and promotional claims answer different legal questions. Obtain separate analysis for the marketing representation.
“One product’s ruling applies to our entire category”
Origin decisions depend on model-specific bills of materials and processes. Do not generalize from a computer example, a battery case, or another company’s determination.
What consumers can—and cannot—conclude from a label
An unqualified Made in USA label represents a high level of domestic manufacture under the FTC standard. An Assembled in USA statement indicates substantial domestic assembly but can coexist with imported components. A qualified statement may describe a narrower domestic contribution, yet its wording and presentation still need to be truthful and substantiated.
No official source in the guidance summarized here provides a reliable population-wide percentage for how many electronics sold in the United States are made domestically. Consumers should therefore avoid assuming that a particular share of the electronics market qualifies and instead examine the exact claim and any disclosed component information for the product they are considering.
Bottom line for electronics makers and buyers
“Made in America” is a production-origin claim, not a branding shortcut. For electronics, an unqualified Made in USA representation requires U.S. final assembly or processing, U.S. significant processing, and all or virtually all components made and sourced in the United States. Imported parts can be compatible with a carefully supported Assembled in USA or other qualified statement only when the U.S. work is substantial and the wording accurately conveys the product’s foreign content. CBP marking decisions and FTC marketing standards must be assessed separately, using the facts of the specific model and production run.
