Local governments can require a data-center applicant to follow the land-use approval process established by state and local law. Depending on the site, that can mean rezoning, a conditional- or special-use permit, site-plan review, building permits, and compliance with adopted standards for noise, setbacks, lighting, traffic, water, stormwater, emergency access and neighborhood compatibility.

There is no nationwide checklist. The answer depends on the state, county or city, the zoning district, the approval route, and the law in effect when the application is filed. Local approval also does not replace state environmental permits, utility regulation or federal requirements.

Start with the decision being requested

Before asking what officials can demand, identify the exact decision and the public body that makes it. A new data center may be allowed by right in one zoning district, but require discretionary review in another. The application could involve several separate decisions rather than one all-purpose permit.

Common local approval paths

  • Rezoning: The applicant asks the governing body to change the parcel’s zoning designation or text. This is usually a legislative decision tied to the comprehensive plan and public-hearing rules.
  • Conditional, special-use or special-exception approval: The use is allowed only after an appointed board, planning commission or governing body finds that specified standards are met and imposes lawful conditions.
  • Site-plan or development-plan review: Staff or a board checks layout, access, drainage, landscaping, utilities, fire protection, lighting and similar site standards.
  • Building and related permits: Construction still requires permits under the building, electrical, mechanical, fire, grading, floodplain or stormwater codes that apply locally.

North Carolina’s 2025 legislation expressly refers to rezoning applications, special exceptions, conditional- or special-use permits and building permits for siting a new data center. Virginia Code § 15.2-2209.5 addresses specified approvals for high-energy-use facilities. Those statutes illustrate why the approval route must be established before anyone describes a requirement as universal.

Documents to obtain first

  1. Current zoning map and the complete ordinance definition of “data center” or comparable use.
  2. The comprehensive plan, area plan and adopted compatibility policies for the parcel.
  3. The applicant’s filing, plans, studies, traffic information and proposed conditions.
  4. Staff reports, hearing notices, meeting minutes and any draft development agreement.
  5. Current amendments, moratoria, effective dates and transition provisions.

What local standards can address

A locality generally may apply standards found in its adopted zoning, subdivision, development, building, noise, stormwater and public-safety codes. It may also adopt new standards through the legislative process required by its state law. Whether a particular condition is valid depends on the statute, ordinance, procedural record and connection to a reviewable land-use impact.

Typical review subjects

Subject What officials may examine Important qualification
Use and compatibility Whether the use belongs in the district; consistency with the comprehensive plan; proximity to homes, schools and other sensitive uses. Some jurisdictions treat data centers as a distinct use; others apply an existing industrial or utility category.
Setbacks and buffers Distance from property lines, residences, roads, streams and other protected features; landscaping or visual screening. Distances are local rules, not national norms.
Noise Generator testing, cooling equipment, construction, tonal noise and nighttime limits; baseline and compliance measurements. Standards, measurement locations and enforcement methods differ by ordinance.
Lighting and appearance Fixture shielding, glare, illumination at property lines, building scale, screening and landscape plans. Requirements must come from applicable design or zoning authority.
Traffic and roads Truck routes, construction traffic, driveway design, road capacity, intersection work and maintenance responsibilities. Traffic conditions should be tied to adopted standards or documented impacts.
Water and wastewater Cooling-water demand, source and availability, wastewater capacity, discharge plans and drought or conservation effects. State agencies may control water-use or discharge permits even when the locality reviews land use.
Stormwater and floodplain Drainage, detention, erosion control, impervious area and floodplain impacts. Local approval does not replace state or federal environmental authorization.
Emergency access Fire lanes, hydrant or water supply, responder access, hazardous-material information and emergency plans. Fire-code and emergency-management authority may be separate from zoning.

Examples of local distances

Calvert County, Maryland, reports a 200-foot setback from property lines and a 400-foot distance from parcels with existing residences or active residential building permits. Those figures describe that county’s reported rules, not a generally applicable standard. Calvert County also reports a six-month moratorium adopted August 18, 2026; its current status and ordinance text should be checked before relying on it.

Linn County, Iowa, reports data-center zoning rules adopted February 18, 2026, covering setbacks, noise, roads, emergency planning and site-plan review. The county also reports a water study for large projects. The adopted code, rather than a summary page, controls the exact obligation.

When impact studies can be required

Officials can require an applicant to supply evidence needed to apply an adopted standard or a statute-specific review. The study should identify its geographic scope, methodology, preparer, assumptions, publication requirements and the decision it informs. A locality cannot automatically demand every conceivable study in every state.

North Carolina’s 500-foot sound assessment

North Carolina’s 2025 law requires an applicant for a new data center to submit a sound-profile assessment for residences and schools within 500 feet before specified rezoning, special-exception, conditional- or special-use and building-permit decisions. The assessment is used to consider consistency with the comprehensive plan and compliance with applicable noise and zoning rules. The law also permits a locality to require assessment of additional subjects.

The statute lists ground and surface water resources, air quality, thermal plumes, agricultural resources, parks, registered historic sites and forestland on the site or immediately contiguous land. Its text states:

“A locality may also require that a site assessment examine the effect of the proposed facility on the community with regard to (i) ground and surface water resources, (ii) air quality, (iii) thermal plumes, (iv) agricultural resources, (v) parks, (vi) registered historic sites, and (vii) forestland on the data center site or immediately contiguous land.”

Virginia’s high-energy-use facility assessment

Virginia Code § 15.2-2209.5 contains site-assessment provisions for certain high-energy-use facility approvals, including sound effects on nearby residential units and schools within 500 feet. It identifies optional assessment topics and expressly preserves existing local zoning authority. The section does not transfer or alter the State Corporation Commission’s jurisdiction. A Virginia locality therefore may conduct the statutory land-use assessment while the commission retains authority assigned to it by state law.

Water, utility and infrastructure studies

Water and utility questions often arise in local site review even when another agency issues the operative permit. Linn County’s reported rules include a water study for large projects. Fort Worth’s development-review materials direct applicants to zoning, noise, water and wastewater resources. These references are starting points; the controlling ordinance and permit conditions determine what must actually be submitted.

Separate local approval from state and federal permits

A data center can need approvals from several governments. Local zoning controls land use, but it generally cannot issue an air, water, wastewater, utility or federal permit reserved to another agency. An applicant may have to satisfy all of them, sometimes in a specified sequence.

Iowa: a clear divided-authority example

The Iowa Department of Natural Resources says it does not issue one permit for a facility as a whole. Depending on the project, it may issue permits involving water use, air quality, wastewater construction or discharge, stormwater and floodplain impacts. The department identifies zoning and land use as responsibilities of local cities and counties. Iowa therefore demonstrates the division between local development approval and resource permits; it is not a nationwide template.

Pennsylvania: local approval in the described DEP workflow

Pennsylvania’s current GRID requirements page says the Department of Environmental Protection will not issue or final-review specified environmental permits until proof of local land-use approvals is submitted. The page describes commitments attached to the state framework. Applicants and officials should read the underlying executive order, agreement and current agency documents for operative requirements, litigation or revisions.

Massachusetts: reported 2026 policy

Massachusetts’ official materials report a 2026 policy requiring local approval before an applicant seeks state permits and describe energy, water, air, noise and community-engagement standards. Confirm the policy’s current legal status and the agency documents that implement it; a state policy description is not the same thing as a municipal ordinance.

Utility regulation is separate

A zoning board may evaluate site impacts from power infrastructure, but it should not promise control over state-regulated utility service. Virginia’s statute specifically preserves State Corporation Commission jurisdiction. Similar boundaries can exist elsewhere for transmission, generation, water allocation or environmental permits.

Conditions, agreements and accountability

Discretionary approval may include conditions addressing impacts within the deciding body’s legal authority. Conditions should appear in the approval record, identify the required action, assign responsibility and provide a measurable compliance method. A voluntary statement by a developer is not automatically an enforceable condition.

Project-specific conditions

St. Louis reported a conditional-use approval in April 2026 with conditions concerning noise, walkability, sustainability, power and water, along with a community-benefits framework. That is a project example, not a general grant of authority to every city. The approval documents determine which promises are binding.

Topics identified in Maryland’s 2026 executive order

Maryland Executive Order 01.01.2026.16 directs development of local-government guidance and identifies possible community-benefit agreement subjects: phasing; noise, lighting, traffic and air quality; buffers; emergency services; financial contributions; expansion commitments; employment; reporting; successor obligations; remedies; decommissioning; and periodic review. Because the order directs guidance, distinguish its policy direction from a county or municipal ordinance already in force.

Questions that reveal whether a condition has teeth

  • What statute, ordinance or permit provision authorizes it?
  • Is it in the final approval record, rather than only in a presentation or press statement?
  • Who monitors compliance, and what reports or measurements are required?
  • What happens after a violation: notice, cure period, fines, permit suspension or another remedy?
  • Does the obligation bind a purchaser, expansion phase or replacement equipment?
  • Are decommissioning funds, restoration duties or periodic reviews specified?

Can a city or county stop a data center?

Sometimes, but not simply because officials dislike the project. A locality may deny a rezoning or discretionary permit when the applicant fails applicable statutory or ordinance standards, or when the requested use is not allowed in the district. If the use is permitted by right and the application satisfies objective standards, the government’s discretion is narrower. State law may also limit local authority or require a particular assessment.

A moratorium, interim ordinance or new zoning rule must follow the state’s procedural requirements and cannot be assumed valid merely because it is politically popular. Check its effective date, duration, exceptions and treatment of applications already filed.

How to evaluate a proposal in any jurisdiction

  1. Map the authority. Write down which body handles zoning, site plan, building, fire, environmental, utility and floodplain matters.
  2. Classify the use. Confirm the code definition and whether the project is by-right, conditional, special-use or rezoning-dependent.
  3. List every required study. Record who must prepare it, who pays, the distance or area covered, measurement methods and publication deadlines.
  4. Match concerns to standards. Translate noise, water, traffic, lighting or emergency concerns into specific adopted criteria rather than general objections.
  5. Check the procedural calendar. Verify notice, hearing, public-comment, decision and appeal deadlines.
  6. Coordinate other permits. Contact the responsible state or federal agency for air, water, wastewater, stormwater, floodplain and utility approvals.
  7. Read proposed conditions word for word. Separate enforceable conditions from voluntary benefits, and identify monitoring, remedies, successor obligations and expansion controls.
  8. Recheck current law. Confirm amendments, moratoria, effective dates and project-specific exceptions immediately before a decision or publication.

What to compare when two sites or jurisdictions are under consideration

Comparison axis Questions to answer
Approval route Which body decides, and is review administrative or discretionary?
Use status Is the facility allowed by right, conditional, special-use or subject to rezoning?
Evidence burden Which studies are mandatory, and what distance, watershed or neighborhood area do they cover?
Operating standards What rules govern noise, setbacks, lighting, traffic, water, wastewater, stormwater and emergency access?
Intergovernmental sequence Must local approval precede state permits, or can reviews proceed concurrently?
Public process What notice, hearing, comment and appeal rights apply?
Long-term accountability Who monitors conditions, and do reporting, expansion, successor, remedy and decommissioning duties survive a sale?

These axes support a fair comparison without implying that one state’s rule applies elsewhere. The controlling answer always comes from the current law and approval documents for the parcel.

Common mistakes to avoid

  • Calling a local example a national requirement. Calvert County’s setbacks and Linn County’s water-study rule are local measures.
  • Confusing a study with a permit. A noise or water assessment supplies evidence; it does not replace an environmental or utility authorization.
  • Overstating executive guidance. Maryland’s executive order identifies topics for guidance; it is not automatically a county ordinance.
  • Ignoring filing dates. North Carolina’s assessment rule and any moratorium or amendment may apply differently depending on when an application was filed.
  • Assuming every promise is enforceable. Only adopted conditions, agreements and permits with a stated remedy reliably create obligations.
  • Assigning utility powers to zoning officials. State commissions and environmental agencies may retain exclusive authority over regulated services.
