Local governments can usually control where a data centre may be built, which planning procedure it must use, and whether its site design and foreseeable neighbourhood effects meet adopted rules. They may review zoning, setbacks, height, screening, noise, lighting, landscaping, stormwater, access, site disturbance and the capacity of local water, wastewater and power infrastructure. Their authority is not unlimited: utility operations, air permits, water discharges and some environmental decisions may belong to state, regional or national agencies. The controlling answer is always the law and planning code in the jurisdiction where the project is proposed.
Why the answer depends on the jurisdiction
“Can the council stop a data centre?” is not a question with one worldwide answer. A municipality acts under enabling statutes, its comprehensive or local plan, zoning map and development code. Those rules determine whether a data centre is a permitted use, a conditional or special use, or a use that is prohibited in a particular district. They also determine which official, commission or elected body decides the application.
Separate three categories before evaluating a proposal:

- Adopted, binding rules: ordinances, zoning text, development standards and formally effective environmental directions that staff and decision-makers must apply.
- Advisory guidance or policy positions: recommendations from planning bodies or associations. They can shape a future ordinance or an applicant’s submission, but they do not automatically create legal requirements.
- Other agencies’ permits: electricity, air-quality, water-discharge, environmental and some transmission decisions that may be outside municipal control.
A local planning approval therefore answers only the questions assigned to the local government. It does not replace every permit needed to construct or operate the facility.

Land use, location and the approval route
Plans and zoning districts
A council can use its land-use plan and zoning map to identify locations where data centres fit, limit them to specified districts, or require a change to the zoning designation. The code may define “data centre,” “server farm,” “technology campus” or related uses differently. A clear definition matters because a large campus with substations, generators, cooling equipment and warehouses may not be treated the same way as a small office containing servers.
Planning staff commonly check whether the proposed district can accommodate the facility’s utility, water, traffic and emergency-access needs. Pennsylvania’s Department of Community and Economic Development toolkit, for example, is intended to help municipalities assess a proposal from the initial inquiry through zoning, permitting and long-term planning, including land-use, infrastructure, fiscal and legal considerations. That toolkit is a planning aid, not a grant of power to every municipality.
By-right, conditional and special approvals
The zoning path controls the amount of discretion and public process. A by-right project may proceed after staff confirms compliance with objective standards. A conditional-use, special-exception or planned-development application normally requires a more detailed record and may allow conditions tied to the code. A rezoning or plan amendment can involve a legislative process and a broader policy decision.

The county says some large projects in certain districts require special-exception approval and hearings before the Planning Commission and Board of Supervisors. Qualifying projects in the heaviest industrial districts may proceed by right if they satisfy the applicable standards. A hearing is therefore a consequence of the zoning route, not an automatic requirement for every data-centre application.
Local example: Tucson
The City of Tucson reports that its Mayor and Council adopted large-scale data-centre regulations on August 5, 2026, effective September 4, 2026. The city says the rules use existing Planned Area Development and Planned Community Development processes and provide neighbourhood coordination, a public hearing, Zoning Examiner review and final Council consideration. This is a Tucson framework; it should not be presented as a model that applies automatically in another state or country.

What site and building effects a local review can address
Separation, height and appearance
Development standards can set setbacks from property lines and sensitive uses, maximum height, building orientation, façade treatment, rooftop-equipment screening and limits on visual clutter. They may also require a buffer from homes, schools, parks, offices or transit facilities. Fairfax County describes rules covering visual screening, building design and minimum distances from homes or Metro stations.
Tucson’s adopted rules include enhanced separation distances from residential, commercial, office and other sensitive locations. The city also describes expanded landscaping and open-space requirements. Whether a similar requirement is available elsewhere depends on the local code and the legal authority supporting it.

Cooling plants, fans, pumps, generators and electrical equipment can create continuous or low-frequency sound. A zoning code may require an applicant sound-impact study, noise barriers, equipment placement, operating limits, construction-hour restrictions or post-occupancy monitoring. Conditions should identify the measurable standard, the measurement location and the remedy for a violation.
Berks County Planning Commission guidance issued in April 2026 recommends considering lighting, buffering, noise and vibration standards and suggests a low-frequency noise analysis. It gives 55 dB at property lines as an example a municipality may consider. That number is illustrative advice, not a universal legal limit. A council cannot simply treat it as binding unless its own law adopts an enforceable standard.
Lighting, landscaping and open space
Local standards can regulate fixture shielding, illumination at property boundaries, hours for certain lighting, tree preservation, landscape buffers, open-space percentages and the appearance of parking or service yards. These measures address glare and the visual transition between an industrial campus and neighbouring properties. They may also reduce stormwater runoff when paired with limits on impervious surfaces.

Stormwater, grading and access
Site-plan review can examine grading, drainage, detention, erosion control, wetlands or other sensitive lands where local law covers them. Berks guidance recommends minimizing land disturbance and impervious surfaces, protecting sensitive lands and agricultural soils, and ensuring emergency access. A local government can require plans and improvements within its authority, while separate environmental agencies may control wetlands, discharges or other regulated resources.
Water, wastewater, electricity and cumulative effects
Capacity evidence
Before approving a site, officials can ask whether water, wastewater and power systems can serve the proposed load without unsafe or unlawful impacts. Useful evidence includes provider capacity letters, proposed connection points, peak and average demand, cooling-water assumptions, backup-generation arrangements and a schedule for phased construction. Berks guidance recommends baseline environmental and infrastructure assessments, identification of energy and water sources and written confirmation from providers about available capacity.
The Local Government Association (LGA) has cautioned that existing UK policy frameworks only partially address data-centre impacts on water use, nature and the environment, and often do so indirectly. Its policy response recommends assessing water availability, wastewater-treatment capacity, energy infrastructure and environmental limits early and aligning local plans with water companies and grid operators. That is a policy assessment, not a universal legal rule.
Cooling and water disclosure
Tucson’s reported rules require adequate water and power access and disclosure of the facility’s energy mix, including renewable sources. Other jurisdictions may have no comparable disclosure requirement unless the local code or a higher-level law provides one.
Maryland’s 2026 executive order illustrates the boundary between local planning and state regulation. Within the state Department of the Environment’s permitting authority and to the extent permitted by law, it directs attention to water availability, cooling options such as closed-loop, air-cooled and reclaimed-water systems, disclosure of water withdrawal and consumption, stormwater and discharges, air monitoring, environmental justice and greenhouse-gas requirements. Those directions do not automatically give a Maryland municipality power to issue every listed permit.

Cumulative and service impacts
A council may evaluate whether several facilities would collectively strain a road, substation, water source, wastewater plant or emergency-response system when the applicable plan or environmental law allows cumulative analysis. The record should distinguish the project’s documented effects from general claims about the data-centre industry. The reviewed authorities do not establish a cross-jurisdiction statistic for typical water use, energy use, jobs, tax revenue or property-value effects, so those figures must be supplied locally and dated if they are used.
Environmental assessment and power thresholds
Environmental review is jurisdiction-specific. In Scotland, the Chief Planner reported that a Scottish Government 2026 Direction requires an environmental impact assessment for new data-centre development exceeding 50 MW of power capacity, effective September 17, 2026. Projects at or below 50 MW remain subject to case-by-case consideration under the existing EIA regulations. The reported potential effects include landscape, biodiversity, soils, water resources, noise and air quality from backup generators.
The Scottish threshold is not a general international trigger. A council elsewhere must apply its own environmental statute and any state or national thresholds. The Scottish Chief Planner also stated that any data centre requiring fossil fuels would add emissions not taken into account in Scotland’s Climate Change Plan; that statement is a Scottish policy context, not a finding about every project or jurisdiction.
Public hearings, evidence and legally supportable conditions
When the public can participate
Notice, written comments and oral testimony depend on the application type and local procedure. Conditional-use, special-exception, planned-development and rezoning cases commonly provide more formal opportunities than by-right site plans. Residents should read the public notice and code to identify the deadline, hearing body, document-access method and topics the decision-maker may legally consider.
What conditions can do
Conditions can translate adopted standards into an enforceable approval: a verified noise study, a required landscape buffer, a drainage improvement, restricted construction hours, emergency-access changes or a monitoring and reporting plan. A condition should have a lawful basis, relate to the project’s effects and be supported by evidence in the record. Officials should not impose an unrelated demand merely because a project is unpopular.

Pre-application coordination
Applicants and municipalities can reduce disputes by meeting before filing. The agenda should identify the proposed use definition, approval route, required studies, utility contacts, emergency responders, environmental agencies and expected hearing dates. Berks guidance recommends pre-application meetings, emergency plans coordinated with local responders, continuity planning for utility disruptions and decommissioning plans.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Long-term accountability after approval
A permit decision does not end local oversight when the code provides continuing obligations. Possible tools include noise or water-use monitoring, periodic reporting, inspection rights, notice of an ownership change, emergency and continuity plans, and a requirement to update contact information for facility operators. Each tool must be authorized by adopted law and drafted clearly enough to enforce.
Decommissioning and financial safeguards
Berks County guidance recommends a decommissioning plan covering equipment removal, recycling, site restoration and, where legally available, financial assurance. These are recommended planning practices, not guaranteed municipal powers. A municipality should verify its enabling statute and local code before requiring a bond, escrow or other security.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsChanges to the approved project
Expansion of power capacity, additional buildings, new generators or a different cooling system may trigger a new review if the code treats them as a material change. The original approval should state which modifications require amended plans, a new hearing or confirmation that existing conditions still apply.
Where local authority ends
Local land-use approval is one piece of a larger permitting system. Fairfax County states that Virginia’s State Corporation Commission controls electricity rates and related matters, including demand and transmission lines, while Virginia’s Department of Environmental Quality regulates air pollution and permits certain cooling-water discharges. Maryland’s executive order likewise assigns specified water, discharge, stormwater and air-quality actions to the state environmental department.
The agency boundary differs by place. For a real proposal, make an authority chart listing each decision, the responsible agency, the legal instrument, the evidence required and the appeal route. A council may be able to deny a site-plan application for failure to meet a setback while having no power to approve a transmission line or issue an air permit.

Checklist for residents and applicants
Residents evaluating a proposal
- Confirm the municipality, zoning district, use definition and application type.
- Read the adopted standards for setbacks, height, noise, lighting, landscaping, stormwater, traffic and emergency access.
- Ask which studies are required and whether they address cumulative effects and nighttime or low-frequency noise.
- Identify the hearing date, comment deadline and decision-maker named in the notice.
- Separate issues the council can decide from utility, air, water and environmental permits handled elsewhere.
- Request conditions tied to specific code provisions and measurable compliance methods rather than general objections.
Applicants preparing a defensible filing
- Obtain a written zoning interpretation and confirm whether the project is by right, conditional, special or rezoning.
- Map homes, schools, offices, transit, agricultural soils, sensitive lands and emergency routes before finalizing the site.
- Commission the required sound, environmental, traffic, stormwater and utility-capacity studies.
- Secure written water, wastewater and power-capacity information and document the proposed energy mix and cooling method.
- Meet with planning staff, utilities, environmental regulators and emergency responders before filing.
- Submit a construction, operations, emergency, continuity and decommissioning plan, labeling recommendations separately from binding commitments.
- Track every condition, reporting duty and material-change trigger in an operating compliance schedule.
Bottom line: a local permit is powerful but limited
A local government can often decide whether a data centre fits a location and can impose adopted, evidence-based standards for site design and neighbourhood effects. It may also require information about infrastructure and environmental impacts and provide a public process when the zoning route calls for one. It cannot assume control over the grid, every water or air permit, or every environmental threshold. The reliable answer for any project is a jurisdiction-specific map of the zoning code, enabling law, evidence requirements and other agencies’ permits.
