Typosquatting is the use of a misspelled or otherwise lookalike domain name to catch people who intended to visit a legitimate website. Cybersquatting is the broader practice of registering, using, or trading on a domain that incorporates someone else’s trademark in bad faith. A typo domain can therefore be one form of cybersquatting, but cybersquatting also covers domains that copy a mark without containing a typing mistake.
The spelling pattern is only a clue. Whether a registration violates a policy or law depends on trademark rights, the registrant’s intent, the domain’s use, the extension involved, and the dispute forum.
Typosquatting and cybersquatting: the practical distinction
ICANN describes cybersquatting as “generally bad faith registration of another’s trademark in a domain name.” Read the full explanation in ICANN’s About Cybersquatting overview. The phrase typosquatting describes a particular way the domain is made recognizable: it resembles a mark because one or more characters have been changed, omitted, added, transposed, or substituted.

|---|---|---|
| Typosquatting | A domain imitates a recognizable name through an intentional or obvious spelling or character variation, often anticipating a typing error. | A typo alone does not prove bad faith, trademark rights, consumer confusion, or liability. |
| Cybersquatting | A broad label for registering or using a domain that incorporates another party’s trademark in bad faith. | The label is not a complete legal test; the applicable statute or dispute policy supplies the required elements. |
WIPO’s Overview of WIPO Panel Views on Selected UDRP Questions treats typo-style domains in the context of the UDRP’s confusing-similarity analysis, while emphasizing that the remaining elements and surrounding facts still matter. In ordinary usage, typosquatting is best understood as a tactic or subset within the wider cybersquatting category, not as a separate legal cause of action.

How a typosquatted domain is constructed
Attackers and opportunistic registrants choose variants that a visitor could plausibly type, read, or accept at a glance. Common patterns discussed in WIPO’s UDRP guidance include:
- Adjacent-key substitutions: replacing a character with a neighboring keyboard key.
- Omissions: leaving out a letter, number, or separator.
- Additions: inserting an extra character or repeated letter.
- Transpositions: reversing the order of two characters.
- Visual substitutions: using characters that look similar in a particular font or script.
- Accented, non-Latin, or Unicode lookalikes: choosing a character from another writing system that resembles a character in the legitimate name.
For example, if a legitimate site uses example-shop.com, a registrant might choose a version with two adjacent letters reversed, one letter missing, or a visually similar Unicode character. These examples explain the recognition technique; they do not by themselves show who registered the domain, why it was registered, or whether a legal violation occurred.
Why a typo is evidence, not a verdict
A near-match can support an argument that visitors are likely to mistake one domain for another. It may also help show that a registrant knew of a mark when choosing the name. Neither inference is automatic. A domain may resemble a mark because of coincidence, a dictionary word, a legitimate criticism or fan use, a reseller activity, or an independent business name. The facts surrounding registration and use determine how a panel or court evaluates it.

- What trademark rights does the complainant actually hold, and in which countries or classes?
- How distinctive or famous is the mark?
- Does the domain resolve to a copy of the legitimate site, advertising links, a competing offer, a parked page, criticism, or no content?
- Has the registrant offered the domain for sale, contacted the mark owner, or registered a pattern of similar names?
- Could the use be a genuine noncommercial or nominative activity rather than an attempt to profit from confusion?
Those questions matter because “typosquatting” is descriptive shorthand. A dispute decision still applies the elements of the relevant policy, and a court still applies the relevant law.
Is registering a typo domain illegal?
There is no universal yes-or-no answer. The domain extension, the owner’s rights, the registrant’s intent, and the way the name is used all affect the analysis. A misspelling can be suspicious and still fail to satisfy a particular policy or statute; conversely, a domain without a literal typo can qualify as cybersquatting if it copies a mark and is registered in bad faith.
United States: the Anti-Cybersquatting Protection Act
In the United States, 15 U.S.C. § 1125(d) creates a civil cause of action when a person has a bad-faith intent to profit from a protected mark and registers, traffics in, or uses a domain name that meets the statute’s requirements. The statute distinguishes claims involving distinctive marks from those involving famous marks and addresses confusing similarity or dilution. Read the current 2024 U.S. Code text at the U.S. Government Publishing Office.
This is a U.S.-specific summary, not a finding about any particular domain. A claimant must establish the statutory elements, including the relevant trademark status and the registrant’s bad-faith intent. A typo pattern can be part of that evidence, but it is not a substitute for proving the elements.

Other countries and policies
Trademark and domain-name rules differ by jurisdiction. Some countries provide court actions, administrative procedures, or both; deadlines, remedies, and evidence standards vary. Do not assume that a result under U.S. law or the UDRP automatically applies elsewhere.
How the UDRP fits in
The Uniform Domain-Name Dispute-Resolution Policy (UDRP) is an administrative process for certain domain disputes. ICANN’s UDRP overview explains that a trademark-rights holder can initiate an expedited proceeding for an allegedly abusive registration. In a typical UDRP complaint, the complainant must address the policy’s required elements, including confusing similarity, the registrant’s lack of rights or legitimate interests, and registration and use in bad faith.
A UDRP decision can order cancellation or transfer of a covered domain, but it is not automatic and it is not the only remedy. ICANN notes that many trademark-based disputes must instead be resolved by agreement, court action, or arbitration before a registrar cancels, suspends, or transfers a name. A party that needs damages, broader injunctions, discovery, or a ruling on issues outside the policy may need a court or another forum.

| Question | UDRP | U.S. court action under § 1125(d) |
|---|---|---|
| Nature of process | Administrative domain-name proceeding under a policy. | Civil litigation under a federal statute. |
| Typical focus | Whether the policy’s domain, rights-or-legitimate-interests, and bad-faith elements are met. | Whether statutory trademark and bad-faith-intent requirements are met. |
| Potential outcome | Usually transfer or cancellation of the domain. | Potentially broader court remedies, subject to the statute and the case. |
| Coverage | Covered domain extensions and qualifying complaints; not every domain or dispute. | U.S. jurisdiction and the statute’s jurisdictional and substantive requirements. |
Does the domain extension change the process?
Yes. WIPO’s Domain Name Dispute Resolution guidance explains that the UDRP applies to generic top-level domains (gTLDs). Some country-code top-level domains (ccTLDs) have adopted the UDRP or a local variation, while others use different rules. The same-looking name can therefore be subject to different procedures depending on its extension.

Before filing or sending a demand, check the current policy for the exact extension. Confirm the provider, filing language, fees, deadlines, available remedies, and whether the registration agreement incorporates the UDRP or a ccTLD-specific policy. WIPO’s guidance also recommends obtaining registration information through ICANN’s Registration Data Request Service (RDRS) or a registrar WHOIS service. Registration-data availability and privacy rules can change, so use a current official channel.
What to do if someone registered a lookalike domain
The safest response is a documented investigation followed by a route that matches the harm and the extension. Do not assume that contacting the registrant, filing a UDRP complaint, or reporting abuse will produce the same result.
- Verify the lookalike. Record the exact domain, extension, spelling differences, punycode or Unicode form where relevant, and the legitimate mark it resembles. Check whether the apparent typo is actually a different business name or a common word.
- Preserve evidence before the site changes. Save dated screenshots, page URLs, redirects, email headers, advertisements, and any offer to sell the domain. Record DNS resolutions and registrar details in a way your counsel can authenticate. Do not log in, submit credentials, download files, or interact with a suspicious site beyond what is necessary to document it.
- Identify the registration information. Use the current registrar’s lookup service or ICANN’s RDRS as described by WIPO. Note the registrar, registration and expiration dates, nameservers, and any published contact channel. Privacy-protected data may require a formal request or legal process.
- Separate trademark issues from security abuse. A domain used for phishing, malware, or other harmful activity may warrant an abuse report to the registrar, hosting provider, or relevant incident-response authority in addition to any trademark action. ICANN’s DNS misuse terminology page provides the organization’s current framing of misuse concerns. An abuse report does not decide trademark ownership, and a trademark complaint does not replace an urgent security response.
- Match the forum to the extension and objective. For a covered gTLD and a conventional abusive-registration claim, evaluate the UDRP. For damages, emergency relief, contested trademark validity, or issues outside the policy, discuss court or arbitration options with qualified counsel. For a ccTLD, follow that registry’s current policy rather than assuming the gTLD process applies.
- Secure the legitimate operation. Enable registrar account multi-factor authentication, lock transfer settings where appropriate, keep registration and DNS contacts current, and monitor high-risk variants. Monitoring can help detect impersonation early; it does not give the owner automatic rights to every similar domain.
How to assess a suspected cybersquatting claim
Use a short decision framework before spending money on a dispute:
- Rights: Is there a registered or otherwise protectable mark, and who owns it?
- Similarity: Does the domain reproduce the mark, a dominant portion of it, or a recognizable variation?
- Legitimate purpose: Is there credible evidence of a bona fide offering, fair criticism, fan activity, or another lawful interest?
- Bad faith: Do the registration date, redirection, pay-per-click links, sales offer, copied branding, or pattern of registrations indicate an intent to exploit the mark?
- Forum: Which policy or court has authority over this extension and conduct?
- Remedy: Is the goal transfer, cancellation, an injunction, damages, disclosure of identity, or simply removal of harmful content?
If the evidence is ambiguous, obtain advice from a qualified trademark or domain-name lawyer in the relevant jurisdiction. A lawyer can test the facts against the exact policy or statute instead of relying on the informal label “typosquatting.”

Common misconceptions
“Every misspelled domain is unlawful.”
No. The spelling may be accidental, descriptive, or connected to a legitimate activity. Liability generally requires more than visual similarity.
“Cybersquatting always means a typo.”
No. Cybersquatting is broader. A domain can copy a trademark exactly, combine it with another term, or use a different character form without representing a conventional keyboard mistake.
“A UDRP complaint automatically takes the site down.”
No. It is an administrative proceeding that can lead to transfer or cancellation when its requirements are met. It does not automatically suspend every domain, award damages, or replace court remedies.

Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →“The same rule applies to every extension.”
No. gTLDs generally fall under the UDRP, while ccTLDs may use the UDRP, a local variation, or another policy. Check the exact extension’s current rules.
Bottom line
Typosquatting names the lookalike technique; cybersquatting names the broader bad-faith trademark-domain practice. Treat a typo as an investigative lead, then establish rights, context, intent, extension coverage, and the remedy you need. The applicable UDRP, national statute, or ccTLD policy—not the label alone—determines whether a claim can succeed.
