PERM labor certification is a U.S. Department of Labor (DOL) review that an employer completes before sponsoring many foreign workers for permanent residence. It tests the U.S. labor market for a specific, permanent, full-time job. PERM is not a green card, an immigrant petition, or a decision by U.S. Citizenship and Immigration Services (USCIS). After certification, the employer normally files Form I-140, and the worker later applies for an immigrant visa or adjustment of status when eligible and a visa number is available.
What PERM labor certification means
PERM stands for Program Electronic Review Management. In practical terms, it is the DOL labor-certification stage of an employment-based green-card case. The employer must show that it has a genuine permanent, full-time job opportunity and that employing the foreign worker will not displace qualified U.S. workers or harm the wages and working conditions of similarly employed U.S. workers.
DOL describes the test as whether enough U.S. workers are able, willing, qualified, and available for the job, and whether the foreign worker’s employment would adversely affect comparable U.S. workers. The agency’s Permanent Labor Certification page explains the purpose and employer responsibility.

That distinction matters. A worker may provide information, documents, and signatures where required, but the sponsoring employer controls the PERM filing and the recruitment record. DOL certification also does not establish that the worker qualifies for a particular immigrant category; USCIS must still decide the later immigrant petition.
What PERM does—and does not—give you
| PERM certification establishes | PERM certification does not establish |
|---|---|
| DOL acceptance of the employer’s labor-market test for the specific job and worker | A green card or lawful permanent-resident status |
| A filing date that generally becomes the employment-based priority date | Approval of Form I-140 |
| That the employer completed the required wage and recruitment process, subject to the case record | That an immigrant visa number is immediately available |
| A certification that must be used in a timely I-140 filing | Permission for the worker to work for any employer or in any job |
The certification is tied to the sponsoring employer, offered position, work location, requirements, and the worker identified in the application. A change in employer, position, location, duties, or minimum requirements can require a new analysis and may prevent the existing certification from supporting the intended case.
Who files PERM and who does what
The employer
The employer is the filing party. It defines the permanent job opportunity, requests the prevailing wage, conducts recruitment and notice procedures, keeps supporting records, and submits the electronic PERM application through DOL’s FLAG system. The employer must be able to offer the job and pay the required wage when the worker becomes a permanent resident.
The foreign worker
The worker does not file the PERM application. The worker supplies accurate education, experience, license, and immigration-history information so the employer can describe the worker and job correctly. A worker should review the proposed duties and minimum requirements before filing because an inaccurate requirement or résumé can create problems at the I-140 stage.

The immigration representative
An employer may use an immigration lawyer or other authorized representative to prepare and submit the case, but representation does not transfer the legal responsibility away from the employer. The employer remains responsible for the truthfulness of the filing and for retaining the recruitment documentation.
How the PERM process works
DOL’s PERM Program Process describes the principal sequence below. The exact recruitment rules depend on the occupation, job requirements, professional classification, and case facts; this is a process map rather than an exhaustive checklist.
- Define a permanent, full-time job opportunity. The employer sets the title, duties, worksite, minimum education and experience, travel or other conditions, and offered wage. Requirements must reflect the job and cannot be tailored improperly to the foreign worker.
- Request a prevailing wage determination. The employer asks DOL’s Office of Foreign Labor Certification (OFLC) National Prevailing Wage Center for the wage level applicable to the occupation and area of intended employment. The employer must be prepared to offer at least the required wage under the applicable rules.
- Complete required recruitment. The employer conducts the recruitment steps that apply to the occupation and provides notice of the filing where required. Recruitment is intended to test whether qualified U.S. workers are available. The employer must record where and when advertisements ran, the responses received, and the lawful, job-related reasons for any rejection.
- Review the recruitment record. Before filing, the employer evaluates applicants consistently against the stated minimum requirements. It should not reject a U.S. applicant for a requirement that was not disclosed or add a new requirement after seeing an applicant.
- File the electronic PERM application. The employer submits the application in FLAG, including the job, wage, recruitment, and worker information. The filing date is important because it generally becomes the priority date used in the later employment-based process.
- Respond if DOL audits the case. DOL can request the recruitment report, résumés, rejection explanations, business records, or other evidence. The employer must answer by the deadline in the audit notice. An audit can substantially extend the case and may result in denial if the employer cannot document compliance.
- Receive certification or another DOL outcome. If certified, the employer can proceed to the USCIS immigrant petition. A denial, supervised-recruitment order, or other adverse action requires a case-specific decision about correction, reconsideration, or a new filing.
DOL rules include exceptions and special recruitment requirements for some professional occupations and other circumstances. Because a missed advertisement, incorrect wage, or inconsistent job description can invalidate an otherwise strong case, employers commonly have counsel review the plan before any recruitment begins.
What happens after PERM is approved?
1. The employer files Form I-140
The employer generally submits the certified labor application with Form I-140, Immigrant Petition for Alien Workers, to USCIS. The petition must show that the offered job fits the requested employment category, that the worker meets the category and job requirements, and that the employer can meet the required wage. USCIS, not DOL, decides the I-140.

2. The priority date is preserved
DOL states that the PERM receipt date is used by USCIS and the Department of State as the priority date. A certified application must be submitted with an I-140 within 180 days; otherwise, the certification expires and cannot support that petition. The 180-day period is a validity limit, not a promise that the entire green-card case will finish within six months.
3. The worker waits for an available visa number
Even an approved I-140 does not always permit immediate filing of the final application. Visa availability depends on the employment category, the worker’s country of chargeability, and the Department of State’s monthly Visa Bulletin. The priority date is compared with the relevant cutoff or filing date under the instructions for that month.
4. The final residence stage occurs
If the worker is in the United States and otherwise eligible, the worker may file Form I-485, Application to Register Permanent Residence or Adjust Status, when the applicable filing chart permits. A worker outside the United States generally completes immigrant-visa processing through a U.S. consulate. USCIS’s employer guide, How Do I Sponsor an Employee for U.S. Permanent Resident Status?, outlines the usual employment-based sequence.
At this stage, the worker must satisfy admissibility, medical, identity, and procedural requirements. The job normally remains the basis of the case, and portability or job-change rules can be technical. A PERM approval alone never confers permanent-resident status.

How long does PERM take?
Processing changes over time, so a number from one month should not be treated as a case guarantee. On October 5, 2026, DOL’s OFLC Processing Times page showed analyst review at December 2025 priority dates and audit review at December 2025. DOL reported an average of 336 calendar days for analyst-review determinations during August 2026. The audit-review average was listed as unavailable.
| DOL indicator | Published information | How to interpret it |
|---|---|---|
| Analyst-review queue | December 2025 priority dates as shown October 5, 2026 | A snapshot of the cases being reviewed, not an individual completion date |
| Audit-review queue | December 2025 priority dates as shown October 5, 2026 | Cases selected for audit are handled separately from ordinary analyst review |
| Average analyst-review determination | 336 calendar days; August 2026 average reported October 5, 2026 | An agency average; a particular case may be faster or slower |
| Average audit-review determination | Unavailable in that snapshot | No reliable average should be substituted |
The page is updated monthly. Check the live FLAG page when planning recruitment, an I-140 filing, or an employee’s status strategy. Recruitment time, prevailing-wage processing, an audit response, USCIS petition processing, and visa-number backlogs are separate periods and are not included in the 336-day analyst-review average.

PERM is frequently associated with EB-2 and EB-3 sponsorship, but category labels alone do not decide whether a case needs labor certification.

|---|---|---|
| EB-2 | Members of the professions holding advanced degrees, and people of exceptional ability | Many employer-sponsored EB-2 cases use PERM, but some statutory pathways have different requirements or exemptions |
| EB-3 | Professionals, skilled workers, and other workers | The offered job, worker’s qualifications, and category-specific rules determine the required process |
USCIS identifies these and other employment-based classifications in its employer guidance. Do not treat the table as an eligibility opinion: the employer’s job, the worker’s education and experience, the petition evidence, and visa availability must be assessed together. Some employment-based routes do not use the standard PERM process and may permit a different filing structure, a different qualification basis, or no permanent job offer. The appropriate comparison is whether a permanent offer is required, whether DOL certification is required, who may file the petition, what qualifies the worker, and how visa availability controls the final stage.

Common PERM problems and practical safeguards
The job description changes after recruitment
Changing the minimum degree, experience, duties, worksite, or travel requirement after advertisements run can make the recruitment record unreliable. Freeze the job description and requirements before recruitment, and document any material business change that requires a new case.
The offered wage is below the required level
The employer should compare the prevailing wage determination with the proposed compensation before recruiting. A later raise does not automatically repair a filing that was based on an incorrect wage or classification.
Recruitment records are incomplete
Keep copies of advertisements, dates, tear sheets or electronic confirmations, notice evidence, résumés, contact information, interview notes, and lawful rejection reasons. A spreadsheet alone may not prove that every required step occurred.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →A U.S. applicant is rejected inconsistently
Apply the stated minimum requirements uniformly. Rejecting an applicant for being overqualified, unavailable for a reason unrelated to the job, or lacking a preference that was never listed can create audit risk. Reasons should be factual, job-related, and supported by contemporaneous records.
The case is selected for audit
Read the audit notice carefully, gather the requested documents, and submit a complete response by the stated deadline. Do not assume that an audit means the case is denied; it means DOL requires additional proof. Missing the deadline can be fatal even when the original recruitment was sound.
The worker changes jobs or the employer restructures
PERM is employer- and job-specific. A merger, worksite move, substantially different role, or resignation may require new immigration planning. Before making a change, the employer and worker should determine whether the I-140 has been filed or approved and whether any later portability rule applies.
The priority date is misunderstood
A priority date is a place in the visa-number line, not an approval date and not a work-authorization date. Track it separately from DOL processing, USCIS petition processing, and the Visa Bulletin.

Quick Recap
PERM checklists for employers and workers
Employer checklist
- Confirm that the opportunity is permanent and full-time and that the business genuinely needs the role.
- Set accurate duties, minimum requirements, location, and wage before recruitment.
- Request and review the prevailing wage determination.
- Complete every required recruitment and notice step for the occupation.
- Preserve the recruitment report and supporting evidence for the required retention period.
- File through FLAG with consistent information.
- Calendar the 180-day certification validity period and prepare the I-140 promptly after approval.
- Monitor DOL processing updates and respond to any audit or notice by its deadline.
Worker checklist
- Give the employer complete, consistent education and employment records.
- Check that the proposed minimum requirements match your actual credentials and experience.
- Understand that the employer, not you, files PERM.
- Keep copies of immigration filings and note the PERM filing or priority date.
- Ask which EB category is being pursued and whether the case depends on visa-number availability.
- Do not treat certification as a green card or unrestricted work authorization.
- Before changing jobs, duties, or location, obtain case-specific advice about the effect on the process.
Does PERM mean you have a green card?
No. PERM is one labor-market step. The normal sequence is employer-sponsored labor certification, the employer’s I-140 petition, and then the worker’s immigrant-visa or adjustment-of-status stage when the worker is eligible and a visa number is available. Each stage has its own evidence, deadlines, and possible grounds for denial. Because category rules, recruitment details, visa availability, and an individual’s immigration history can change the outcome, this overview is not a legal eligibility determination; employers and workers should obtain qualified U.S. immigration advice for a specific case.
