India’s Goods and Services Tax (GST) Council is the constitutional Union–State forum that recommends how GST should be structured and administered. The Union Finance Minister chairs it, with the Union and every State represented. The Council normally seeks consensus. If a proposal is put to a vote, it needs at least three-fourths of the weighted votes of members present and voting: the Union has one-third of the total weight and the States together have two-thirds.
What the GST Council is
Article 279A of the Constitution of India establishes the GST Council as a joint forum of the Union and the States. It was created to provide a single institutional setting for decisions affecting a tax that operates across state boundaries. Rather than allowing each government to design unrelated consumption-tax rules, the Council considers common principles for the national GST framework.
The Council is a recommendatory constitutional body. Its recommendations inform action by the Union and State governments, but a recommendation should not be described as automatically changing a statute, rule or tax rate. Whether a recommendation takes legal effect depends on the relevant constitutional provision, law, notification or other government action that implements it.
Article 279A says the Council is guided by two connected objectives: a harmonised structure of GST and the development of a harmonised national market for goods and services. Those objectives explain why the Council deals with rates, exemptions, thresholds and place-of-supply rules rather than only with administrative questions.

Who sits on the GST Council?
The Constitution specifies the Council’s core membership.
- Chairperson: the Union Finance Minister.
- Union representative: the Union Minister of State in charge of Revenue or Finance.
- State representatives: one minister nominated by each State Government, generally the minister responsible for Finance or Taxation.
- Article 356 representation: where a proclamation under Article 356 is operating in a State, the Constitution provides for a representative nominated for that State.
This structure puts the Union and State executives in the same decision-making forum. It is not a body in which the Union appoints all voting members, nor is it a gathering of private-sector representatives. The members are government representatives acting within a constitutional process.
What the Council can recommend
Article 279A lists a broad GST policy remit. The subjects include:

- which goods and services should be taxed or exempted;
- model GST laws for the Union and the States;
- principles governing the levy of GST;
- principles for determining the place of supply;
- thresholds below which businesses or transactions may receive specified treatment;
- GST rates and rate bands;
- special rates for specified periods or circumstances; and
- special provisions for particular States.
These categories cover both the design of the tax and the way it applies to transactions. For example, a discussion about a rate band concerns the tax structure, while a place-of-supply recommendation concerns which jurisdiction is treated as the location of a supply. A Council recommendation on one of these subjects is a policy step; the resulting legal obligation must still be checked in the applicable legislation or notification.
How a GST Council decision is made
The formal process has two important features: consensus is the normal method, and the Constitution supplies a weighted voting rule if a vote is requested.

1. The matter is placed before a duly constituted meeting
A proposal, agenda item or recommendation is considered at a Council meeting. The Constitution requires a quorum of one-half of the Council’s total membership. Quorum answers the threshold question—whether enough members are present for the meeting to be duly constituted. It is separate from the number of votes needed to approve a proposal.
2. Members discuss the proposal
The Council’s official description says that, in general, decisions are taken through a consensus-based approach during meetings. Consensus does not mean that every participant has an identical policy preference in every detail. It means the Council normally works through discussion and agreement rather than immediately counting opposing blocks.
3. A division can be sought
If the matter is not settled through consensus, the procedural material describes discussion followed by a vote when a division is sought. At that point, the constitutional voting rule governs the result.
4. The weighted threshold is applied
Article 279A(9) provides: “Every decision of the GST Council shall be taken at a meeting, by a majority of not less than three-fourths of the weighted votes of the members present and voting.” The relevant test is therefore not a simple headcount of ministers. A proposal must obtain at least 75 percent of the applicable weighted votes cast by members who are present and voting.
The Constitution assigns the Union Government one-third of the total voting weight. All the State Governments together hold two-thirds. The Union block is therefore significant but cannot, by itself, reach the three-fourths threshold. The phrase “present and voting” matters. A member who is absent, or who is present but does not cast a vote, is treated differently from a member who votes for or against the proposal under the applicable procedure. The Council’s meeting must still satisfy the separate quorum requirement. For a simple illustration, imagine that the Union supports a proposal and the States are divided. The Union contributes its one-third weight, and enough supporting State weight must join it to reach three-fourths. If every State opposed the proposal, the Union’s one-third could not pass it. Conversely, the rule does not give each individual State a veto: a proposal can succeed with some State governments opposed if the supporting weighted votes meet the constitutional threshold. The exact arithmetic for a particular meeting depends on which members are present and voting and on the official record of that vote. Recommended Free Tools Not with only the Union vote. Because the Union has one-third of the total weight and a proposal put to a vote needs at least three-fourths, Union support alone is insufficient. State support is therefore necessary for a proposal to clear the constitutional voting threshold. That does not mean every State must support every proposal. The States collectively hold two-thirds of the weight, and the Constitution does not describe the system as “one State, one vote.” A coalition of supporting States can provide the required weighted share even if other States vote against the proposal, provided the recorded votes of members present and voting reach three-fourths. This distinction resolves two common but opposite errors: the Union cannot unilaterally carry a voted decision, and a single State does not automatically block one. The practical outcome depends on the weighted distribution of votes at the meeting. Quorum and approval are different legal tests and should not be merged. Quick wins for a faster PC: Article 279A(7) states: “One-half of the total number of Members of the GST Council shall constitute the quorum at its meetings.” That sentence concerns attendance, not the percentage of votes required to approve an agenda item. The Council’s constitutional role is to make recommendations to the Union and the States. The recommendation may lead to a change in a law, rule, notification, rate schedule or administrative instruction, but the Council’s meeting outcome and the later legal instrument are distinct events. For a current compliance question, identify both documents: first, the dated Council meeting record or release describing the recommendation; second, the legislation, notification or other authoritative instrument that implemented it. A headline saying that the Council recommended a rate change is not, by itself, proof that the rate has already changed for every taxpayer or transaction. The same caution applies to exemptions, thresholds and place-of-supply measures. Their effective date, scope, conditions and territorial application come from the implementing authority’s text. Businesses should use that text, rather than an undated summary, when calculating GST or filing returns. Meeting-specific information changes over time, so use dated official records when checking a claim. The official archive is time-sensitive. For example, the archive listed a press release concerning recommendations from the 57th meeting dated 8 October 2026. That date is an illustration of why a reader should consult the current archive and the associated implementation documents rather than rely on a static summary. No. The constitutional fallback is a three-fourths weighted-vote requirement among members present and voting. A simple count of supporters does not reproduce that rule. No. The Constitution allocates two-thirds of the total voting weight to the States collectively. The operative calculation is weighted, not a one-State-one-vote tally. The Union alone has only one-third of the voting weight and cannot reach three-fourths without supporting State weight when a proposal is put to a vote. No. Half the membership is the quorum requirement for the meeting. Each voted proposal must separately satisfy the three-fourths weighted-vote rule. Not necessarily. The Council recommends; the legal effect must be verified in the relevant implementing law or government instrument. GST applies to economic activity that crosses State boundaries, while many tax administrations and revenues remain connected to individual governments. The Council’s Union–State composition creates a forum for coordinating those interests. Its remit allows the participants to address rates, exemptions, thresholds and transaction-jurisdiction rules within one national framework. Do these 3 things before closing this tab: The combination of consensus practice and a constitutional voting safeguard is deliberate. Consensus gives governments room to negotiate a workable common position. The weighted rule provides a defined way to decide a matter if agreement cannot be reached informally, while preventing either the Union or a small group of States from controlling the entire process alone.
