An H-1B is a U.S. nonimmigrant, employer-sponsored work category for a specialty occupation—a position requiring highly specialized knowledge and a logically related degree field. It is not a general work permit, and the worker normally cannot start the process alone.
The usual sequence is Department of Labor action, cap registration when required, USCIS petition filing and adjudication, visa processing at a U.S. embassy or consulate when travel requires a visa, and admission to the United States. Registration selection, petition approval, visa issuance and admission are separate decisions. This explanation reflects agency material checked on October 13, 2026; filing windows, fees and security rules can change, so verify the current instructions before a case is filed.
What an H-1B visa is—and what it is not
The Department of State describes the category as “Specialty occupations in fields requiring highly specialized knowledge.” In practical terms, a U.S. business or qualifying agent asks the government to authorize a particular foreign worker for a particular specialty-occupation role. The authorization is tied to the petition and its terms, rather than being an open work permit that can be used for any employer.

That label does not by itself answer how long a person may remain, whether an extension is available, or whether the person can later pursue another immigration path. Those questions depend on the approved petition, the worker’s circumstances and the rules in force when the filing is made.
A visa is also not the same thing as immigration status. A visa stamp is a travel document used to seek admission at a port of entry. A petition is the employer’s request for H-1B classification. Admission is the inspection decision made when the traveler arrives. A person in the United States may have valid H-1B status without currently needing a new visa stamp, while a person abroad generally needs the visa process before traveling in H-1B classification.

Who starts the case and who makes each decision?
The prospective U.S. employer, or an authorized agent where the rules permit an agent filing, initiates the registration and petition process. The worker supplies evidence and completes the personal portions of later visa processing, but does not submit an H-1B petition as a self-directed work-permit application.

How the H-1B application process works
1. The employer matches a real job to a qualified worker
Eligibility begins with the position, not merely the applicant’s diploma. A specialty occupation requires highly specialized knowledge and a directly related degree field. USCIS’s 2024 modernization guidance explains that a generalized degree is insufficient by itself. A role may accept a range of qualifying fields, but the relationship between those fields and the position’s actual duties must be logical.
That means an employer should be able to describe the duties, explain why they require specialized knowledge, and show how the proposed degree field relates to those duties. The worker must separately show the education or other qualifications required for the offered role. “Any bachelor’s degree” is not a complete eligibility test.
2. The Department of Labor step comes before USCIS
The Department of State’s category directory gives the sequence as “DOL then USCIS.” The employer therefore completes the applicable labor-condition step before submitting the USCIS petition. Requirements concerning the offered wage, notices, attestations, filing method and timing are controlled by current Department of Labor instructions; they should not be inferred from an old checklist or a different visa category.
Keep a copy of the labor-condition filing and make sure the job description, work location and petition evidence are consistent. A material mismatch can create questions even when the worker and employer otherwise appear eligible.

3. The employer registers the beneficiary if the case is cap-subject
For a cap-subject case, the employer or agent submits an electronic registration during the registration window announced by USCIS. USCIS guidance identifies a $10 registration fee and permits one registration per beneficiary per fiscal year. The beneficiary-centered selection system took effect on March 4, 2024.

If registrations exceed the number of projected slots, USCIS may randomly select enough unique beneficiaries to meet the cap. This is the step commonly called the H-1B lottery, although selection is not a lottery ticket that grants immigration status. Selection allows the petitioner to submit Form I-129 for that beneficiary; it does not approve the petition, establish H-1B status or guarantee a visa.
A registration number belongs to the beneficiary for the relevant fiscal-year process. Employers should use accurate information and avoid duplicate registrations for the same person. The registration fee is only the charge for that registration process, not the complete cost of an H-1B petition.
4. The employer files Form I-129 with USCIS
After selection, when selection is required, the petitioner files Form I-129 within the filing period specified by USCIS and includes evidence for the job, the employer, the worker and the requested classification. The petition must reflect the position that was registered and the labor-condition filing that preceded it.
Some cases may be cap-exempt, so not every H-1B filing follows the registration-and-selection route. Whether a particular employer, position or filing qualifies for an exemption is case-specific. The 2024 modernization materials also address changes involving specialty-occupation criteria, amendments after worksite changes, cap exemptions and F-1 cap-gap extensions. Use the current USCIS form instructions and rule text for the facts of the case.

USCIS’s own guide cautions that its guidance “is not a substitute for any rule. Only the final rule can provide complete and definitive information regarding its requirements.” Treat summaries as orientation, then check the controlling regulation and current filing instructions.
5. USCIS adjudicates the petition
USCIS reviews Form I-129 and the supporting record and issues the petition decision. A favorable decision establishes the approved petition basis; it is not itself a visa stamp and does not physically admit someone to the country.
The result also depends on the requested action. A worker abroad may need consular visa processing before travel. A worker already in the United States may be requesting a change or extension of status and may not need a new visa stamp unless travel later requires one. The approval notice and its validity dates should be read together with the person’s current immigration status.
6. The worker applies for a visa when travel requires one
After the petition stage, a worker outside the United States who needs an H-1B visa generally follows the Department of State process for petition-based visas. The worker completes the required online application, pays the applicable fee, schedules an appointment if the post requires one, and brings the documents and passport requested by the designated embassy or consulate.
Appointment availability, interview rules, document lists and passport-return arrangements vary by post. The local consular website and the appointment provider’s current instructions control those details. A petition approval does not guarantee visa issuance; the consular officer makes a separate visa decision.

The Department of State fee schedule accessed on October 13, 2026 lists a $205 nonimmigrant visa application processing fee for petition-based H categories, including H-1B. Reciprocity or other applicable charges can be separate, and this amount is not the total USCIS cost of the case.
7. Admission is the final, separate step
With an approved petition and, when required, a valid visa, the traveler requests admission at a U.S. port of entry. The inspecting officer examines the travel documents and circumstances and determines whether to admit the person in H-1B classification. Visa issuance and admission are therefore different events, just as petition approval and visa issuance are different events.

Do not assume that every H-1B worker enters a lottery. Conversely, do not assume that a selected registration eliminates the petition review; selection only opens the filing opportunity.

USCIS’s modernization materials cover the beneficiary-centric registration process and changes affecting specialty occupations, amendments after worksite changes, cap exemptions and F-1 cap-gap extensions. A case prepared under an older form edition or older interpretation can be rejected or require correction. Use the current rule, form edition and filing address.

Online-presence review notice
A Department of State notice dated September 18, 2026 lists H-1B and H-4 applicants among categories already subject to online-presence review. The notice says the instruction to make profiles public or open applies to newly added categories it lists for October 1. It should not be presented as a blanket new H-1B instruction based on that notice alone. Follow the current instructions issued by the particular consular post handling the application.
Common mistakes and how to prevent them
Assuming registration equals approval
Keep separate records for the registration result, the I-129 receipt and decision, the visa decision and the admission record. Each stage has its own decision-maker and effective dates.
Describing the job too generally
A generic title or a claim that the role needs “a bachelor’s degree” does not explain the specialty-occupation connection. Map the actual duties to the specialized knowledge and to the relevant degree field.
Using an outdated fee or form
Registration windows, USCIS fees, form editions and consular charges change. Recheck the USCIS and Department of State pages on the date the employer submits the filing and on the date the worker schedules the interview.
Ignoring the worksite or petition facts
Changes in duties, location or employment structure can affect an amendment, an exemption analysis or the evidence USCIS expects. Compare the proposed filing with the approved petition and obtain case-specific advice when facts have changed.
Treating a visa as permission to work for anyone
H-1B authorization is tied to the approved employment arrangement. A visa stamp does not convert the category into an unrestricted employment authorization document.

- Define the role: document duties, work location, required knowledge and the degree fields that logically relate to those duties.
- Confirm the worker’s qualifications: collect education and identity records that support the position’s requirements.
- Complete the Department of Labor stage: use the current labor-condition instructions and keep the filing consistent with the proposed petition.
- Classify the route: decide whether the case is cap-subject, potentially cap-exempt, an extension, an amendment or a change of status.
- Register if required: submit one accurate registration per beneficiary during the USCIS window and pay the stated registration fee.
- File Form I-129: if selected, file within the permitted period with the registration information and supporting evidence; use the current instructions for any cap-exempt route.
- Plan the post-approval step: determine whether the worker needs consular visa processing, an appointment and the current $205 fee, or will seek a status action inside the United States.
- Check travel and admission: carry the documents requested by the consulate and understand that admission is decided separately at arrival.
What to remember
H-1B is an employer-led route for a specific specialty occupation, not a general work permit. The employer or agent starts the case; the Department of Labor step precedes USCIS; cap-subject cases require registration and possible selection; USCIS must still approve Form I-129; and a worker who needs to travel may need a separate visa decision before seeking admission. Because fees, filing windows and consular policies are date-sensitive—including the reported 2025 $100,000 condition for certain petitions—check the current agency instructions for the exact case before money or travel plans are committed.
