A Stingray is a brand name commonly used for a cell-site simulator: surveillance equipment that imitates a cellular tower. Nearby phones may select the simulator as the strongest or most attractive tower and transmit identifying or other signaling information, much as they would when connecting to a carrier network. Investigators can use those exchanges, along with signal-range or direction information, to identify a target device and narrow its location.
The process can initially involve phones belonging to people who are not targets. The exact authority, retention period and technical capability depend on the agency, jurisdiction and equipment. The U.S. Department of Justice (DOJ) has a policy for its own domestic criminal investigations, but that policy is not a universal rule for every government body.
What a Stingray cell-site simulator is
A cell-site simulator is a radio device operated directly by investigators rather than by a mobile carrier. It transmits signals that make it appear to nearby phones that another cellular tower is available. Phones choose towers according to network-selection rules, including signal characteristics, so a simulator can attract devices in its operating area.

Once a phone responds, it can send information used to identify the device or account and to manage the connection. The DOJ policy describes this as signaling information, not ordinary browsing of everything stored on the phone. A February 5, 2026, Seventh Circuit opinion similarly described a simulator as mimicking a tower, prompting nearby devices to connect and transmit signaling information; after connection, the equipment can obtain identifiers such as a phone or subscriber number.

The term “Stingray” began as a product name, but it is now often used informally for this broader category of equipment. Other descriptions include IMSI catcher or cell-site simulator. The important distinction is who controls the radio system: a carrier’s tower is part of a commercial network, while a simulator is deployed for a particular investigative purpose.

How a Stingray tracks a phone
Tracking is a sequence of radio interactions and repeated measurements, not a magic map that instantly displays a person’s position. A typical operation can involve these stages.
1. The simulator presents itself as a tower
The device broadcasts cellular signals as though it were network infrastructure. The DOJ policy says nearby devices may identify the simulator as the most attractive tower in the area and transmit signals that identify the device, similarly to a connection with a legitimate networked tower.
2. Nearby phones respond
Every compatible phone in range may react, not only the intended target. During an initial sweep, the equipment can receive identifiers from multiple devices. That is why a simulator’s operation can affect bystanders even when investigators are looking for one particular phone.

3. Investigators match or distinguish the target
If investigators already know an identifier for the phone they seek, the simulator can look for that identifier among the devices that respond. The DOJ policy says that, after a known target is identified, the simulator can obtain signaling information relating to that target.
If the target’s identifier is unknown, the policy describes limited collection from non-target phones for the purpose of distinguishing the target. This is different from treating every nearby phone as an investigative target, but it still means that other devices can enter the initial collection process.
4. Operators use signal information to narrow the area
Investigators can use the strength, range or direction of the response and then change the simulator’s position or operating setup. By repeating the measurements, they can reduce the area in which the target phone is likely to be located. A 2015 New York court described a progression from an approximate area to a more precise location as the equipment moved closer to the phone.
That court’s description is evidence about the equipment and record before it, not a guaranteed accuracy figure for every model or deployment. Buildings, terrain, radio interference, network conditions and the simulator’s configuration can all affect what an operator can infer.
5. The phone does not necessarily need to be on a call
The same New York opinion said, based on its understanding of the equipment, that the phone had to be powered on with remaining battery life but did not have to be participating in a call. Treat this as a court-specific description rather than a universal specification. Different systems and operating conditions may behave differently.

A simulator’s core function is to obtain device-identifying and signaling information through a cellular connection. Examples discussed in the DOJ materials include a phone or subscriber identifier and information used to distinguish one responding device from another.

The DOJ policy for criminal investigations expressly prohibits using a cell-site simulator to collect the contents of communications. It lists emails, text messages, contacts and images stored on the phone as examples of content that the technology may not collect under that policy. The policy restriction is an operational rule for DOJ use; it is not proof that every simulator product has identical hardware or software capabilities.
The 2015 New York opinion separately said that the record before the court was not definitive about whether simulators generally, or products associated with one vendor, could monitor call or text content. Therefore, two claims must be kept separate: what a particular device might technically be capable of doing, and what an agency is permitted to do under its governing policy or law.
Why bystander phones may be involved
Radio systems cannot always identify the wanted phone before they receive responses from the surrounding area. Phones nearby may therefore transmit identifiers or signaling information during the search. The DOJ policy addresses this directly:

- When the target is unknown, signaling information from non-target phones may be obtained for the limited purpose of distinguishing the target.
- Once the known device is located, the DOJ’s 2015 announcement says collected data must be deleted, and at least daily.
These requirements describe DOJ handling, not a retention standard automatically imposed on every state, local or federal agency. A person whose phone responds during a sweep may never be the target, but the initial radio exchange can still place the device’s identifier in the simulator’s collection.
Stingray tracking versus carrier cell-site records
Both methods can provide clues about a phone’s location, but they come from different systems and are created for different reasons. Carrier records are generated and maintained as part of providing mobile service. A carrier can retain records showing which towers handled communications and when; those records can indicate a phone’s general location at times when communications occurred.
A simulator, by contrast, is a portable or otherwise directly operated law-enforcement system used in a targeted, real-time deployment. It collects signaling information from phones in the simulator’s vicinity rather than retrieving the carrier’s historical business records.

DOJ Deputy Assistant Attorney General Richard Downing drew this same basic distinction in 2016 testimony: carrier information is created in the carrier’s business, while a simulator is equipment law enforcement operates directly to collect nearby-device signaling information.

How precise is the location?
A simulator can narrow a search, but the evidence does not support one universal accuracy radius. Precision depends on the equipment, antenna arrangement, radio environment, operator’s movements and the target phone’s response. The 2015 New York court described location becoming less approximate as the equipment moved closer, which explains the practical method without promising a fixed number of feet or meters.
Think of the result as an iterative narrowing process. An initial response may show that a phone is somewhere within the simulator’s effective area. Additional readings from different positions can indicate which direction or smaller area is more consistent with the signal. Obstacles and reflections can complicate that inference, so an apparent signal maximum is not automatically the phone’s exact physical position.

The DOJ issued its cell-site simulator policy on September 3, 2015; the public announcement page was updated February 5, 2025. For DOJ use inside the United States in furtherance of criminal investigations, the policy generally requires a search warrant supported by probable cause. It also describes limited exceptions.
The policy is not a nationwide statute and does not automatically govern state or local police departments, other federal agencies or foreign authorities. Those organizations may operate under different statutes, court decisions, agency policies or warrant practices. To evaluate a particular deployment, the relevant jurisdiction and agency policy must be identified first.
DOJ’s announcement also describes supervision, auditing and data-management requirements. Exceptions to the warrant rule must be tracked and reported, and collected data must be handled and deleted according to the policy’s rules. These administrative safeguards are separate from the technical question of how a radio simulator identifies a phone.

Common misconceptions to avoid
“It is just the same as asking a carrier for a location record.”
No. A carrier record is produced by the carrier’s network and may be historical. A simulator is law-enforcement equipment that interacts with nearby phones during an operation.
“Only the target phone communicates with it.”
Not necessarily. Nearby phones can respond during the initial collection. DOJ policy addresses those non-target responses and imposes handling limits for DOJ investigations.
“A simulator automatically reads messages and photos.”
DOJ policy prohibits collecting communication contents in its criminal investigations, including examples such as emails, texts, contacts and images. That policy statement should not be converted into a universal claim about every product’s technical design. The New York court record did not definitively resolve the broader capability question.

“The DOJ policy applies to every police agency.”
It does not. The policy covers DOJ use in domestic criminal investigations and expressly says it does not apply to other federal agencies. State and local requirements can differ.
What this means for privacy
A phone can disclose identifying or signaling information simply by responding to cellular infrastructure that appears attractive to it. That creates a privacy issue even when the owner is not under investigation, because the initial collection can include multiple nearby devices. The central safeguards are therefore legal authorization, limits on purpose, supervision and prompt deletion—not an assumption that only the intended phone ever interacts with the equipment.
The available evidence does not establish that a particular consumer setting, app, pouch or detector will defeat every simulator. Such countermeasure claims depend on radio technology, device behavior and the specific equipment involved and should not be inferred from the general description above.
The practical takeaway
A Stingray cell-site simulator impersonates a tower, attracts nearby phones, receives identifying or signaling information and uses repeated signal observations to narrow a target phone’s location. Bystander devices can be part of the initial collection. That is fundamentally different from obtaining a carrier’s historical tower records, and it does not justify assuming that communication contents are collected or that DOJ rules bind every agency. For any real-world case, the decisive questions are which agency deployed the equipment, what jurisdiction applies, what authorization was obtained and how the collected data was retained and deleted.
