To export from India to the United States, first establish your Indian exporter setup, define the exact product and transaction, assign import responsibilities with the US buyer, and verify the product-specific US rules before dispatch. There is no universal US export checklist: food, cosmetics, electronics, textiles, machinery and other goods can fall under different agencies, labels, tests, certificates and restrictions.

Use the sequence below as a first-shipment plan. It helps you identify the information a customs broker, freight forwarder and US importer will need, while avoiding guessed tariff codes, incomplete invoices and last-minute compliance surprises.

1. Define exactly what you are selling

Regulatory and customs decisions depend on the product, not merely the business category. Before requesting quotes or preparing labels, create a written product profile for every item or model you intend to ship.

Record the product facts

  • Commercial description in plain language, including what the item does.
  • Composition, materials, ingredients, components and any chemical content.
  • Intended use and, where relevant, the user or setting for which it is designed.
  • Country of origin and the location where manufacturing or substantial processing occurs.
  • Unit value, total quantity, package dimensions, net weight and gross weight.
  • Packaging format, retail presentation and whether the goods are samples, commercial stock or gifts.
  • Sales channel: direct-to-consumer, business-to-business or sale to a US importer or distributor.

These details determine the likely tariff classification, customs value, agency jurisdiction, labeling scope and records your buyer may need. A general article cannot reliably assign a tariff rate, permit, certificate or label rule without them.

2. Confirm that India allows the export

Check the Indian export-policy status before accepting an order. Goods may be freely exportable, restricted, prohibited or subject to a license, policy condition, certificate or no-objection requirement. Product-specific rules can apply even when the product appears ordinary.

Set up and maintain your IEC

India’s Foreign Trade Policy 2023 states that an Importer Exporter Code (IEC) is mandatory for goods exports except specified exemptions. The IEC is the core exporter identifier used in Indian trade procedures.

The same policy requires an IEC holder to update or confirm its details electronically every year during April–June. The policy language says: “An IEC holder has to ensure that details in its IEC is updated electronically every year, during the April-June period.” Failure to complete the required update can lead to deactivation. Check the live Directorate General of Foreign Trade (DGFT) status, current notices and any amendments immediately before shipping rather than relying on an old copy of the policy.

Check product-specific Indian conditions

Ask whether your product requires a special license, inspection, certificate, authorization or declaration. Keep the classification and policy rationale in your shipment file so your broker or adviser can understand why you treated the goods as freely exportable or applied for an authorization.

3. Agree US import responsibilities before you quote

Do not leave customs responsibility implicit in a quotation. Before production or payment, agree the commercial delivery term and identify who will perform each US entry task.

Put these questions in writing

  • Who will act as the importer of record in the United States?
  • Who will appoint and instruct the customs broker?
  • Who pays duties, merchandise-processing charges, brokerage fees, freight, insurance and destination charges?
  • Which delivery term applies, and where does risk transfer from seller to buyer?
  • Who supplies product registrations, testing, certificates, label approvals and technical records?
  • Who handles an inspection, detention, examination, rejection or request for additional information?
  • Which originals, electronic filings and documents must arrive before the goods?

The buyer or importer should have the broker validate the tariff classification and expected duty using the exact product details and the current US tariff schedule. Do not promise a landed price based on a code you guessed or on a rate copied from another product.

4. Prepare the Indian baseline export documents

For goods exports, India’s Foreign Trade Policy 2023 identifies three baseline document groups:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Document group Purpose What to verify
Bill of lading, air waybill or other applicable transport receipt Evidence of carriage and shipment details Names, addresses, package count, weights, routing and the party entitled to receive the goods
Commercial invoice-cum-packing list States the sale, value, quantities and packing information Descriptions, units, prices, currency, total value, marks, package contents and weights agree with the order
Shipping bill, bill of export or postal bill of export Indian export declaration for the applicable transport channel Exporter identity, product details, value, destination and filing status are correct

Restricted goods, goods subject to policy conditions and products governed by other laws may require additional documents or no-objection evidence. Your freight forwarder and US importer should confirm destination-specific requirements early enough to obtain them.

5. Make every shipment record tell the same story

Inconsistent descriptions are a common cause of holds and entry questions. The purchase order, invoice, packing list, transport document, export filing and broker instructions should identify the same goods, quantities and parties.

Build a precise commercial invoice

US Customs and Border Protection (CBP) expects the commercial invoice or an acceptable substitute to provide an adequate merchandise description, quantities, values or approximate values, and the appropriate eight-digit Harmonized Tariff Schedule of the United States (HTSUS) subheading. The invoice should describe what the goods are in terms a customs officer can understand, not just a marketing name, internal SKU or vague phrase such as “parts” or “samples.”

Give the buyer or broker the composition, function, model, quantity, unit value, total value, country of origin and packaging data they need to validate the entry. Do not invent an eight-digit HTSUS code or customs value. Classification can depend on technical characteristics and intended use; the US importer or its broker should make or confirm the entry determination.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Run a document consistency check

  • Compare product names and model numbers across the order, invoice, packing list and transport booking.
  • Reconcile unit counts, carton counts, net weight and gross weight.
  • Confirm that currency, unit price, extended price and total invoice value calculate correctly.
  • Ensure the country-of-origin statement matches the actual manufacturing facts.
  • Give the broker the final documents, not an earlier quotation or draft packing list.

The US Department of Commerce warns that “Discrepancies or omissions in documentation may result in the export of merchandise being delayed, may result in nonpayment, or even result in the seizure of the exporter’s goods by the U.S. or foreign customs officials.” Treat document review as a release gate, not an administrative afterthought.

6. Check the US rules for the exact product

After the product profile and importer roles are clear, identify the US agency or agencies that regulate the goods. Requirements can include facility registration, advance notice, safety standards, laboratory testing, labeling, certificates, permits, records or restrictions. The applicable rule depends on the product and use case.

Food shipments need additional coordination

For food, applicable US Food and Drug Administration (FDA) requirements can include facility registration and prior notice. Imported food must meet US safety and labeling requirements and may be inspected, detained or refused.

The Foreign Supplier Verification Program (FSVP) importer—generally the US owner or consignee—has responsibilities to verify that imported food meets US safety standards. Before shipping, agree with that importer which supplier records, hazard information, preventive-control evidence, test results, specifications and verification activities it expects. Supplying a commercial invoice alone does not satisfy the importer’s food-verification duties.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Other products require their own review

Non-food goods can still be regulated by a specialist US authority or subject to mandatory product standards. For example, materials, electrical characteristics, consumer use, children’s use, medical claims or chemical content may change the applicable requirements. Have the importer or a qualified product-compliance adviser identify the relevant regulator before you print final labels or manufacture a large batch.

7. Choose a shipment setup deliberately

A customs broker or freight forwarder can coordinate filings and transport, but hiring one does not transfer your responsibility for truthful product information and accurate documents. Compare providers and delivery arrangements against the factors that affect both cost and clearance risk.

Comparison point Questions to ask
Importer-of-record responsibility Which party makes the entry, responds to customs and remains responsible for compliance?
Landed-cost transparency Who pays duty, taxes, brokerage, handling, storage and other destination fees, and when are they due?
Speed and tracking What transit time, milestone updates and exception alerts are included?
Regulatory experience Has the provider handled this product category and its relevant US regulator?
Insurance and claims What coverage applies, what exclusions exist and who files a loss or damage claim?
Fees and destination coverage Which origin and destination services are included, and which are billed separately?

Agree the commercial terms

Record the currency, payment method, payment timing, insurance, freight responsibility, delivery term, packaging standard, dispatch date and shipment milestones. Also specify what happens if customs examines the goods, requests a document, delays release or rejects a label.

8. Verify the shipment before dispatch

Use a final pre-dispatch review that both the exporter and US buyer or broker can approve.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Confirm exporter status: verify that the IEC is active and its annual details update is complete when required; check current DGFT policy and notices.
  2. Freeze the product description: approve composition, use, origin, quantity, value, packaging and model information.
  3. Confirm classification: obtain the US importer or broker’s review of the HTSUS subheading and entry data; do not rely on an unverified code.
  4. Complete Indian filings: prepare the invoice-cum-packing list and applicable shipping bill, bill of export or postal bill of export, plus any required authorization or certificate.
  5. Complete US compliance: verify registrations, prior notice, tests, labels, certificates and agency records that apply to the product.
  6. Reconcile documents: compare every quantity, value, package count, weight, party name and origin statement across all records.
  7. Release the logistics booking: provide the final documents and labels to the forwarder by the agreed deadline.
  8. Confirm payment and contingency contacts: identify who can authorize extra storage, inspection support, relabeling or return if clearance is delayed.

9. Keep a complete shipment file

Retain the final sales terms, purchase order, commercial invoice, packing list, transport document, Indian export filing and shipping-bill details. Add the classification rationale, buyer and broker instructions, product certificates, test reports, label versions, payment evidence and relevant correspondence.

Recordkeeping periods can differ between Indian and US requirements and by product category. Confirm the applicable retention period with the relevant authority, broker or qualified adviser. A well-organized file lets you answer a customs or buyer question without reconstructing the transaction months later.

Common first-export mistakes and fixes

  • Using a generic product description: replace “handicrafts,” “parts” or “food items” with material, function, model and quantity details.
  • Guessing the tariff code: send the technical product profile to the US importer or broker for classification review.
  • Quoting a delivered price without assigning duties: state the delivery term and identify who pays every destination charge.
  • Printing labels before checking the regulator: confirm US agency rules and importer approval before final production.
  • Assuming a forwarder guarantees compliance: review the final records yourself and ensure the provider has current instructions.
  • Ignoring IEC maintenance: check the DGFT portal during the April–June update period and again before dispatch.
  • Treating food like general merchandise: coordinate FDA requirements and the FSVP importer’s verification records before shipping.

The practical standard is simple: the Indian exporter, US importer, broker and forwarder should all be working from the same product facts, commercial terms and final document set. If any party cannot explain who is responsible for a requirement, pause the shipment until that responsibility is assigned and recorded.
