Defaulting on a home-improvement loan can lead to late charges, collection calls, credit-report damage, a lawsuit, and—when your home secures the debt—possible foreclosure. A PACE assessment is different: its payments are collected through property taxes, so nonpayment can create tax-sale risk. An unsecured personal loan does not give the lender the same direct mortgage claim, but a court judgment can still enable garnishment or a property lien under state law.
Your next step is to identify exactly what you signed, contact the lender or servicer before the account gets further behind, and respond to every legal notice by its deadline.
First, identify what “home-improvement loan” means in your paperwork
The label is informal. The legal consequences come from the contract and the collateral, not from the fact that the money paid for a roof, kitchen, HVAC system, or other project. Look at the promissory note, account statements, mortgage or deed of trust, security instrument, and any tax-assessment documents.

| Loan structure | How you pay | What secures it | Main default exposure |
|---|---|---|---|
| Unsecured personal or installment loan | Monthly payment to a lender or finance company | No collateral pledged in the original agreement | Fees, collections, credit reporting, lawsuit, and possible judgment remedies such as garnishment or a lien, subject to state law |
| Home equity loan | Usually fixed monthly installments | Your home equity | Foreclosure is possible if the loan is not repaid |
| HELOC | Payments on a revolving line; rate is commonly variable | Your home equity | The lender may restrict the line, accelerate the balance under the contract and applicable law, and pursue foreclosure |
| PACE assessment | Collected through the property-tax bill | A property-tax assessment attached to the home | Delinquent taxes and a possible tax sale, depending on local rules |
“Default” may have a defined meaning in your agreement. Some contracts distinguish a late payment from a default that permits acceleration or legal action. Notice and cure requirements also differ by contract and state.

What usually happens after a missed payment
Late charges and account notices
A missed payment can trigger a late fee, a notice of delinquency, and a demand that you bring the account current. The agreement controls the amount and any grace period. For a HELOC, the payment itself may already be rising because the interest rate is variable or because the line has moved from its draw period into its repayment period.
Collection activity
The lender may continue servicing the account, assign it to a collection department, or sell the debt to another company. Keep every letter, statement, payment confirmation, and phone log. If a debt collector contacts you, ask who currently owns the debt and how the amount was calculated. Dispute an amount or account you believe is wrong in writing and retain proof of delivery.
Credit-report consequences
Late and defaulted payment history can be reported to the credit-reporting companies. The CFPB says negative account information is generally reportable for up to seven years. That is a reporting period, not a promise about a particular credit-score drop; scoring effects vary with the rest of your file, the severity and recency of the delinquency, and whether the account is later brought current.

Consequences by loan type
Unsecured personal or installment loan
Because the original agreement did not pledge the house, the lender does not have the same direct foreclosure remedy that a mortgage or home equity lender has. That does not make the debt consequence-free. The creditor can seek payment, hire or sell to a collector, and file a civil lawsuit.
If you ignore a summons, the court may enter a default judgment. A judgment can add lawful interest, court costs, or attorney fees and may permit wage garnishment, a bank-account levy, or a lien on property, depending on state law, exemptions, and the creditor’s use of the required court process. A judgment lien is not the same thing as the consensual mortgage lien created when you originally borrowed against the home. Whether a lien attaches, its priority, and what property is exempt are jurisdiction-specific questions.
Home equity loan
A home equity loan is secured by the home. The CFPB explains that a lender could foreclose if the borrower cannot repay. Foreclosure may be judicial, requiring a court case, or nonjudicial, using a power-of-sale process where state law permits. The notices, right to cure, sale procedure, and timeline vary by state and by the documents you signed.

HELOC
A HELOC is also secured by the home. The CFPB warns that falling behind can put the property at risk. HELOCs commonly have a variable interest rate, so the required payment can increase. Many also have a draw period followed by a repayment period; payments can be significantly higher once new borrowing stops and principal must be repaid.
Federal Regulation Z, 12 CFR § 1026.40, permits a creditor to terminate a home-equity plan and accelerate the outstanding balance after the consumer actually fails to meet required payment terms. The rule does not override state right-to-cure protections or other applicable law. A lender’s ability to act therefore depends on the actual payment failure, the agreement, required notices, and state procedure—not simply on a prediction that you might miss a future payment.
PACE assessment
PACE financing is repaid through the property-tax bill rather than an ordinary monthly loan statement. The CFPB cautions that the assessment can substantially increase the tax payment and that failure to pay can put the homeowner at risk of losing the property through a tax sale. The exact collection process is local.

Before assuming a mortgage workout or consumer-loan rule applies, confirm the local PACE program, the tax collector’s procedures, the assessment’s place in the property-tax system, and any notices you have received. The CFPB also warns that, after signing, options to dispute the work or charges may be limited.

Can an unsecured default make you lose your house?
Not directly in the same way as a home equity loan or HELOC. An unsecured creditor generally must first sue and obtain a judgment before using judgment remedies. If state law permits a judgment lien on real estate, that lien can affect your property even though the original loan was unsecured. A lien may complicate a sale or refinance and can remain subject to statutory exemptions and priority rules.
That possibility is different from a lender’s contractual right to foreclose a home that was pledged as collateral. For a secured loan, foreclosure is built into the security arrangement; for an unsecured loan, the creditor must establish the debt and follow the judgment process before seeking post-judgment collection tools.
Foreclosure and tax-sale process: what you should expect
Secured home-equity debt
The CFPB describes both judicial and nonjudicial foreclosure systems. A typical case can involve a delinquency notice, a formal default or acceleration notice, a lawsuit or trustee process, a right to cure or reinstate where available, and a scheduled sale. The order and timing are not uniform nationwide. Read every notice for the exact deadline and the name of the party that can answer questions.
PACE and property taxes
A PACE delinquency can be handled through the local property-tax collection system. Tax notices, penalties, redemption rights, and sale schedules are controlled by local law. Missing a tax-bill deadline can therefore create a different risk path from missing a monthly installment, even if both financed the same improvement.

Lawsuits, judgments, and old debts
If a creditor or collector sues, read the complaint and summons immediately and file a response by the stated deadline. Do not assume that calling the collector replaces a formal court response. If you can, consult a consumer-law or debt attorney, legal-aid office, or other qualified local help.
A judgment may authorize collection tools such as wage garnishment, a bank-account levy, or a property lien. None is automatic: the creditor must use the procedure available in your jurisdiction, and exemptions can protect some income or assets.
Time limits for filing a collection lawsuit vary by state, debt type, and sometimes the governing-law clause in the agreement. The CFPB says many states have periods of three to six years, while some are longer. An expired limitations period may be a defense, but it does not necessarily erase the debt. You may need to raise the defense in court, and making a partial payment or acknowledging an old debt can affect the period in some jurisdictions. Get local advice before taking either action on an old account.
What to do as soon as payment trouble is foreseeable
- Classify the debt. Confirm whether the account is unsecured, secured by a mortgage or deed of trust, a HELOC, or a PACE assessment. Check whose name appears on the note and who currently services it.
- Call before the next missed payment if possible. Ask for hardship programs, a repayment plan, a modification, a temporary forbearance, the amount needed to cure, late fees, any deadline, and how the arrangement will be reported to credit bureaus. Request the terms in writing.
- Calculate the cure amount. Separate missed principal and interest from late fees, legal charges, escrow or tax amounts, and any accelerated balance. Ask whether a payment arrangement changes the interest rate, maturity date, monthly amount, or total cost.
- Protect your records. Keep the signed agreement, statements, canceled checks, electronic confirmations, contractor invoices, notices, emails, and notes of every call.
- Verify collection claims. If a collector contacts you, confirm the creditor, account number, balance, and ownership. Send a written dispute promptly if the debt or amount is inaccurate.
- Open every legal notice. A summons, foreclosure notice, trustee notice, tax delinquency notice, or sale notice has a deadline. Calendar it and seek legal help immediately rather than waiting for another letter.
- Use free housing help for mortgage-related distress. The CFPB recommends contacting your servicer and a HUD-approved housing counselor. Counseling and help through the servicer or HUD-approved counselor are available at no cost. Avoid anyone demanding an upfront fee, telling you to stop communicating with the servicer, or guaranteeing that foreclosure will be prevented.
How to evaluate a repayment plan or modification
Do not judge an offer only by the new monthly payment. Compare the following items in writing:
- Whether the home remains collateral and whether the lender reserves foreclosure rights.
- Whether payments are monthly or collected through property taxes.
- The exact amount required to become current, including fees and legal costs.
- The new interest rate, payment, term, maturity date, and total amount repaid.
- How the account will be reported while you are on the arrangement and after completion.
- Whether a lien, judgment, tax assessment, or payment change could affect a future sale or refinance.
- Any state-specific right to cure, reinstatement period, or foreclosure procedure.
Possible arrangements include a repayment plan that spreads arrears over future payments, a modification that changes the rate or term, or a temporary forbearance. Mortgage-related borrowers may also be offered options identified by the CFPB, such as a repayment plan, forbearance, short sale, or deed-in-lieu. Those pathways do not automatically apply to an unsecured contractor loan or a PACE assessment, and approval depends on the loan and your circumstances.
Quick Recap
Common mistakes that make the situation worse
- Assuming every improvement loan can be foreclosed. First determine whether the house was pledged as collateral or whether the debt is unsecured.
- Assuming an unsecured loan has no property consequences. A judgment may support a lien or other remedies under state law.
- Waiting for a universal “three missed payments” rule. Contract terms, notices, cure rights, and state foreclosure systems differ.
- Ignoring a PACE amount on the tax bill. Treat it as a property-tax obligation and contact the local collector or program administrator promptly.
- Paying a credit-repair company to remove accurate history. Accurate negative information generally remains reportable for the applicable period; inaccurate information can be disputed directly for free.
- Ignoring court papers while negotiating by phone. A settlement discussion does not automatically extend a response deadline.
- Accepting a “lower payment” without checking the total cost. A longer term, capitalization of arrears, or a variable rate can increase what you ultimately owe.
Questions to ask the lender, servicer, or tax office
- What exact event makes this account “in default” under my agreement?
- What is the total amount needed to cure today, and how will it change after the next due date?
- Has the account been accelerated, assigned, or referred to a collector?
- Will you accept a repayment plan, modification, or temporary forbearance?
- Will interest, late fees, or legal costs continue during the arrangement?
- How will each option be reported to credit bureaus?
- For a secured account, what notices and cure rights apply in my state?
- For PACE, which tax office controls collection and what redemption or payment options exist?
