For the seven EDF-owned Advanced Gas-cooled Reactor (AGR) stations, transfer for decommissioning is a controlled change of responsibility, not a single switch-off event. EDF first removes the spent fuel and demonstrates that the reactor is fuel-free. The Nuclear Decommissioning Authority (NDA) then takes ownership, its subsidiary Nuclear Restoration Services (NRS) becomes the licensed site operator, and NRS carries out the long programme of dismantling, waste management and site remediation under continuing regulatory oversight.
Hinkley Point B completed the first English AGR transfer on 1 October 2026, after the Office for Nuclear Regulation (ONR) approved NRS as the new site licensee. The sequence below explains what that handover means, what continues afterwards and why the arrangements should not automatically be applied to every UK nuclear site.
The transfer in one view
A generating station does not transfer merely because its turbines stop producing electricity. In the AGR programme, the outgoing operator remains responsible while the plant is defueled, the fuel is shipped away and the site is prepared for a new licensing and ownership arrangement. Only after those conditions are met can the organisations change formally.

| Generation ends | EDF Energy | Reactors are shut down and prepared for fuel removal. | The station enters a defueling and preparation phase. |
| Defueling | EDF Energy | Spent fuel is removed from reactor channels, cooled in ponds, placed in flasks and sent to Sellafield. | Fuel inventories are progressively removed from the site. |
| Fuel-free verification | EDF Energy, with regulatory scrutiny | The site demonstrates that the reactors and relevant storage systems are free of spent fuel. | The principal physical readiness condition for transfer is met. |
| Licence change | ONR | ONR assesses the proposed corporate licensee and approves the change under the nuclear site licensing regime. | NRS can become the site licensee and permit holder. |
| Ownership and programme transfer | NDA and NRS | The NDA takes ownership under the AGR arrangements and NRS assumes operational control. | Decommissioning becomes an NDA-group programme. |
| Post-transfer care and dismantling | NRS | Facilities are maintained, hazards are reduced, radioactive materials are managed and structures are dismantled when safe and practicable. | The site moves through decommissioning rather than simply being abandoned. |
1. Electricity generation ends, but the nuclear work does not
When an AGR stops generating, the station still contains fuel, radioactive components, cooling and handling systems, buildings, waste stores and safety-critical equipment. The first priority is therefore to place the shut-down reactors in a safe condition and remove the spent fuel for which EDF remains responsible before the handover.

EDF’s explanation of the AGR process describes fuel being taken from roughly 300 fuel channels in each reactor. Once removed, assemblies are cooled in a pond for a minimum of 90 days before they are packaged for transport. Flasks then carry the fuel to Sellafield for further cooling and storage. EDF describes approximately 400 spent-fuel flasks being shipped from each EDF site and estimates three to five years for defueling a site. Those are fleet-level explanatory figures from EDF; they are not independently verified, site-specific measurements, and the source does not give them a publication year.
Why defueling comes first
Removing the spent fuel substantially changes the hazard profile and the work that the future operator must control. It does not make a station non-radioactive: reactor graphite, activated metals, contaminated systems and radioactive waste remain. It does, however, remove the operating fuel inventory and the associated fuel-handling and cooling obligations. The government’s AGR business plan therefore describes transfer as following defueling and a formal fuel-free verification.
2. Preparation and fuel-free verification
Fuel removal is a campaign rather than a single operation. EDF must keep the reactor, ponds, cranes, handling machines, cooling systems, radiation protection arrangements and transport interfaces under control until the last relevant fuel has left. The outgoing operator remains the site licensee and the “controlling mind” throughout this preparation period.

What the verification does and does not mean
- It confirms the fuel status required by the AGR transfer plan.
- It does not release the site from the nuclear licensing regime.
- It does not end maintenance, radiation protection, emergency arrangements or waste controls.
- It does not decide the site’s final land use or prove that all buildings can immediately be demolished.
3. Ownership and the nuclear site licence are separate decisions
A central legal point is that ownership transfer does not automatically transfer a nuclear site licence. Section 38 of the Energy Act 2004 makes clear that a nuclear transfer scheme by itself does not move the licence. ONR licenses a corporate body to operate a particular nuclear site and attaches conditions that apply throughout the site’s lifecycle, including decommissioning.
Consequently, the AGR handover has two linked but distinct elements. The NDA receives ownership and responsibility under the government arrangement, while ONR separately decides whether NRS is suitable to hold the nuclear site licence. Hinkley Point B illustrates the sequence: following ONR’s assessment and approval, NRS assumed the site-licensee role on 1 October 2026.
ONR said the transfer was acceptable because NRS demonstrated “the necessary capability and competence to hold the licence.” The regulator also stressed why the licence remains important after generation: “It is vital for the continued safety of the workforce and the public that nuclear facilities no longer generating energy are adequately maintained and that decommissioning and dismantling is progressed in a timely manner.”

4. Who is responsible at each point?
| Organisation | Responsibility in the AGR arrangement |
|---|---|
| EDF Energy | Remains site licensee and strategic authority before transfer; completes defueling and prepares the station for handover. |
| Nuclear Decommissioning Authority | Takes ownership and responsibility for the site once the AGR transfer arrangement is completed. |
| Nuclear Restoration Services | NDA subsidiary that becomes site licensee and environmental-permit holder, then leads the post-transfer decommissioning programme. |
| Office for Nuclear Regulation | Assesses and grants nuclear site licences, including the approval needed for a change of corporate licensee. |
| Environment regulator | Controls environmental permitting for radioactive substances, waste and related activities. The responsible regulator depends on the UK nation and the site. |
| Nuclear Liabilities Fund | Under the revised AGR arrangement, pays qualifying EDF decommissioning costs on a cost-pass-through basis; this description is specific to that arrangement. |
5. What NRS does after the handover
Once NRS holds the licence, it becomes the organisation with day-to-day legal and operational responsibility for the site. The work normally proceeds in a risk-reduction sequence rather than an instant demolition programme.

Safe management and maintenance
Buildings, ventilation, electrical supplies, fire systems, water systems, lifting equipment, monitoring instruments and security arrangements must remain reliable for as long as they support a safety case or a decommissioning task. ONR’s lifecycle approach means a station that no longer generates electricity still has to be adequately maintained.
Hazard reduction and waste handling
NRS characterises radioactive and non-radioactive materials, separates waste streams, removes systems where doing so reduces risk and sends waste to approved treatment, storage or disposal routes. The order depends on the site’s safety case, available facilities, worker exposure, radioactive inventories and national waste policy.
Dismantling and remediation
After systems are made safe and hazards are reduced, structures and plant can be dismantled in stages. Contaminated areas may require decontamination; activated reactor materials require specialised handling and packaging. Remediation then addresses residual contamination and infrastructure under the regulator’s requirements. A transfer starts this programme; it does not establish a universal date on which the land becomes unrestricted.

The nuclear site licence is only one part of the regulatory framework. Environmental permits cover activities such as radioactive-substance disposal, waste storage, discharges and other impacts. Under the AGR arrangement, NRS becomes the relevant permit holder after transfer, with the exact regulator determined by whether the station is in England, Wales or Scotland.

Land, buildings, equipment, records, contracts and other assets also need an orderly handover. NDA interface agreements define responsibilities before, during and after decommissioning and remediation. The NDA strategy discusses institutional controls for the eventual management of delicensed assets, but it does not set one final land use for every station. A site could therefore remain under controls, be reused for a nuclear purpose or be released subject to conditions, depending on the evidence and decisions for that particular location.
7. How the work is funded
The revised AGR arrangements provide that qualifying EDF decommissioning costs are met by the Nuclear Liabilities Fund on a cost-pass-through basis. This is a feature of the AGR settlement, not a general rule for every UK nuclear project. Other sites can have different ownership histories, contracts, liabilities and funding mechanisms, so the AGR funding description should not be applied to historic Magnox stations, newer reactors or privately structured facilities without site-specific evidence.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.8. The programme is rolling, not simultaneous
The NDA is preparing to take on seven AGR stations. The 2025–28 business plan describes transfers over the next decade, after each station completes defueling and fuel-free verification. Stations therefore move through the process at different times, reflecting reactor condition, fuel campaigns, regulatory readiness and the capability of the incoming organisation.
As of 13 October 2026, the confirmed completed handover in the current regulator announcement is Hinkley Point B. It generated electricity from 1976 until 2022, both reactors had been defueled, and NRS became site licensee on 1 October 2026 after ONR approval. Dates for the other stations should be checked against their individual announcements; the general programme does not establish a reliable date for each one.

9. What changes for workers, communities and the public?
The most visible change is the identity of the responsible organisation, not an immediate change in the physical appearance of the station. Workers continue maintenance, monitoring, security, waste handling and decommissioning tasks, but they do so under NRS’s management system and safety case once the licence changes.
For nearby communities, regulatory oversight continues through ONR and the relevant environment regulator. Environmental monitoring, permitted discharges, radioactive-waste movements and emergency arrangements remain subject to applicable conditions. The end of electricity generation removes the normal operating output, but it does not remove the need for trained staff, controlled access or public protection measures.
10. Questions the transfer does not answer by itself
- When will the site be completely demolished? The transfer date does not set a universal completion date. The schedule depends on hazards, waste routes, engineering work and regulatory decisions.
- Is the land automatically safe for unrestricted public use? No. Delicensing and any future land release require evidence, regulatory agreement and appropriate institutional controls.
- Does fuel-free mean radioactivity-free? No. Activated reactor components, contaminated systems and radioactive waste remain.
- Does every UK nuclear station follow the AGR model? No. Magnox, AGR, research, fuel-cycle and newer reactor sites have different histories, licences, regulators and liabilities.
- Does the NDA become the operator directly? In this arrangement the NDA takes ownership while its subsidiary NRS becomes the site licensee, permit holder and decommissioning lead.
11. A practical way to read a future transfer announcement
When another station is announced as ready to transfer, check five separate facts rather than treating “handover” as a single label:
- Whether generation has ended and all spent fuel has been removed.
- Whether the operator has completed and evidenced fuel-free verification.
- Which organisation owns the land and assets after the transaction.
- Which corporate body holds the ONR nuclear site licence and environmental permits.
- What funding agreement, decommissioning scope and intended controls apply to that site.
Those checks distinguish a political or commercial ownership announcement from the legally effective change in nuclear responsibility.
The bottom line
For the UK AGR programme, transfer for decommissioning is the point at which a prepared, defueled station moves from EDF’s licensed control into the NDA group, with NRS taking the nuclear site licence and leading the work. ONR approval, environmental permitting, continuing maintenance and staged hazard reduction all remain essential. The handover changes who is accountable; it does not end regulation, radioactive work or the long process of dismantling and deciding the site’s eventual condition.
