If a U.S. importer uses the wrong tariff classification or reports too little dutiable information, U.S. Customs and Border Protection (CBP) can demand the unpaid duties and, depending on the facts, impose a civil penalty under 19 U.S.C. § 1592. The result turns on the size of the revenue loss, the importer’s level of care or intent, whether entries have liquidated, and whether CBP has begun or announced a formal investigation. A customs broker does not transfer the importer’s legal responsibility.

This is a general explanation, not a case-specific legal opinion. An importer that finds a possible error should preserve its records and obtain prompt advice from qualified customs counsel or an experienced customs broker.

What happens if I classified my imports incorrectly?

CBP may review the entry, determine that the classification or other declaration was incorrect, and reliquidate the entry at the proper rate. The importer can then owe the difference between the duties paid and the duties legally due. A material omission—such as failing to provide facts that affect classification, value, quantity, or eligibility for a reduced rate—can create the same exposure even when the tariff number itself was entered correctly.

Under 19 U.S.C. § 1592, CBP can also seek a civil penalty when an act or omission results in a loss of lawful revenue or otherwise violates the statute. The statute distinguishes negligence, gross negligence, and fraud. Those labels are factual and procedural conclusions, not choices an importer can make after the fact.

CBP’s enforcement process considers the entry records, product information, internal controls, communications, prior advice, and what a reasonable importer should have done. A mistake made despite documented, reasonable care is not evaluated the same way as a deliberate false statement or a repeated failure to investigate an obvious classification issue.

CBP can issue a notice demanding additional duties, propose or assess a penalty, or take other collection and enforcement steps. The amount and procedure depend on the entries involved and their status. There is no reliable universal calculator that can predict a particular importer’s outcome from the tariff difference alone.

Will I get fined if I underpaid customs duties?

Possibly. The historical ranges below come from CBP’s Customs Administrative Enforcement Process Informed Compliance Publication, issued in February 2004. They describe the guide’s treatment of section 1592 violations at that time; they are not a current individualized estimate and should not be used without checking current law, CBP practice, and the facts of the case.

CBP culpability category Historical range when there is a duty loss Historical range when there is no revenue loss Important qualification
Fraud 5 to 8 times the total duty loss 50% to 80% of dutiable value Subject to the publication’s stated statutory cap and factual findings.
Gross negligence 2.5 to 4 times the total duty loss 25% to 40% of dutiable value Historical guidance only; the government must establish the applicable facts and procedure.
Negligence 0.5 to 2 times the total duty loss 5% to 20% of dutiable value Historical guidance only; reasonable-care evidence can be important.

These figures show why the same tariff mistake can have very different consequences. They do not establish that CBP will select the top or bottom of a range, that every case qualifies for a particular multiplier, or that the ranges remain unchanged. The publication also describes statutory caps and separate treatment for different circumstances.

Negligence

Negligence generally concerns a failure to exercise the reasonable care expected in importing. Examples can include relying on an unsupported tariff number, failing to review a supplier’s product change, or not maintaining information needed to substantiate a classification. The question is not simply whether an error occurred, but whether the importer’s process was adequate for the risk.

Gross negligence

Gross negligence reflects a more serious disregard of the importer’s obligations. Repeated errors after warnings, ignoring readily available product facts, or maintaining no meaningful classification controls can support a more severe allegation, although the government’s position still depends on the complete record.

Fraud

Fraud involves intentional deception or a deliberate act or omission to evade a legal requirement. A high duty bill or an incorrect code, by itself, does not prove fraud. Evidence of intent, concealment, falsified documents, or knowingly false descriptions can materially change the case.

Can CBP make me pay back duties?

Yes. If CBP determines that the proper duty was higher than the amount deposited, it can seek the shortfall through the entry’s liquidation and collection process. The importer may also face interest or penalties, depending on the legal basis and procedural posture. Whether an entry has liquidated, and when, can affect which correction or protest options remain available.

“Paying back duties” is therefore not one single remedy. The government may be correcting the duty calculation, assessing a penalty for the conduct that caused the loss, or doing both. An importer should identify each affected entry and separate the underlying duty issue from any alleged violation of section 1592.

Does using a customs broker protect me?

No. CBP states: “The importer is always ultimately responsible for knowing CBP requirements and for ensuring their importation complies with all federal rules and regulations.” A broker can prepare and transmit entry information, classify products based on supplied facts, and communicate with CBP, but the importer remains responsible for the accuracy and completeness of what it provides.

Broker involvement can still be valuable evidence of a reasonable-care system when the importer supplied complete, accurate information, asked appropriate questions, reviewed the work, and corrected known problems. Conversely, an importer cannot rely on a broker as a blanket defense if it withheld product details, ignored discrepancies, or approved information it knew was wrong.

What should I do after discovering a possible error?

  1. Stop the problem from spreading. Identify the product, tariff number, country of origin, valuation method, and date range involved. Pause use of a suspect code for new entries while qualified advisers assess it.
  2. Preserve the evidence. Gather entry summaries, commercial invoices, purchase orders, packing lists, product specifications, photographs or drawings, technical literature, origin records, classification analyses, broker instructions, emails, duty calculations, and every CBP notice.
  3. Map the affected entries. Record entry numbers, ports, import dates, quantities, declared values, duties deposited, liquidation dates, and whether a protest, demand, or penalty notice has been received. Include related products that may share the same classification rationale.
  4. Reconstruct the decision. Document who selected the tariff provision, what facts were available, what alternatives were considered, and when the importer first learned of a possible error. Do not rewrite old records or create backdated explanations.
  5. Get targeted advice quickly. A customs attorney or experienced broker can evaluate classification, valuation, disclosure, liquidation, and penalty issues together. Deadlines and available mechanisms vary with the entry status and the government’s actions.
  6. Preserve communications with CBP. Respond accurately to requests and avoid speculative statements. A formal response strategy should be coordinated with counsel when a notice alleges a violation or investigation.

Do not assume that simply sending money, changing a tariff number prospectively, or filing a document labeled “prior disclosure” resolves every entry. The proper route depends on the facts and timing.

Can I correct an import entry after finding a mistake?

Sometimes, but there is no single correction deadline or universal filing that applies to every error. The available path can depend on whether the entry is unliquidated or liquidated, whether CBP has issued a notice, whether a formal investigation has begun or is known, and whether the issue concerns classification, value, origin, quantity, or another declaration.

Before liquidation

Entries that have not liquidated may offer more practical opportunities to work with the broker and CBP, but the importer must use the mechanism that fits the entry and the error. The fact that an entry is still open does not automatically make every amendment permissible.

After liquidation

Liquidation can change the available remedies and the time in which they must be used. A CBP CROSS ruling, in a particular procedural context, discusses voluntary reliquidation within 90 days. That example is not a universal cure or a general 90-day rule for all classification and duty mistakes; it illustrates why an importer should check liquidation dates immediately.

Prior disclosure

CBP’s historical enforcement guidance says a prior disclosure made before, or without knowledge of, the commencement of a formal investigation may substantially reduce penalties. The guide describes different historical treatment for negligence, gross negligence, and fraud, including circumstances involving interest or reduced penalties. Eligibility, required content, timing, and effect are fact-specific. A disclosure should be prepared with advice that accounts for all affected entries and the agency’s procedural posture.

How can an importer prevent a repeat error?

Use a documented reasonable-care process

Assign responsibility for classification, retain the facts supporting each decision, and review codes when a product’s materials, design, use, packaging, supplier, or manufacturing process changes. Periodic audits should test both the tariff number and the quality of the underlying description.

Request a binding classification ruling prospectively

CBP’s Binding Ruling Program allows an importer or another interested party to request a decision before importing and filing entries. CBP describes a tariff-classification ruling as binding, while stating that duty rates are not binding. The request must present complete and accurate product facts; a ruling is tied to the facts submitted, so a materially different product may not receive the same treatment.

Write precise cargo descriptions

In guidance published February 13, 2026, CBP said descriptions should be clear, use plain language, and contain enough information to identify the commodity’s size, shape, and characteristics. CBP summarized the standard as: “A precise commodity description is clear and concise.” A better description supports classification work, but a description alone does not decide the tariff heading. Technical facts, composition, function, and legal interpretation may still be required.

How the key decision factors interact

Factor Why it matters
Culpability Negligence, gross negligence, and fraud carry different potential penalty treatment.
Actual revenue loss A duty shortfall can create a repayment obligation and affect the penalty framework.
Liquidation status It can determine which correction, protest, or reliquidation procedures remain available.
Investigation status Knowledge of a formal investigation can affect whether a prior disclosure is available or effective.
Notice received A demand, pre-penalty notice, or other CBP communication may impose a response process and deadline.
Quality of records Complete product facts and contemporaneous controls help show what the importer knew and what care it exercised.

Examples of how outcomes can differ

An isolated classification mistake with strong records

An importer discovers that a product was coded incorrectly, has complete specifications and a written classification analysis, and promptly identifies every affected entry. The importer may still owe the duty difference, but the records can be relevant to whether the conduct was negligent and to discussions about correction or penalty treatment.

A recurring error after warnings

An importer continues using a tariff number after a broker, supplier, or CBP communication raises a specific classification concern. Repetition and disregard of available information can create a more serious reasonable-care problem than a single, documented mistake.

A deliberate false description

An importer intentionally describes merchandise inaccurately to obtain a lower duty rate. That conduct presents substantially greater exposure than an inadvertent coding error because intent and concealment may support a fraud allegation.

Questions importers commonly ask

Does an incorrect tariff number automatically mean fraud?

No. An incorrect number establishes an error, not intent. CBP evaluates the importer’s conduct, records, knowledge, and response when determining culpability.

Can I wait until my next shipment to fix the code?

Waiting can increase the number of affected entries and may complicate the record. Once a credible issue is identified, isolate the product and obtain advice on both future entries and past entries.

Is a binding ruling a guarantee of a specific duty rate?

No. CBP describes classification decisions as binding but says duty rates are not. The ruling also depends on the facts presented in the request.

What information should my broker receive?

Provide a complete, current description, including relevant size, shape, characteristics, composition, function, technical specifications, and any product changes. Keep the supporting documents and review the entry data before or promptly after filing.
