Short answer: A pending PERM labor-certification application belongs to the sponsoring employer and the specific job described in that filing. If you leave before certification, the case normally does not transfer to your new employer; the new employer generally must begin its own labor-certification process. The often-mentioned “180-day rule” is usually an AC21 portability rule that applies later, when an eligible employment-based Form I-485 has been pending for at least 180 days. It is not a way to move a pending PERM from one company to another.
Employer withdrawal has a different effect at each stage. Withdrawal of an approved I-140 can cause automatic revocation if it occurs before the applicable protection threshold. A later withdrawal may leave the petition approval intact, but it rescinds the original employer’s job offer. Your exact result depends on which form is pending or approved, when each filing occurred, and whether a replacement job meets the same-or-similar occupational classification test.
First, identify which immigration stage you are in
People often call PERM, I-140 and I-485 together a “green-card application,” but they are separate filings with different owners, purposes and deadlines. The answer to a job change or sponsorship withdrawal starts with the stage of the case.
| Stage or event | General consequence | What the rule does not mean |
|---|---|---|
| PERM pending with the U.S. Department of Labor (DOL) | The application remains tied to the sponsoring employer and its job opportunity. A new employer generally needs its own process. | The pending case is not transferable under AC21 portability. |
| PERM certified, I-140 not approved | The employer must submit the certification with Form I-140 to U.S. Citizenship and Immigration Services (USCIS) within the certification’s 180-day validity period. | Certification is not an approved immigrant petition or permanent residence. |
| I-140 approved, but no qualifying I-485 pending | Withdrawal timing controls whether the approval is automatically revoked. Even retained approval does not preserve the former employer’s job offer. | An approved I-140 alone does not give unrestricted job portability. |
| I-485 pending at least 180 days | AC21 may allow a qualifying move to a new employer if the new job is in the same or similar occupational classification and the underlying petition remains valid. | The 180 days are not counted from PERM filing or from changing jobs. |
The controlling details include the form involved, the I-140 approval date, the I-485 filing and pending dates, the reason for any withdrawal, and the duties and classification of the proposed new job.

If your PERM is still pending when you change jobs
PERM is DOL’s permanent labor-certification process. The employer is seeking certification for a particular full-time, permanent job opportunity and must complete the required recruitment and filing steps for that position. DOL uses the date it receives the application as the priority date. If the application is certified, the employer then submits that certification to USCIS with Form I-140.
Because the filing is employer- and opportunity-specific, your resignation does not convert the pending case into a case for your new company. The new employer normally must evaluate its own position and start its own PERM process, including its own recruitment and filing. The first employer may also stop pursuing the existing case or notify DOL that it no longer intends to employ you.
What you should not do
- Do not assume your new company can simply substitute its name on the pending application.
- Do not treat the 180-day validity period for a certified labor certification as a job-change grace period.
- Do not rely on I-485 portability when you have not yet filed an I-485 or when it has not been pending for the required period.
If you are considering resigning while PERM is pending, ask both employers for their immigration timelines before setting a last day. A new PERM can take a materially different amount of time because recruitment, audit risk and DOL processing begin again.
If PERM is certified but the I-140 is not approved
A certification is an important step, but it is not the same as an approved immigrant petition. DOL states that the certified labor certification must be submitted with Form I-140 within 180 days of certification. If the employer misses that period, the certification expires and cannot be used for that filing.
The certification describes the original employer’s job opportunity. It is not a general-purpose document that another company can use for a different position. If the sponsor changes before the I-140 is approved, do not assume the old certification can be transferred. The new employer generally needs to pursue the labor-certification process for its own job.

Questions to confirm before a move
- Has the employer actually filed the certified PERM with USCIS?
- What is the exact certification date, and when does its 180-day submission period end?
- Has USCIS issued an I-140 approval notice, or is the petition still pending or not yet filed?
- Will the original employer continue offering the certified position through the immigrant-petition stage?
Keep copies of the certified labor certification, the I-140 receipt or approval notice, and any withdrawal correspondence. Those records establish which stage you reached and which deadlines may apply.
If the I-140 is approved but your I-485 has not been pending for 180 days
An approved I-140 does not by itself create AC21 portability. The petition is evidence that USCIS approved the immigrant petition for the original employer’s offered position; it is not a blanket authorization to accept any new job.
Under 8 CFR 205.1(a)(3)(iii)(C), withdrawal of an employment-based petition can lead to automatic revocation when it occurs before the applicable 180-day protection threshold. The relevant timing analysis can involve both the date USCIS approved the I-140 and the date the associated I-485 was filed. An immigration attorney must examine the notice dates and the exact withdrawal circumstances rather than applying a generic “180 days” slogan.
What happens if the employer withdraws early
If the employer withdraws during a period in which automatic revocation applies, the approved I-140 may no longer support your employment-based immigrant process. That can affect the ability to continue adjustment of status or obtain an immigrant visa through that petition. The result is not cured merely because you previously received an approval notice.
What happens if the employer withdraws later
A withdrawal made at least 180 days after I-140 approval, or at least 180 days after the associated I-485 filing, generally does not automatically revoke the approval unless another revocation ground applies. This is a petition-retention rule, not a promise that the old job still exists.

The regulation expressly distinguishes those issues: when the petitioning employer withdraws, its job offer is rescinded. Unless you qualify for INA 204(j) portability, you generally need a new employment-based preference petition to seek adjustment of status or issuance of an immigrant visa. Retained approval therefore does not let you take an unrelated job automatically.
If your I-485 has been pending for at least 180 days
USCIS describes AC21 portability for certain adjustment applicants in the EB-1, EB-2 and EB-3 preference categories. The adjustment application must have been pending for 180 days or more, the underlying employment-based I-140 must remain valid for portability purposes, and the new job offer must be in the same or similar occupational classification as the job described in the original petition.
This is the 180-day rule most workers mean when they ask whether they can change employers. The clock is tied to the period that the I-485 has been pending. It does not start when PERM was filed, when PERM was certified, when the I-140 was filed, or when you gave notice to your employer.
How to count the relevant period
- Find the I-485 receipt notice and record the filing or receipt date shown by USCIS.
- Confirm that the adjustment application has remained pending for at least 180 days. A case that was denied, withdrawn or otherwise terminated does not provide the same pending period.
- Verify that the underlying I-140 was approved and remains valid for the portability analysis.
- Compare the original offered position with the new job’s actual duties, occupational classification, level of responsibility and required skills.
- Preserve written evidence of the new offer and provide the required information to USCIS in the manner applicable to your case.
Do not treat the calendar date alone as a guarantee. USCIS applies the same-or-similar standard to the facts, not just to matching job titles.
What “same or similar occupational classification” means in practice
USCIS’s portability rule uses an occupational-classification comparison. A new title that sounds similar can still involve substantially different work, while different titles can sometimes describe comparable occupations. Relevant facts may include the primary duties, the occupation’s classification, required education or experience, salary and seniority, worksite and industry context, and whether the new role reflects a normal career progression.

For example, moving from one software-engineering role to another software-engineering role may present a stronger same-or-similar argument than moving from engineering into sales, even if the employer calls both positions “technical.” A promotion or change in employer does not automatically disqualify a case, but neither does a familiar title automatically qualify it.
Build a comparison file
- The original PERM and I-140 job description, including duties and minimum requirements.
- The new employer’s offer letter and detailed duty statement.
- Classification information and evidence explaining how the two occupations relate.
- Compensation, worksite and seniority details that show whether the move is a normal occupational progression.
- Your I-485 receipt and a calculation of the pending period.
Because “same or similar” is fact-sensitive, obtain individualized legal advice before relying on portability where the duties, occupation or career direction has changed substantially.

Stopping or withdrawing a pending PERM
This ends or abandons the employer’s labor-certification effort. It does not create a transferable PERM for another company. A new employer generally starts its own case.

The employer may choose not to use the certification. The certification still has a 180-day validity period for submission to USCIS, but that deadline does not force the employer to continue sponsoring you and does not make the document portable.

Withdrawing an I-140
The timing of withdrawal in relation to I-140 approval and I-485 filing matters. Early withdrawal can cause automatic revocation; later withdrawal may leave approval intact while rescinding the job offer. A retained petition is not the same as a continuing offer of employment.
Rescinding the job offer without a simple “withdrawal” label
The legal effect may still be significant even if the employer uses different terminology. The regulation focuses on the petitioning employer’s job offer being rescinded and on whether you qualify for INA 204(j) portability. Obtain the written notice and have counsel identify whether USCIS received a withdrawal, whether the petition remains valid, and what filing is needed next.
A practical decision checklist before you resign
- Inventory every filing. Record PERM filing and certification dates, the I-140 receipt and approval dates, and the I-485 receipt date.
- Confirm the current status. Check whether each matter is pending, approved, withdrawn, denied or expired.
- Calculate each 180-day period separately. The PERM certification-submission deadline, I-140 retention timing and I-485 portability threshold are different clocks.
- Ask the sponsoring employer for its position in writing. Find out whether it plans to continue the job offer, withdraw a petition, or merely stop pursuing a pending PERM.
- Compare the new role before accepting it. Gather a detailed description rather than relying on the job title.
- Coordinate the transition. Changing jobs before a qualifying I-485 period can put the immigrant process at risk even if an I-140 was approved.
- Get case-specific advice when timing is close. This is especially important if a withdrawal notice has arrived, your I-485 is approaching 180 days, or the new role is in a different occupation.
Common mistakes that cause avoidable problems
- Confusing PERM validity with portability: the certified labor certification’s 180-day submission period is a DOL deadline, not AC21 job protection.
- Counting from the wrong date: AC21 uses I-485 pending time, while petition-retention rules also examine I-140 approval and I-485 filing dates.
- Assuming an I-140 approval is a personal benefit: the petition is tied to the employer’s offered job unless a specific portability rule applies.
- Ignoring the job offer: an I-140 can remain approved after a qualifying withdrawal while the original offer is nevertheless rescinded.
- Using titles instead of duties: same-or-similar eligibility is a factual occupational comparison.
- Waiting for a notice before preserving evidence: save receipts, approval notices, job descriptions and employer communications as soon as a move or withdrawal becomes possible.
- Assuming every immigrant category qualifies: USCIS describes this AC21 pathway for certain EB-1, EB-2 and EB-3 adjustment applicants, not as universal protection for every category.
When professional review is especially important
Consider consulting a qualified U.S. employment-immigration attorney before acting if your employer has threatened withdrawal, if you are about to resign, if the I-485 has been pending close to 180 days, or if the replacement position changes your occupation or core duties. The attorney can map the dates, determine whether automatic revocation rules apply, assess same-or-similar eligibility and identify whether a new employment-based petition is required.

Bottom line
A pending PERM normally stays with the sponsoring employer and cannot simply follow you to a new company. A certified PERM must be used within its 180-day validity period, but that deadline is not portability. After I-140 approval, withdrawal timing determines whether approval is automatically revoked, yet even retained approval does not preserve the original job offer. The clearest path to changing employers is AC21 portability after an eligible I-485 has been pending at least 180 days, with a valid underlying petition and a new job in the same or similar occupational classification.
