Short answer: bitcoin shown in an exchange account can become inaccessible when the platform fails. Withdrawals may stop, a court may control the company, and customers may need to file and prove claims. Whether you recover the coins, their cash value, or anything at all depends on the account contract, the legal entity you dealt with, how the assets were held, the exchange’s records, the insolvency process and the governing law. A displayed balance is not a guarantee of immediate access or full recovery.
What usually happens first
A failed exchange generally moves through several stages rather than disappearing in a single event. The sequence and timing vary by case, but customers commonly face the following progression:
- Withdrawals are restricted. The platform may pause bitcoin and cash withdrawals while it investigates a liquidity problem, responds to regulators or seeks court protection. A successful login does not mean that transfers will work.
- The company enters a formal proceeding or restructuring. In a U.S. bankruptcy, a court appoints or recognizes debtors, approves notices and sets procedures for claims, asset sales and distributions. A restructuring outside bankruptcy can use a different process.
- Customer balances are reconciled. Administrators compare exchange ledgers, blockchain movements, bank records and account terms. Missing or inconsistent records can delay the process.
- Customers become claimants unless assets are returned directly. A claimant may have to submit a proof of claim, respond to an objection or accept a court-determined amount. Filing a claim does not establish that the claim is valid, how much it is worth or when it will be paid.
- Distributions occur, if assets remain and the claim is allowed. Payments can be made in bitcoin, another digital asset or cash, depending on court orders and the available estate. A claim can be paid only after higher-priority expenses and claims are addressed.
These steps can take months or years. During the interim, an account may show a balance that cannot be transferred, sold or used.

When you leave bitcoin with a centralized exchange, the platform typically holds private keys or controls access through a custody arrangement. The crucial legal question in a failure is not simply what the app displayed. It is whether the bitcoin is treated as customer property that should be returned, or as property of the company’s estate that supports creditors.

A 2026 SEC-filed company disclosure warns that custodial digital assets could be considered property of a custodian’s estate and that customers could be treated as general unsecured creditors. If that treatment applies, customers may face a markdown or a total loss after secured creditors, administrative expenses and other priority claims. The disclosure also emphasizes that the issue is unsettled and depends on particular contracts and facts.
Even a court finding that customers ultimately own the assets may not provide immediate access. The court or administrator may first need to identify which wallets hold customer coins, determine whether assets were mixed, and verify each customer’s entitlement. Those disputes can keep withdrawals frozen while ownership is decided.
The contract and legal entity can decide your position
Read the terms that applied when you used the service, not only the current version on its website. Look for clauses covering custody, title, lending, rehypothecation, set-off, arbitration, governing law and which company is the counterparty. A group of related companies may operate the brand, app, wallet infrastructure and lending products through different legal entities.

The Celsius proceeding demonstrates why that distinction matters. In a March 9, 2023 opinion, the U.S. Bankruptcy Court for the Southern District of New York found Celsius Network LLC contractually liable under the relevant terms of use, rather than treating every debtor or non-debtor affiliate as equally responsible. That was a case-specific interpretation of those contracts; it does not establish the result for another exchange or product.
Your account type also matters. Ordinary spot custody is not necessarily governed like a lending, yield, margin or staking account. A product that allows the platform to use or lend assets can create different rights and different risks from a service that promises to hold coins for withdrawal.
What the FTX claim process illustrates
FTX-related proceedings show that even the value of a digital-asset claim can require a court decision. In a June 26, 2024 opinion, the U.S. Bankruptcy Court for the District of Delaware addressed estimation of cryptocurrency-based claims. The opinion stated: “No bankruptcy court has ever estimated the value of cryptocurrency-based claims, nor, as far as I can determine, has any court ever conducted a valuation of crypto type assets.” That sentence described the court’s assessment of the issue in that proceeding; it is not a promise about how another case will be handled.

Claim estimation can involve the date used for valuation, the asset or currency in which payment is made, disputed transactions and whether the account terms permit a particular calculation. A filed claim therefore differs from a recovery. The court may reduce, reject or estimate it, and later orders may determine the form and timing of any distribution.

How to assess your own exposure
| Question | Why it matters | Evidence to collect |
|---|---|---|
| What account product did you use? | Spot custody, lending, yield, margin and other products can carry different promises and permissions. | Product page, enrollment screen, statements and the terms in force on the relevant date. |
| Which legal entity contracted with you? | A brand can involve several companies; liability may attach to only one entity. | Terms, privacy notice, invoices, emails and account-opening disclosures. |
| How were the assets held? | Segregated wallets, omnibus wallets and records of beneficial ownership can lead to different factual and legal questions. | Custody disclosures, wallet addresses supplied by the platform and transaction records. |
| Where was the service and proceeding based? | Governing law, court jurisdiction and insolvency rules determine notices, deadlines and priorities. | Contract’s governing-law clause, regulatory notices and official court documents. |
| What can you prove? | An administrator must reconcile your balance and transactions before allowing a claim or distribution. | Exports, screenshots, deposits, withdrawals, trade history and correspondence. |
Do not infer legal protection from labels such as “custodial,” “segregated” or “insured” without reading the actual agreement and identifying who provides the protection. Marketing language is not a substitute for the operative contract or a court order.
Are exchange-held bitcoins insured?
Do not assume that bitcoin on a crypto exchange is covered by bank deposit insurance or by the protections available at a securities brokerage. The Administrative Office of the U.S. Courts describes SIPA as a liquidation framework for eligible securities brokerage firms. Under that framework, customers may receive customer property and, in some circumstances, advances from the Securities Investor Protection Corporation; if those resources are insufficient, a customer can participate as an unsecured creditor.

SIPA is a distinct regime. The cited court explanation does not establish that ordinary bitcoin held at a crypto exchange qualifies for SIPA, and the available materials do not create a blanket rule for every bank-linked crypto service or private insurance policy. Protection must be verified for the specific product, legal entity and jurisdiction.
What to do if the exchange is still operating
If withdrawals remain available, you can decide whether to move assets to a wallet or another service, but a transfer is not guaranteed to succeed and does not erase other disputes about the account. Check every detail before broadcasting a transaction.
Recommended Free Tools
- Confirm the asset and network. Select the exact bitcoin network supported by both the exchange and destination. Sending on an incompatible network can make funds unrecoverable.
- Verify the destination address. Compare the address on a trusted screen or device, check the first and last characters and send a small test amount when practical.
- Save proof. Download the withdrawal receipt, transaction ID, timestamp and resulting blockchain confirmation.
- Keep tax and transaction records. Moving coins does not remove reporting obligations or resolve the cost basis of earlier trades.
Never treat a successful withdrawal as evidence that every customer will be paid or that the platform is solvent. It only confirms that one transaction was processed.

What to do after a failure or bankruptcy notice
- Use official notices. Find the court docket, appointed administrator or claims agent named in a court filing. Bookmark the official case page and verify communications independently.
- Preserve your records. Save account statements, trade history, deposits, withdrawals, wallet addresses, support tickets and the terms that governed the account. Keep original files as well as readable copies.
- Identify the correct claimant and entity. A claim may need to name the legal company in your contract, not the exchange’s public brand or a related affiliate.
- Check the deadline and required proof. Deadlines are case-specific. Missing a bar date or submitting incomplete evidence can jeopardize participation.
- Review any claim statement carefully. Compare the administrator’s balance and valuation with your own records. Follow the published procedure to dispute an error.
- Protect yourself from scams. Do not pay an unofficial “recovery agent” an upfront fee for a guaranteed return. Use contact details from court documents, not social-media messages.
These are general information steps, not legal advice. A substantial or disputed claim may require advice from a lawyer qualified in the relevant insolvency and jurisdiction.
Self-custody changes the risk, not the need for care
Holding bitcoin in a wallet for which you control the keys removes dependence on an exchange’s solvency for routine access. It also transfers responsibility to you. A hardware wallet is one category of device used for this purpose, but no device guarantees recovery and no product has been tested or ranked here.
- Back up the recovery phrase exactly as instructed and store copies in separate, secure locations.
- Never disclose the phrase or approve an unexpected transaction.
- Plan for inheritance, device failure and loss of access before moving a large balance.
- Understand that a lost or exposed recovery phrase can cause permanent loss even when no company has failed.
Self-custody therefore trades platform and creditor risk for key-management, theft and recovery risk. The appropriate choice depends on your technical ability, security arrangements and need for convenience.
Common assumptions that can mislead customers
- “My dashboard says I own 0.5 BTC, so I can withdraw 0.5 BTC.” The display is an account record, not proof that the coins are immediately available or legally segregated.
- “The exchange is regulated, so losses are insured.” Regulation, licensing and insurance are different questions. Verify the actual coverage and its exclusions.
- “A bankruptcy claim means I will be paid.” A claim must be allowed, valued and paid from available assets according to the court’s priority rules.
- “The outcome in one high-profile case sets the rule.” FTX and Celsius addressed different contracts, entities and questions. Neither predicts every customer’s result.
- “If I wait, the value will be calculated at today’s bitcoin price.” The valuation date and payment method are determined by the applicable process and orders, not by a customer’s preference.
What is and is not predictable
You can predict the questions a court or administrator will ask: what product you used, which company promised performance, where the coins were held, what the contract says, what records prove your balance and which law governs the proceeding. You cannot responsibly predict a universal recovery percentage or deadline. The SEC-filed disclosure describes the custody issue as fact-specific and relatively untested, while the FTX opinion highlights the novelty of valuing cryptocurrency claims.
This explanation is U.S.-focused because the cited materials are U.S. court, regulatory and company filings. Other countries may use different insolvency priorities, licensing rules, customer-property doctrines and claim procedures. For a particular failure, rely on current official notices and the law governing your contract.
