A vacant government building does not become cost-free when employees leave. The public owner usually continues paying for security, utilities, inspections, insurance, routine upkeep, repairs and, eventually, the work needed to transfer or sell the property. In the federal system, a General Services Administration (GSA) building is generally supported through the Federal Buildings Fund, which is financed largely by rent paid by federal tenant agencies and limited by congressional appropriations. Other federal agencies may charge disposal preparation to their own salaries-and-expenses or operations-and-maintenance accounts. State and local rules vary: a transfer, lease, sale or demolition can shift costs only under the applicable statute and agreement.

What “vacant” means for a public building

Vacancy usually means the building is no longer needed for its former public function, not that the government has stopped controlling it. Until ownership changes or the structure is demolished, the owner remains responsible for preventing damage and protecting the public asset.

  • Security: locks, alarms, patrols, cameras, access control and responses to trespass or vandalism.
  • Utilities: electricity for alarms, fire systems, pumps, heating or cooling needed to prevent frozen pipes, mold and equipment failure.
  • Inspection and routine maintenance: roof checks, grounds work, pest control, water management and life-safety testing.
  • Repairs and compliance: correction of unsafe conditions, accessibility work, environmental cleanup and historic-preservation reviews where required.
  • Administration: property staff, legal work, appraisals, surveys, environmental studies, marketing and transaction costs.

Those obligations can last months or years. The U.S. Government Accountability Office (GAO) stated in its 2026 report Federal Real Property: Funding and Other Challenges Have Hindered Progress Under a Temporary Disposal Process that the federal disposal process “may take years, sometimes decades, with the federal government bearing the cost of the property until the disposal is completed.”

What happens to a vacant federal building

When a federal agency decides it no longer needs real property, the process generally moves through review, possible reuse and disposal. GSA describes several possible outcomes rather than a single automatic path.

  1. The owning agency identifies the property as excess or underused. It documents that the space is no longer required and notifies GSA when GSA’s process applies.
  2. Initial review and acceptance occur. GSA and the landholding agency examine title, condition, occupancy, security, environmental issues and any continuing federal need.
  3. Other federal agencies get an opportunity to take it. An interagency transfer can keep the building in federal use and avoid a public sale, but the receiving agency must have authority, funding and a suitable mission.
  4. Public-purpose screening follows. Eligible applicants may seek a conveyance or transfer for uses such as an educational facility, historic monument, public park or qualifying homeless-assistance project. Eligibility, permitted use and statutory conditions apply.
  5. The property is prepared for disposal. Work can include environmental remediation, historic-preservation compliance, surveys, appraisals, security measures and clearing occupants or personal property.
  6. Sale or another conveyance is completed. Depending on the circumstances, the government may use a competitive public sale, a negotiated sale authorized for a particular situation, or a transfer to a federal, state or local agency or another eligible public-benefit recipient.

A community cannot simply claim an empty federal building. Each public-purpose route has eligibility rules, deadlines and use restrictions. GAO reported that some eligible state, local and nonprofit public-benefit transfers in the process it reviewed could receive discounts of up to 100 percent, but that is not a universal free-transfer rule; the governing statute and transaction documents control.

Federal outcomes at a glance

Outcome What it means What determines it
Retained by the original agency The agency keeps control, even if only part of the site is occupied. Mission need, security, budget and future plans.
Interagency transfer Another federal agency takes the property for an authorized use. Receiving agency interest, authority and funding.
Public-benefit conveyance An eligible public entity or nonprofit receives the property for a specified public purpose. Statutory eligibility, application review, permitted use and conditions.
Negotiated sale The government sells directly when a legally recognized circumstance supports that method. Authority for negotiation, valuation and transaction terms.
Competitive public sale The property is offered to bidders through a public sales process. Marketability, title, condition, environmental status and sale authority.

Who pays while a federal building is empty?

GSA-managed buildings

GAO’s March 26, 2026 testimony explains that GSA collects rent from tenant agencies and deposits it into the Federal Buildings Fund. The fund supports federal real-property acquisition, operations, maintenance and disposal. Congress sets annual limits on how much GSA may obligate, so the fund does not provide unlimited spending authority. In practical terms, a vacant GSA-controlled property is financed through a government-wide real-estate funding mechanism supported substantially by agency rent, subject to appropriations and program priorities.

Buildings held by other federal agencies

Not every federal building is in GSA’s inventory. For other landholding agencies, disposal preparation can be charged to the agency’s salaries-and-expenses account or its operations-and-maintenance account. GAO’s September 2026 report notes that environmental remediation, historic-preservation compliance and other preparation work compete with the agency’s regular funded activities. The owner therefore may have to choose between spending on an empty site and spending on current mission needs.

Why “taxpayers pay” is incomplete

Public money ultimately supports government property, but that phrase does not identify the actual payer within the budget. The useful questions are: Which entity owns the property? Is it in the Federal Buildings Fund or another account? Are tenant rents available? Has Congress imposed an obligation limit? Is a receiving entity already responsible under a transfer agreement? Those answers explain who is carrying the cost at a particular point in time.

How large are the federal costs and sales?

GAO reported more than $17 billion in annual maintenance and operating costs for more than 246,000 federally owned buildings, using fiscal year 2024 data. That is a portfolio-wide figure, not a calculation of vacant-building costs, so it should not be used to estimate the cost of one empty property.

From October 2013 through November 2025, GSA completed 921 real-property sales that generated $1.4 billion, according to GAO’s April 9, 2026 report. The amounts are for the report’s defined period and are nominal dollars. In the context described by GAO, about 70 percent of federal property disposals were competitive public sales; that percentage is not a claim that 70 percent of every vacant building is sold publicly.

GAO also reported that GSA had identified 47 properties for an accelerated-disposal approach as of March 2026. The count is a dated program snapshot, not a tally of properties already sold. GAO found that GSA had not established performance goals tying the accelerated approach to specific time savings or avoided costs, and had not determined how to evaluate private brokers against other sale methods.

What can delay a federal disposal?

  • Relocation and mission planning: The agency may need money and time to move staff, records, equipment or secure functions.
  • No receiving agency: An interagency transfer cannot proceed without a willing and authorized federal user.
  • Public-purpose eligibility: Applications for education, parks, historic or homeless-assistance uses require documentation and compliance with the applicable program.
  • Environmental liabilities: Contamination, asbestos, lead, underground tanks or other hazards may require investigation and cleanup before transfer or sale.
  • Historic-preservation obligations: Reviews and mitigation measures can affect the schedule and the permitted alterations.
  • Title and survey problems: Boundary, easement, access or occupancy issues can prevent a clean transaction.
  • Market conditions: A property may need an appraisal, repairs or a different sale strategy to attract bidders.
  • Appropriations and authority: Even an approved disposal plan can wait for available funds or statutory authority.

These barriers explain why holding costs can continue after a building has been declared unnecessary. Disposing of a property is a separate, funded project rather than an automatic administrative step.

What happens in states and municipalities?

There is no nationwide state or local rule that determines who pays for every vacant courthouse, school, office or public works site. Ownership records, state statutes, local ordinances, budgets, debt documents and transfer agreements must be read together.

Maine school property example

Maine’s 20-A M.R.S. §4103 illustrates how a closed public school can be handled under a specific state law. A school board may lease or transfer certain buildings, and lease proceeds may be used for maintenance and other authorized purposes. The statute also allows a transfer to a municipality. If the town accepts the transfer, it may become liable for outstanding indebtedness under the statutory terms. A local government therefore does not automatically receive a debt-free building simply because the school has closed.

West Virginia vacant-building example

West Virginia’s §8-12 illustrates a different approach. It authorizes municipalities to create vacant-building registration and maintenance programs by ordinance, set standards for owners and, in some circumstances, take municipal action or place liens under the statute and local rules. The law does not create a general duty for a municipality to assume maintenance obligations that remain with the owner. A city may regulate a neglected vacant structure without becoming its owner or principal payer.

These examples show why a state or local answer must be building-specific. A school district, county, city or state agency may retain the property, lease it, transfer it, sell it, demolish it or accept a new obligation under a negotiated agreement.

How to find out who pays for one specific building

  1. Confirm ownership and control. Check the deed, title record, parcel map and any federal or state property inventory. The occupying agency may not be the owner.
  2. Read the governing law. Identify state school-property statutes, public-land laws, local vacant-building ordinances and any special legislation authorizing a transfer or sale.
  3. Find the budget account. Review appropriations, capital plans, facilities budgets and financial reports for security, utilities, maintenance, remediation and disposal.
  4. Check leases and agreements. A lease, interagency agreement, deed, grant or conveyance document may assign utilities, repairs, insurance, debt or permitted use to another party.
  5. Look for environmental and historic requirements. These obligations can explain both the delay and the cost of a proposed sale or reuse.
  6. Ask which outcome is active. Determine whether the property is being held for reuse, screened for public benefit, marketed for sale, under contract or scheduled for demolition.
  7. Verify the proceeds and debt terms. The selling entity’s authority, destination of proceeds and treatment of outstanding debt should appear in the statute, budget documents or transaction agreement.

Common misconceptions

“Empty means abandoned.”

An unused public building can remain under active custodial control. Security, inspections and funding decisions continue even when no regular workforce occupies it.

“The nearest city automatically gets it.”

Federal and state transfers require legal authority, eligibility and acceptance. A municipality may decline a building or accept it only with specified maintenance, use or debt obligations.

“Every vacant building is sold.”

Retention, interagency reuse, public-benefit conveyance, negotiated sale and competitive sale are all possible. Demolition may also be considered when reuse or sale is not practical, subject to applicable authority and funding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A sale ends all public cost immediately.”

Preparation, cleanup, appraisal, marketing and transaction work occur before closing. The public owner carries those costs until the transfer or sale is completed; the agreement then determines which obligations move to the recipient.

The practical answer

For a vacant federal building, start with the landholding agency and the funding mechanism, not with a generic assumption that “taxpayers” pay. A GSA-managed property generally draws on the Federal Buildings Fund, while another agency may use its own operating or salaries-and-expenses accounts. The building may be reused, transferred for an eligible public purpose, sold or retained for years while legal, environmental, historic and budget issues are resolved. For a state or local property, the deed, statute, budget and transfer agreement determine who maintains it and whether debt or other obligations shift. Vacancy changes the building’s use; it does not, by itself, change the owner’s responsibility.
