In the U.S. federal system, seized Bitcoin is usually not sold immediately. The government generally keeps the cryptocurrency in the form in which it was seized while forfeiture proceedings continue. A sale or conversion before final forfeiture is an exception that requires specific circumstances and Department of Justice consultation. After forfeiture becomes final, the executive branch can dispose of the Bitcoin, commonly by selling it, and deposit the proceeds into the applicable forfeiture fund. Recognized claims, court instructions, and victim-compensation procedures can change where the money ultimately goes.
This explanation covers the federal process reflected in Department of Justice guidance and federal cases. State, territorial, and non-U.S. rules can differ, and a particular court order controls the asset in that case.
The short answer: seizure is custody, not an automatic sale
A seizure gives the government control of the Bitcoin while it determines whether the property is subject to forfeiture. It does not by itself authorize an immediate auction or conversion into dollars. Under the U.S. Department of Justice Asset Forfeiture Policy Manual 2025, cryptocurrency should generally remain in the form seized until a final judicial forfeiture order is entered or an administrative forfeiture becomes final.
The sequence is therefore usually:
- Law enforcement seizes and secures the cryptocurrency.
- An asset-forfeiture office records and stores it under agency procedures.
- Potential owners, lienholders, and other claimants receive the notices required by the applicable proceeding.
- A court or agency decides whether forfeiture is proper.
- After final forfeiture, the government decides how to dispose of the asset, commonly through a commercially feasible sale.
- Proceeds are deposited in the designated government fund, subject to court orders and valid claims.
Victims may receive money through a remission, mitigation, or other victim-compensation process, but compensation is case-specific rather than automatic.

What happens immediately after Bitcoin is seized?
Secure custody and tracking
The DOJ Asset Forfeiture Policy Manual 2025 says the agency processes seized cryptocurrency through its asset-forfeiture department and assigns a Consolidated Asset Tracking System identification number. That identifier allows the government to track the property through custody, forfeiture, and disposition.
The Bitcoin may be held temporarily under the seizing agency’s procedures. Once a U.S. Marshals Service or approved contractor receiving wallet is available, certain cryptocurrencies can be transferred there for pre-forfeiture storage under current procedures. The transfer is a custody step; it is not a sale and does not determine the eventual value or recipient of the proceeds.
Why custody is technically important
Cryptocurrency custody requires control of the relevant wallet credentials and a documented chain of custody. Moving coins to a government-controlled wallet can reduce the risk of loss or unauthorized access while the legal case is pending. The policy does not establish one public wallet, exchange, auction house, or pricing method for every case. The responsible agency and the operative order determine the practical handling.

The DOJ manual states: “Cryptocurrency should be kept in the form it was seized and not liquidated (i.e., converted to fiat currency or other cryptocurrency) until a final order of forfeiture is entered or an administrative forfeiture is final.” This is an official DOJ policy statement, not statutory language.
Keeping the asset in cryptocurrency form protects the parties against a dispute over when and at what price the government converted it. Bitcoin’s price can change substantially between seizure, a court ruling, and the end of an appeal. If the government converts the coins too early and a court later orders their return, the government may have to make the owner whole, including for price fluctuations. Preserving the asset avoids making a premature sale price the measure of what must be returned.

“Preserved” does not mean the market value is fixed. The number of Bitcoin may remain the same while its dollar value rises or falls. The relevant legal question is whether the property has been finally forfeited, not whether its market price has changed.
When can Bitcoin be sold before forfeiture is final?
Interlocutory sale is the exception
A pre-forfeiture sale is commonly described as an interlocutory sale. DOJ policy treats it as a limited exception, not the normal response to a seizure. A prosecutor or agent may seek one after consulting the DOJ Money Laundering, Narcotics and Forfeiture Section.
The manual identifies circumstances in which a sale may be requested by, or made with the consent of, all parties claiming an ownership interest. It also allows consideration of a sale in certain cases involving victims with pecuniary losses. The legal papers and the judge’s order determine whether that route is available in a particular case.
What the exception changes
An interlocutory sale converts the cryptocurrency into money before the final forfeiture decision. The proceeds generally go into the Seized Asset Deposit Fund unless the court orders otherwise. The sale proceeds stand in place of the Bitcoin for purposes of the ongoing proceeding, so a later ruling can address ownership, forfeiture, and distribution without the government continuing to hold the coins themselves.
Because the sale occurs before the case is resolved, it does not prove that the owner has lost the property. A claimant can still contest forfeiture under the procedures and deadlines in the case.

How the court decides forfeiture and resolves claims
Notice and opportunity to claim
Federal forfeiture proceedings can involve civil actions against the property, criminal forfeiture tied to a defendant’s conviction, or administrative forfeiture when the governing rules allow the agency to act without a judicial judgment. The exact notices, deadlines, and burdens differ by proceeding. Potential owners, lienholders, and other third parties must use the procedure stated in the notice or court order.

The order normally follows service on known potential claimants and publication of notice when required. A failure to file a claim can lead to a default judgment, but one case’s no-claim result should not be treated as typical.
Example: Southern District of Georgia, June 2024
In a June 4, 2024 order from the U.S. District Court for the Southern District of Georgia, the forfeited property included 9.9036518 BTC, 0.00013 BTC, and Tether. The court recorded service on known potential claimants and publication of notice. No claim or answer was filed before default judgment. The order vested title in the United States and authorized the U.S. Marshals Service, Secret Service, and/or another duly authorized law-enforcement agency to dispose of the property according to law.
This illustrates the division of roles: the court resolves the legal status of the property, while an authorized agency carries out custody and disposition. It does not establish that every seized-Bitcoin case ends in default or uses the same agencies.
Who controls the sale after final forfeiture?
DOJ Justice Manual guidance states that “The disposition of property forfeited to the United States is an executive branch decision and not a matter for the court.” After successful forfeiture, the Attorney General may dispose of the property by sale or another commercially feasible method without obtaining a second approval from the court, subject to the governing law and the terms of any existing order.

Archived U.S. Attorneys’ Manual guidance says property that is not placed into official use or transferred is promptly sold after successful forfeiture, with the proceeds promptly deposited in the applicable fund. In practice, the responsible agency may use an authorized contractor or another approved channel. The federal sources do not establish one universal auction venue, public bidding format, timing rule, or pricing formula for all cryptocurrency dispositions.
A court can still issue directions that affect the process, and recognized third-party claims or distribution provisions can limit what the agency may do with the proceeds. “Executive branch decision” describes who normally handles disposition; it does not erase the rights created by a valid court order or an approved claim.
Where does the money go?
The destination depends first on whether the sale occurred before or after final forfeiture.
| Timing | Typical destination | What can change the result |
|---|---|---|
| Before final forfeiture (interlocutory sale) | Generally the Seized Asset Deposit Fund | A court order, ownership agreement, victim-related provision, or other applicable direction |
| After final forfeiture | The relevant federal forfeiture fund | Recognized third-party claims, court instructions, remission or mitigation, and other statutory or regulatory requirements |
The fund deposit is not the same as an immediate payment to the person whose Bitcoin was stolen or to a former owner. The government must first apply the process governing claims and distributions in that matter.

Can victims or former owners receive money?
Victims
Victim recovery is possible when investigators trace stolen cryptocurrency, obtain forfeiture, and then liquidate the asset. A DOJ release from Georgia describes a victim whose stolen cryptocurrency was traced and seized, forfeited, and liquidated; the release says the net proceeds were returned to that victim. That is an example of a completed recovery, not a promise that every victim will be paid directly.

In other cases, officials may need to identify eligible victims and process applications before any payment. Compensation can depend on proof of loss, the number of claimants, available proceeds, and the terms of the court order or applicable remission and victim-compensation program.
Former owners and third-party claimants
A person asserting a legitimate ownership or lien interest must follow the claim procedure and deadlines in the notice or case. If the court rejects forfeiture or recognizes a claimant’s interest, the government may have to return property or distribute proceeds as directed. The policy concern about premature conversion is one reason the default is to retain Bitcoin until forfeiture is final.
People should not assume that a wallet address appearing in a case file proves ownership. Control of a private key, a transaction trail, contracts, and other evidence may all matter, depending on the legal issue and proceeding.

Government announcements often use different financial terms. Treating them as interchangeable can produce a seriously misleading account of what happened to the Bitcoin.
| Figure or event | What it represents | What it does not prove |
|---|---|---|
| Approximately $1,185,922.91 in the Southern District of Georgia, reported November 13, 2025 | Cryptocurrency that officials said had been seized, forfeited, and recently liquidated into U.S. currency | It is not a nationwide total or a guaranteed victim payout |
| $627.9 million, DOJ Office of Inspector General FY 2025 | A partial interbank settlement received by the U.S. Marshals Service on October 10, 2025, toward an $11 billion forfeiture order against Alameda Research; payments went out to victims in November 2025 | It is not a Bitcoin auction price |
| 127,271 Bitcoin estimated at $8.0 billion at seizure, reported in the FY 2025 OIG statements | An estimated value at the time of seizure in what the report described as DOJ’s largest forfeiture action filed at that time | It is not realized sale proceeds, a final market value, or proof that all coins were sold |
An estimate at seizure, a forfeiture judgment, an interbank settlement, liquidation proceeds, and a victim payment are separate events. Any report about “the value of seized Bitcoin” should identify which event and date it is describing.
A practical timeline for a typical federal case
- Seizure: Agents take control of the cryptocurrency under legal authority and document the wallet, transaction history, and quantity.
- Asset tracking: The forfeiture department assigns a Consolidated Asset Tracking System number and arranges secure storage.
- Notice and claims: The government serves known potential claimants and publishes notice when required. Claimants must respond using the stated procedure.
- Pending case: Bitcoin normally remains in cryptocurrency form. An interlocutory sale can occur only when the applicable exception and approvals are satisfied.
- Decision: A court enters a forfeiture order, or administrative forfeiture becomes final, or the property is returned.
- Disposition: If forfeited, the executive branch selects a lawful sale or other commercially feasible disposition and handles the proceeds.
- Distribution: Funds move into the designated account, then any approved third-party claims, remission, mitigation, or victim-compensation payments are processed.
Common misunderstandings to avoid
- “Seized” means “sold.” Seizure generally starts custody and litigation; it does not itself trigger liquidation.
- A court order always sets the sale price. Courts decide forfeiture and can authorize disposition, but executive agencies generally conduct the post-forfeiture disposition.
- Every case uses a public auction. Federal guidance allows sale or another commercially feasible method and does not specify one universal venue.
- All sale proceeds go directly to victims. Proceeds normally enter a designated fund first, and victim payments depend on the applicable process.
- The estimate at seizure equals the money realized. Cryptocurrency prices move, and an estimate, judgment, settlement, liquidation receipt, and payment describe different stages.
- A reported recovery sets a general success rate. Federal sources cited here provide individual case results, not a nationwide percentage showing how often seized Bitcoin is sold, returned, or paid to victims.
What to check in a specific case
To understand a particular seizure, read the operative forfeiture complaint or indictment, the notice to potential claimants, any interlocutory-sale order, the final forfeiture judgment, and the agency’s disposition or victim-compensation notices. Check five details:
- Whether the matter is civil, criminal, or administrative forfeiture.
- Whether forfeiture is final or still subject to claims or appeal.
- Which agency or authorized contractor holds the cryptocurrency.
- Whether the stated dollar amount is an estimate, a court-ordered amount, a settlement, liquidation proceeds, or a payment.
- Whether a remission, mitigation, or victim-compensation process is open, pending, or complete.
DOJ’s Justice Manual disposition section carries a January 2026 update marker, while the central cryptocurrency policy source is the 2025 Asset Forfeiture Policy Manual. For a live matter, the current order and agency instructions control over a general explanation.
