A bankruptcy filing does not automatically cancel a restaurant’s gift cards, loyalty points, reservations, or deposits—and it does not guarantee that any of them will be honored. In a U.S. Chapter 11 case, the restaurant may keep operating and ask the bankruptcy court for permission to continue customer programs. Your practical rights depend on the debtor’s legal entity, whether the location is open, the petition date, any interim or final court order, and the instructions issued by the restaurant or claims agent.
What a bankruptcy filing changes—and what it does not
“Bankruptcy” is not one event with one customer outcome. A Chapter 11 filing starts a court-supervised restructuring. The debtor may seek authority to keep restaurants open, pay employees and suppliers, accept new bookings, redeem old gift cards, and operate loyalty programs while it reorganizes or sells assets. A filing announcement is therefore not proof that every restaurant has closed or that every customer benefit has ended.
The evidence discussed here comes from U.S. Chapter 11 filings and a U.S. bankruptcy-court memorandum dated across 2017, 2019, 2020, 2022, and 2024. It does not establish a universal rule for Chapter 7, another bankruptcy chapter, another country, or every state-law remedy. A debtor’s motion is a request, not an order. Read the entered order and the latest location and program instructions before treating a card, points balance, booking, or deposit as usable.

How to evaluate your specific customer benefit

Can a pre-filing card still be used?
Possibly. A restaurant that remains open can request authority to honor gift cards sold or issued before the petition date. A 2017 U.S. bankruptcy-court memorandum recounts a restaurant Chapter 11 case in which the debtor continued operating and, by an order entered December 1, 2016, was allowed to redeem all outstanding prepetition gift cards. The court discussion identified customer retention and goodwill as reasons supporting redemption.

That example shows what a court can authorize; it is not a promise for another restaurant. Some debtors ask for discretion to honor cards, rather than a requirement to accept every card at every location. A store may also be closed, sold, franchised, or operated by a different legal entity, creating practical limits even when a program is approved.
What if the restaurant refuses the card?
The same court memorandum states: “The Bankruptcy Code does not explicitly provide for the treatment of pre-petition gift card claims.” It explains that an unredeemed card can represent a monetary claim, potentially analyzed as a priority claim for a deposit or as a general unsecured claim. Courts have reached different results, and the memorandum says the gift-card issue was not before that court for decision in the case it addressed. Do not treat its discussion as a universal ruling.
If the debtor does not honor your card, the case may require you to file a proof of claim by a published claims bar date. A claim is not the same as an immediate refund: distributions depend on the case’s assets, classification, and confirmed plan or liquidation outcome. Priority treatment is fact-specific and disputed in some cases; never assume a gift card will be paid ahead of ordinary unsecured creditors.

What restaurant filings show
- In 2019, an officer declaration for Restaurants Unlimited said the debtors sought authorization, in their discretion, to honor cards purchased or issued before filing and to maintain the gift-card program after filing.
- In a separate 2020 motion, a debtor sought authority—but not direction—to honor old cards and continue its program. The motion itself does not establish that the court granted the request or what happened afterward.
- In September 2024, debtors for BurgerFi and Anthony’s Coal Fired Pizza reported case-specific gift-card receipts and estimated liabilities. BurgerFi reported $122,000 in 2023 receipts and $81,000 for 2024 to date, with estimated outstanding liabilities of $464,000 at the petition date. Anthony’s reported $3,000,000 in 2023 receipts and $844,000 for 2024 to date, with estimated outstanding liabilities of $610,000. These are debtor-reported figures in that motion, not an industry statistic.
Rewards points, coupons, and dining credits
Points are not automatically cash
Restaurant rewards can be discounts, coupons, free menu items, Reward Dollars, dining credits, or other contractual benefits. Earning and redemption rules, minimum purchases, blackout conditions, and expiration dates can differ. Nothing in the reviewed filings establishes a right to cash out a balance or requires a debtor to keep a program running after filing.
Restaurants Unlimited’s 2019 filing described points earned on meals, beverages, and gift-card purchases and sought to continue that program. Luby’s 2020 filing described Louie Nation points redeemable for dining credits and promotions, not cash. A 2024 BurgerFi and Anthony’s filing described distinct mechanics involving points, Reward Dollars, free items, and expiration terms. Those examples demonstrate why the named debtor’s current rules matter; they do not set rules for another chain.
How to protect a points balance
Save a screenshot showing the balance, account identifier, terms, and expiration date. Record whether points were earned before or after the petition date. Then check the debtor’s customer-program order and current app or website notice for permitted redemptions. If the order authorizes only existing discounts or coupons, do not assume you can continue earning points, transfer them, or exchange them for money.

Reservations, events, and deposits
Why a booking is case-specific
A reservation is an operational promise, not a guarantee that the business will remain open. The restaurant may continue service, move the booking to a purchaser, change menus or hours, or reject the contract. The filing date alone does not automatically cancel a reservation, preserve it, or create a refund right.

A 2022 customer-program motion by a hotel operator with restaurants asked for authority to honor gift cards, hold customer deposits, and continue, modify, or terminate customer programs. The filing described dining and hotel gift cards and deposits for future stays, weddings, corporate gatherings, and other events. It sought permission to apply held deposits to scheduled reservations and events so customers’ plans would not be disturbed. This is an example of relief requested from a court—not proof that every reservation or deposit in another case will be honored.
Questions to ask the location
- Is this exact location open, and which legal entity now operates it?
- Is the reservation in the debtor’s system, and can the location confirm the date and deposit in writing?
- If the venue closes or is sold, will the purchaser accept the booking, move it, or return the deposit?
- Does a court order address deposits, customer contracts, or event reservations?
Keep the confirmation, menu or package terms, payment receipt, and every written response. A phone assurance that is not reflected in the docket or a written customer notice may be difficult to prove later.

Step-by-step: protect a card, points balance, or booking
- Identify the legal debtor. Use the restaurant’s bankruptcy notice or docket to find the exact entity and case number. A single brand can involve separate corporate entities, franchisees, and locations.
- Find the controlling documents. Search the docket for “customer programs,” “gift cards,” “loyalty,” “rewards,” “deposits,” and “reservations.” Read the entered interim or final order, not just the motion, press release, or declaration.
- Check whether the location is operating. Confirm hours and acceptance policy with the specific restaurant. If a purchaser or franchisee is involved, ask who bears redemption or booking obligations.
- Preserve evidence. Save the card number and proof of purchase; screenshots of points, coupons, and expiration terms; reservation confirmations; deposit receipts; and emails or chat transcripts with customer service.
- Use an authorized benefit promptly, if appropriate. If the order and location confirm redemption, verify restrictions before visiting. Do not spend money or travel based solely on an unentered request.
- Prepare a claim if required. If a pre-filing card is rejected, locate the claims agent’s instructions and bar date. Complete a proof of claim with the documented amount and supporting records. Whether the claim receives priority depends on the case and applicable law.
- Check for updated notices. Sale orders, closure notices, amended program terms, and plan notices can change the practical answer after an initial order.
Important differences that change the outcome
Before versus after the petition date
A benefit purchased or earned before filing may be treated differently from a new purchase or post-filing transaction. Keep the transaction date and receipt. The debtor’s order may authorize only specified prepetition obligations, or it may set separate rules for post-filing sales.
Corporate restaurant versus franchise location
The brand name does not identify the legal obligor. A franchisee may operate the restaurant and negotiate reimbursement with the franchisor or other participating locations. The 2024 BurgerFi and Anthony’s filing discussed reimbursement arrangements between the brands and participating franchisees, illustrating why a card’s acceptance can depend on the location and intercompany agreement.
Operating case versus liquidation or closure
An open Chapter 11 restaurant has a practical reason to preserve goodwill and may seek authority to redeem cards or continue rewards. A closed or liquidating business may leave customers with only a bankruptcy claim, subject to the case’s deadline and distribution. Do not infer the second situation from the filing headline alone.

Motion versus entered order
A motion states what the debtor wants. An interim or final order states what the court authorized, often with conditions, limits, or a deadline. Customer notices can explain implementation, but they do not replace the order.
Common mistakes and safer alternatives
- Mistake: Assuming “Chapter 11” means immediate closure. Safer approach: Verify the location’s operating status and the relevant order.
- Mistake: Treating a motion as permission. Safer approach: Look for the signed interim or final order and any later amendment.
- Mistake: Calling points cash. Safer approach: Read the program’s redemption and expiration terms and document the balance.
- Mistake: Assuming a reservation guarantees a refund or a seat. Safer approach: Obtain written confirmation from the location and check sale or closure notices.
- Mistake: Filing a claim without checking the deadline. Safer approach: Follow the claims agent’s official instructions and retain proof of submission.
- Mistake: Promising yourself a chargeback or priority payment. Safer approach: Review card-issuer terms, governing law, the bankruptcy notice, and the particular case before relying on any remedy.
What customers can reasonably expect
The most defensible expectation is conditional: an operating debtor may preserve customer programs to retain goodwill, but the court and the debtor determine the scope. A pre-filing gift card can be honored under an order, as the December 1, 2016 restaurant example shows. If it is not honored, it may become a monetary claim, with uncertain priority and a claims deadline. Rewards may continue only in the form and period authorized. Reservations and deposits require direct confirmation and may be affected by a sale, closure, or new operator.
For a named restaurant, the reliable answer comes from three current checks: the bankruptcy docket and entered customer-program order, the exact location’s operating status, and written instructions from the debtor, purchaser, or claims agent. Keep your records until the card, points, reservation, or claim is fully resolved.
